Michael Kiernan running for open Des Moines city council seat

Former Des Moines City Council member Michael Kiernan announced yesterday that he will run for the open seat in Ward 3 this year, focusing on an “agenda of improving public safety, fixing potholes and continuing progress.” He held the at-large city council seat from 2004 to 2010 and served as Iowa Democratic Party state chair from January 2009 to June 2010. Josh Mandelbaum has been campaigning in Ward 3 for the last two months. His strong challenge drove 24-year incumbent Christine Hensley to retire rather than seek re-election. Now that the odds of a Democrat winning this seat have increased, Kiernan has decided to give it a shot. In a thinly-veiled swipe at Mandelbaum, Kiernan posted on Facebook yesterday, “I’ve been hearing a lot about crime in our city lately. I keep expecting to hear people who say they want to serve our community talk about this issue. Instead, all I’m hearing about is political endorsements and campaign war chests.” He echoed the talking point in his news release and on Twitter: “Lot of talk about politics, political endorsements and political cash…no talk of public safety. That’s why I am running.”

If Kiernan had attended Mandelbaum’s first event as a candidate, he would have heard his opponent talk about many substantive issues including “the importance of public health and public safety” and “providing resources to our first responders, police and fire.” Granted, Mandelbaum’s campaign did announce last month that he had raised more than $110,000 in three weeks, “recruited over 150 volunteers to help door-knock and hold house parties, and will soon have an elected official and labor leader endorsement list.” Taking on an entrenched incumbent requires a lot of groundwork, including early fundraising and lining up prominent supporters. But contrary to the impression Kiernan is trying to create, endorsements and cash have not been the focus of Mandelbaum’s message to Des Moines residents. I enclose below a map of the ward, covering west-side and south-side neighborhoods, as well as Kiernan’s news release, more background on his life and career, and the list of elected officials backing Mandelbaum. (His campaign hasn’t rolled out the labor endorsements yet.)

Mandelbaum has not publicly commented on Kiernan entering the race. I anticipate his case to Democratic voters will be similar to a statement his campaign released after Hensley disclosed her retirement plans: “When this race looked impossible to win, Josh stepped up to run because the values we share as a community were being threatened everyday.” I’ve closely followed Mandelbaum’s work over the years and will encourage voters in the ward to support him, because of his skills and commitment to progressive policies.

Local elections are non-partisan, but I expect some Republican backed by corporate interests to join the field in Ward 3 before long. I welcome tips on other possible candidates.

Branstad nominees held accountable for violating women's constitutional rights

Iowa Senate Democrats held two members of the Iowa Board of Medicine accountable yesterday for hasty action in 2013 to approve an anti-abortion rule that had no scientific basis and was later found unconstitutional by a unanimous Iowa Supreme Court.

Iowa Board of Medicine Chair Diane Clark and fellow board member Dr. Hamed Tewfik became the first (and probably the only) nominees for state boards or commissions to be rejected by the Iowa Senate this year. Republicans are predictably denouncing the vote as “petty partisan politics.” But senators have confirmed without dissent the overwhelming majority of more than 200 people Governor Terry Branstad selected.

Clark and Tewfik have only themselves to blame for losing their prestigious positions.

Only four senators voted to hold Geri Huser accountable

Disappointing but not surprising: the Iowa Senate on April 10 confirmed Geri Huser as chair of the Iowa Utilities Board by 44 votes to four. Senators delayed consideration of Huser’s nomination in late March, after Ryan Foley reported for the Associated Press that she “has maintained a busy and profitable private legal practice” during her first two years as board chair.

Iowa Code 474.8 stipulates that each utilities board member “shall devote the member’s whole time to the duties of the office.” For decades, every other attorney appointed to that board halted his or her legal practice during the term of service. For some reason, Huser decided those standards need not apply to her. She has also given out conflicting information about her work for the Skinner Law Office. Although she has claimed not to receive any income from that firm, she appears to work out of their office, as Bleeding Heartland discussed near the end of this post.

Only four senators–Democrats Tony Bisignano, Kevin Kinney, Bob Dvorsky, and Herman Quirmbach–found Huser’s outside legal work concerning enough to oppose giving her two more years of greater administrative responsibility and higher pay as the board chair. Most Iowa Senate confirmations are unanimous, so four votes against Huser indicates unusually strong discomfort with her conduct.

On the other hand, the 44 senators who supported Huser on Monday sent a clear message to Iowans. If state law on devoting one’s “full time” to public service gets in the way of a earning a side income, sometimes during regular business hours, powerful and well-connected officials don’t need to follow that rule.

Huser’s ongoing legal practice isn’t her only unprecedented behavior as Iowa Utilities Board chair. Less than six months into her term, she withheld funding for energy centers affiliated with state universities. That inappropriate exercise of her authority was disruptive to the centers and possibly illegal. At the time, a former lawmaker who helped create the energy centers described Huser’s interference as “way out of line.”

Democratic State Senator Joe Bolkcom works at the Center for Global and Regional Environmental Research at the University of Iowa, which got caught up in Huser’s power play, even though the Iowa Energy Center at Iowa State University was her primary target. I am seeking comment from Bolkcom on his vote to confirm Huser and will update this post as needed.

Iowa Democrats, talk less about ALEC and more about people's lives

Thousands of Iowans will suffer brutal consequences from the two major bills Republican senators approved Monday. House File 295 blocks local governments from raising the minimum wage. Once Governor Terry Branstad signs the bill, thousands of people working in Linn, Johnson, and Wapello counties will get an immediate pay cut. Some 25,000 people in Polk County will be stuck earning $7.25 an hour, instead of getting a raise to $8.75, beginning next week. House File 518 will make it harder for employees to file workers’ compensation claims and will vastly reduce benefits for those who do qualify, especially anyone with a shoulder injury.

Both bills passed on party-line 29-21 votes after Republicans had rejected every effort to mitigate the harm done to working people.

As each Democratic amendment went down during hours of debate on the Senate floor, feelings of sadness, disgust and anger came through in the speeches of some Democrats and independent State Senator David Johnson. Why are you doing this, several asked their GOP colleagues. You don’t have to follow your floor manager, some pleaded. You can reject the “shameful” attempt to target poor people or those affected by life-altering workplace accidents.

Another dismal day in the Iowa legislature provoked an outpouring on social media, where progressive activists have mobilized this year in response to the Republican agenda. A measurable wave of “greater grassroots activism on the political left” is one of the few bright spots in the national landscape. In Iowa too, ordinary people are contacting their state lawmakers in record numbers and showing up to challenge them at district forums.

Watching these discussions unfold, I’ve noticed a reflexive tendency to blame one destructive Iowa GOP bill after another on the Koch brothers or the American Legislative Exchange Council. The more Democrats make the conversation about Koch money or ALEC, the easier it is for Republicans to avoid talking about the real-world consequences of their actions.

Iowans Lose with Senate "Loser Pays" Bill

Bill Brauch, the former director of the Consumer Protection Division in the Iowa Attorney General’s Office, warns about a “little sleeper of a bill” that would be “a nuclear weapon against judicial fairness.” -promoted by desmoinesdem

Iowa Senate Republicans have hit the ground running this session, and their agenda is replete with extreme proposals. One of them hasn’t gotten much notice yet but, if enacted, would represent the most radical change to Iowa’s judicial system since its inception.

Senate Study Bill 1008 would impose the “loser pays” standard in all civil actions in Iowa courts. This means that if you lose a civil lawsuit you not only have to pay your own attorney fees, you have to pay the other side’s attorney fees as well. Another term for this would be “instant bankruptcy!”

Imagine you are injured in a car accident and sue the other driver to seek recovery for your injuries. If the case is hard-fought both sides might run up tens of thousands of dollars in attorney fees. Say the case is a close one and you lose by a whisker – the jury thought you had a good case but your proof fell just short. Under SSB 1008, you’ll not only have to pay your own attorney fees, you’ll have to pay the other side’s as well!

Who's who in the Iowa Senate for 2017

The Iowa legislature’s 2017 session begins today with minor adjustments to business in the state House but massive changes in the Senate. After ten years of Democratic control, the last six with a one-seat majority, the upper chamber now contains 29 Republicans, 20 Democrats, and one independent (former Republican David Johnson).

I enclose below details on the Iowa Senate majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Senate committees. Click here to find the same information from the 2016 legislative session.

Just six senators are women (five Democrats and a Republican), down from ten women serving in the chamber in 2013 and 2014 and seven during the past two years. All current senators are white. To my knowledge, the only African-American ever to serve in the Iowa Senate was Tom Mann, elected to two terms during the 1980s. No Latino has ever served in the Iowa legislature; in 2014, Nathan Blake fell 18 votes short of becoming the first to join the Senate. No Asian-American has served in the state Senate since Swati Dandekar resigned in 2011.

As a group, the members of the new majority caucus have much less legislative experience than do their Democratic counterparts. As detailed below, only three of the 29 Senate Republicans have served ten or more years in the Iowa legislature, compared to thirteen of the 20 Democrats.

Some non-political trivia: the 50 Iowa senators include two with the surname Johnson, four Marks, three Bills, and two men each named Richard (Rich and Rick), Robert (a Rob and a Bob), Dan, Tim, Tom, Jeff, and Charles (one goes by Chaz).

Never let it be said that the 2016 Iowa legislature accomplished nothing

In four months of work this year, Iowa lawmakers made no progress on improving water quality or expanding conservation programs, funded K-12 schools and higher education below levels needed to keep up with inflation, failed to increase the minimum wage or address wage theft, let most criminal justice reform proposals die in committee, didn’t approve adequate oversight for the newly-privatized Medicaid program, opted against making medical cannabis more available to sick and suffering Iowans, and left unaddressed several other issues that affect thousands of constituents.

But let the record reflect that bipartisan majorities in the Iowa House and Senate acted decisively to solve a non-existent problem. At a bill-signing ceremony yesterday, Governor Terry Branstad and supporters celebrated preventing something that probably never would have happened.

Iowa Senate approves transgender protections in hate crimes law

The Iowa Senate voted today to add protections for transgender people to Iowa’s hate crimes law. Currently, hate crimes are defined as offenses “committed against a person or a person’s property because of the person’s race, color, religion, ancestry, national origin, political affiliation, sex, sexual orientation, age, or disability, or the person’s association with a person of a certain race, color, religion, ancestry, national origin, political affiliation, gender identity, gender expression, sex, sexual orientation, age, or disability.” Senate File 2284 would add the words “gender identity” and “gender expression” to that list. Democratic State Senator Matt McCoy has championed this bill and addressed his colleagues yesterday about last week’s horrific murder of Kedarie Johnson, a 16-year-old high school student in Burlington who was transitioning from female to male. I enclose the video of that speech below.

During today’s floor debate, Republican State Senator Mark Chelgren, who is also running for Congress in Iowa’s second district, offered an amendment that would have removed all individual classes from the state code on hate crimes. McCoy countered that such an amendment would “destroy the point of a hate crimes statute.” Senators rejected Chelgren’s amendment by 30 votes to 18, with Republicans Bill Dix, Mike Breitbach, Charles Schneider, and Jack Whitver joining all 26 Democrats to vote no. Chelgren then withdrew another amendment he had proposed, which would have added “military veteran or military personnel status” to the list of protected classes.

Republican Senator Jake Chapman offered an amendment to add “unborn status” to the hate crimes bill, but as he was speaking in its favor (and graphically describing abortion procedures), Democratic Senator Tony Bisignano questioned whether the remarks were relevant. McCoy then formally objected that the amendment was not germane, and Senate President Pam Jochum ruled the objection “well-taken” and Chapman’s amendment out of order.

Schneider was the only Republican to join all 26 Democrats in approving the bill on final passage. Republicans Rick Bertrand and Brad Zaun were absent, and the 21 other GOP senators voted no. Schneider represents my own district in the western suburbs of Des Moines, and I’m proud to see him continue a tradition of Republicans from this area supporting protections for LGBT Iowans. The same was true when the Iowa House and Senate added sexual orientation and gender identity to the state’s Civil Rights Code in 2007, and when lawmakers approved an anti-bullying bill the same year.

I don’t expect Iowa House Republican leaders to bring up Senate File 2284 this year, but I hope to be proven wrong.

UPDATE: The video from today’s debate is up on the Iowa legislature’s website. Chapman went on for several minutes, starting around the 1:38 mark. Jochum repeatedly asked him to confine his remarks to why “unborn status” should be included in the hate crimes statute, but Chapman kept talking about abortion procedures.

Medicaid oversight bill passes Iowa Senate with bipartisan support

Since Terry Branstad returned to the governor’s office, the overwhelming majority of Iowa Senate votes on contentious political issues have fallen along strict party lines: 26 Democrats one way and 24 Republicans the opposite. However, the Branstad administration’s rush to privatize Medicaid has created space for bipartisanship, as a growing number of Republicans acknowledge the dangers of shifting to managed care for a program through which one in six Iowans access health services.

Last month, three GOP senators joined their Democratic colleagues to vote for a bill that would have halted Iowa’s Medicaid privatization. That legislation is going nowhere in the Republican-controlled state House, and federal officials recently approved waivers to allow the Iowa Department of Human Services to implement the managed care policy as of April 1.

Yesterday a quarter of the GOP state senators voted with all 26 Democrats for a Medicaid oversight bill that had cleared the Senate Human Resources Committee unanimously. In her remarks to open floor debate on Senate File 2213, Human Resources Committee Chair Amanda Ragan said the bill was designed “to safeguard the interests of Medicaid members, encourage the participation of Medicaid providers, and protect Iowa taxpayers.” She told colleagues, “we must require DHS and the managed care companies to protect consumers, preserve provider networks, address the unique needs of children and assure accountability.”

IA-Sen: Patty Judge thinking about challenging Chuck Grassley

The Des Moines Register’s Jason Noble snagged a surprising scoop yesterday: former Lieutenant Governor and Iowa Secretary of Agriculture Patty Judge is considering running for the U.S. Senate this year. Referring to Grassley’s approach to the U.S. Supreme Court vacancy, Judge told Noble,

“Iowans have always been straight shooters, and up until the recent time I would have said the same thing about Chuck,” Judge said. […]

“I don’t like this double-speak,” Judge said. “I don’t like this deliberate obstruction of the process. I think Chuck Grassley owes us better. He’s been with us a long time. Maybe he’s been with us too long.”

To qualify for the Democratic primary ballot, Judge would need to submit nominating papers with the Secretary of State’s Office by March 18, three weeks from today. That doesn’t leave much time to collect at least 2,104 signatures, including minimum amounts in at least ten Iowa counties. But Judge could pull together a campaign quickly, having won three statewide elections–for secretary of agriculture in 1998 and 2002 and on the ticket with Chet Culver in 2006.

Three other Democrats are seeking the nomination to run against Grassley: State Senator Rob Hogg, former State Senator Tom Fiegen, and former State Representative Bob Krause. Former State Representative Ray Zirkelbach launched a U.S. Senate campaign in November but ended his campaign last month, Zirkelbach confirmed by phone this morning.

Dozens of Democratic state lawmakers endorsed Hogg in January. I enclose the full list below. Any comments about the Senate race are welcome in this thread.

Little has changed since last year, in contrast to the Iowa House, which saw some big changes in the majority Republican caucus since the legislature adjourned in June.

Term limits are a terrible idea generally but would be especially awful if applied to the Iowa Senate, as the longest-serving current senator bizarrely advocated last year. The experience gap between Democrats and Republicans is striking. As detailed below, only four of the 24 Senate Republicans have ten or more years of experience in the Iowa legislature, compared to seventeen of the 26 Democrats. No current Iowa Senate Republican has more than 20 years legislative experience, whereas six Democrats do.

District Court lets stand Branstad veto of mental health institute funding

Polk County District Court Judge Douglas Staskal has dismissed a lawsuit challenging Governor Terry Branstad’s authority to veto funding intended to keep two in-patient mental health facilities open. Twenty Democratic state lawmakers and the president of Iowa’s largest public-employee union filed the lawsuit in July, arguing that the governor’s line-item vetoes violated Iowa Code provisions requiring that the state “shall operate” mental health institutes in Mount Pleasant and Clarinda. But Judge Staskal found that “Existing statutes cannot limit the Governor’s item veto authority,” which “is of constitutional magnitude. The only limitations that have been placed on that authority have been derived from the language of the constitution itself. […] And, there is no language in the item veto provision which suggests a statutory limitation on the power it creates. It is elementary that, to the extent there is conflict between a constitutional provision and a statute, the constitution prevails.”

I enclose below longer excerpts from the court ruling, which can be read in full here. Mark Hedberg, the lead attorney representing the plaintiffs, told Bleeding Heartland they “are preparing an appeal” to the Iowa Supreme Court “and will ask that it be expedited.”

Judge denies motion to dismiss lawsuit over Branstad closing mental health facilities

Polk County District Court Judge Douglas Staskal ruled yesterday that a lawsuit challenging Governor Terry Branstad’s line-item vetoes of mental health facility funding can move forward.

A group of Democratic state legislators and AFSCME, Iowa’s largest public employee union, filed the lawsuit in July. Last month, attorneys for the state filed a motion to dismiss the lawsuit or force the plaintiffs to “recast” (revise and resubmit) their court filing.

But in a thirteen-page ruling, Judge Staskal rejected the state’s arguments that “the plaintiffs lack standing, have failed to state a claim upon which relief could be granted and that the case presents a nonjusticiable political question.” He found that AFSCME Iowa Council 61 President Danny Homan has standing because he represents the interests of state workers who were laid off when the state government closed in-patient mental health facilities in Clarinda and Mount Pleasant. The judge also noted that state legislators “have standing to challenge the propriety of the Governor’s exercise of his veto authority.” Judge Staskal found plaintiffs had stated a claim: “a challenge to the Governor’s exercise of his line-item veto authority.” As for the political question, the ruling noted, “Whether to close Clarinda and Mount Pleasant is a policy matter for the other branches of government. Whether the Governor’s particular use of his line-item veto power is constitutional is a matter for the courts.”

Judge Staskal did find in favor of one argument advanced by state attorneys, releasing Iowa Department of Human Services Director Chuck Palmer as a co-defendant: “The Director [Palmer] plainly has no authority to veto legislation and there is no allegation that he did veto legislation. Therefore, there is no conceivable set of facts upon which relief could be granted on the claim that the Director exercised an improper veto.”    

The legislators who joined this lawsuit are State Senators Rich Taylor, Tom Courtney, Janet Petersen, Tony Bisignano, Herman Quirmbach, and Dick Dearden, and State Representatives Bruce Hunter, Curt Hanson, Jerry Kearns, Mark Smith, Art Staed, Ako Abdul-Samad, Jo Oldson, Ruth Ann Gaines, Sharon Steckman, Todd Taylor, Mary Gaskill, Kirsten Running-Marquardt, Timi Brown-Powers, and Dave Jacoby.

Adventures in wishful thinking

Longtime Republican Polk County Supervisor Robert Brownell apologized this week for calling Democratic State Senator Tony Bisignano names in an e-mail to seven Iowa House Republicans.

Such classless behavior is unbecoming an elected official, but Brownell’s faulty political analysis is perhaps more shocking. In the controversial e-mail, Brownell speculated that Republicans could retake the Iowa Senate majority in 2016 if State Senator Matt McCoy decides to run for Congress.

Sorry, no.

Iowa Senate approves bills on wage theft, minimum wage increase

While the gasoline tax increase grabbed most of the attention, the Iowa Senate approved two other significant bills on Tuesday. Senate File 270 would combat Iowa’s wage theft problem, estimated to cost workers about $600 million annually. After the jump I’ve enclosed State Senator Bill Dotzler’s opening remarks on the bill, which cover its key provisions. Victims of wage theft testified at an Iowa Senate hearing in late January, and when you hear their stories, it’s hard to understand why this remains a partisan issue.

It makes sense when you read the lobbyist declarations on the bill, showing various labor groups in favor and business groups opposed (including the Iowa Association of Business and Industry, the National Federation of Independent Business, the Iowa Retail Federation, the Iowa Grocery Association, and the Iowa Propane Gas Association). During the Senate Labor and Business Committee’s hearing on wage theft, GOP Senator Rick Bertrand had criticized the idea of forcing more “paperwork” on all Iowa businesses because a minority are stealing wages from workers. Democrats later incorporated some amendments suggested by Bertrand. Nevertheless, the final vote on Senate File 270 was strictly partisan, with 26 Democrats in favor and 23 Republicans against. Senators approved a similar bill last year, also along party lines. It died in the Iowa House.

Senate File 269, which would raise Iowa’s minimum wage from $7.25 to $8.00 this year and to $8.75 next year, cleared the Iowa Senate on February 24 as well. This time Bertrand joined the 26 Democrats in voting for the bill; the other 22 Republicans who were present opposed it. For the last couple of years, many Democrats nationally and in Iowa have endorsed a minimum wage of $10.10.  I assume Senate File 269 set a lower goal in the hope of attracting bipartisan support, but I would have stuck with $10.10. Not only is that closer to a living wage, it’s closer to the purchasing power of Iowa’s minimum wage the last time it was raised in early 2007.

Incidentally, only three of the current Iowa Senate Republicans were in the legislature when Iowa last raised the minimum wage in 2007. Of those, David Johnson voted for raising the minimum wage to $7.25, while Brad Zaun and Jerry Behn voted against it.

Republican statehouse leaders have no interest in raising the minimum wage now, but when a minimum wage increase came to a vote in 2007, it passed with huge bipartisan majorities in both chambers. At that time, supporters included nine current Iowa House Republicans: Kraig Paulsen (now Iowa House Speaker), Linda Upmeyer (now Iowa House Majority Leader), Clel Baudler, Dave Deyoe, Cecil Dolecheck, Jack Drake, Dan Huseman, Linda Miller and Dawn Pettengill (she was a House Democrat at that time but switched to the Republican Party later in 2007). Seven of the current Iowa House Republicans voted against raising the minimum wage to $7.25 in 2007: Greg Forristall, Pat Grassley, Tom Sands, Chuck Soderberg, Ralph Watts, Matt Windschitl, and Gary Worthan.

A bill that would raise Iowa’s gasoline tax by 10 cents a gallon is on its way to Governor Terry Branstad’s desk after approval today by both chambers in the Iowa legislature. The Iowa Senate passed Senate File 257 this morning by 28 votes to 21. Sixteen Democrats and twelve Republicans voted for the bill, while ten Democrats and eleven Republicans opposed it. Senate Majority Leader Mike Gronstal had reportedly insisted on at least half the GOP caucus supporting a gas tax increase as a condition for bringing the bill to the floor.

A few hours later, the Iowa House took up the Senate bill (rather than the bill that cleared two House committees last week). Thirty Republicans and 23 Democrats voted yes, while 26 Republicans and 20 Democrats voted no.

Only two state legislators missed today’s votes: Republican State Senator Mark Chelgren and Republican State Representative Chip Baltimore. Baltimore voted against the House version of this bill in committee last week, while Chelgren doesn’t serve on the committees that approved the bill in the Senate. Chelgren appears to have been absent for all of today’s votes, while Baltimore was at the Capitol but left the chamber when the gas tax bill came up. Speaking to reporters later, he tried to make a virtue out of his absence: “I refuse to legitimize either the bill or the process with a vote.” Weak sauce from a guy who is widely expected to seek higher office someday.

Conservative groups are urging Branstad to veto Senate File 257, but that seems unlikely, given the governor’s recent comments on road funding. Branstad’s spokesman said today that the governor will carefully review the final bill before deciding whether to sign it.

Final note: several of the “no” votes came from lawmakers who may face competitive re-election campaigns in 2016. Who's who in the Iowa Senate for 2015

The Iowa legislature’s 2015 session begins today. Democrats maintained their 26 to 24 majority in the upper chamber. After the jump I’ve posted details on the Iowa Senate majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Senate committees. Where relevant, I’ve noted changes from the previous committee assignments. Click here for a similar post on the new Iowa House.

I’ve also enclosed below details on the tenure of all 50 Iowa senators. The experience gap between the caucuses is striking, even more so since three of the longest-serving GOP state senators retired in 2014. Only seven of the 24 Republicans have served in either the state House or Senate for more than four years, whereas nineteen of the 26 Democrats have more than four years of legislative service. Only four of the 24 Senate Republicans have ten or more years of experience in the Iowa legislature, compared to seventeen of the 26 Democrats. No current Iowa Senate Republican has more than 20 years legislative experience, whereas six Democrats do.

Just seven of the 50 senators are women, down from ten women in the chamber two years ago. The Democratic caucus includes 20 men and six women; the Republican caucus 23 men and one woman.

All current Iowa senators are white. To my knowledge, no African-American has ever served in the Iowa Senate. CORRECTION: Bleeding Heartland reader northwest points out that I forgot Tom Mann, who represented part of Des Moines in the Iowa Senate during the 1980s.

No Latino has ever served in the Iowa House or Senate; Nathan Blake fell 18 votes short of becoming the first in 2014. No Asian-American has served in the state Senate since Swati Dandekar resigned in 2011.

Some non-political trivia: the 50 state senators include three Marks, three Bills, three Richards (who go by Rich, Rick, and Dick), two Mikes, two Toms, two Joes, and two men named Charles (one goes by Chaz).

Third-party and independent candidates in Iowa's 2014 elections

The filing period for general election candidates in Iowa closed last Friday, so it’s a good time to review where candidates not representing either the Democratic or Republican Party are running for office. The full candidate list is on the Iowa Secretary of State’s website (pdf(. After the jump I discuss all the federal, statewide, and state legislative races including at least one independent or minor-party candidate. Where possible, I’ve linked to campaign websites, so you can learn more about the candidates and their priorities.

Rarely has any Iowa election been affected by an independent or third-party candidate on the ballot. Arguably, the most recent case may have been the 2010 election in Iowa’s first Congressional district. Final results showed that Democratic incumbent Bruce Braley defeated Republican challenger Ben Lange by 4,209 votes, while conservative candidates Rob Petsche and Jason Faulkner drew 4,087 votes and 2,092 votes, respectively.

Republicans nominate Jonathan Lochman in Iowa Senate district 17

After fielding candidates in every Iowa Senate district in 2012, Republicans left a bunch of low-probability seats uncontested this year. One of those districts now has a GOP candidate, however: a special convention on July 24 selected Jonathan Lochman to run in Iowa Senate district 17. I don’t see a website for his campaign, but Lochman’s on Facebook here. During 13 years of active duty in the U.S. Army, he served wartime tours in both Afghanistan and Iraq. He’s now the Iowa coordinator for Team Rubicon (the Iowa chapter is on Facebook here).

Iowa Senate district 17 is open because State Senator Jack Hatch is running for governor. Tony Bisignano narrowly won a contentious three-way primary in this heavily Democratic seat covering parts of downtown Des Moines and the south side. In a press release, Lochman asserted that Bisignano would “be a rubber stamp for the radical, obstructionist agenda of Mike Gronstal,” whereas the Republican would “be an independent voice for my community.” Iowa Senate Minority Leader Bill Dix asserted, “Des Moines voters deserve a candidate​ like Jonathan Lochman, who has​ the integrity, honor and passion to effectively represent their interests at the State Capitol​.” Judging from that comment and various Republican posts on social media, the plan is for Lochman to win by playing up Bisignano’s drunk driving arrests and scandals from his previous term of service in the Iowa Senate during the 1990s.

It would be a historic upset for a Republican to win a state legislative seat here. The latest official figures show that Senate district 17 contains 16,388 active registered Democrats, 6,559 Republicans, and 9,792 no-party voters. Bisignano should have help from the Iowa Democratic Party’s coordinated campaign, because other Democratic candidates (notably Hatch, U.S. Senate nominee Braley, and IA-03 nominee Staci Appel) are counting on good GOTV in strongholds like the south side of Des Moines.

Also on July 24, Polk County Republicans held a special convention to nominate Army veteran Tom Hess in Iowa House district 34, covering half of Senate district 17. Hess will challenge longtime Democratic State Representative Bruce Hunter and has about the same chance of winning as Lochman (slim to none). As of July 1, House district 34 contained 8,404 active registered Democrats, 3,497 Republicans, and 5,114 no-party voters.

UPDATE: Cityview’s Civic Skinny published a detailed account of Tony Bisignano’s drunk driving arrest and how the case unfolded from there. Many details were new to me, and I suspect that if they had been more widely known, Nathan Blake might have won the Senate district 17 Democratic primary.

The most surprising fact recounted by Civic Skinny is that Jennifer Jacobs apparently e-mailed her draft Des Moines Register story on the OWI to Bisignano before publishing. Double-checking quoted remarks is one thing, but I am not aware of any newspaper where it is standard practice to run a full draft by the public figure who is the subject of the article.

Bisignano wins Iowa Senate district 17 as Blake opts against recount

Tony Bisignano will be the Democratic nominee in Iowa Senate district 17, as second-place finisher Nathan Blake declined to request a recount. From a Facebook status update Blake posted yesterday:

According to the official canvass from the Polk County Auditor’s Office, I ended up 18 votes behind in the Democratic primary election for Iowa State Senate District 17. I congratulate Tony Bisignano on a hard-fought victory. Thank you to my supporters, volunteers, and all who voted. Thanks especially to my wife and partner, Andrea, and our two kids for their patience, support, and sacrifices over the last year. I am proud of the campaign we ran. We won over 60% of the Election Day vote, even if we came up a few votes short.

As for the future, I am committed to to electing Democrats up and down the ballot in Iowa this November. I will continue my work in public service, fighting for consumers as an Assistant Iowa Attorney General. I promise to stay involved in progressive politics and will seek future opportunities to serve in elective office. The issues we care about are too important to sit on the sidelines.

A recount wouldn’t have changed the result, so I think Blake did the right thing not to go through the motions. He did manage a very strong election-day turnout, which is promising for any future candidacies.

Senate district 17 was the best chance for Democrats to elect Iowa’s first Latino state legislator, but two other opportunities remain this year in House district 60 and Senate district 47.

UPDATE: In a Facebook post, Bisignano said of Blake, “I can’t say enough about his poise and character. He has a very bright future in public service and I’m looking forward to helping him. His positive and respectful campaign shows what people want and expect from their public officals.”

Tony Bisignano's lead will hold up in Iowa Senate district 17

Tony Bisignano will be the next state senator representing Iowa Senate district 17, barring some extraordinary turn of events. The final election-night vote count showed him leading with 1,438 votes, to 1,425 for Nathan Blake and 1,001 for Ned Chiodo. Yesterday, officials counted six additional ballots, which all had been hand-delivered to the Polk County Auditor’s office on June 3, primary election day. Bisignano gained five votes and Chiodo one. So the final unofficial result shows Bisignano leading Blake by 1,443 to 1,425.

According to the Polk County Auditor’s elections office, three ballots from Senate district 17 arrived in the mail on June 4, but none will be counted, because they were postmarked June 3. In order to be counted, a late-arriving absentee ballot must be postmarked the day before the election at the latest.

On election night, Blake wrote on Facebook that his “campaign is reviewing all options to ensure that every vote is counted and accurately recorded.” I haven’t seen any statement since on whether he will request a recount. (There are no automatic recounts for Iowa primary elections.) I can’t imagine that a recount would change an eighteen-vote margin. In recent years, recounts of various Iowa House and Senate races have typically only changed the totals by a handful of votes, at most.

No Republican has filed to run in Senate district 17, an overwhelmingly Democratic seat in terms of voter registration. I was hoping for a different outcome in this primary, but I wish Bisignano well in his Iowa Senate work and offer condolences on the loss of his mother. I’ve posted below his statement on his mother’s passing and the primary election results. Bisignano won this race on early GOTV, building up a 102-vote margin on Chiodo and a 649-vote margin on Blake through absentee ballots. Blake had strong election-day turnout, especially considering that there were no competitive Democratic primaries for governor, U.S. Senate, or the third Congressional district, but it wasn’t quite enough. No doubt he’ll have other opportunities to run for office.

Final note for Iowa election trivia buffs: Patrick Rynard set a record this year that will likely never be broken. He has now managed two campaigns that spawned cases eventually reaching the Iowa Supreme Court. Rick Mullin’s Iowa Senate race in Sioux City in 2010 led to the recent court ruling about negative political advertising. Bisignano’s candidacy (or more accurately Chiodo’s determination to drive his rival off the ballot) prompted a high court ruling that may lead to thousands of Iowans getting their voting rights back.

Iowa primary election results thread

Polls close at 9 pm, and I’ll be updating this post regularly with primary election results. Rumor has it that turnout was relatively low, even on the Republican side where there are hard-fought primaries for U.S. Senate and the third Congressional district. According to the Polk County Auditor’s office, as of this afternoon only 1,506 absentee ballots had been requested and 1,350 absentee ballots received for today’s GOP primary. Keep in mind that roughly half of all Republican voters in IA-03 live in Polk County, and six campaigns were competing for their votes. Not to mention that five U.S. Senate candidates should have been locking in early votes in Iowa’s largest county.

By comparison, 2,883 Democratic primary absentee ballots were requested in Polk County, and 2,296 of those returned by today. The lion’s share were from Iowa Senate district 17 in Des Moines, where three candidates are seeking to replace Jack Hatch (2,475 absentee ballots requested and 1,950 returned). Democratic campaigns have long pushed early voting more than Republicans, but still–that’s a shocking failure to GOTV by the various Republican campaigns.

Labor union endorsements in contested 2014 Iowa Democratic primaries

With less than two weeks remaining before June 3, interest groups with a preference in competitive primaries have presumably made their views known by now. On the Democratic side, labor unions are most likely to get involved in primaries, so I wanted to compile in one place the full list of candidates in competitive Democratic races who have been endorsed by one or more organized labor group. None of the Democrats seeking statewide office in Iowa this year has a primary opponent, and I’ve omitted county-level races. The list below includes candidates running for Congress in the first district and seeking various Iowa House and Senate seats.

I will update this post as needed if I learn of other labor union endorsements. Note that many other Democratic candidates already have or will have organized labor’s official support for the general election campaign. Blog for Iowa posted all of the Iowa Federation of Labor AFL-CIO’s endorsements for 2014 here. Tom Miller endorses Nathan Blake in Iowa Senate district 17 primary

Iowa Attorney General Tom Miller has endorsed Assistant Attorney General Nathan Blake in the Democratic primary to represent Iowa Senate district 17. State Senator Jack Hatch is running for governor rather than seeking re-election in that heavily Democratic seat. Blake, former State Senator Tony Bisignano, and former State Representative Ned Chiodo are competing in the Democratic primary. No Republican has filed to run for the seat covering much of downtown Des Moines and the south side of the capital city (this post includes a detailed map). Several organized labor groups are backing Bisignano. Chiodo’s supporters include U.S. Senator Tom Harkin.

After the jump I’ve posted Miller’s statement, which the Des Moines Register published as a letter to the editor on May 10. I’ve also enclosed Blake’s biography.

While Miller’s public support for the assistant attorney general covering consumer protection is no surprise, it will likely enrage Chiodo. In a court challenge to Bisignano’s eligibility, Chiodo argued that Miller should have recused himself from the three-member panel that originally cleared Bisignano to run for office despite an aggravated misdemeanor. Chiodo’s court filing asserted that Miller had a conflict of interest, since Blake potentially would benefit from two heavyweights of south-side politics splitting the primary vote.

A Polk County District Court judge rejected that argument, and the Iowa Supreme Court did not rule on whether Miller should have recused himself when five justices determined Bisignano was eligible to run for office.

Any comments about the Senate district 17 race are welcome in this thread. From what I’ve heard, Chiodo was the first to go negative (against Bisignano) in direct mail. I encourage Bleeding Heartland readers who live in the district to save campaign flyers or mail pieces and, if possible, send me scanned copies: desmoinesdem AT yahoo.com . Before the June 3 primary, I plan to post an overview of key arguments for and against each candidate. I am encouraging my friends in the district to vote for Blake. Not only is Blake capable and progressive, I think the Iowa Senate has plenty of long-serving elected Democrats and would benefit from some new blood.

Blake’s official bio also notes that if elected, he “would be the first Latino to serve in Iowa’s legislature.” Two Latina Democrats are running for the statehouse this year as well: Maria Bribriesco against Senator Roby Smith in Senate district 47, and Karyn Finn against Republican incumbent Walt Rogers in House district 60. CORRECTION: Bleeding Heartland user Mitch notes in the comments that I forgot to mention Maria Rundquist, a Latina who is one of two Democrats challenging incumbent Rick Bertrand in Iowa Senate district 7.

Tom Harkin endorses Ned Chiodo in Iowa Senate district 17

Iowa politics junkies, help me out here: Has U.S. Senator Tom Harkin ever endorsed a candidate for an Iowa legislative district in a competitive Democratic primary with no incumbent? I can’t think of any prior examples, but it happened yesterday. The full text of Ned Chiodo’s press release is after the jump. Money quote: “I am proud to support Ned Chiodo for State Senate,” said Harkin. “I have known him for many years, and without question he has the integrity and experience to lead Iowa forward.”

Chiodo certainly has a lot of political experience: five terms in the Iowa House, one term as Polk County Auditor, and many years lobbying the Iowa legislature. Harkin’s endorsement is a slap at the other highly experienced candidate in the SD-17 primary: Tony Bisignano. I guess the long friendship allowed Harkin to overlook Chiodo’s effort to knock Bisignano off the ballot, which could have disenfranchised tens of thousands of Iowans had the Iowa Supreme Court reached a different conclusion.

Harkin is an original co-sponsor of a U.S. Senate bill “that would reduce recidivism rates by restoring voting rights to individuals after they have served their time and have been released from incarceration.” Yet he is endorsing an Iowa Senate candidate who argued that ineligible voters in Iowa include anyone convicted of an aggravated misdemeanor which can carry a prison sentence–regardless of whether the person was ever incarcerated.

I am urging my friends in Iowa Senate district 17 to support Nathan Blake, the third candidate in the Democratic primary. The Iowa Senate Democratic caucus already has plenty of members with at least decade’s experience as state legislators. How about a capable new person, who supports progressive values and doesn’t have Chiodo’s or Bisignano’s baggage?

Mid-week open thread: Who could have imagined?

Here’s your mid-week open thread, Bleeding Heartland readers: all topics welcome.

I have been thinking about the latest Iowa Supreme Court decision a lot today. A year ago, I would have sworn that as long as Terry Branstad remains governor, there’s nothing anyone can do for the thousands of ex-felons permanently disenfranchised in this state. Branstad couldn’t wait to sign that executive order as soon as he was back in office. Under the convoluted procedure he created, only a small fraction of 1 percent of those who have completed their prison terms have managed to regain their voting rights.

The day State Senator Jack Hatch declared his candidacy for governor, I could never have imagined the unlikely chain of events that followed. First, arch-rivals Tony Bisignano and Ned Chiodo set their sights on Hatch’s Iowa Senate seat. Then, Bisignano was caught driving drunk again. Then, Chiodo not only challenged Bisignano’s right to seek office but continued to pursue his case in court after losing before a panel of top state officials. (In contrast, the voter who challenged State Senator Joe Seng’s registration as a candidate in IA-02 two years ago dropped his effort after the same panel determined Seng had qualified for the primary ballot.)

Then, Chiodo refused to take the Polk County District Court’s no for an answer. Still I had no clue where all this was going–until yesterday, when three of the Iowa Supreme Court justices determined that not all felonies should be considered “infamous crimes,” which justify stripping Iowans of their rights as electors. Very soon, one or more non-violent felons are likely to file suit, demanding that their rights be restored. Depending on where Justice Brent Appel comes down on the issue (he recused himself from the Chiodo/Bisignano case), the Iowa Supreme Court may eventually declare unconstitutional the 1994 law defining “infamous crimes” as felonies.

We don’t know whether a majority on the court will take this stance. As Ryan Koopmans points out, the Chiodo ruling came out incredibly quickly. One or more of the justices may change his mind after reflecting on the issues for a while. Still, the potential for a major advance in Iowa voting rights is mind-blowing.  

Divided Iowa Supreme Court rules Tony Bisignano can run in Iowa Senate district 17 (updated)

A three-way Democratic primary is assured in Iowa Senate district 17, as the Iowa Supreme Court announced this afternoon that it has affirmed a district court ruling on Tony Bisignano’s eligibility to run for office. Rival candidate Ned Chiodo filed a lawsuit last month, saying Bisignano’s recent aggravated misdemeanor conviction for second-offense OWI should be considered an “infamous crime.” The Iowa Constitution disqualifies citizens convicted of “infamous crimes” from exercising the privileges of “electors.”

Chief Justice Mark Cady wrote the plurality opinion, joined by Justices Daryl Hecht and Bruce Zager. Overturning Iowa Supreme Court precedents set in 1916 and 1957, the court ruled that “infamous crimes” cannot be interpreted to mean any crime punishable by a prison sentence, including aggravated misdemeanors. On the other hand, the court did not simply accept the 1994 law defining “infamous crimes” as felonies. Citing historical references including an 1839 Iowa territorial statute, the plurality argues that not all felonies are “infamous,” and that the words had different meanings at the time the Iowa Constitution was adopted in the 1850s. It did not go on to define which felonies should be considered infamous crimes in the present context.

Justice Edward Mansfield wrote a concurring opinion, joined by Justice Thomas Waterman. The concurrence agrees that Bisignano retains his rights as an elector, because aggravated misdemeanors cannot be considered “infamous crimes.” However, Mansfield would have accepted the bright-line definition from the 1994 state law, equating felonies with “infamous crimes.” He warned that the plurality opinion would serve as a “welcome mat” for future litigation from felons claiming that they should be entitled to vote, because their convictions were not for “infamous crimes.” On balance, I agree most with Mansfield’s opinion.

Justice David Wiggins dissented, arguing that the court should not have rewritten “nearly one hundred years of caselaw.” He would have found Bisignano ineligible to run for office under the longstanding precedent that “infamous crime” means any crime punishable by a prison sentence. Wiggins’ dissenting opinion does not accept the 1994 law which defined “infamous crimes” as felonies, because interpreting the state Constitution is a job for the Iowa Supreme Court, not the state legislature.

Justice Brent Appel recused himself from this case.

The Iowa Supreme Court did not rule on Chiodo’s separate claim that Attorney General Tom Miller should have recused himself from the panel that allowed Bisignano to remain on the ballot. Chiodo argued that Miller had a conflict of interest, because one of his employees, Assistant Attorney General Nathan Blake, is also seeking the Democratic nomination in Senate district 17.

One thing’s for sure: today’s ruling won’t be the last attempt by the Iowa Supreme Court to clarify the definition of “infamous crimes.”

Court rejects challenge to Bisignano candidacy in Iowa Senate district 17

Polk County District Court Judge David Christensen on April 2 rejected Ned Chiodo’s appeal against a panel decision allowing Tony Bisignano to run for Iowa Senate district 17. Chiodo, Bisignano, and Nathan Blake all qualified for the Democratic primary ballot in the seat Senator Jack Hatch is vacating in order to run for governor. Chiodo challenged Bisignano’s eligibility to run for office, citing a drunk driving offense that is an aggravated misdemeanor. A panel of Attorney General Tom Miller, State Auditor Mary Mosiman, and Secretary of State Matt Schultz concluded that Bisigano could run, because Iowa Code specifies felony convictions (not aggravated misdemeanors) as disqualifying citizens from voting or running for office.

Chiodo’s appeal in Polk County District Court rests on two legal arguments: Miller should have recused himself from the panel deciding whether Bisignano is eligible, and Bisignano’s second-offense OWI should be considered an “infamous crime” under Iowa case law. Judge Christensen concluded that Chiodo “failed to assert sufficient grounds to disqualify the Attorney General from serving on the Panel,” nor was Chiodo “prejudiced by the inclusion of the Attorney General in the Panel.”

After the jump I’ve posted the second half of Judge Christensen’s ruling. Although three Iowa Supreme Court decisions indicate that crimes punishable by a prison sentence can be considered “infamous crimes,” the Iowa legislature has since spelled out its clear intention to revoke the rights of electors only in cases of felonies. The judge denied Chiodo’s petition for review, since he “failed to carry his burden to show that the Panel’s decision was unconstitutional,” and there was no evidence that decision was “based upon an erroneous interpretation of a provision of law,” or illogical, arbitrary, capricious, or an abuse of discretion. The judge ordered Chiodo to pay court costs.

The Iowa Supreme Court is likely to have the final say on this matter, but I find it hard to imagine they will disqualify Bisignano. Doing so would potentially disenfranchise tens of thousands of Iowans with aggravated misdemeanor convictions.

Weekend open thread: Infamous crimes and aggravated misdemeanors

Ned Chiodo’s challenge to Tony Bisignano’s eligibility to run for Iowa Senate district 17 has brought new attention to some legal confusion over which crimes can cause Iowans to lose their voting rights. The Iowa Constitution does not specify which “infamous crimes” should disqualify citizens from voting or holding public office. Chiodo’s attorney cites case law from the Iowa Supreme Court suggesting that aggravated misdemeanors as well as felonies can be considered “infamous crimes.” Yet a law passed in 1994 defined “infamous crimes” as state or federal felonies.

State Representative Mary Wolfe, an Iowa House Democrat who is also a criminal defense attorney, just reposted a piece she wrote in 2012, explaining why aggravated misdemeanor convictions do not disqualify voters. (I recommend clicking through to read her whole analysis.) Wolfe notes with dismay the “complete and total disconnect between Iowa’s Governor and Secretary of State on such a straightforward, yes or no issue.” Secretary of State Matt Schultz’s website correctly indicates that convicted felons whose rights have not been restored may not register to vote. However, Governor Terry Branstad’s website states that “infamous crimes” may include aggravated misdemeanors and any crime that “may be punishable” by more than one year in prison. That could include a long list of offenses, including the second Operating While Intoxicated charge to which Bisignano pled guilty earlier this year.

At this writing, Branstad’s website still contains that misinformation about some aggravated misdemeanors leading to the loss of voting rights, even though Branstad himself signed the 1994 law defining “infamous crimes” as felonies. Speaking to reporters a few weeks ago in defense of his policy permanently disenfranchising all but a handful of ex-felons, the governor equated “infamous crimes” with felonies.

Because Chiodo plans to take his case to court, a Polk County District judge (and perhaps eventually the full Iowa Supreme Court) will settle any questions over whether Iowa’s 1994 law supersedes previous court rulings on this issue.  

Panel clears Tony Bisignano to run in Iowa Senate district 17; court may have final say

Attorney General Tom Miller, Secretary of State Matt Schultz, and State Auditor Mary Mosiman decided unanimously that Tony Bisignano may run in the Democratic primary to represent Iowa Senate district 17 despite a recent drunk driving charge. Democratic rival Ned Chiodo had challenged Bisignano’s candidacy, saying a second-offense OWI is an aggravated misdemeanor punishable by a prison sentence. Therefore, “long-established case law from the Iowa Supreme Court” place this charge among the “infamous crimes” that render citizens ineligible to vote or hold office under the Iowa Constitution. Attorneys representing both sides presented their case to the three-member panel on Wednesday. Tipping his hand, Miller shared concerns expressed by Bisignano’s lawyer that thousands of Iowans could lose their voting rights if Chiodo’s challenge were upheld. In fact, Miller estimated that 35,000 to 50,000 people could become ineligible to vote under that standard.

Today Chiodo’s attorney confirmed plans to appeal in Polk County District Court. The case may eventually reach the Iowa Supreme Court, as language in the state constitution and a 1994 law are in conflict. I don’t see how the matter could be resolved before the June 3 primary, let alone before the Polk County Auditor’s office will have to print primary ballots.

After the jump I’ve posted statements from Bisignano’s campaign. The winner of the Democratic primary is virtually guaranteed to succeed Jack Hatch in Iowa Senate district 17. Republicans do not even have a candidate running in this heavily Democratic area of Des Moines.

I’m disappointed that Ned Chiodo is willing to sacrifice the voting rights of thousands of people in order to advance his political career. By the same token, I would prefer not to elect a repeat drunk driver to the legislature. Whether or not Bisignano’s offense meets the legal definition of an “infamous crime,” his behavior posed a danger to himself and others. If I lived in Senate district 17 I would vote for new blood in the Democratic caucus: Nathan Blake. The official announcement of his candidacy is at the end of this post.

Ned Chiodo sets up three-way primary in Iowa Senate district 17

Former State Representative and Polk County Auditor Ned Chiodo formally announced on Monday that he will seek the Democratic nomination in Iowa Senate district 17, which Senator Jack Hatch is vacating to run for governor. Chiodo has been planning his campaign since last summer.

The district covering parts of downtown Des Moines and most of the south side will not be competitive in the general election, as it contains more than twice as many registered Democrats as Republicans. But the Democratic primary will be an epic battle featuring two giants of south-side politics (Chiodo and former State Senator Tony Bisignano) and Nathan Blake, a relative newcomer to Iowa politics. Bisignano has the backing of a large organized labor group. Blake goes into the primary as an underdog, but presumably his chances improve if Bisignano and Chiodo split the south-side vote.

Five Iowa Senate races to watch in 2014

It’s the time of year for blog posts about notable candidates and upcoming elections. Every politically engaged Iowan knows already that 2014 will be an unusually exciting year. We haven’t seen an open U.S. Senate race since 1974. The last time Iowa’s first Congressional district was open was in 2006. The last time Iowa’s third Congressional district was open was in 2002, but it wasn’t a wide open seat, since incumbent Representative Leonard Boswell moved into Polk County to run. Amazingly, 1940 was the “last time there was a Congressional race in Polk County without an incumbent seeking re-election.” All of Iowa’s statewide elected officials are up for re-election as well this year, and the secretary of state’s position may become open if Matt Schultz decides to go for the Republican nomination in IA-03.

Since Bleeding Heartland readers already know about the big Iowa races to watch, I want to focus today and tomorrow on the elections that are likely to determine control of the Iowa House and Senate in 2015 and 2016.

Labor group sticking with Tony Bisignano in Iowa Senate district 17

The Central Iowa Building and Construction Trades Council is standing by its endorsement of former State Senator Tony Bisignano in the Democratic primary to represent Iowa Senate district 17. Bisignano is one of three Democrats running for the seat State Senator Jack Hatch is vacating in order to run for governor. Bisignano was recently arrested for driving with a blood alcohol level over the legal limit. Commenting on that arrest, Cityview’s Civic Skinny columnist noted that supporters of Ned Chiodo “think Bisignano should drop out.” Both Chiodo and Bisignano have a political base on the south side of Des Moines. The third candidate, Nathan Blake, lives in the Sherman Hill neighborhood near downtown.

The latest edition of Cityview contains a letter to the editor by Earl Agan Jr., president of the Central Iowa Building and Construction Trades Council. He explains why his group “reaffirmed” its support for Bisignano last week. I’ve posted excerpts from Agan’s letter after the jump.

Any comments about the race in Iowa Senate district 17 are welcome in this thread. The winner of the Democratic primary is almost certain to succeed Hatch in the Senate. As of October 2013, Senate district 17 contained 16,943 registered Democrats, 7,179 Republicans, and 11,256 no-party voters.

Iowa Senate district 17 candidate arrested for OWI

When you’re planning a political comeback, this isn’t how you want to make news:

The Des Moines Register says Tony Bisignano, a Democrat, acknowledged his mistake and took responsibility for his action.

A police report says the 61-year-old was arrested at 12:38 a.m. Monday in Altoona. The report says his blood alcohol level was 0.099 percent.

Bisignano has been arrested for operating while intoxicated twice before, most recently 12 years ago.

Former State Senator Bisignano was the first Democrat to declare in Iowa Senate district 17, which Jack Hatch is vacating to run for governor. He faces a likely three-way primary against Ned Chiodo and Nathan Blake. The strong partisan lean of this district means that the primary winner will almost surely succeed Hatch.

An embarrassing number of Iowa state legislators have been arrested for drunk driving, on both sides of the aisle. Former State Senator Jeff Lamberti was even elevated to head the powerful Iowa Racing and Gaming Commission shortly after his OWI last year. So I wouldn’t consider today’s news to be a game-ender for Bisignano in the Democratic primary. Still, it can’t be helpful for him to have a third arrest of this kind on his record.

On the plus side, today was probably the best day in months for a candidate to dump some unflattering news. This story will be overshadowed by the federal government shutdown and the opening of the state health insurance exhanges.

Three-way Democratic primary coming in Iowa Senate district 17

State Senator Jack Hatch’s entry to the governor’s race opens up a safe Iowa Senate seat for Democrats in Polk County. This morning Assistant Iowa Attorney General Nathan Blake announced his candidacy in Iowa Senate district 17. Blake’s campaign is on the web, Facebook, and Twitter. I’ve posted his press release after the jump, along with a map of the district and the latest voter registration numbers there.

This race is likely to be one of the most interesting primary battles in Iowa next year. Blake will face two warhorses of Democratic politics on the south side of Des Moines. Lobbyist and former State Representative Ned Chiodo confirmed by telephone this morning that he will also run in Senate district 17. He will formally announce his campaign at a later date. Former State Senator Tony Bisignano became a candidate in this district months ago and immediately locked down a major labor union endorsement.

Nathan Blake is likely candidate in Iowa Senate district 17

Democrats on the south side of Des Moines may not have a competitive race to replace Kevin McCarthy in House district 33, but they’ll still be at the center of an exciting primary in Iowa Senate district 17. Former State Senator Tony Bisignano is already running in the district State Senator Jack Hatch currently holds, and former State Representative Ned Chiodo is leaning toward running. Assistant Iowa Attorney General Nathan Blake confirmed by telephone this week that he is also exploring a candidacy in Senate district 17, pending Hatch’s decision on whether to run for governor. Given that Hatch recently hired Grant Woodard to manage his exploratory committee and already ran a television commercial criticizing Governor Terry Branstad, I doubt there’s any realistic chance Hatch will seek another term in the Iowa Senate in 2014.

Blake has worked in the Consumer Protection Division of the Iowa Attorney General’s Office since 2011. He originally moved to Des Moines out of law school and, after a few years in private practice, worked on Barack Obama’s presidential campaign in Iowa in 2007 and 2008. Blake then served as special assistant to the U.S. Department of Agriculture’s Under Secretary for Food, Nutrition, and Consumer Services Kevin Concannon.

Assuming Hatch runs for governor, the Senate district 17 Democratic primary could become an interesting generational battle between Bisignano and Chiodo, two war horses of the south side, and Blake, a relatively fresh face on the scene. Young professional Chris Diebel opted to run for the Des Moines City Council instead of for this Senate seat.

The Daily Kos Elections team has been compiling 2012 presidential election results by state legislative district as well as by Congressional district. Yesterday the Iowa numbers were added to the database. Looking closely at the presidential vote in the legislative districts provides some insight about where the competitive Iowa statehouse races might be next year. Ned Chiodo likely to run in Iowa Senate district 17

Ned Chiodo confirmed by telephone today that he plans to run for Iowa Senate district 17 next year, assuming current State Senator Jack Hatch does not seek re-election to that office. Chiodo said that if he becomes a candidate, he will support a “progressive populist agenda.”

Chiodo served five terms in the Iowa House during the 1970s and 1980s, representing some neighborhoods on the south side of Des Moines that are now part of Senate district 17. He was elected Polk County auditor in 1984, when he retired from the Iowa House and Hatch ran successfully in the district he had represented. Chiodo has also been a registered lobbyist at the state legislature for a number of years.

Former State Senator Tony Bisignano became a candidate in Senate district 17 immediately after Hatch announced last month that he is exploring a gubernatorial bid. The June 2014 Democratic primary will be the real election in the district, where there are now 16,942 registered Democrats, 7,163 Republicans, and 11,137 no-party voters. Another possible Democratic candidate is Chris Diebel, a marketing specialist who is managing director of LPCA Public Strategies (Jeff Link’s political consulting outfit).
