Final Culver condition of the state thread

Governor Chet Culver addresses Iowa legislators for the last time this morning. Iowa Public Television will carry the speech, and I’ll liveblog after the jump. Meanwhile, use this thread for any comments about Culver’s record and legacy. I expect Culver will highlight efforts to increase renewable energy production and give more children access to health care and preschool, while leaving the state in better fiscal condition than most of the country.

I see Governor-elect Terry Branstad declined Culver’s invitation to attend today’s speech, and Culver won’t attend inaugural events on Friday.

UPDATE: The speech is now over, and my liveblog is after the jump. The biggest surprise for me came toward the end: Culver alluded to a report prompted by last summer’s massive egg recall, recommending five changes in Iowa law to address food safety issues. I’ll write a separate post later with more details on those proposed changes.

GOP spending cut plans begin to collide with reality

Iowa House Republican leaders rolled out their state budget cutting proposals yesterday. They plan to introduce the “Taxpayers First Act” immediately when the 2011 session begins next week. Rod Boshart covered the planned spending cuts here, repeating the House Republicans’ claim that the bill would “cut state spending by $114 million this year.” That figure doesn’t appear to correspond to the non-partisan Legislative Services Agency’s document spelling out how much each proposal would save in fiscal years 2011, 2012 and 2013. The first two pages of that document cover fiscal savings from proposals that would not require legislative action; the second two cover proposals that would require new legislation (and therefore support from the Democratic-controlled Iowa Senate as well as Governor-elect Terry Branstad’s signature). If everything on the first two pages of the GOP wish list happens, general fund spending would actually increase by $23 million in the current budget year, while about $43 million would be saved from other state government funds, leading to net savings of around $19 million. Even if you assume everything on the second two pages also becomes law (very unlikely), at most $73 million would be saved from the fiscal 2011 budget. That’s way short of the “hundreds of millions” of dollars incoming Iowa House Speaker Kraig Paulsen promised Republicans would cut from the current-year budget.

What happened? The LSA analysis didn’t support the fantasy budget cut numbers House Republicans have been throwing around for ages. Six examples are after the jump.

Mauro resolves HAVA audit, lands Branstad administration job

Secretary of State Michael Mauro announced on December 29 that his office and the U.S. Election Assistance Commission have resolved all outstanding issues related to Iowa’s use of federal Help America Vote Act funds when Chet Culver was secretary of state. A federal audit originally questioned the use of about $2.5 million of the $30 million in HAVA funds Iowa received. By June of this year, federal officials reduced to $576,000 the amount Iowa would have to pay back.  The final agreement reached won’t cost Iowa anything.

For three years, state elections staff have worked to correct a long list of problems in an effort to avoid a large repayment, but federal officials concluded $221,000 in “disallowed costs” couldn’t be fixed or whittled down further.

However, the state won’t have to write a check to repay that money, said Secretary of State Michael Mauro said today.

Mauro asked federal officials to give the state a credit for expenses that were eligible for federal voting funds, but that Mauro chose to cover with state money knowing that questionable spending would likely need to be repaid.

Governor Chet Culver’s general counsel Jim Larew emphasized in a statement that “no federal rules were broken,” and “Most of the federal rules that were interpreted to evaluate the Iowa HAVA program had not even been published by the time Iowa HAVA was completed.”

This settlement wraps up four years of outstanding work by Mauro as secretary of state. He never should have lost his re-election bid.

Last month, Governor-elect Terry Branstad praised Mauro’s work and said he would consider hiring him in his administration. On December 30, the Branstad/Reynolds transition announced that Branstad will nominate Mauro to head the Iowa Labor Commission. Before that term starts on May 1, 2011, Mauro will serve as deputy director at Iowa Workforce Development, beginning January 3.

I’ll post a more extensive update on Branstad’s personnel choices and policy statements in the next few days. After the jump I’ve posted Mauro’s press release and Larew’s statement on the HAVA audit resolution, as well as the Branstad statement on Mauro’s new position, which praised “the fair and even way [Mauro] administered election laws and how he effectively managed the Iowa secretary of state’s office.” No wonder Branstad never did much to help Mauro’s opponent Matt Schultz, in stark contrast to his longstanding and highly visible advocacy for attorney general candidate Brenna Findley.

Iowa Republicans afraid to speak out against impeaching Supreme Court justices

Before the November election, advocates for retaining the three Iowa Supreme Court justices on the ballot warned that throwing out the judges over one controversial decision would bring more politics into the judicial arena. The new debate over impeaching the four remaining Supreme Court justices shows that’s exactly what has happened.

In 2009, calls for impeaching the Supreme Court justices were a bridge too far even for Bob Vander Plaats, Iowa’s leading critic of the Varnum v Brien ruling. Now newly-elected Republican State Representatives Tom Shaw, Kim Pearson and Glen Massie are drafting articles of impeachment to introduce during the 2011 legislative session.

So far not one GOP official has spoken out against using a controversial ruling as grounds for criminal proceedings against four judges.

New Secretary of State Schultz hires Jim Gibbons, Mary Mosiman for top jobs

Secretary of State-elect Matt Schultz has announced several important hires in the past week. Former Republican Congressional candidate Jim Gibbons will serve as Chief Deputy and Director of Business Services, while longtime Story County Auditor Mary Mosiman will run the Elections Division.

Lawyers drop effort to keep ousted Supreme Court justices on bench

Three attorneys who are challenging last month’s judicial retention elections today withdrew their request for an injunction to allow Iowa Supreme Court Chief Justice Marsha Ternus and Justices David Baker and Michael Streit to continue serving after December 31. The attorneys filed their lawsuit last week, saying the retention vote was illegal because the Iowa Constitution stipulates that judges “shall at such judicial election stand for retention in office on a separate ballot which shall submit to the question of whether such judge shall be retained in office […].” Lynda Waddington reports today that the lawsuit will go forward, but plaintiffs dropped their request to let Ternus, Baker and Streit continue to serve after learning that “the Iowa Judicial Branch and the justices removed from service were not in favor of it.”

A court will consider this lawsuit sometime next year. I believe it will go nowhere for reasons I discussed here. Iowa has been holding judicial retention elections in conjunction with general elections for nearly five decades. No one has ever demanded that voters be provided special ballots for the retention vote. IowaVoter points out that when Iowans approved the constitutional amendment on replacing judicial elections in 1962, lever machines rather than paper ballots were widely used. I share IowaVoter’s reading of the relevant passage in the constitution: it means that there must be a separate ballot line for each judge, so voters aren’t asked to retain or not retain the judges as a group.

Any comments about Iowa’s judicial system are welcome in this thread. I believe an impeachment spectacle during the 2011 legislative session will only make it harder for Governor-elect Terry Branstad to get lawmakers to pass the modest reform he favors (requiring partisan balance for judicial nominating commissions).

Previewing the Iowa Senate district 35 special election (updated)

Last week Larry Noble resigned from the Iowa Senate, effective December 17, because Governor-elect Terry Branstad selected him to be commissioner of the Iowa Department of Public Safety in the next administration. After the jump I’ve posted Noble’s official biography from his campaign website. He is well qualified to lead the Department of Public Safety and will have no trouble winning confirmation from his former Iowa Senate colleagues.

Noble’s resignation leaves Republicans with 22 seats in the Iowa Senate. Democrats are assured of a slim majority in the chamber with 26 seats. A January 4 special election in Senate district 48 will determine the successor to Kim Reynolds, who resigned to become lieutenant governor. Sometime this week, Governor Chet Culver will set a date for the special election to replace Noble. The election will take place within 45 days of Culver’s announcement, probably in late January.

Senate district 35 covers most of the northern half of Polk County (map). It includes the Des Moines suburbs of Ankeny and Johnston, as well as Grimes, Polk City, Alleman, Elkhart and rural areas north of I-80. The area has experienced rapid population growth in the past decade and leans strongly Republican. The seat was last vacant in 2006, when Jeff Lamberti stepped down to run for Congress. Iowa Democrats recruited Ankeny Mayor Merle Johnson and invested heavily in the race, but Noble won by 52 percent to 48 percent in a Democratic wave year. Democrats did not nominate a candidate against Noble when he came up for re-election in 2010. As of December 1, Senate district 35 had 23,450 registered Republicans, 18,065 registered Democrats and 19,017 no-party voters.

So far no one has announced plans to run in Senate district 35. Democrats and Republicans will hold special district nominating conventions to select candidates.

Branstad keeps DOT head Richardson in place for now

Governor-elect Terry Branstad has asked Nancy Richardson to remain head of the Iowa Department of Transportation “through the 2011 legislative session.” Governor Tom Vilsack appointed Richardson to head the DOT during his second term; she was one of the few department heads Governor Chet Culver kept in place. A Branstad press release with background on Richardson is after the jump. It says she “is a strong leader and we appreciate her willingness to serve in the administration as we continue our nationwide search for a new director.”

Perhaps Branstad will take several months to consider DOT candidates from around the country, but he hasn’t been using that kind of process for other appointments announced so far. Shortly after the election, he offered the Department of Inspections and Appeals director job to Rod Roberts, who hadn’t even applied for the position, let alone competed against other possible appointees in an interview.

My first thought on hearing the news about Richardson was that Branstad has already decided on a new DOT director, but for some reason that person isn’t available to start the job until the spring. (The Iowa legislature’s 2011 session begins in January; most years, legislators wrap up their work in April.) It could be someone outside Iowa who needs a few months to relocate, or someone who needs to finish a major project in her/his current job, or perhaps a sitting state legislator who doesn’t want to step down until after the session.

Alternatively, Branstad may have someone controversial in mind for the DOT position. State department heads must be confirmed by the Iowa Senate. If Branstad appoints Richardson’s replacement after the session ends, that person will be able to serve on an interim basis until the Senate considers the nomination in early 2012.

UPDATE: Branstad’s spokesman Tim Albrecht told the Des Moines Register, “We do not have anyone lined up at this time. We are still in the midst of our search, and that is not confined to the borders of Iowa. This is going to be a thorough search to find the right individual.” I wonder why Branstad wants a much more lengthy search for this position than for various other important state departments.

While she stays on the job, I hope that Richardson will help persuade Branstad not to back out of a passenger rail project that would connect Iowa City to Chicago via the Quad Cities. Richardson isn’t a visionary for alternative modes of transportation, but she supported the Culver administration’s efforts to promote passenger rail in Iowa. Branstad said he is reviewing the costs and benefits of the project. The federal government has approved $230 million in funding for the Iowa portion of the rail connection. Republican Senator Chuck Grassley has spoken favorably about the project, and Des Moines business leaders hope the Chicago-Iowa City connection will one day be extended through Des Moines and on to Council Bluffs and Omaha.

Republican governors-elect in Ohio and Wisconsin have rejected federal funding for passenger rail projects. That decision is already costing Wisconsin jobs and will cost Ohio economic development opportunities.

Brenna Findley to be Branstad's legal counsel

Governor-elect Terry Branstad announced yesterday that Brenna Findley will be his administration’s legal counsel. Findley was bound to get a good job in state government, given the national and state Republican money behind her candidacy for attorney general, and the way Branstad promoted her all year long. He also appeared in one of Findley’s television commercials, which he did not do for other down-ticket Republican candidates.

I had heard rumors Findley might be put in charge of the Iowa Department of Public Safety, since her commercials in the attorney general’s race had a strong public-safety angle. On the other hand, the Iowa Senate has to confirm heads of state departments, and some might have questioned Findley’s qualifications for that kind of position.

Findley doesn’t have much experience in the practice of law, but Branstad doesn’t need state senators to confirm his staff appointees. Before running against Attorney General Tom Miller, Findley served as Representative Steve King’s chief of staff for seven years. Earlier this year, she joined a law firm run by former U.S. Attorney Matt Whitaker and State Representative Chris Hagenow, who (like Findley) are both potential Republican candidates for higher office. Iowa reaction to federal ruling against health insurance mandate

U.S. District Court Judge Henry Hudson ruled today that the individual mandate to purchase health insurance is unconstitutional. The mandate, scheduled to go into effect in 2014, is a key provision in the Patient Protection and Affordability Act, which President Barack Obama signed in March. The mandate creates a guaranteed increased market for private insurers in exchange for new regulations, such as ending discrimination based on pre-existing conditions. Most of the two dozen lawsuits filed against the federal health insurance reform law have challenged the individual mandate. Judges dismissed several of those cases earlier this year, but Virginia Attorney General Ken Cuccinelli found a somewhat sympathetic ear in Judge Hudson, who wrote, “No specifically constitutional authority exists to mandate the purchase of health insurance. […] Salutatory goals and creative drafting have never been sufficient to offset an absence of enumerated powers.”

Hudson arguably should have recused himself from this case, since he owns a significant share in the Republican consulting firm Campaign Solutions, Inc. That firm has worked against health care reform and for various Republicans, including Cuccinelli. But in fairness to Hudson, he rejected the plaintiff’s call to strike down the entire health insurance reform law, or to issue an injunction against implementing that law. In any event, legal challenges to the mandate are bound to work their way up to the U.S. Supreme Court one way or another. (The Justice Department will appeal Hudson’s ruling.)

Senator Chuck Grassley’s office released this statement:

As Ranking Member of the Senate Committee on Finance, in 2008 and 2009, Senator Grassley participated in the bipartisan effort for health care reform that could secure support across the political spectrum.  In September 2009, that effort was thwarted by Democratic leaders in Washington.  From 2007 through 2009, there was a rigorous debate over the individual mandate.  President Obama staunchly opposed it as a candidate for President.  The concerns he raised then became more clear as the reform debate unfolded, including enforcement.  Health insurance companies lobbied for the mandate, which drives billions of tax dollars in new subsidies directly to them.

Senator Grassley’s comment:

“The nonpartisan Congressional Research Service called requiring people to buy a good or service or be penalized a ‘novel issue,’ and now a federal court has ruled it unconstitutional.  The ruling is likely to be appealed, but it’s a clear signal that the constitutionality of the law, which was moved through Congress with a lot of controversy and partisanship, isn’t as certain as its supporters have argued.”

Hmmm, something seems to be missing from that statement. Oh, now I remember: Grassley supported an individual health insurance mandate in 1993 and 2007, and said in June 2009 that “there is a bipartisan consensus [in Congress] to have individual mandates.”

Senator Tom Harkin, a key author of the health insurance reform law, didn’t think much of the judge’s reasoning:

“On the merits, the Virginia Attorney General’s suit is clearly wrong.  When people seek medical care without health insurance and don’t pay for it, they aren’t ‘opting out’ of the health care market.  Instead, it adds more than $1,000 per year to the premiums of American families who act responsibly by having coverage.  This clearly affects interstate commerce and is thus within Congress’ power to regulate.  

“Two federal courts in Michigan and Virginia have already dismissed similar cases, and the Virginia court should have followed their lead.  I’m confident that the appellate courts and the Supreme Court will find the Affordable Care Act constitutional and in doing so, ensure that Americans keep crucial new protections against the unfair practices of insurance companies.”

I will update this post as other Iowa politicians comment on Hudson’s ruling.

UPDATE: From Representative Steve King, a leading Republican advocate of repealing the health insurance reform:

“With Judge Hanson’s decision, a federal court has now ruled in accordance with what I have always said – Obamacare’s requirement that Americans purchase health insurance or pay a fine is unconstitutional. Obamacare’s ‘individual mandate’ always restd on the absurd premise that the Commerce Clause empowered the federal government to regulate Americans’ decisions not to engage in commercial activity… With the ‘individual mandate’ that lies at the heart of the legislation ruled unconstitutional, the badly-flawed Obamacare law is now completely dysfunctional, further accelerating the need for Congress to repeal it.”

Governor-elect Terry Branstad hasn’t commented on this lawsuit, but he announced today that Brenna Findley will be his legal counsel. Findley was King’s chief of staff for seven years before running unsuccessfully for Iowa attorney general. She made challenging health insurance reform (specifically the individual mandate) a major issue in her campaign. Branstad promoted her candidacy at virtually every campaign stop and appeared in one of Findley’s television commercials.

Strawn to run Iowa GOP through 2012 elections

Matt Strawn announced yesterday that he will seek another two-year term as chairman of the Republican Party of Iowa. The party’s State Central Committee will formally elect a chair in January, but no serious opposition to Strawn will emerge. He has the support of Governor-elect Terry Branstad, incoming Iowa House Speaker Kraig Paulsen, and Senator Chuck Grassley.

Strawn earned another term by guiding Iowa Republicans to major gains in the state. The political climate was generally favorable to the GOP, of course, especially in the Midwest, and the huge campaign war chests of Branstad and Senator Chuck Grassley gave Republicans a financial advantage. Still, Strawn helped lay the groundwork. Iowa Republicans had never focused on GOTV outside of their famed 72-hour operation just before election day. This year early voting among Republicans in the state was up 83 percent compared to 2006. According to Strawn, that success made it possible for the Republicans’ election-day GOTV to focus on state legislative races. Republicans exceeded expectations by winning six Democratic-held state Senate seats and racking up a net gain of 16 in the Iowa House.

Another reason for Republicans to stick with Strawn is that he can be a neutral figure in the run-up to the Iowa caucuses. To my knowledge, Strawn didn’t publicly support any of the 2008 presidential candidates who might run again next year. He and his wife Erin have donated to various Republican candidates, including members of Congress outside Iowa during the last few cycles, but I couldn’t find any record of contributions from them to presidential candidates. CLARIFICATION: Strawn was previously Iowa caucus director for John McCain, but he wasn’t associated with any Republicans who might challenge Barack Obama in the upcoming election cycle.

The state GOP can’t afford to have many candidates copy McCain’s strategy of mostly skipping Iowa, because the “straw poll” event set for August before each presidential caucus year is a major fundraiser for the party.

Speaking of which, I was intrigued to see Bob Vander Plaats say this recently:

Advisers differ on how late [Mike Huckabee] could jump in, but Vander Plaats said he’d advise Huckabee to wait until extremely late – after the August Iowa GOP straw poll – to survey the lay of the land and make up his mind.

“He could come in as an energized, fire in the belly, Fred Thompson,” he said, referring to the former Tennessee senator’s much-anticipated run in 2008 – a late entry that fizzled when Thompson seemed to have little stomach for the rigors of the trail.

Strange advice, since the 2007 Iowa GOP straw poll was Huckabee’s breakout event, thanks in large part to a helping hand from Americans for Fair Taxation. I’m struggling to think of any example of a presidential candidate doing well in the Iowa caucuses thanks to a late start on organizing. It sounds like Vander Plaats is trying to undermine the state party’s premiere fundraising event. Perhaps he thinks downgrading the straw poll will help elevate the significance of whatever his new organization (The Family Leader) has planned. Or, maybe he believes state party leaders were involved in helping recruit Terry Branstad back into politics at a time when Vander Plaats seemed to have the GOP gubernatorial nomination locked up. I’ve always wondered how much Strawn encouraged the business leaders who lobbied Branstad to run for governor in the summer of 2009.

Miller-Meeks to Public Health and other Branstad appointment news

Governor-elect Terry Branstad announced today that ophthalmologist Dr. Mariannette Miller-Meeks will run the Iowa Department of Public Health in his administration. A press release noted that Miller-Meeks “has served as the first woman President of the Iowa Medical Society and was the first [woman] on the faculty in the Department of Ophthalmology at the University of Iowa and councilor for Iowa to the American Academy of Ophthalmology.” Miller-Meeks was the Republican nominee in Iowa’s second Congressional district in 2008 and 2010. She worked hard during both campaigns but lost to Dave Loebsack in Iowa’s most Democratic-leaning Congressional district.

Also on December 9, Branstad announced that he will tap Chuck Palmer to head the Department of Human Services in his administration. Palmer did that job during Branstad’s previous time as governor from 1989 to 1999. Most recently he has been president of Iowans for Social and Economic Development, “an asset development organization with the mission of creating opportunities for low and moderate income Iowans to increase income and achieve financial stability.”

Branstad has pledged to reduce the size of state government by 15 percent, and keeping that promise would likely require significant cuts in the departments Miller-Meeks and Palmer will be running. The current budget (fiscal year 2011) allocated $935.5 million from the general fund to health and human services. That’s 17.7 percent of the general fund budget alone, or 15.9 percent of total state expenditures, including federal stimulus money and reserve funds as well as general fund spending. More than $200 million in federal stimulus money supported Iowa’s Medicaid budget in the current budget year, but similar support won’t be forthcoming in future years now that Republicans have a majority in the U.S. House of Representatives.

Republicans set to axe Power Fund, Values Fund

Incoming Iowa House Speaker Kraig Paulsen discussed plans for shrinking state government in a December 8 speech. Rod Boshart has the story:

“You should us expect us to make some tough choices,” Paulsen told a Des Moines Partnership lunch crowd. “I think you’re going to see us just wholesale eliminate a couple difference programs and a couple different offices and we’re going to start with those that have marginal or no benefit.

The incoming House leader said voters sent a clear signal that government at all levels is growing too big too fast, regulating too much, and spending and taxing too much – issues the reconfigured House plans to address next session.[…]

The Power Fund has been administered by the Iowa Office of Energy Independence in conjunction with the Iowa Power Fund Board, two entities that were created when the program was enacted in the 2007 legislative session.

Paulsen also said he would prefer to replace the Grow Iowa Values Fund, started by former Gov. Tom Vilsack, with “things that would grow the economy” under the new public-private partnership envisioned by Governor-elect Terry Branstad [….]

Paulsen’s premise is incorrect. Iowa’s state government has not been growing during the past decade; on the contrary, general fund spending has fallen as a share of the economy and of personal income. But that’s a subject for another day.

House Republicans have advocated cutting the Power Fund for some time, and doing so would theoretically save $25 million per budget year. According to Boshart, the Values Fund received $45 million in fiscal year 2010 and $38 million for fiscal year 2011. I don’t believe the real savings will be nearly so large, because too many business interests have benefited from Values Fund and Power Fund grants. Lobbyists will work to ensure that significant funding for business support remains under a different department or program.

In addition, the Iowa Senate, which is under Democratic control, may insist that the state continue to invest significant resources in renewable energy. Senate Majority Leader Mike Gronstal said last month,

If [R]epublicans have another approach that will help keep us at the forefront of renewable energy in this state and clean energy and green energy we’re completely open to looking at that. It doesn’t have to be called a power fund, it doesn’t have to be called I-jobs.

I will say this: cutting the Power Fund is more realistic than some other big savings proposed by House Republicans in the past. I expect Paulsen will be disappointed by the Legislative Services Agency’s analysis of how much can truly be saved by privatizing the state vehicle fleet or denying benefits to undocumented immigrants. The Iowa Senate will block efforts to eliminate the preschool program, although some money may be saved by means-testing that program, as Governor-elect Terry Branstad has advocated. Last year’s government reorganization already improved efficiencies in state purchasing.

One old Republican idea I haven’t heard Paulsen mention lately is implementing “the Principal Plan” to impose salary cuts on non-union state employees. House Republicans have called for requiring the governor to negotiate pay reductions on a sliding scale, from 2 percent for employees earning less than $40,000 per year up to a 10 percent salary reduction for those earning more than $100,000. A new job for Rod Roberts and other Branstad appointment news

Governor-elect Terry Branstad announced today that former State Representative Rod Roberts will head the Iowa Department of Inspections and Appeals in the next administration. Roberts gave up his seat after six five terms in the Iowa House to run for governor. He won about 9 percent of the vote in the Republican primary. I believe his candidacy helped Branstad by attracting social conservatives who might otherwise have consolidated behind Bob Vander Plaats.

Branstad and other Republicans have criticized Dean Lerner, the head of the inspections and appeals department in Chet Culver’s administration. They claim state inspectors have been too tough on businesses, particularly nursing home owners. The nursing home industry already gets most of what it wants from state legislators, and will cheer Roberts’ appointment. I am skeptical that Branstad plans to improve on his dismal record of nursing home regulation.

UPDATE: Clark Kauffman reported in the Des Moines Register on December 9,

Roberts, 53, told The Des Moines Register Wednesday that he didn’t apply for the job. Instead, he said Branstad contacted him shortly after the election and offered him the job. […]

Roberts said his 10 years of experience as a lawmaker will help him lead the agency, although he acknowledged he faces a steep learning curve because he has no staff management or regulatory experience.

Roberts also said he would not have any conflicts of interests – despite ties that he and his wife have to facilities that are inspected and regulated by the employees he will supervise.

Roberts has served on the boards that govern the New Hope Village care center in Carroll and its charitable foundation.

His wife, Patricia Roberts, is director of development for the foundation that provides financial support for St. Anthony Regional Hospital and Nursing Home in Carroll.

Kathie Obradovich argues that Roberts should “pledge to have no part in any regulation of operations where he has personal ties and relationships. Staff members should handle it.”

Also on December 8, Branstad named Teresa Wahlert as his choice to head Iowa Workforce Development. She is a past president of the Greater Des Moines Partnership and a member Iowa Business Hall of Fame who informally advised Branstad’s gubernatorial campaign.

Finally, Branstad announced that Courtney Kay-Decker will head the Iowa Department of Revenue. Kay-Decker is a Davenport attorney who was a member of the Iowa State Tax Review Board from 2000 to 2007.

Meanwhile, outgoing Governor Culver was in Washington recently. Culver told the trade publication North American Windpower that he met with members of Congress to advocate for legislation to promote renewable energy. Presumably some job-hunting was going on as well.

For the near term, Culver will focus on completing the five weeks he has remaining as Iowa governor. After that, he will begin weighing his options. He wants to stay involved with either a wind energy company or a public interest group, adding that he would rather focus his energy on the task at hand rather than dwelling on the November defeat.

Culver chaired the Governors’ Wind Energy Coalition and lobbied Congress for a strong renewable electricity standard while the federal climate change bill was being debated. I don’t expect any progress on promoting renewable energy at the federal level, especially now that Republicans will control the House of Representatives. The tenative tax cut deal President Barack Obama struck with Republican leaders includes extending biofuels subsidies but not tax credits for wind or solar power.

Latest Branstad administration news and appointments

Governor-elect Terry Branstad announced three appointments on December 7. He will retain Brigadier General Tim Orr as Adjutant General of the Iowa National Guard, a post Orr has held since March 2009. Story County Treasurer Dave Jamison, who unsuccessfully ran for state treasurer, will head the Iowa Finance Authority in the Branstad administration. Retired Iowa Army National Guard Brigadier General Jodi Tymeson will lead the state Department of Veterans Affairs. Tymeson retired from the Iowa House this year, having represented district 73 for five terms.

Press releases containing background information on all three appointees are after the jump. None of them should have trouble being confirmed by the Iowa Senate. I noticed the Branstad administration’s bio of Tymeson didn’t mention her most recent role as co-chair of Bob Vander Plaats’ gubernatorial campaign.

Branstad has asked all state department heads to send him their resignations by December 15. He will replace most, if not all, of Governor Chet Culver’s appointees.

Branstad named three new staffers today. His liaison to the Iowa House and Senate will be Todd Schulz, who has handled government relations for Newton-based Iowa Telecom. The governor’s executive scheduler will be Alicia Freed, a former staffer for Senator Chuck Grassley who most recently worked as project manager for RuffaloCODY LLC in Cedar Rapids. Jimmy Centers, who was northeast Iowa field coordinator for Branstad’s gubernatorial campaign, will be deputy communications director. I wouldn’t be surprised if Centers got a promotion before too long, because Branstad’s communications director Tim Albrecht may go work for one of the Republican presidential campaigns in 2011.

Meanwhile, Branstad spoke about his property tax plans while addressing the Iowa Taxpayers Association’s annual meeting in West Des Moines today.

In proposing to cut commercial property tax rates by 35 percent to 40 percent for new businesses and phase down rates for existing businesses in a like manner over four or five years, Branstad said part of the lost revenues for local entities could be offset by increased business activity that would generate new property tax receipts. He also suggested that cities and counties should be less aggressive in offering tax increment financing and abatements that create disparities among new and existing businesses.

The price tag for lowering the commercial property tax burden would depend on the growth the proposed relief could generate, he said. Branstad said his plan would be to provide state funding to hold local governments “harmless” but not give them a windfall in the process – similar to when the state phased out the property tax on machinery and equipment in the 1990s when he previously served as governor.

“We want to make this adjustment in a fair way,” Branstad said, conceding that the cost could be as much as $500 million over four years.

The Iowa Taxpayers Association supports Branstad’s property tax plans, but Republican legislative leaders have warned getting the proposal through the legislature will be difficult. Yesterday Democratic Senate Majority Leader Mike Gronstal described the phase-out of the property tax on machinery and equipment as “pretty close to the biggest unfunded mandate in the history of the state.” The executive directors of the National League of Cities and the Iowa League of Cities both expressed concern about Branstad’s proposal:

No other state in the nation is considering similar cuts to commercial property taxes, said Donald Borut, executive director of the National League of Cities, a national advocate for municipalities. Resulting cuts to key city services such as police protection and road improvements ultimately could push businesses away, he said.

“The objective” to lower commercial property tax “is a laudable one, but the cost to municipalities could be draconian,” Borut said. “If there is some way to guarantee in blood that the municipalities would be held harmless, it’s one thing, but I don’t know how one can do that. Even with the best intentions, the pressures would be enormous.”

UPDATE: James Q. Lynch has more on local government officials worrying about Branstad’s property tax proposals. In that piece, Cedar Rapids Mayor Ron Corbett raises some good points:

Cedar Rapids is more dependent on property taxes than many communities, Corbett said. It has no gaming revenue and it local option sales tax is dedicated to flood recovery.

On a personal level, he’d like to see property tax relief targeted to benefit local businesses.

“Is there some different classification within commercial property tax base so you’re not giving Wal-mart a tax break at the same level as small business” he said.

Iowa’s three-member Revenue Estimating Conference again raised projections for state revenues during the current fiscal year and fiscal year 2012, following another month of growing state tax collections in November. The news hasn’t deterred Republican leaders from planning mid-year budget cuts, and legislators from both parties acknowledged the end of federal stimulus funds will make the next budget year difficult. Branstad puts Debi Durham in charge of job creation

Governor-elect Terry Branstad today put Debi Durham in charge of job creation for his administration. She will start as head of the Iowa Department of Economic Development, which Branstad plans to convert into a public-private partnership. Durham’s work will be crucial for some of Branstad’s central campaign promises: creating 200,000 new jobs, increasing family incomes by 25 percent, and reviewing all state economic development programs to discard ones that don’t work. Branstad has said he will travel widely to sell Iowa to the business community, and Durham will be a partner in those marketing efforts.

Durham has worked for the Siouxland Chamber of Commerce for 17 years, and “chairs the board of the Iowa Chamber Alliance, a coalition representing the chambers of commerce in the state’s 17 largest metro areas.” She told reporters that leaving Sioux City was a hard choice. Outside economic development circles, she is best known as the Republican nominee for lieutenant governor in 2002, the year Doug Gross lost to Governor Tom Vilsack. Bret Hayworth wrote a good profile of her during the 2002 campaign. Incidentally, Gross also intended to remake IDED into a public-private partnership. Yet again, Branstad is following his former chief of staff’s playbook. David Roederer, who also headed Branstad’s staff in the past and will run the Department of Management in the new administration, has worked closely with Durham too. He was executive director of the Iowa Chamber Alliance during her time as board chair.

During this year’s campaign, Governor Chet Culver said IDED already has plenty of business input and has helped keep Iowa’s unemployment far below the national average. He also cited news reports showing that the Indiana Economic Development Corporation, which Branstad embraced as a model, touted “bogus” job creation claims and concealed information about tax credits some companies received. Iowa legislators should ensure that the revamped IDED doesn’t have similar transparency problems. Branstad can’t restructure economic development programs by government directive; he needs a new state law for that.

Culver appointed Durham to the Iowa Department of Transportation Commission and “spoke highly” of her during the September gubernatorial debate in Sioux City. Assuming the Iowa Senate confirms Durham (which should be no problem), she may need to give up her position on the transportation commission. If so, expect Branstad to appoint someone friendly to road-builders’ interests.

In related news, Branstad is raising money from private donors to help pay for the transition from Chet Culver’s administration to his own. Current Iowa law set aside only $10,000, clearly not enough to cover those costs. I look forward to seeing the list of donors. People looking to preserve certain business tax breaks or economic development incentives may be eager to help the new administration.

“Obviously when you hear private/public partnership that is the biggest question is the transparency,” Durham said. “What I can assure you and I’m going to take my lead from Gov. Branstad. Everything about Gov. Branstad and this administration is transparent  So anything that will have anything to do with any public funds or public funding will certainly meet that threshold of transparency.

One of Branstad’s key campaign promises is to create 200,000 jobs throughout the next five years. Durham acknowledged after today’s press conference that the goal is a tall order.

“I think it is a stretch goal but like I said will go to work every single day knowing that is the goal before us,” Durham said.

Weekend open thread: Huckabee in Iowa edition

What’s on your mind this weekend, Bleeding Heartland readers?

Past and perhaps future presidential candidate Mike Huckabee is in Des Moines tonight Sunday, headlining the Iowa Family Policy Center’s annual fundraiser. Other speakers include WHO talk radio personality Steve Deace and Iowa Family Policy Center Action president Chuck Hurley.

The big event is also Bob Vander Plaats’ debut as “president and chief executive officer of an umbrella group that includes the Iowa Family Policy Center, Marriage Matters and their political action committee.” The Iowa Family Policy Center endorsed Vander Plaats for governor. Huckabee came to Iowa to campaign for Vander Plaats, who chaired his successful Iowa caucus campaign in 2008.

Vander Plaats told journalists this week that his umbrella group will mobilize social conservatives and endorse a candidate for the upcoming Iowa caucus campaign. If Huckabee stays out of the presidential race, several campaigns will work hard to win the approval of Vander Plaats, Hurley and Deace. If Huckabee runs again, other candidates may as well not waste their time.

I got a robocall from Huckabee Thursday or Friday of this week, but I don’t know whether it was a fundraising call or an attempt to identify supporters. The call ended quickly after I answered “no” to the question, “Do you consider yourself pro-life?”

I’m headed to a friend’s birthday party tonight as soon as my version of Jewish noodle kugel comes out of the oven for the potluck. Quite a few Branstad voters will be in attendance (including the birthday girl), and I’m determined not to get into any arguments.

My Twitter feed is full of Republicans freaking out about Governor Chet Culver’s deal with AFSCME. A 2 percent raise for state employees, followed by a 1 percent raise, is far from excessive. Republican complaints about Culver’s lack of “courtesy” amuse me. It wasn’t too polite of Terry Branstad to spend millions of dollars on tv ads lying about I-JOBS and how Culver managed the state’s finances.

UPDATE: To clarify, the proposed contract with AFSCME involves a 2 percent across the board salary increase starting July 1, 2011, a 1 percent across the board salary increase starting January 1, 2012, another 2 percent across the board salary increase beginning July 1, 2012, and a 1 percent across the board salary increase starting January 1, 2013.

Paulsen threatens layoffs as Culver strikes deal with AFSCME

Governor Chet Culver accepted a tentative deal today on a new two-year contract with with largest union representing state employees. The contract would increase the pay of all state workers covered by AFSCME by 2 percent in fiscal year 2012 (from July 2011 through June 2012), with another 1 percent wage increase in fiscal year 2013. Some employees would qualify for other pay increases as well.

Iowa Republicans immediately denounced the deal.

Iowans, keep a closer watch on loved ones in nursing homes

For years, Iowa legislators have been eager to do whatever the nursing home industry asks of them. The Iowa Health Care Association’s lobbying efforts on behalf of nursing home owners have yielded impressive results. In 2009, the Iowa House and Senate unanimously passed a bill eliminating fines for dozens of violations at elder care facilities. Lawmakers from both parties have lobbied for the industry’s wish list in Washington. They have whined about inspectors “gotcha mentality” and in some cases interfered with the work of nursing home inspectors.

The Iowa Health Care Association’s influence will increase in the next administration. Governor-elect Terry Branstad told Iowa Public Television in October that he will appoint new leadership for the Department of Inspections and Appeals, with a view to more “collaborative and cooperative” work with nursing homes. That’s not good news for residents whose lives literally depend on how standards of care are enforced.

Gronstal re-elected leader and other Iowa Senate news

The Iowa Senate Democratic caucus on November 14 re-elected Mike Gronstal as majority leader and Jack Kibbie as Senate president. Five senators will serve as assistant majority leaders: Joe Bolkcom of Iowa City, Bill Dotzler of Waterloo, Wally Horn of Cedar Rapids, Amanda Ragan of Mason City, and Steve Sodders of State Center. Linn County Supervisor Brent Oleson got Iowa Republicans excited on Saturday by tweeting that Horn would challenge Gronstal, but according to this Des Moines Register report by Jennifer Jacobs, “No one mounted a challenge for either leadership role, several senators said.”

Branstad transition update

Governor-elect Terry Branstad announced yesterday that David Roederer will serve as his budget director, in charge of the state’s Department of Management. Roederer has been part of Branstad’s “inner circle” for decades. The Des Moines Register’s Thomas Beaumont wrote in September,

Roederer, a lobbyist from Johnston, is a multi-faceted troubleshooter, a role he carved out serving in several key posts for Branstad, including chief of staff and campaign manager, during a difficult stretch of the administration.

A serious problem-solver with the ability to bring people together, Roederer is often at work behind the scenes on key campaign issues and has worked on presidential and congressional campaigns since Branstad left office.

Roederer was a key sounding board for Branstad in June as the Republican nominee evaluated a list of prospects for his lieutenant governor running mate.

Jeff Boeyink will be Branstad’s chief of staff in the new administration. Boeyink spent many years working for Iowans for Tax Relief. He served as the Republican Party of Iowa’s executive director for a few months in 2009, but left that position to manage Branstad’s gubernatorial campaign.

Tim Albrecht, who handled communications for the Branstad campaign, will be communications director for the new administration. Since September, Albrecht has been running the right-wing news aggregator The Bean Walker in addition to dealing with the media on behalf of Branstad. No word on how long he plans to combine those jobs.

I’ve been waiting to see what position Branstad would give to Jim “Burn the Boats” Gibbons. He lost to Brad Zaun in the third Congressional district primary but had major donors and supporters who are also close to the incoming governor. Yesterday Matt Schultz announced that Gibbons will chair his secretary of state transition team, “advising on issues and personnel decisions related to the business services division of the office.” Maybe Schultz will give Gibbons a senior staff position. Incidentally, Story County Auditor Mary Mosiman will advice Schultz “on issues and personnel decisions related to the elections division.”

UPDATE: Todd Dorman cracks a few jokes about Branstad taking his wife Chris on a “much-deserved” 10-day vacation in France. I don’t begrudge them their trip, but can you imagine what conservatives would say if a newly-elected Democrat took off for Europe?

Unopposed in 2008, defeated in 2010

Reading up on the carnage that was last week’s Congressional elections, I noticed that two House Democrats lost their seats despite having run unopposed in 2008. The unlikely losers were Rick Boucher in Virginia’s ninth district and Phil Hare in Illinois’ seventeenth district, including the Quad Cities area (though polls had shown Hare in trouble this fall).

I wondered whether any Iowa Democrats suffered the same fate. It turns out that three of the 13 Iowa House incumbents defeated last week did not have a Republican opponent in 2008. In each case, special circumstances may have exacerbated the generally bad environment for Democratic candidates this year.

Branstad not sold on new passenger rail for Iowa

Governor-elect Terry Branstad expressed concern today about the cost of new passenger rail links between Chicago and cities in Iowa.

“Well, I want to analyze the situation,” Branstad said. “I’m very concerned about the federal debt.” Public transportation advocates say if states like Ohio and Wisconsin reject high speed rail, it could stymie projects all across the Midwest. Branstad says he doesn’t want to rush to judgment.

“I want to carefully review and analyze the circumstances and I understand there are concerns about the huge cost of this and how cost effective it is and how much it would really be utilized,” Branstad said.

In late October, the U.S. Department of Transportation announced $230 million in funding for a new Amtrak route connecting Iowa City to Chicago via the Quad Cities. Senator Chuck Grassley has spoken approvingly about the project. A spokesman for the Federal Railroad Administration told me last week, “The money has been awarded.” One question mark is whether the route could be completed if the Iowa legislature declines to fund our state’s share of the costs in future years:

The project will cost $310 million, and Iowa and Illinois will pay pro-rated shares of costs not covered by the federal government. Iowa lawmakers have already appropriated $10 million and need to come up with another $10 million, said Tamara Nicholson, director of the Iowa DOT’s rail office. The state would also pay an estimated $3 million annually in operating subsidies. […]

Train supporters hope the route will someday be extended to Des Moines and Omaha. Des Moines Mayor Frank Cownie has endorsed the idea and Tom Kane, executive director of the Des Moines Area Metropolitan Planning organization, says passenger trains are important to the future of Des Moines and the national transportation system.

“We know that much of the air traffic out of Chicago is for trips of less than 500 miles, so why are we flying? There will also be future congestion on the interstate highway system, particularly from freight and trucks. This will give our transportation consumers a choice,” Kane said.

Kane’s point is valid, but Republican lawmakers would probably rather widen interstate highways, even if that proved more costly than adding rail capacity.

The best hope of bringing Branstad around is a lobbying effort by business interests. Quite a few corporations and business groups support the Quad Cities Passenger Rail Coalition. The Greater Des Moines Partnership and central Iowa Young Professionals Connection back extending passenger rail across Iowa. This year’s chairman of the Greater Des Moines Partnership is Doug Reichardt, who is close to Branstad and was rumored to be on his short list for running mates last year. One of the partnership’s past presidents, Teresa Wahlert, “played a lead role in Branstad’s economic development agenda” during this year’s campaign.

Branstad's plans for I-JOBS money easier said than done

Governor-elect Terry Branstad would prefer not to spend I-JOBS money that has not already been allocated, but he may not be able to prevent spending those funds on infrastructure. On Thursday, Branstad taped this weekend’s episode of Iowa Public Television’s “Iowa Press”, and Kay Henderson asked him what he planned to do with I-JOBS money that had not already been handed out. Branstad responded,

“First of all, I think most of it has already been spent,” Branstad says. “But that that hasn’t been spent, my general inclination is to say it shouldn’t be spent.” […]

Branstad, who takes office on January 14, says he has no intention of trying to reclaim any state grants that have already been awarded, but he’s going to “analyze” his options for whatever remains in the I-JOBS account.  

“I want to evaluate each and every project based on its merits,” Branstad says. “I don’t think we should just be willy-nilly trying to spend money. Instead, I want to look at protecting the taxpayers’ interest in the process, but if there’s a project that’s been obligated, then we have the responsibility to fulfill it.”

Iowa has already sold all $875 million of I-JOBS bonds. More than $665 million of the bond proceeds have been awarded to specific projects. The incoming governor’s options for dealing with the remaining $200 million are limited:

Deputy Iowa Treasurer Stefanie Devin said it was unlikely that Branstad could stop any of the projects because of rules for how the money is spent.

“They are tax-exempt bonds,” Devin said. “They have to be spent on capital projects. It’s not like you can sit on that money for 20 years.”

I doubt Branstad will be able to find a way around spending this money. Once all the grants have been awarded, he may even quietly acknowledge the benefits of infrastructure projects around the state. I wouldn’t be surprised to see him smiling for the cameras next year at grand openings for projects I-JOBS made possible. Who knows–maybe someday New Jersey Governor Chris Christie (who’s borrowed more in one year than Chet Culver did in four) will persuade Branstad that selling bonds to invest in infrastructure can be “fiscally responsible.”

Is failure on gay marriage more valuable to Republicans than success?

Senate Democratic Leader Mike Gronstal promised this week to block an Iowa Senate vote on a constitutional amendment to ban same-sex marriage, even if a majority of senators sign a petition asking for a vote. The Republican reaction to Gronstal’s comments makes me wonder whether gay marriage will be in the coming decade what the death penalty was to Iowa Republicans in the 1980s and 1990.

Reinstating the death penalty was a major theme in all of Terry Branstad’s previous election campaigns. But as governor he didn’t deploy his political capital to push that bill through the state legislature, even when Republicans controlled both chambers during his last two years in office. Many Iowa Democrats believed Branstad valued having the issue to run on more than he cared about the policy.

In light of Tuesday’s election results, Republicans sound surprisingly resigned to failure on passing a marriage amendment in the new legislature.

Battle brewing over Iowa Supreme Court nominations

Judicial nominating commissions will soon begin evaluating possible replacements for Iowa Supreme Court Justices Marsha Ternus, Michael Streit and David Baker. The law gives the commissions 60 days to submit a short list of candidates for judgeships to the governor, which means soon to be former Governor Chet Culver could nominate justices before Governor-elect Terry Branstad is sworn in. Branstad said yesterday that he should appoint the new members of the high court:

“I think it would be inappropriate to have a governor that was just rejected by the voters try to rush through appointments to a court when the court was just rejected as well. I think we need to really sit down and think this thing through in a really careful way,” Branstad says. “But really my focus is on jobs. That’s why the people of Iowa elected me as governor and that’s where I’m going to put my focus in the days ahead.”

Culver has not promised to let Branstad appoint the new justices. A November 3 statement from the governor’s office said only this:

“I am reviewing the matter carefully to ensure the judicial selection process that is utilized now is consistent with the Iowa Constitution, with Iowa law, and with past practices used in the course of both Democratic and Republican administrations in instances when multiple vacancies in our appellate courts have been created simultaneously.”

Meanwhile, Republican Party of Iowa Chairman Matt Strawn says it would be “unconscionable” for Culver “to thumb your finger in the eyes of the voters who just repudiated those Supreme Court Justices and, quite frankly, repudiated you and the one party, Democrat rule in Des Moines.” Strawn also called for “a further discussion too on how we change the way judges are nominated and selected in this state as well, because I think that too is part of the problem.” Getting rid of Iowa’s judicial nominating commissions would require a constitutional amendment, but a new law could make minor changes. For instance, Branstad has endorsed efforts to require partisan balance on the judicial nominating commissions.

The Supreme Court has already heard some oral arguments in this year’s caseload. It’s not clear whether the four remaining justices will issue rulings on those cases or rehear the oral arguments once replacements for Ternus, Streit and Baker have been selected.

The November 4 edition of the Des Moines Register published a map showing the judicial retention vote by Iowa county. There was a strong urban/rural split in the voting. In seven counties, more than 70 percent of votes cast on retention said no to all three judges. In 48 counties, the no votes on retention totaled between 60 and 70 percent. In 34 counties, the no votes totaled between 50 and 60 percent. In Clinton County, Streit and Ternus received a majority of votes for retention, but the yes votes for Baker fell below 50 percent. All three judges received a majority of yes votes in the remaining nine counties: Winneshiek (Decorah area), Black Hawk (Waterloo/Cedar Falls), Story (Ames), Polk (Des Moines), Linn (Cedar Rapids), Johnson (Iowa City), Muscatine, Scott (Quad Cities), and Jefferson (Fairfield area). New strategy needed to put money in conservation fund

Advocates celebrated passage of a constitutional amendment creating a Natural Resources and Outdoor Recreation Trust Fund for Iowa, but there’s no guarantee new money will ever be allocated to protecting soil and water. Governor-elect Terry Branstad and incoming Iowa House Speaker Kraig Paulsen said yesterday a sales tax increase is off the table:

“This election was to a large extent driven by growth in government,’ said Paulsen, a Republican from Hiawatha. “Too much spending. Too much debt. The public did not elect Republicans so we could come down and raise taxes.”

“I don’t see House Republicans passing a sales tax increase for the forseeable future,” Paulsen said. “I don’t even think that will be under consideration.”

Said Branstad, of Boone: “I don’t support any tax increases. I made that clear during the election,” Branstad said. ” If it’s contingent on a sales tax increase, we’ve said there won’t be a sales tax increase. I’m supportive of conservation funding, but not raising taxes.”

Sean McMahon of Iowa’s Water & Land Legacy, the coalition that pushed for the new fund, on Tuesday said his organization is considering its next move. It may leave it up to individual Iowans and various environmental and recreation groups to push for the tax.  The group spent several years pushing the issue to a vote, and some of the preparation went back a decade.

Asking environmental groups and the “hook and bullet” crowd (Izaak Walton League, Pheasants Forever, Ducks Unlimited) to push for a sales tax increase would be a disastrous waste of time. The votes won’t be there in the legislature, and Branstad won’t want to break his promise on tax hikes as quickly as he did in 1983. Anyway, people like me didn’t get involved with the environmental movement to advocate for regressive taxes.

Groups that worked to pass this amendment should focus on lobbying for direct appropriations to the new fund. Voters approved the amendment by a wide margin. Making waterways safer for recreation and improving habitat for wildlife can be viewed as economic development tools for small towns and rural areas. Finding private donors who agree to match all or part of the state’s contribution to the fund might persuade legislators to get the conservation efforts going on a small scale. Successes would build a constituency for increasing the funding in future years.

That strategy may not work, but it’s better than pinning all hopes on a sales tax hike that won’t happen. Bleeding Heartland readers, please share your thoughts or suggestions for getting money allocated to the natural resources fund.

Iowa and national election discussion thread

Time for a new thread on the statewide election results. I haven’t dug into the county-level returns in the governor’s race yet, but Chet Culver didn’t even carry Polk County, which he won with a 21,000 vote margin in 2006. Culver did carry Johnson County, but by a much smaller margin than in 2006. What happened in your area, Bleeding Heartland readers?

UPDATE: Culver carried only eight counties: Black Hawk (Waterloo/Cedar Falls area), Linn (Cedar Rapids), Johnson (Iowa City), Dubuque, Des Moines (Burlington area), Lee (Ft. Madison/Keokuk), Story (Ames), and Jefferson (Fairfield). Culver almost carried Floyd County, where Republicans easily won House district 14. I guess Charles City loves I-JOBS! LATE UPDATE: The unofficial results indicate that Culver did carry Floyd County (barely), by fewer than 100 votes.

Branstad carried Wapello County (Ottumwa) for the first time. In his 1994 landslide victory, Bonnie Campbell carried only four counties: Story, Johnson, Des Moines and Wapello.

The down-ticket Democrats had a lot of ground to make up with Chuck Grassley winning the U.S. Senate race 64 percent to 33 percent and Terry Branstad winning 53 percent to 43 percent. Secretary of State Michael Mauro outperformed Culver, which he wasn’t able to do in 2006, but still fell short against Matt Schultz. It’s a shame to see such a competent public official lose in a wave election. Iowa will continue to benefit from his work to make voting more accessible and secure, with paper ballots. I expect the new legislature to act on Schultz’s top priority, photo ID requirements, and I wonder if they will also revoke same-day voter registration.

Iowa Republicans didn’t miss many targets, but I think they overlooked an opportunity by not investing in the state treasurer’s race. Michael Fitzgerald won his eighth term by an unusually narrow (for him) margin: just under 53 percent to 47 percent. A few hundred thousand dollars thrown toward Dave Jamison’s campaign could have won that race. Jamison didn’t have the resources to improve his name identification or make his case against Fitzgerald. Last year some conservative blogger, it may have been Krusty, said Christian Fong should have challenged Fitzgerald instead of running for governor as a 32-year-old. With his background in finance, his connections to major Republican fundraisers, and his roots in both eastern and western Iowa, Fong might have outperformed Jamison.

Tom Miller winning more than 55 percent of the vote was such a relief. The Republicans threw everything they had at him, and he ran a non-existent campaign until the final month, but he still defeated Brenna Findley convincingly. Miller even carried Woodbury County, where Republicans romped. Now he can get back to work on state attorneys’ coordinated investigation of foreclosure practices:

Mr. Miller’s status as a point man in the multistate investigation has been seen by many observers as a sign that the states will push for a sweeping settlement requiring lenders to implement mortgage modifications allowing homeowners to stay in their houses.

Mr. Miller, who has monitored mortgage-industry practices for years, had already begun discussions with some lenders, including Bank of America. In one meeting last week at Mr. Miller’s office, he and officials from other states told Bank of America executives and outside lawyers that state attorneys general would like additional aid to be offered to borrowers, such as further principal reductions on certain delinquent loans where people owe much more than what their homes are worth, according to people familiar with the meeting.

Doubt Findley would have been interested in seeking concessions from corporations to people underwater on their mortgages.

Environmentalists lost a few supporters in the Iowa Senate last night, but today many advocates are cheering the passage of the Iowa Water and Land Legacy trust fund amendment. I wouldn’t count on that fund being filled anytime soon, and I don’t support a regressive sales tax increase. However, it’s good to know that if Branstad follows through on plans to shift from income taxes to consumption taxes, he won’t be able to avoid allocating more money to soil and water conservation. The big margin of victory for this amendment (62.7 percent yes, 37.3 percent no) was also a blow to the Iowa Farm Bureau Federation’s prestige. Farm Bureau never opposed this amendment the two times state legislators passed it nearly unanimously, and a Farm Bureau representative was on the group that helped shape the amendment wording. For some reason, Farm Bureau decided late in the game to made a play to stop this amendment. In doing so, they disappointed some sympathetic legislators and enraged conservatives who backed a constitutional convention. The Farm Bureau’s messaging urged a no vote on the constitutional convention question as well as the soil and water trust fund.

Feel free to comment on races from outside Iowa that caught your eye. A few U.S. Senate seats haven’t been called, but the chamber seems likely to have 53 Democrats and 47 Republicans. Republicans will pick up between 60 and 70 House seats, meaning they will hold 240 to 250 seats in the new chamber (218 are needed for a majority). Republicans are on track to hold about 30 governorships, although several states have yet to be decided. Republicans swept Michigan, Ohio and Pennsylvania, assuring that they can replicate their successful gerrymanders of those states. Florida approved ballot measures that were designed to limit gerrymandering, but opponents may challenge those rules in court. Florida will still have a Republican governor and legislature, but if the ballot measures stand Democrats may make gains at the state level and in Congressional districts.

Democrats did better in some states (Connecticut, California, West Virginia) than in most others, but a common thread was Republican gains among independents, working-class whites and suburban voters. For instance, Joe Sestak fell just short in the Pennsylvania Senate race, losing to Pat Toomey 51 percent to 49 percent. He did as well in Philadelphia as Bob Casey did four years ago, but couldn’t match Casey’s performance in other parts of the state.

The Republican campaign for president will start winding up any day now, so get ready for more Iowa visitors. On that note, one person who has been touted as a presidential prospect, Mike Pence, may be laying the groundwork to run for governor of Indiana instead.

First take on the Iowa House and Senate results (updated)

Democrats suffered big losses in the Iowa House and Senate last night. Assuming no results change through recounts, the House is likely to switch from 56 Democrats and 44 Republicans to 59 Republicans and 41 Democrats. I’ve seen some online references to a 58-42 split, but that’s not how the count looks based on unofficial results posted on the Secretary of State’s website.

Democrats maintain control of the Iowa Senate, but their majority shrank from 32-18 to 27-23. Governor-elect Terry Branstad should easily be able to get his agenda through the Iowa House, and Senate Majority Leader Mike Gronstal may have trouble keeping his caucus united.

UPDATE: Late returns could change the outcome in two Senate seats; it’s possible the chamber could have a 25-25 split, or a 26-24 Democratic majority.

SECOND UPDATE: A few more races could switch as more absentee ballots come in. As of Wednesday evening, Democrat Tom Schueller is now trailing in House district 25 by about 150 votes.

IA-Gov: Closing arguments for Branstad and Culver

For most of this year, Governor Chet Culver wasn’t campaigning as actively as Republican Terry Branstad, but the governor has been making up for lost time. Since his third debate with Branstad on October 21, Culver has headlined dozens of campaign events around the state. The governor performed well in that debate and has sharpened his stump speech. Everywhere he goes, he says he feels the momentum that will win him another term.

While Iowa Democrats insist the polling trendlines favor Culver, Branstad has led in every poll released since he entered the Iowa governor’s race. His campaign has played it safe the last few weeks and appears to have avoided any “game-changing” mistakes.

New Register poll is bad news for Democrats, Supreme Court justices

The latest Iowa poll for the Des Moines Register finds Republicans leading the gubernatorial and U.S. Senate races and Iowa’s Supreme Court justices likely to be ousted. Selzer and Co sampled 805 likely Iowa voters between October 26 and 29.

Terry Branstad leads Governor Chet Culver 50 percent to 38 percent. That’s down from a 19-point lead in the Register’s September poll, but still a comfortable advantage. Culver’s campaign released an internal poll last week showing a much tighter race, with Branstad ahead 46-40. I had assumed Republican internal polling also showed Culver gaining, because the Cook Political Report just shifted its rating on the Iowa’s governor’s race from safe Republican to leaning Republican. I don’t think they would make that rating change if private polling showed Branstad at 50 percent with a double-digit lead.

Kathie Obradovich blogged tonight that Culver leads by 9 percent among respondents who had already voted, even though he trails by 12 percent among the whole sample. The Register’s other piece on the new poll refers to “the electorate’s conservative profile” but gives no details about the partisan breakdown of the sample. I will update this post if more details emerge about the poll’s demographics.

Selzer and Co found Senator Chuck Grassley leading Roxanne Conlin 61 percent to 30 percent, virtually the same margin as in the Register’s September Iowa poll.

The news for Iowa Supreme Court justices wasn’t much better:

A third of likely Iowa voters say they will vote to retain Chief Justice Marsha Ternus and Justices David Baker and Michael Streit. Thirty-seven percent say they will vote to remove all three. Ten percent plan to retain some. The rest either don’t plan to vote on judicial retention or haven’t made up their minds.

I thought it was foolish for the anti-retention groups to feature Representative Steve King in their radio commercials, but if voters throw out the judges, King will be able to take some credit.

Obradovich didn’t give poll numbers for the Congressional races but noted, “Mariannette Miller-Meeks appears to have the best chance of any of the GOP challengers to unseat an incumbent Democrat.” That would be quite an achievement, since Iowa’s second district has the strongest Democratic lean. However, Miller-Meeks has been campaigning hard, and the Democratic Congressional Campaign Committee’s latest commercial against her is atrocious. It wouldn’t surprise me if that ad drives more voters toward Miller-Meeks than toward incumbent Dave Loebsack.

Iowa Democrats need to get out the vote and hope the Register’s poll contains faulty assumptions about who will turn out on Tuesday.

UPDATE: One positive sign for Loebsack is the large lead Democrats have in early voting in the IA-02 counties (pdf file).

SECOND UPDATE: The best news in the poll: Tom Miller 45, Brenna Findley 34.

Findley, a 34-year-old Dexter lawyer and tea party favorite, has spent more on advertising than Miller, who was first elected in 1978. However, Miller leads Findley among independent voters by 20 percentage points and nets a larger share of support from Democrats than Findley receives from Republicans.

The impeccable timing of David Vaudt

Exactly one week before election day, State Auditor David Vaudt released his report on Iowa’s film tax credit program, which Governor Chet Culver halted in September 2009. The audit found problems with about $26 million of the $32 million in tax credits awarded under the program. The Des Moines Register summarized the key findings and covered the civil and criminal cases filed so far in connection with fraudulent film tax credits.

Getting this fiasco back in the spotlight is likely to hurt Culver and help GOP candidate Terry Branstad, whom Vaudt has endorsed and joined on the stump. Branstad’s campaign seized on the chance to slam inadequate oversight of the film tax credit program. Vaudt probably also benefits from making news just before voters will see his name on the ballot. The audit featured prominently in newscasts on October 26 and was a front-page story in many Iowa newspapers the following day. According to Radio Iowa,

Vaudt, a Republican, was asked about the timing of the release of the report the week before the election.

Vaudt says the governor actually requested the investigation, and his office worked in collaboration with the Department of Revenue and the Attorney General’s office. Vaudt says they handled this report like any other and released it once the report was completed.

More like two months after completing the report. Radio Iowa posted the full report here (pdf file). On page 6, a cover letter from Vaudt and his chief deputy, Warren Jenkins, states, “Copies of this report have been filed with the Department of Management, the Division of Criminal Investigation, the Attorney General’s Office and the Polk County Attorney’s Office.” That letter was dated August 19, 2010. What’s Vaudt’s excuse for waiting nearly ten weeks to release the report to journalists?

Culver told the Des Moines Register on Tuesday, “The timing is interesting. It was purely political but [Vaudt]’s been the most partisan auditor that we’ve ever had so it’s not a surprise.” Scott Harrington, campaign manager for Democratic candidate for state auditor Jon Murphy, on 26 October asked Vaudt “to provide a detailed timeline as to how today was determined to be the appropriate date to release this report.” I’m not holding my breath until that happens.

Culver-Branstad final debate discussion thread

Share any reactions to today’s debate between Democratic Governor Chet Culver and Republican Terry Branstad in this thread. My thoughts are after the jump.

Note: some Bleeding Heartland readers have had trouble commenting lately using Internet Explorer. The problem seems to disappear when they try a different web browser (such as Firefox, Safari, or Chrome).

UPDATE: Watched the whole debate on Iowa Public television, which has posted the video on the web. To my mind, this was Culver’s strongest performance, and he probably helped himself with people who once supported him but weren’t sold on a second term yet. Branstad didn’t make any huge mistakes, but he evaded several questions and came across as hesitant at times. I doubt any Branstad supporters would change their minds based on the debate, though. More specific comments about each candidate’s strong and weak moments are at the bottom of this post.

Iowa GOP all in for AG candidate Findley

The latest round of financial reports for Iowa statewide candidates are available on the Iowa Ethics and Campaign Disclosure Board website, and once again Republican attorney general candidate Brenna Findley has turned in strong numbers. Thanks to transfers totaling $547,500 from the Republican Party of Iowa, Findley raised $756,617 between July 15 and October 14. During the same period, Democratic incumbent Tom Miller raised $243,326. The huge support from the Iowa GOP allowed Findley to spend more than twice as much as Miller during the reporting period ($661,252 to $298,604). Most of each candidate’s spending went toward advertising: $564,000 for Findley and $225,000 for Miller. Findley has been up on statewide radio for a month and started running television commercials before Miller did. To my knowledge, Miller has not done any radio advertising. Lynn Campbell listed the largest donors to the Findley and Miller campaigns at IowaPolitics.com.

The state party’s massive support for Findley is striking. Republicans have not run a strong challenger against Miller for ages. The party didn’t even nominate a candidate for attorney general four years ago. Also, the Iowa GOP did essentially nothing for state treasurer candidate Dave Jamison or secretary of state candidate Matt Schultz. Jamison received contributions from several of Findley’s high-dollar individual donors and some of the same political action committees backing her (including those created by potential presidential candidates), but the only direct support from the Republican Party came from some GOP county central committees. Schultz received donations from some of those presidential candidate PACs but even less than Jamison from the county central committees and “usual suspect” individual donors.

One could argue that Findley earned the party’s backing through her strong fundraising. She reported far more donations in May and July than the other Republican challengers for statewide offices. Without any financial support from the Iowa GOP, Findley would still have been competitive with her opponent’s contributions and cash on hand totals. She has been an energetic campaigner all year, and serving as Representative Steve King’s top staffer for seven years probably opened a lot of doors for her in terms of fundraising.

Jamison raised $60,479.25 between July 15 and October 14. That was more than the $32,070.52 State Treasurer Michael Fitzgerald raised during the same period, but Fitzgerald had $94,073.48 cash on hand as of October 14 compared to $14,608 for Jamison. Schultz raised $25,903.60 since the July disclosure reports, while Secretary of State Michael Mauro raised $52,862.51. Mauro had $64,267 on hand as of October 14, while Schultz had $7,000.94 on hand and $18,174.77 in unpaid bills to himself. If I were Jamison or Schultz, I’d be upset to be ignored by the state party that gave Findley more than half a million dollars. A hundred thousand or two for Jamison and Schultz would have been enough for a bare-bones paid advertising campaign.

Republican gubernatorial candidate Terry Branstad has been praising Findley at just about every campaign stop for months. He makes a brief appearance in one of her tv ads too. Before the June primary, I thought perhaps Branstad was singling out Findley because there were competitive GOP primaries for the other offices. However, even after winning their primaries Jamison and Schultz haven’t received as much attention or help from Branstad as Findley has.

Final note on the attorney general’s race: Findley and Miller debated yesterday in Iowa City. Unfortunately, the debate won’t be broadcast on Iowa Public Television, but Mediacom cable subscribers can watch it on channel 22 at 2 pm on October 26 and 11 am on October 31. In the Cedar Rapids/Iowa City market, Mediacom subscribers can watch the debate at 7 am on October 24, 8 pm on October 25 or 7 am on October 31.
