“We are owning our organization’s history and are committed to addressing the implicit bias and structural racism within our organization and communities,” Planned Parenthood North Central States declared on July 24, near the top of a statement denouncing racist and eugenicist ideas espoused by Margaret Sanger. Formed in 2018 when Planned Parenthood of the Heartland merged with a neighboring organization, the affiliate operates 29 clinics in Iowa, Minnesota, Nebraska, North Dakota, and South Dakota.

Many who believe in Planned Parenthood’s mission–especially the white women who have been the majority of the organization’s volunteers in Iowa–know little about Sanger other than that she established the country’s first birth control clinic. Although I’m a third-generation supporter of Planned Parenthood in Iowa, I was ignorant about Sanger’s eugenicist views for much of my adult life. Those views were repugnant, and it’s important for reproductive rights advocates to be clear about rejecting them.

More than four months into the novel coronavirus pandemic, Governor Kim Reynolds and the Iowa Department of Public Health are finally acknowledging that slowing the spread of COVID-19 will require many more Iowans to routinely cover their faces in public.

Their “#StepUpMaskUpIA” campaign might have been more successful if state officials had pushed the message before reopening businesses and lifting other COVID-19 mitigation strategies in May and June. Instead, top officials waited until new coronavirus cases, hospitalizations, and deaths had been trending upward in Iowa for weeks.

Public health experts at the University of Iowa urged state leaders months ago to call for universal use of face coverings. But at her televised news conferences, Reynolds repeatedly asserted that expanded testing would allow the state to “manage” and “control” the virus. At the same events, the governor regularly portrayed face masks as something vulnerable Iowans might need, or a precaution people could bring with them in case they found themselves in a crowded setting.

As recently as last week, Reynolds was photographed in close proximity to others, with no one’s face covered. Even now, she refuses to delegate authority so local governments can issue enforceable mask orders.

U.S. Senator Joni Ernst told members of the Iowa Farmers Union in June that she’d prefer for fossil fuel companies not to be eligible for COVID-19 relief funds.

However, months earlier she was among only two farm state senators to sign a letter aimed at ensuring that oil, gas, and coal companies would have access to federal funding from the Coronavirus Aid, Relief, and Economic Security (CARES) Act.

Iowa’s seven largest cities are spending more on policing per capita and a greater portion of their municipal budgets on law enforcement compared to the 1990s, according to a new report by the Iowa Policy Project. Over the same time period, spending on social services per capita and as a share of the municipal budget has declined in six of those cities.

Colin Gordon and Peter Fisher authored “Policing, public safety and community priorities,” published on July 22 (also available in pdf format). They examined budgets for the 24 Iowa cities with populations of at least 20,000, because “it is in our larger urban settings in Iowa that the problems with policing — including a well-documented pattern of disproportionate minority contact — are most acute.”

Seven of the cities studied are “metropolitan”: Des Moines, Cedar Rapids, Davenport, Sioux City, Waterloo, Council Bluffs, and Dubuque. Seven are suburbs in large metro areas: West Des Moines, Ankeny, Urbandale, Bettendorf, Marion, Coralville, and Johnston. Three are college towns: Iowa City, Ames, and Cedar Falls. Seven are micropolitan cities: Mason City, Marshalltown, Clinton, Muscatine, Burlington, Fort Dodge, and Ottumwa.

Some 63,245 absentee ballot request forms are en route to Linn County residents, with voters’ names, birth dates, addresses, and personal identification numbers filled in. Joel Miller, the top elections official in Iowa’s second-largest county, supervised the delivery of envelopes containing the forms to the U.S. Postal Service Bulk Mail Center in Cedar Rapids on the afternoon of July 20, he told Bleeding Heartland.

Iowa Secretary of State Paul Pate and Republican lawmakers moved on July 17 to block Democratic county auditors from sending pre-filled absentee ballot request forms. However, Miller said his research indicated neither Pate nor state lawmakers had the legal authority to stop his mailing. The Secretary of State’s office did not file for an injunction or serve notice of any impending lawsuit.

Postage for the first installment of Linn County’s mailing will cost $24,412.57, according to Miller. But pre-filling the forms will save his office a significant amount of staff time, as fewer forms will come back incomplete or with the wrong voter PIN.

This project started with the goal of clearing up some confusion surrounding Iowa’s novel coronavirus (COVID-19) death statistics.

Specifically, I wanted to debunk a conspiracy theory making the rounds on Facebook, Twitter, and Reddit.

I also planned to explain why the number of deaths for a given day on the state’s official website (coronavirus.iowa.gov) didn’t always match the number of new deaths that had been announced on that date. Many readers had asked about the discrepancy.

I was almost ready to publish in early July, but I needed to nail down one detail. Did the total fatalities on the state website (793 at this writing) reflect all of what the U.S. Centers for Disease Control describes as “multiple cause” COVID-19 deaths, or only what the CDC labels “underlying cause” deaths?

After asking that question more than half a dozen times over two and a half weeks, I still haven’t received an answer. So much for the Iowa Department of Public Health’s supposed “transparency” and “constant communication with media” on the pandemic.

U.S. Senate seats once considered safe for Republicans, like Iowa’s, are now dead heats. States that shifted to the Republicans in 2016 (Pennsylvania, Iowa, Wisconsin, Michigan, Ohio) have moved decisively toward the Democrats. Texas is in play, and this week saw a very good pollster find Joe Biden with a 13-point lead in Pennsylvania.

Two enormous events–the Black Lives Matter protests and the COVID-19 crisis–have upended American politics, just as an oil crisis and a hostage crisis upended politics in 1980. Events seem out of control, as they did in 1980, and like then, the president seems completely out of his depth.

Usually when an elected leader holds a press conference to offer additional guidance on a topic, everyone leaves with a deeper understanding of the issue. Unfortunately that wasn’t the case following Governor Kim Reynolds’ July 17 press conference on students returning to school amid the COVID-19 pandemic.

Instead, we got a new interpretation of a law that went into effect on July 1, which runs counter to much of the work schools have been doing.

Following the press conference, the governor released a proclamation that limits the ability of both public and private schools to offer remote learning and which loosens the current requirements on the qualifications for substitute teachers.

Iowa Secretary of State Paul Pate kept quiet for weeks.

He said nothing in public as Republican lawmakers sought to stop him from taking steps that contributed to record-breaking turnout in Iowa’s primary election.

He said nothing when legislators agreed to allow him to exercise emergency powers over an election only with approval from the GOP-dominated Legislative Council.

He had no public comment when Governor Kim Reynolds signed that bill.

Nor did he react when Republicans on the Legislative Council voted down a Democratic motion to let the secretary of state send absentee ballot request forms to all registered Iowa voters before the November election.

Pate’s staff did not respond to journalists’ inquiries about whether he would attempt to send a universal absentee request mailing this fall.

The secretary of state finally broke his silence on July 16 with a written proposal to mail every active registered Iowa voter an absentee ballot request form. But that’s not all. Pate’s also seeking to stop county auditors from making it easier for their constituents to return complete and accurate requests for absentee ballots.

Republicans on the Legislative Council will surely approve Pate’s request when they meet on July 17. But it’s not clear the secretary of state has the legal authority to limit what county auditors send voters.

“I am embarrassed and saddened by the way the media has been treated during COVID,” Polly Carver-Kimm wrote in an email to the Des Moines Register on July 15. “You are not receiving timely answers and you are getting scripted talking points when you do get an answer.”

Carver-Kimm discussed the state’s handling of press inquiries hours after being shown the door as communications director for the Iowa Department of Public Health.

Five months after resigning as state chair of the Iowa Democratic Party, Troy Price will join the party’s State Central Committee as vice chair of the Stonewall Caucus.

The party’s governing body consists of 32 district representatives (eight from each of Iowa’s four Congressional districts) and 24 members representing twelve “constituency caucuses.” State convention delegates elected the SCC members from their own Congressional districts last month. All business was conducted online due to the COVID-19 pandemic.

Democrats held online meetings on July 11 to select constituency caucus leaders. Benton Renaud won a three-way race for Stonewall Caucus chair. During his acceptance speech, he endorsed Price, who went on to defeat four other candidates for vice chair.

Who could have predicted it, other than anyone familiar with reproductive health care?

Republican lawmakers and Governor Terry Branstad eliminated Iowa’s successful Medicaid Family Planning Waiver in 2017 and created a new state program that excluded abortion providers. The move forced Planned Parenthood to close four of its Iowa clinics around the state and dramatically decreased the number of Iowans receiving birth control and other reproductive services.

Preliminary data from the Iowa Department of Public Health indicate that Iowans had 25 percent more abortions in 2019 than in the previous year.

Linn County Auditor Joel Miller has notified the Iowa Secretary of State’s office that he plans to begin mailing absentee ballot request forms to all active registered voters in his jurisdiction on July 20. Contrary to guidance from the state’s elections director, forms will have voters’ names, birth dates, addresses, and personal identification numbers filled in.

A showdown is brewing between the Iowa Secretary of State’s office and county auditors planning to make it easier for voters to submit accurate and complete absentee ballot request forms for the 2020 general election.

A top deputy to Secretary of State Paul Pate warned county auditors this week not to mail absentee ballot request forms with the voter personal identification number (PIN) field filled in.

July 6 was the first day Iowans can request an absentee ballot for the 2020 general election. Under normal circumstances, I prefer voting early in person and have encouraged others to do the same. But voting by mail is by far the safest option for 2020, in light of the COVID-19 pandemic.

Republican legislators signaled last week they won’t allow Secretary of State Paul Pate to send absentee ballot request forms to every registered voter again.

Election officials in Iowa’s largest counties aren’t waiting to see how things play out. Several auditors are already making plans for their own universal mailings. Higher turnout in those counties should benefit Democratic candidates for federal offices and state legislative seats.

It was painful to watch.

Governor Kim Reynolds has signed into law provisions that would make it harder for county auditors to process some absentee ballot request forms.

Democratic election lawyers have signaled plans to challenge the new restrictions, which copy an administrative rule struck down in court last year.

As Donald Trump’s presidency continues to spawn scandals that would seem farfetched as a movie plot, top Iowa Republicans remain silent whenever possible on news that reflects poorly on their party’s standard-bearer.

The latest shameful example: U.S. Senators Joni Ernst and Chuck Grassley have said nothing in public about reports indicating a “Russian military intelligence unit offered and paid bounties to Taliban-linked militants to kill U.S. and coalition troops in Afghanistan.”

Ernst’s silence is particularly striking, since she built her political brand on (and still frequently invokes) her career of service in the Iowa National Guard.

It took them long enough.

After federal courts blocked two laws designed to suppress unauthorized access to livestock production facilities, Iowa lawmakers approved and Governor Kim Reynolds signed a third attempt to keep animal rights activists from filming or photographing conditions inside farm buildings or slaughterhouses. This time, the legislature finally took the path state attorneys recommended way back in 2011: beef up the trespassing law as applied to agriculture, without reference to speech or expression.

The new law has a realistic chance to survive a court challenge.

At least 702 Iowans have died from novel coronavirus infections, according to the state’s official website at midday on June 26. Less than four months since the state recorded its first case, the death toll from COVID-19 alone is higher than the number of Iowans who have died in any recent year of flu or pneumonia, which has been the state’s eighth leading cause of death. Those fatalities occurred despite social distancing and other unusual precautions like restricted nursing home visits since March.

Statistics archived by the U.S. Centers for Disease Control indicate that 697 Iowans died of flu or pneumonia in 2018, reflecting a worse than usual flu season. Iowa deaths in that category numbered 582 in 2014, 618 in 2015, 504 in 2016, and 578 in 2017.

Secretary of State Paul Pate will need approval from the Legislative Council in order to use his emergency powers to alter election procedures, under a bill Governor Kim Reynolds signed on June 25.

While Republicans have a majority on that legislative body, it’s not clear they would use that power to prevent Pate from repeating steps that led to record-breaking turnout for the June 2 primary.

Another Friday night has brought another irregular ouster of a federal official whose work should be insulated from politics.

Four days later, U.S. Senator Chuck Grassley, a self-styled warrior for oversight and accountability in Washington, has said nothing. Neither has Senator Joni Ernst, who like Grassley serves on the committee that oversees the justice system.

“You know, I haven’t heard Theresa Greenfield say one thing that Chuck Schumer hasn’t told her to say,” Senator Joni Ernst declared today on her Twitter feed. “And that’s not what Iowans expect in a leader.”

Several political reporters quickly noted the role reversal in Ernst’s call for six debates with her Democratic opponent. Usually challengers want more debates in order to raise their profiles before the general election. An incumbent making that demand is likely trailing, as the three most recent published polls on Iowa’s Senate race suggest.

Other endangered Republican senators have similarly called for frequent debates this fall, a sign of justified fear that President Donald Trump’s sinking approval will drag them down in November.

Another thing about Ernst’s taunt struck me as more strange, though. If she wants to make the election about who slavishly follows her party’s leader, Iowa’s junior senator is on exceptionally weak ground.

Top Iowa House Democrats advised members of the caucus to get tested for novel coronavirus this week, House Minority Leader Todd Prichard confirmed on June 19.

“In addition to wearing masks, socially distancing, and going through the health screenings daily during session, we did recommend members get tested following session,” Prichard said via email. He added that his team was “not aware of any members or staff” exposed to COVID-19 at the capitol as legislators wrapped up their work for the year.

Prichard had no comment on Bleeding Heartland’s other questions, related to Republican State Representative Gary Worthan’s absence from the Iowa House chamber beginning on June 5.

Spirits lifted in the pro-choice community when Iowa House Majority Leader Matt Windschitl did not call up a constitutional amendment on abortion shortly after the legislature reconvened this month.

Republican leaders wanted to pass the amendment, which had advanced from committee months earlier. When a high-profile bill doesn’t come to the floor, it often means the majority party doesn’t have the votes for final passage.

Indeed, at least three of the 53 House Republicans resisted immense pressure to vote for legislation designed to overturn an Iowa Supreme Court ruling protecting “the constitutional right of women to terminate a pregnancy.”

Unfortunately, the holdouts agreed to a last-minute abortion restriction that may provide a faster way to undo the high court’s work.

UPDATE: Governor Kim Reynolds signed this legislation on June 30.

Iowa Republicans have perfected the art of sneaking attacks on constitutional rights or the rule of law into budget bills shortly before adjourning for the year.

Last-minute budget amendments in 2019 sought to shorten the Iowa Supreme Court chief justice’s term, increase the governor’s influence over selecting judges, restrict medical care for transgender Iowans, and stop Planned Parenthood from obtaining sex education grants. Those measures spawned four lawsuits.

Judges will surely hear challenges to legislation Republicans enacted while burning the midnight oil this past weekend. A forthcoming post will address a 24-hour waiting period for abortion, approved during the session’s closing hours.

This post focuses on provisions that would make it harder for Iowans to vote by mail. Marc Elias, one of the country’s most prominent Democratic election lawyers, promised on June 14, “This will not stand. We will sue.”

Don’t bet against him. A Polk County District Court already struck down similar language in an administrative rule as “irrational, illogical, and wholly unjustifiable.”

“Let them vote! Let them vote!” Black Lives Matter protesters chanted a few minutes after Governor Kim Reynolds signed a police reform bill on June 12. Reynolds did not acknowledge hearing them, continuing to pass out pens to advocates of the legislation, which the Iowa House and Senate had unanimously approved the night before.

The protesters want the governor to sign an executive order automatically restoring voting rights to Iowans who have completed felony sentences. Iowa has the country’s strictest felon voting ban, which disproportionately disenfranchises African Americans. Reynolds has resisted calls to issue an executive order, saying she wants the legislature to approve a state constitutional amendment on felon voting instead.

The Iowa legislature adjourned for the year on June 14 without the constitutional amendment clearing the Senate.

For many thousands of Iowans with felony convictions, an order from Reynolds provides the only path to voting before 2024. She should issue one as soon as possible.

Iowans haven’t voted a sitting U.S. senator out of office since 1984, but a third poll taken since the June 2 primary shows Senator Joni Ernst slightly trailing Democratic nominee Theresa Greenfield.

One poll might be dismissed as a fluke. Two polls might be explained away by the fact that groups supporting Greenfield commissioned the surveys. But Selzer & Co, which conducts the Iowa Poll for the Des Moines Register and Mediacom, has no dog in this fight.

Most bills lawmakers introduced this year to address Iowa’s notorious racial disparities didn’t get far before the Iowa House and Senate suspended their work in mid-March, due to the COVID-19 pandemic. By the time the legislature got back to work on June 3, large protests were underway daily in Iowa and across the country, in response to the horrific killing of George Floyd at the hands of Minneapolis police.

Democratic lawmakers unveiled a “More Perfect Union plan” designed to prevent “violent conflicts between law enforcement and Iowa residents” on June 4. A bill incorporating their proposals sailed through both chambers unanimously a week later, with a group of Black Lives Matter protesters watching from the public gallery.

House members approved the amended bill by 95 votes to 2 on the evening of June 11. The Senate took up the bill around 12:45 am on June 13. Following a brief debate, during which three Democratic senators spoke against the House version, senators concurred with the House amendment and approved the bill by 31 votes to 16. However, some of the disenfranchising provisions related to absentee ballots surfaced again on June 14, attached to a budget bill. Bleeding Heartland covered that debate here.

After a contentious debate on June 10, the Iowa Senate approved by 30 votes to 19 a bill including controversial changes to election law. The proposal has drawn extensive local and national media coverage for a provision that would ban Iowa’s secretary of state from sending absentee ballot request forms to any voter who did not request one.

House File 2486 now goes to the lower chamber, where an amendment filed the evening of June 10 suggests Democrats and Republicans have agreed to strip out much of Senate State Government Committee Chair Roby Smith’s handiwork.

In its most closely-watched meeting in living memory, the Iowa State Fair board voted on June 10 not to hold the fair this year, due to the coronavirus pandemic.

Although the board’s 11-2 vote was livestreamed, the brief meeting shed no light on the deliberations. There was no public discussion of the pros and cons of postponing the event until 2021. Nor did members debate alternative scenarios explored by staff, like holding a scaled-back event with limited attendance, mandatory face coverings, or temperature checks.

All board members present avoided a public stand on the difficult decision through a secret ballot vote, in apparent contradiction with Iowa’s open meetings law.

Governor Kim Reynolds’ designated representative on the body missed the meeting entirely.

A wide-ranging election bill is eligible for Iowa Senate debate on June 10. Judging by the party-line vote in the State Government Committee on June 5, the Republican majority seems likely to rubber-stamp House File 2486 and send it to the Iowa House.

State Senator Roby Smith proposed many bad ideas in his 30-page amendment to that previously innocuous bill. The most controversial would prevent Republican Secretary of State Paul Pate from sending an absentee ballot request form to any voter who did not ask for one. Pate’s decision to send such forms to every registered Iowa voter contributed to record-setting turnout for the June 2 primary.

Smith has denied he is trying to suppress voting by mail. But talking points he and a Republican ally floated in recent days do not withstand scrutiny. Pate didn’t need lawmakers to appropriate state funds for the mass mailing, didn’t need legislative approval to send the forms, and didn’t exceed his authority under Iowa law.

The 2016 elections were so devastating for Iowa Democrats that I thought Iowa had probably relinquished swing-state status and would not have a targeted U.S. Senate race in 2020.

However, Senator Joni Ernst’s approval numbers have been sliding for some time. The first two polls published following last week’s primary election show Democratic Senate nominee Theresa Greenfield slightly leading Ernst.

The same surveys point to a highly competitive race between President Donald Trump and Joe Biden for Iowa’s six electoral votes.

Novel coronavirus (COVID-19) infections and deaths could increase or decrease substantially in the coming months, depending on how many Iowans practice social distancing or wear personal protective equipment (PPE) routinely in public, according to a modeling app designed by University of Iowa faculty and graduate students.

Six professors of biostatistics or epidemiology collaborated on the model, while a group of graduate students worked on the app and translated materials for a Spanish-language version. The university’s College of Public Health COVID-19 Response Team “developed this tool as a free public service to state and local policymakers, business leaders, and others to assist in guiding the community response to the coronavirus pandemic.”

This incredibly useful resource was derived from publicly-available data, so is not subject to restrictions on release state government imposed as part of the contract the Iowa Department of Public Health and UI College of Public Health signed in April to develop Iowa-specific modeling for COVID-19. Governor Kim Reynolds and state health officials largely ignored that modeling when drafting plans to reopen businesses and venues in May and June, saying “real-time data” was informing such policies.

Running against a sitting office-holder from your own party is always an uphill battle. Many Iowa House or Senate members have faced primary challengers during the past decade, but only a handful have failed to win their party’s nomination.

Christina Bohannan beat the odds on June 2, taking 66 percent of the vote against 20-year State Representative Vicki Lensing in Iowa’s most Democratic House district.

No one can write off the outcome as a fluke of a low-turnout environment. Statewide turnout set a new record for an Iowa primary, and voter participation in Johnson County was sky-high as well. Unofficial results showed 6,687 residents of House district 85 cast ballots for either Bohannan or Lensing.

Bohannan’s win and in particular the margin of victory should put every Iowa legislator on notice: you have to keep earning your constituents’ support.

Iowa’s 2020 primary turnout hit a new record, thanks largely to Secretary of State Paul Pate’s actions to facilitate more voting by mail.

Days later, Senate State Government Committee Chair Roby Smith introduced an amendment that would prevent Pate from taking the same steps during the general election. County auditors from both parties oppose the proposal.

U.S. Senator Chuck Grassley’s reputation as a defender of whistleblowers and government oversight has taken a hit lately, as President Donald Trump sidelined five inspectors general over a span of two months and rebuffed the senator’s demand for an explanation.

In an escalation of sorts, Grassley announced on June 4 that he would hold up two of Trump’s nominees until the White House complies with federal law requiring that the president explain in writing why he removed inspectors general.

The senator might have some leverage if he were willing to block high-priority nominees for the administration. But the opposite is true. The same day Grassley took a stand on inspectors general, he and Iowa’s Senator Joni Ernst advanced yet another unqualified judicial nominee.

Occupational Safety and Health Administration (OSHA) staff conducted on-site inspections of two more Iowa meatpacking plants this week, the Iowa Division of Labor confirmed to Bleeding Heartland on June 2.

Documents provided the following day show regulators closed at least four coronavirus-related complaints against Iowa pork processors with no inspection.

Inspectors toured the Tyson Foods turkey plant in Storm Lake and the Perdue Premium pork facility in Sioux Center on June 1. Both site visits stemmed from “media referrals” rather than complaints, meaning officials acted on unspecified news reports or information relayed to OSHA by a journalistic source.

The fields are set for Iowa’s 2020 federal campaigns. The U.S. Senate race and three out of four House races could be highly competitive this November. However, Democratic prospects for picking up the fourth Congressional district took a big hit last night.

The Iowa Supreme Court will determine whether a law designed to deny sex education grants to Planned Parenthood violates the Iowa Constitution’s equal protection guarantee. The state of Iowa filed a notice on June 1 that it will appeal last month’s Polk County District Court ruling, which found the law unconstitutional.
