Weekend open thread: Wrapping things up

Iowa legislative leaders made significant progress toward avoiding a government shutdown this week. After the Senate approved new budget bills on Tuesday and Wednesday, negotiators reached new compromises on Thursday. Conference committees cut deals on two-year budgets for economic growth, justice and agriculture/natural resources. The Iowa Senate then passed those three compromise bills on Friday with bipartisan majorities. Senate Majority Leader Mike Gronstal expressed confidence that the House and Senate can finish work on the budget in time for the end of the fiscal year on June 30. Early next week I’ll publish more details on the budget compromises taking shape. To my knowledge, statehouse Democrats and Republicans are still far from agreeing on property tax reform, which Governor Terry Branstad has said must get done this year.

Branstad won a major victory by getting legislators to pass a two-year budget. Senate Democrats had previously warned that biennial budgeting would facilitate a “power grab” by the governor. On Friday the Iowa Senate unanimously approved a bill to address that concern, limiting how much money the governor can transfer between legislative sessions.

The Rebuild Iowa Office, a temporary agency created by then-Governor Chet Culver after the historic 2008 floods, closed this week as scheduled. Lynn Campbell published a good piece about the office and its work. The closure isn’t timely, as western Iowa deals with major flooding along the Missouri River.

“We still feel that there is a need for a recovery office of some sort – they can call it whatever they want – to continue to focus on all these disasters that are happening over and over again,” said Ron Randazzo, Rebuild Iowa’s strategic planner. […]

Iowa Homeland Security and Emergency Management Division now will be the lead agency for the state’s disaster response and recovery.

But Susan Judkins Josten, RIO’s intergovernmental affairs director, said the Legislature hasn’t acted on a transition plan and hasn’t required the homeland security division to change its operations. The state also doesn’t have plans to retain the knowledge developed by RIO.

Leading Iowa Republicans aren’t worried. House Speaker Kraig Paulsen told Campbell that he never supported creating a separate office to handle disaster recovery efforts. Governor Terry Branstad was scathing in comments to Rod Boshart:

“I think it really turned out to be kind of an ineffective agency and I think the Legislature was right in their decision in 2009 to sunset it,” the governor said. “All RIO did was paper shuffling and coordination. […]”

Branstad said he believes his administration has established a better system of direct accountability and management by having the state’s Homeland Security and Emergency Management agency take the lead on dealing with disasters such as the current flooding along the Missouri River, while other state agencies address funding issues with the federal government, public safety and other issues.

“In my opinion there’s been money wasted in having an extra layer” that has now been eliminated, the governor said. “When you have to go through a coordinating agency and you have the paperwork involved, it just slows things down. I think the change will be for the better, speed things up, cost us less, be much more efficient and make it possible for people to get straight answers quicker.”

Democratic State Senator Rob Hogg praised RIO officials for keeping the focus on flood prevention efforts as well as disaster recovery. I share Hogg’s concern that in RIO’s absence, no state agency will push for better floodplain management in Iowa. Branstad did virtually nothing on that front after Iowa’s 1993 flooding (at the time the worst ever) and hasn’t pushed for action since returning to office.

In happier news, New York became the sixth state to legalize same-sex marriage last night. Four Republicans in the GOP-controlled state Senate voted for the marriage equality bill, which Democratic Governor Andrew Cuomo immediately signed into law.

10 days to an Iowa government shutdown?

Iowa’s current fiscal year ends on June 30, which gives Governor Terry Branstad, Republican leaders in the Iowa House and Democratic leaders in the Iowa Senate just ten days to approve a 2012 budget without disrupting state government operations. Although the parties have settled on a total spending target for the next fiscal year, they are still at odds over funding for key programs. They appear to have made no progress toward a compromise on commercial property tax reform, which Branstad demands as part of any final budget deal.

More Iowa budget brinksmanship, or close to a breakthrough?

The current fiscal year ends in 17 days, and the leaders who have been negotiating next year’s budget have sent mixed signals in recent days about a possible compromise. Last Wednesday, the Iowa House approved House File 697 on a party-line vote of 54 to 38. The House Journal for June 8 (pdf) includes roll call votes on various amendments and final passage. The 600-page bill includes a budget for two fiscal years and Republican property tax reform plan. Its more controversial provisions include not allowing any growth in K-12 education budgets during the 2012 fiscal year and closing 37 Iowa Workforce Development offices around the state. (UPDATE: Republican State Representative Jason Schultz asserted on June 14 that the House-approved omnibus budget bill requires Iowa Workforce Development to keep all its branch offices open for one more year.) Iowa Senate Democrats have portrayed both of those proposals as deal-breakers and support a higher overall spending target than the $5.99 billion House Republicans approved. Critics have also warned that the changes to commercial property taxes won’t target help to “main street” and small businesses and could force local governments to make big cuts in services.

The omnibus bill didn’t appear to be a promising step toward a budget compromise. Senate Democrats had denounced the proposal as a “Frankenstein” monster. Leading House Democrats sharply criticized the bill after it was approved following less than six hours of debate. Yet on June 9, House Speaker Kraig Paulsen implied that passing House File 697 had been an effective bit of brinksmanship:

“Running the omnibus bill yesterday and sending that over to the Senate had the effect that we were hoping for, and that was it kick-started the negotiations,” said Paulsen, R-Hiawatha, on Thursday after a meeting with Senate leaders that he described as “arguably the most productive meeting we’ve had in two months with the Senate.”

Also on June 9, Senate Majority Leader Mike Gronstal released this statement:

“I am encouraged by negotiations this morning with Republican legislators and the Governor’s staff. We believe that we can reach an agreement that would receive bipartisan support in the Senate and pass the House because it would avert a government shutdown by making spending cuts while still investing in our future.

“In the end, we believe a deal will be possible because Iowans are raising their voices after being empowered with vital, accurate information about the effects of woefully inadequate investments in our schools and other key services.”

Governor Terry Branstad kept his cards close to his chest during a June 10 taping of Iowa Public Television’s “Iowa Press” program. Click here for the video and full transcript. He praised House Republicans for passing “a comprehensive budget” that includes “critically important” property tax reforms. Regarding a broader agreement, Branstad said, “I’m cautiously optimistic that it can get worked out but there’s a lot of details that have to be worked out.” He declined to be specific about how the government would function if no new budget is approved by the start of the next fiscal year on July 1. All sides in the negotiations insist they are working to prevent a shutdown of some state government services.

UPDATE: Senate Appropriations Committee Chair Robert Dvorsky said in a June 13 statement,

Senate Democrats are eager to resume negotiations with the Governor’s staff and House Republicans this afternoon.

Last week, we took a significant step in the negotiations by agreeing to the general fund spending limit proposed by the House Republicans.

This week, the negotiations will focus solely on the details of each of the separate spending bills.

Assuming agreements can be reached in a timely manner, the final hurdle toward adjournment will be cleared and there will be no state government shutdown.

Iowa Senate passes abortion clinic bill on party-line vote

On a party-line 26 to 23 vote, the Iowa Senate today approved a bill to restrict the locations of clinics where abortions are performed after 20 weeks gestation. Senators also rejected an attempt to bring up a broader ban on abortions after 20 weeks.

GOP opposing alternate bill to block Council Bluffs abortion clinic

Yesterday the Iowa Senate Ways and Means Committee advanced a bill that would restrict where abortions after the 20th week of pregnancy can be performed in Iowa. The bill is aimed at stopping Dr. Leroy Carhart from opening a new clinic in Council Bluffs without adding new restrictions on a woman’s right to have a late-term abortion. However, Republican leaders in both chambers of the state legislature spoke out against that approach yesterday. Details and next steps in this controversy are after the jump.

Senate to focus on Council Bluffs clinic; abortion bill's fate uncertain

Iowa Senate Ways and Means Committee Chair Joe Bolkcom announced today that he will introduce new legislation designed to stop Omaha-based Dr. Leroy Carhart from opening an abortion clinic in Council Bluffs.

Iowa House passes pro-nuclear bill; Senate prospects unclear

After more than five hours of debate, the Iowa House on April 26 approved a bill to let MidAmerican Energy charge consumers for costs associated with a nuclear reactor it may or may not build in the coming decade. House File 561 passed 68 to 30. All Republicans present except two voted yes, joined by 12 House Democrats: Deborah Berry (district 22), Chris Hall (district 2), Minority Leader Kevin McCarthy (district 67), Dan Muhlbauer (district 51), Pat Murphy (district 28), Rick Olson (district 68), Brian Quirk (district 15), Mark Smith (district 43), Phyllis Thede (district 81), Andrew Wenthe (district 18), John Wittneben (district 7) and Mary Wolfe (district 26). The remaining 29 House Democrats voted against the bill. Two Republicans voted no: Guy Vander Linden (district 75) and Kim Pearson (district 42).

Weekend open thread: Abortion and pregnancy edition

This week Governor Terry Branstad declared April to be “Abortion Recovery Month” in Iowa. Anti-choice organizations and crisis pregnancy centers were invited to the proclamation signing, and women who regret their abortions spoke at a press conference. Human beings have complex reactions to significant life events, and I feel empathy for anyone who feels sad about important choices. However, it is inaccurate to suggest that all women who exercise their legal right to an abortion need to go through a “recovery” process. The American Psychological Association’s Task Force on Mental Health and Abortion concluded in a 2008 report that “among adult women who have an unplanned pregnancy the relative risk of mental health problems is no greater if they have a single elective first-trimester abortion than if they deliver that pregnancy. […] the TFMHA reviewed no evidence sufficient to support the claim that an observed association between abortion history and mental health was caused by the abortion per se, as opposed to other factors.” Some mental health professionals believe that “emotional issues, especially feelings of guilt, begin to rise along with anti-choice efforts to restrict abortion.”

The Iowa House approved a 20-week abortion ban at the end of March. The bill is modeled on a Nebraska statute and is intended to deter an Omaha-based doctor from opening a new abortion clinic in Council Bluffs. It has stalled in the Senate Government Oversight Committee. Committee Chairman Tom Courtney said in mid-April that it was too late in the legislative session to adequately review the bill this year, and he would prefer to take it up in 2012. Council Bluffs Mayor Tom Hanafan, a Democrat, recently urged the Senate to act on the bill before adjourning. The mayor does not want his city to become “home to a clinic that specializes in later term abortions.” Senate Majority Leader Mike Gronstal, who represents the Council Bluffs area, has said he would not block the abortion bill from coming to a vote and is letting the normal committee process work.

Women who are pregnant and planning to stay pregnant should be aware that April is cesarean awareness month. At the request of Iowa chapters of the International Cesarean Awareness Network, Branstad issued a proclamation to that effect. The c-section rate in Iowa rose to 30.2 percent in 2009, the most recent year for which statistics are available. That is way above the optimal level, but the national average is even higher at 32.9 percent. The central Iowa chapter of the International Cesarean Awareness Network posted statistics for c-sections and vaginal births after cesareans (VBACs) in Iowa hospitals here. Unfortunately, more than three quarters of Iowa hospitals prohibit pregnant women from even attempting VBACs. The U.S. Department of Health and Human Services’ Healthy People 2010 initiative set a goal of reducing the cesarean birth rate for low-risk women to 15 percent for women giving birth for the first time and 72 percent for women who have had a prior cesarean birth. Having a doula present during labor has been proven to reduce the need for cesareans and other major interventions.

Whether or not they are able to become pregnant, all sexually active people should be aware that April is STD Awareness Month. The Centers for Disease Control has lots of relevant facts and figures here. Planned Parenthood of the Heartland clinics across Iowa are encouraging people to get themselves tested for sexually transmitted diseases.

UPDATE: State Representative Kurt Swaim is not running for re-election in the new House district 82, which covers Davis and Van Buren counties and most of Jefferson County, including Fairfield. Swaim and fellow Democrat Curt Hanson were both placed in that district, but most of the population lives on Hanson’s current turf. Swaim was one of four House Democrats to vote for the 20-week abortion ban, one of three House Democrats to vote for a constitutional amendment banning same-sex marriage, and one of nine House Democrats to vote for a bill banning secret recordings on Iowa farms. Hanson voted against all of those bills.

Shorter Branstad to lawmakers: My way or the highway

Before this year’s legislative session began, I thought the Democrats in the Iowa Senate would more easily find common ground with Governor Terry Branstad than with the Republican-controlled Iowa House. Branstad dealt with a Democratic or divided legislature for 14 of his 16 previous years as governor, while most of the House Republicans weren’t serving in the legislature at that time.

This week Branstad proved me wrong, rejecting key provisions of a compromise bill that passed both chambers unanimously and a Democratic offer to meet him halfway on biennial budgeting. Follow me after the jump for more on those stories.

Evidence doesn't support Branstad's claims on biennial budgeting

Governor Terry Branstad, Republican Iowa House Speaker Kraig Paulsen and Democratic Senate Majority Leader Mike Gronstal met yesterday to talk about the state budget. Paulsen left the meeting feeling less optimistic that the Iowa legislature will finish its work for the year on schedule, by April 29. Senate President Jack Kibbie concurred that the budget discussion “didn’t go very well.” Unresolved issues include the overall amount of state spending, allocations for education and human services, and the right approach for commercial property tax reform.

Kibbie told IowaPolitics.com that the biggest roadblock is Branstad’s commitment to two-year budgeting. The governor vetoed a one-year transportation appropriations bill last week, claiming two-year plans were essential to “restore predictability and stability to the state budgeting process.” In a press release on Monday, Branstad repeated that his administration “remains committed to a biennial state budget,” which, he said, would provide “predictability for communities while ensuring a solid fiscal foundation for future generations of Iowans.”

I’ve never understood how Branstad can say with a straight face that it’s fiscally responsible to approve a two-year spending plan in the absence of two-year revenue projections. Furthermore, most states that adopt biennial budgets face a projected budget gap larger than Iowa’s for fiscal year 2012. Names and numbers are after the jump.

Commission recommends passage of first Iowa redistricting plan

The five-member Temporary Redistricting Advisory Commission unanimously recommended today that the Iowa legislature “accept the first proposed Congressional and Legislative redistricting plan,” submitted by the Legislative Services Agency on March 31. I’ve posted the full text of the commission’s report after the jump. Key excerpt:

a. The Commission is grateful to those members of the public who made the effort to provide oral and written testimony concerning the redistricting plan and for those members of the public who attended the public hearings conducted throughout the state. While the concerns expressed by the participants at the public hearings concerning the plan were thoughtful and constructive, they were not within the constitutional and statutory criteria upon which the plan is to be evaluated by the Commission and the Commission is of the opinion that the Legislative Services Agency has satisfied those constitutional and statutory requirements.

b. The Commission is supportive of the many comments heard during the public hearings praising Iowa’s unique and nonpartisan redistricting process.

The commission’s report did not specifically address concerns that Bettendorf resident James Davis raised in a 20-page document last week. Bleeding Heartland discussed Davis’ arguments about the “convenience” standard and other criticisms of the redistricting plan here.

Click here to download the proposed Iowa maps for four Congressional districts, 100 House districts and 50 Senate districts. The Legislative Services Agency’s report on the redistricting proposal is available there too. The Iowa House and Senate may consider House Study Bill 235 as early as this Thursday. If both chambers approve the plan and Governor Terry Branstad signs the bill, Iowa will be the first state to complete its redistricting process.

On Iowa Public Television over the weekend, House Speaker Kraig Paulsen said of the proposal, “I look at the House map, I see a pathway to Republican control;  I can also see a pathway to Democratic control.  So that tells me maybe there’s a heightened level of fairness.” Senate Majority Leader Mike Gronstal commented, “I’d actually say the opposite.  We kind of both don’t like what we see but don’t figure there’s a way to get a better map.  If it was actually stacked pretty well for Democrats, I’m pretty sure Speaker Paulsen is going to take it down in the House and vice versa.  So we both look at the map and see no guarantees, but we both see a pathway. And that is […] that is kind of the essence of a fair map.”

Iowa House passes big government abortion ban

The abortion issue magically transforms conservatives from people who want to keep bureaucrats from getting between you and your doctor into people eager to let the government limit pregnant women’s medical care. The Iowa House demonstrated that contradiction again yesterday, as representatives approved a ban on most abortions after 20 weeks gestation.

House File 657 is modeled on a Nebraska statute with the intent of stopping Omaha physician Leroy Carhart from opening an abortion clinic in Iowa. State representatives voted 60 to 39 to send the bill to the Senate. The yes votes included 56 Republicans and four Democrats: Dan Muhlbauer (district 51), Brian Quirk (district 15), Kurt Swaim (district 94) and Roger Thomas (district 24). Three first-term Republicans–Kim Pearson (district 42), Glen Massie (district 74) and Tom Shaw (district 8)–voted no, along with the rest of the House Democratic caucus. Those Republicans have argued against the bill because it would ban less than 1 percent of abortions in Iowa; their opposition forced House Republican leaders to pull the bill out of the House Human Resources Committee and send it to Government Oversight instead.

Anti-abortion legislation that stalled earlier this year in an Iowa House committee appears likely to pass the lower chamber soon. House File 5 would ban abortions after the 20th week of pregnancy, using a “fetal pain” standard adapted from a similar bill in Nebraska. More than 30 House Republicans are co-sponsoring the bill, hoping to deter Omaha-based abortion provider Dr. Leroy Carhart from opening a clinic in Council Bluffs.

Nine Iowa senators call for shelving pro-nuclear bill

Nine Iowa Senate Democrats have signed an open letter asking their colleagues to shelve a pro-nuclear power bill this session and to create a legislative commission “to thoroughly investigate all of the issues including the need for a nuclear power plant, the costs and impact on utility rates, financing and liability issues, safety and waste disposal issues, and renewable energy alternatives.” The senators who signed were Daryl Beall (district 25), Dennis Black (district 21), Joe Bolkcom (district 39), Dick Dearden (district 34), Robert Dvorsky (district 15), Gene Fraise (district 46), Jack Hatch (district 33), Rob Hogg (district 19) and Pam Jochum (district 14). The full text of their letter is after the jump. Excerpt:

Specifically, we have the following concerns:

* There is very little known about how much a new nuclear power plant would cost or how it would

impact utility rates, especially for seniors, working families, and Iowa businesses.

* The proposed technology – small modular reactors – is unproven and has not been approved by

the Nuclear Regulatory Commission.

* There are significant safety and financial liability concerns, especially after the nuclear disaster in Japan. United States Senator Joseph Lieberman has called for “putting the brakes on” the construction of new nuclear power plants “until we can absorb what has happened in Japan.”

* There are potential issues with the creation of a permanent government bureaucracy to permit, monitor, and regulate any new nuclear power plants.

* There are unresolved siting issues about where the plant or plants would be located and how the property would be acquired for the construction of the plants.

MidAmerican Energy is only in the first of what was represented to be a three-year study on the feasibility of constructing a new nuclear power plant in Iowa. When that bill was passed, it was contemplated that Iowa would take at least three years to make any decision about new nuclear power plants. There is no rush.

Speaking to the Des Moines Register yesterday, Iowa House Speaker Kraig Paulsen predicted the bill will pass this year. Iowa’s only current nuclear power plant is in Paulsen’s district. Democratic Senate Majority Leader Mike Gronstal supports the bill.

MidAmerican Energy President William Fehrman is expected to attend an Iowa Senate Commerce subcommittee hearing on the bill later today. Fehrman has said the bill would help MidAmerican attract investors for a nuclear construction project. Critics point out that the legislation would lead to higher utility bills for hundreds of thousands of Iowans and would tilt the field so far in favor of expanding nuclear power that less costly energy efficiency and renewable energy projects might not be pursued.

On the other hand, even before this week’s crisis at the Fukushima facility in Japan, financing was not coming together for proposed nuclear power plant projects in the United States. So one could argue that even if this bill becomes law, MidAmerican probably won’t attract the investor support needed to build nuclear plants here. In that case, why let the company charge its Iowa customers more now to pay for anticipated future construction costs?

Meanwhile, the U.S. Nuclear Regulatory Commission has ranked the 104 nuclear power plants across the country in terms of earthquake risk. Iowa’s Duane Arnold nuclear reactor is 26th on that list. Yesterday several U.S. Senate Democrats urged the head of the NRC to conduct a thorough review of all nuclear reactors in this country, especially those in earthquake-prone areas.

In Germany, political leaders have decided to temporarily shut down seven of the country’s oldest nuclear reactors in order to conduct a safety review. The prime minister of Spain has also called for a review of all that country’s nuclear power plants. A nuclear energy expert whose name I didn’t catch pointed out yesterday on CNN that baseload demand for electricity is relatively low in the spring, so it wouldn’t cause problems on the grid to shut down U.S. nuclear power plants for a month or two during a safety review.

UPDATE: Fehrman told the Iowa Senate subcommittee that “MidAmerican Energy customers would see their power bills rise 10 percent over a decade to pay for the investor-owned utility’s share of a proposed Iowa nuclear plant.” He confirmed that the plant would be completed no sooner than 2020, and that Iowa ratepayers would not get their money back, even if the construction never moved forward.

Sen. Swati Dandekar of Marion said Iowans are concerned about paying for a project that may cost more than the utility thinks, given the nation’s record on cost overruns at nuclear plants.

“There is no doubt there is a history of cost overruns in this industry,” Fehrman said. “We’ve asked for more oversight of this project, and that’s in the bill.”

MidAmerican is pushing legislation that would set some of the rate-making principles to be applied to the plant, in effect telling investors how the utility would recover its expenses.

Also on Thursday, the Iowa chapter of the Sierra Club and the American Association of Retired Persons came out against the bill.  From an AARP statement:

“AARP believes it is unfair to consumers and bad policy for the Iowa General Assembly to enact legislation that would allow utility companies to charge consumers in advance for costs of a new plant before it is in service, and require consumers to continue to have to pay even if the plant development is canceled, or goes over budget [….] AARP is concerned about this legislation, not because of the question of nuclear power, but because we oppose raising rates for consumers already struggling to afford their utility bills for a plant yet to be built, where we don’t know the actual cost to build, and may or may not even be built in Iowa.”

Still the self-styled taxpayer watchdog groups are missing in action on this bill.

Iowa reaction to crisis at Japan nuclear facilities (updated)

Several Iowa elected officials commented on expanding nuclear energy production Monday in light of the deteriorating situation at Japan’s Fukushima nuclear power plant. Two Iowa Republicans and Democratic Senate Majority Leader Mike Gronstal indicated that they don’t want the cascade of events at Fukushima to derail efforts to build new nuclear power plants in Iowa. However, Democratic State Senator Joe Bolkcom called for a “pause” to more closely scrutinize the impact of a nuclear energy bill that has been on a fast track in the Iowa House and Senate.

Iowa Republican budget schizophrenia discussion thread

Republican elected officials are sending a mixed message about Iowa’s finances. Before the 2011 legislative session began, Republicans were outraged about a so-called “unaffordable” union contract that would give state workers modest raises, at a cost of about $100 million a year for two years.  Barely a week into the session, a party-line Iowa House vote approved a broad “deappropriations” bill, in which about a third of the savings came from cutting Iowa’s preschool grant for four-year-olds. The universal voluntary preschool program was expected to cost $70 million to $75 million per year (according to Legislative Services Agency estimates), or up to $90 million by some other estimates.

Since then, House Republicans have passed House File 185, which allows zero growth in K-12 education budgets for the next two fiscal years. That was an unprecedented move. In nearly 40 years, the Iowa legislature has never approved less than 1 percent allowable growth for school district budgets: not during the farm crisis, not during the recessions and budget crunches of the early 1980s, early 1990s, 2001-02 or 2009-10. Now, we are told, our dire fiscal condition doesn’t leave any room to spend $65 million to allow school districts to increase their budgets by 2 percent.

Yet on February 16, the Iowa House approved House File 194 on a mostly party-line vote. The bill would cut Iowa’s individual income tax rates by 20 percent, which the Legislative Services Agency estimates would cost $330 million during fiscal year 2012 and more than $700 million in each of the next three fiscal years.  How Iowa can afford that loss of revenue and what services would be cut to keep the budget balanced, House Republicans don’t say.

Meanwhile, Governor Terry Branstad plans to lay off hundreds of state workers to cut labor costs and sent state legislators a draft budget with no allowable growth for K-12 schools for two years. This week Branstad offered a preschool plan that would support fewer children at a lower cost ($43 million per year). He and his Department of Education director, Jason Glass, have repeatedly said Iowa cannot afford to continue the preschool program as currently structured. Yet Branstad’s plan to cut corporate taxes in half would deprive the state of at least $100 million in revenues. He has proposed about $450 million in commercial property tax cuts, with the idea that state government would reimburse local governments for much of that lost revenue. If our budget constraints are so severe, how can we afford those policies?

Six Iowa Republicans who may live to regret marriage vote

After a crowded public hearing last night and about three hours of floor debate today, the Iowa House approved House Joint Resolution 6, a constitutional amendment that would ban all legal recognition for same-sex relationships in Iowa. All 59 Republicans present voted for the amendment, as did three House Democrats who represent rural districts: Kurt Swaim, Dan Muhlbauer and Brian Quirk. The bill now goes to the Iowa Senate, where Majority Leader Mike Gronstal has pledged to keep it from receiving a floor vote.

Many of the 37 House Democrats who voted no on the amendment took to the floor to speak out against the bill. You can read excerpts from their remarks here, here, here and here. (UPDATE: Several of the House Democrats’ speeches from the chamber are on YouTube as well.)

In contrast, only a few Republicans gave prepared remarks supporting the amendment, including lead sponsor Dwayne Alons (rarely afraid to say something ridiculous) and House Judiciary Committee Chairman Rich Anderson. Anderson justified the amendment as serving the state’s interest in promoting childbearing:

“We want to drive procreation into a stable relationship and procreation only happens between a male and a female. See a male and a female can do something that a homosexual couple cannot: They can create children accidently. That’s the issue. It’s not about love. It’s not about romance. It’s about driving state policy toward responsible procreation.”

The Iowa Supreme Court addressed and rejected that argument on pages 59 and 60 of the Varnum v Brien ruling. Anderson also raised the familiar “slippery slope” concern that legal same-sex marriage would lead to state recognition of incestuous and polygamous unions. No one’s tried to do that in the other four U.S. states that recognize same-sex marriages, or in Canada or any of the European countries that do the same.

Given how strongly the Republican base supports overturning same-sex marriage rights, I was surprised more Republicans weren’t eager to explain their votes on the House floor. Tea party favorites Kim Pearson and Glen Massie even declined to yield to a question from Democrat Nathan Willems on whether the equal protection clause applies to all Iowans. House Majority Whip Erik Helland “answered” Willems’ question, but in a non-responsive way.  

It got me wondering: deep down, are they not proud of what they’re doing? Perhaps some of them secretly agree with former Republican State Senator Jeff Angelo, who has changed his position on marriage equality and now views a constitutional amendment as “government intrusion in the lives of law-abiding citizens.” Rarely do legislators vote to change the constitution, and Iowa has never before approved an amendment to limit the rights of citizens. If House Republicans believe the public interest demands putting minority rights up for a majority vote, they owe us compelling arguments.

Politically, it was probably wise for House Republicans to keep quiet during today’s debate. Many must realize that they’re on the wrong side of history, as public opinion polls show increasing support for same-sex marriage rights. A “loud and proud” statement for the public record supporting this bill could be embarrassing 10 or 20 years from now.

Still, I wonder if voting for House Joint Resolution 6 will ever become a political liability for any of today’s Republican lawmakers. During the 1980s and 1990s, decades-old opposition to school desegregation or other policies of the civil rights era occasionally became a campaign issue. I remember many politicians apologizing for things they said or votes they took in the 1960s and 1970s. During the 2008 presidential race, Republican candidate John McCain felt compelled to admit he had been “wrong” to oppose a holiday honoring Dr. Martin Luther King, Jr.

Next phase begins in battle over Iowa spending cuts

The Iowa House approved a major “deappropriations” bill, House File 45, on January 19 by a party-line vote of 60 to 40. Republican leaders fast-tracked what they call the Taxpayers First Act, which passed the House Appropriations Committee on the third day of the 2011 session. The bill would cut dozens of programs while increasing spending in a few areas. In addition, $327.4 million from this year’s surplus revenue would go into a new “Tax Relief Fund,” instead of being used to help close the projected budget gap for fiscal year 2012. This bill summary (pdf) lists the budget cuts and supplemental appropriations in House File 45. Click here for the full bill text.

Although the majority of speakers at a January 18 public hearing opposed the bill, and organizations lobbying against the bill outnumber those that have signed on in support, the House Republicans passed the bill with few significant changes. Democrats offered many amendments as floor debate went late into the evening on January 19, trying to save funds for the statewide voluntary preschool program, passenger rail, smoking cessation programs, and sustainable communities, among other things. Representatives rejected almost all those amendments on party-line votes. This page shows what amendments were filed, and the House Journal for January 19 contains the roll call votes.

House File 45 now moves to the Iowa Senate, which has a 26-24 Democratic majority. Democratic senators are likely to back increased expenditures for mental health services and indigent defense while opposing many of the spending cuts. Republicans set to axe Power Fund, Values Fund

Incoming Iowa House Speaker Kraig Paulsen discussed plans for shrinking state government in a December 8 speech. Rod Boshart has the story:

“You should us expect us to make some tough choices,” Paulsen told a Des Moines Partnership lunch crowd. “I think you’re going to see us just wholesale eliminate a couple difference programs and a couple different offices and we’re going to start with those that have marginal or no benefit.

The incoming House leader said voters sent a clear signal that government at all levels is growing too big too fast, regulating too much, and spending and taxing too much – issues the reconfigured House plans to address next session.[…]

The Power Fund has been administered by the Iowa Office of Energy Independence in conjunction with the Iowa Power Fund Board, two entities that were created when the program was enacted in the 2007 legislative session.

Paulsen also said he would prefer to replace the Grow Iowa Values Fund, started by former Gov. Tom Vilsack, with “things that would grow the economy” under the new public-private partnership envisioned by Governor-elect Terry Branstad [….]

Paulsen’s premise is incorrect. Iowa’s state government has not been growing during the past decade; on the contrary, general fund spending has fallen as a share of the economy and of personal income. But that’s a subject for another day.

House Republicans have advocated cutting the Power Fund for some time, and doing so would theoretically save $25 million per budget year. According to Boshart, the Values Fund received $45 million in fiscal year 2010 and $38 million for fiscal year 2011. I don’t believe the real savings will be nearly so large, because too many business interests have benefited from Values Fund and Power Fund grants. Lobbyists will work to ensure that significant funding for business support remains under a different department or program.

In addition, the Iowa Senate, which is under Democratic control, may insist that the state continue to invest significant resources in renewable energy. Senate Majority Leader Mike Gronstal said last month,

If [R]epublicans have another approach that will help keep us at the forefront of renewable energy in this state and clean energy and green energy we’re completely open to looking at that. It doesn’t have to be called a power fund, it doesn’t have to be called I-jobs.

I will say this: cutting the Power Fund is more realistic than some other big savings proposed by House Republicans in the past. I expect Paulsen will be disappointed by the Legislative Services Agency’s analysis of how much can truly be saved by privatizing the state vehicle fleet or denying benefits to undocumented immigrants. The Iowa Senate will block efforts to eliminate the preschool program, although some money may be saved by means-testing that program, as Governor-elect Terry Branstad has advocated. Last year’s government reorganization already improved efficiencies in state purchasing.

One old Republican idea I haven’t heard Paulsen mention lately is implementing “the Principal Plan” to impose salary cuts on non-union state employees. House Republicans have called for requiring the governor to negotiate pay reductions on a sliding scale, from 2 percent for employees earning less than $40,000 per year up to a 10 percent salary reduction for those earning more than $100,000. Who's who in the Iowa Senate for 2011

Iowa Senate Democratic leaders announced committee assignments on December 6. After the jump I’ve posted details on the leadership team and committee chairs. Asterisks are next to the names of all Democrats who were elected to four-year terms in 2008 and therefore will be up for re-election in 2012. Redistricting will force some Democrats who were just elected this year to be on the ballot again in two years, but until the new map is approved, we won’t know where the extra elections will take place.

Democrats currently hold 26 of the 50 Iowa Senate seats. Republicans hold 23 seats, and a special election will be held in Senate district 48 in January. News roundup on Iowa revenues, taxes and budgeting

Iowa’s three-member Revenue Estimating Conference again raised projections for state revenues during the current fiscal year and fiscal year 2012, following another month of growing state tax collections in November. The news hasn’t deterred Republican leaders from planning mid-year budget cuts, and legislators from both parties acknowledged the end of federal stimulus funds will make the next budget year difficult. Gronstal re-elected leader and other Iowa Senate news

The Iowa Senate Democratic caucus on November 14 re-elected Mike Gronstal as majority leader and Jack Kibbie as Senate president. Five senators will serve as assistant majority leaders: Joe Bolkcom of Iowa City, Bill Dotzler of Waterloo, Wally Horn of Cedar Rapids, Amanda Ragan of Mason City, and Steve Sodders of State Center. Linn County Supervisor Brent Oleson got Iowa Republicans excited on Saturday by tweeting that Horn would challenge Gronstal, but according to this Des Moines Register report by Jennifer Jacobs, “No one mounted a challenge for either leadership role, several senators said.”

Iowa House and Senate results nearly final

County auditors have been certifying election results this week, and the Iowa House is almost certain to be split 60-40 in favor of Republicans. Three seats were determined by extremely narrow margins. Democrat Donovan Olson does not plan to seek a recount in House district 48, where he trails Chip Baltimore by fewer than 30 votes. Republican Roger Arthur does not plan to seek a recount in House district 18, where he finished 36 votes behind Andrew Wenthe. Republican Lannie Miller has not decided whether to ask for a recount in House district 7, but John Wittneben’s margin of 32 votes is unlikely to be overturned in a recount.

The Iowa Senate is headed for a 26-24 Democratic majority. Certified election results put Democrat Keith Kreiman 12 votes behind Mark Chelgren in Senate district 47, while Democrat Tod Bowman is 71 votes ahead of Andrew Naeve in Senate district 13. If I were Kreiman, I would ask for a recount to be sure, but even a tiny margin of 12 votes (0.06 percent of the votes cast in that Senate race) probably wouldn’t be reversed.

Jennifer Jacobs reported in the Des Moines Register,

Election results show that voters angry about the Iowa Supreme Court’s gay-marriage ruling played a role in defeating Kreiman.

In 2006, Kreiman won 71 percent of the votes in his home county, Davis County. This year, 774 more Davis County residents voted on judicial retention than in 2006.

Davis County was one of seven counties where the anti-retention vote was above 70 percent.

I suspect Mariannette Miller-Meeks’ strong Congressional campaign played at least an equally important role in Chelgren’s win. Senate district 47 includes Miller-Meeks’ home base, the Ottumwa area, and she worked extremely hard all year.

Senate Republican leader Paul McKinley tried to psych out Democrats this week by saying he has “thought about” trying to convince state senators to switch to the GOP: “I think there are individuals that we know that clearly were put in tough situations over the past two or three years and might be more prone to that, but we thought about it. We’ll analyze where we are and proceed accordingly.”

Two Democrats flipping together could give Republicans a majority in the upper chamber, but I very much doubt that will happen. The moderate Democrats in the Senate caucus have more pull with Senate Majority leader Mike Gronstal than they would as junior members of a Republican majority. Also, it’s not as if McKinley could promise party-switchers a smooth ride to re-election. U.S. Representative Parker Griffith of Alabama got crushed in a GOP primary this year after deserting the Democratic Party. An incumbent in a vulnerable Iowa Senate seat would not survive a Republican primary after voting for I-JOBS and all four of Chet Culver’s budgets.

Is failure on gay marriage more valuable to Republicans than success?

Senate Democratic Leader Mike Gronstal promised this week to block an Iowa Senate vote on a constitutional amendment to ban same-sex marriage, even if a majority of senators sign a petition asking for a vote. The Republican reaction to Gronstal’s comments makes me wonder whether gay marriage will be in the coming decade what the death penalty was to Iowa Republicans in the 1980s and 1990.

Reinstating the death penalty was a major theme in all of Terry Branstad’s previous election campaigns. But as governor he didn’t deploy his political capital to push that bill through the state legislature, even when Republicans controlled both chambers during his last two years in office. Many Iowa Democrats believed Branstad valued having the issue to run on more than he cared about the policy.

In light of Tuesday’s election results, Republicans sound surprisingly resigned to failure on passing a marriage amendment in the new legislature.

First take on the Iowa House and Senate results (updated)

Democrats suffered big losses in the Iowa House and Senate last night. Assuming no results change through recounts, the House is likely to switch from 56 Democrats and 44 Republicans to 59 Republicans and 41 Democrats. I’ve seen some online references to a 58-42 split, but that’s not how the count looks based on unofficial results posted on the Secretary of State’s website.

Democrats maintain control of the Iowa Senate, but their majority shrank from 32-18 to 27-23. Governor-elect Terry Branstad should easily be able to get his agenda through the Iowa House, and Senate Majority Leader Mike Gronstal may have trouble keeping his caucus united.

UPDATE: Late returns could change the outcome in two Senate seats; it’s possible the chamber could have a 25-25 split, or a 26-24 Democratic majority.

SECOND UPDATE: A few more races could switch as more absentee ballots come in. As of Wednesday evening, Democrat Tom Schueller is now trailing in House district 25 by about 150 votes.

Marriage equality anniversary thread

One year ago today, the Iowa Supreme Court’s Varnum v Brien ruling went into effect. From April 27, 2009 through the end of last year, at least 1,783 same-sex couples received marriage licenses in Iowa. The real number is probably higher, because about 900 marriage licenses did not specify the gender of the couple involved. Despite a petition drive led by some Iowa Republicans and the Iowa Family Policy Center, not a single county recorder denied a marriage license to a same-sex couple.

Although all three Republican candidates for governor say they want to overturn the Varnum v Brien ruling, marriage equality is probably here to stay. Conservative groups are not urging voters to pass a ballot initiative calling for a constitutional convention, which would be the quickest path to amend the Iowa constitution. Bob Vander Plaats probably won’t win the Republican nomination for governor, much less the November election, and even if he did, his plan to halt gay marriage by executive order is a non-starter.

That leaves the self-styled defenders of traditional marriage one path: approving an amendment restricting marriage rights in two separately elected Iowa legislatures, then convincing a majority of Iowans to vote for that amendment (in November 2014 at the earliest).

Republicans have an outside shot at winning a majority in the Iowa House in 2010, but they have virtually no chance of taking back the Iowa Senate this year. Democrats currently hold a 32-18 majority in the upper chamber. A net gain of four or five seats is the best-case scenario for the GOP, and I consider a net gain of two or three seats much more likely. That leaves Senate Majority Leader Mike Gronstal in a position to block all efforts to bring a constitutional amendment on marriage to a floor vote during the 2011 and 2012 legislative sessions.

Gubernatorial candidate Rod Roberts claims he could force Democrats to allow a marriage vote. His plan is to veto all legislation, including the state budget, until the Iowa House and Senate have voted on a marriage amendment. I doubt a Republican could win that game of chicken even if Governor Chet Culver is defeated this November. Polling indicates that most Iowans are not eager to ban gay marriage and think the state legislature has more important things to do. Anyway, the most likely Republican nominee, Terry Branstad, has an incoherent position on gay marriage and probably would make only a token effort to get a constitutional amendment passed.

Republicans fail to bring marriage amendment to Iowa House or Senate floor

Republicans in the Iowa House and Senate failed this morning to force floor votes on a constitutional amendment to ban same-sex marriage. In the Senate, minority leader Paul McKinley asked colleagues “to sign a petition that would allow Senate Joint Resolution 2001, which would begin the process of amending the state’s constitution to ban same-sex marriage, to be brought to the Senate floor for a vote despite not being approved by a committee.” Only one of the 32 Iowa Senate Democrats (Tom Hancock) joined the 18 Republicans in signing this petition.

Later this morning, House Republicans tried a procedural maneuver that could have allowed a floor vote on House Joint Resolution 6 (a constitutional amendment on marriage) despite the fact that no House committee has approved it. The procedural motion needed 51 votes to pass, but only one Democrat, Dolores Mertz, voted with the 44 House Republicans. Mertz is a co-sponsor of the marriage amendment and votes consistently with Republicans on social issues.

Last April, two Democrats (Mertz and Geri Huser) joined with House Republicans on a similar procedural vote. Good for Huser for voting with the majority this time around. One House Democrat was absent today: Mark Kuhn, who also missed yesterday’s proceedings in the chamber. It seems likely that he is either sick or was unable to get to Des Moines from his home in rural Floyd County. North-central Iowa just got hit with another major winter storm.

House Republican leader Kraig Paulsen acknowledged today that opponents of marriage equality don’t have the 51 votes needed to force a vote this session in the Iowa House.

McKinley warned in a statement, “the voters this November will have an opportunity to decide if they are content with the continued Democrat obstruction and inaction.” Republicans keep saying they want to “let the people vote” on marriage. As it happens, this November Iowans will have an opportunity to pass a ballot initiative on convening a constitutional convention. Some Republicans want to take that route, but most are afraid to back a constitutional assembly. It seems like they want a campaign issue to use against Democrats more than they want to amend the constitution by the quickest means possible.

Unfortunately for Republicans, recent polling data suggests gay marriage is not a high priority for most Iowans. Every statehouse Democrat should be echoing the words from House Speaker Pat Murphy’s official statement today:

“In these tough economic times, Iowans want the Legislature to keep focused on help for middle class families and small businesses.  In this shortened session, my goal is to keep the House focused on key priorities — balancing the state budget without raising taxes while creating good-paying jobs for Iowans and making sure every child receives a quality education and affordable health care.”

Murphy and Iowa Senate Majority Leader Mike Gronstal strongly supported the Iowa Supreme Court’s Varnum v Brien ruling, and they deserve a lot of credit for holding their caucuses together today. As Gronstal has promised, Republicans will not succeed in writing discrimination into our state’s constitution.

In related good news, the New Hampshire House Judiciary Committee voted down two bills today that were aimed at repealing same-sex marriage rights in that state.

The House spent almost 30 minutes on a rarely used “call-of-the-House” in which each of the 100 members were ordered into the chambers to vote unless they were previously excused.  

Hancock explained why he joined the Senate Republicans as follows: “I live in a highly Catholic area and I think that’s what the folks wanted me to do […] I never received that many contacts to say not to.”

Pat Murphy said Republicans “can go ahead and use” the House vote in the upcoming campaign, but added, “I would advise Republicans that ‘It’s the economy, stupid.’”

Culver "Condition of the State" speech thread

Governor Chet Culver addresses the Iowa House and Senate this morning. Kathie Obradovich’s latest column emphasizes that Culver has broken with tradition this year by not submitting his draft 2011 budget to lawmakers before the big speech. (The governor submitted a draft budget for fiscal year 2010 in late December 2008.) Obradovich concludes that Culver needs to be in the “spotlight” without focusing on the budget.

She doesn’t mention other factors that seem likely to have delayed the budget draft. The Tax Credit Review Panel, which Culver appointed after the film tax credit fiasco, only just submitted its recommendations on January 8. I can’t imagine how the governor’s staff would put together a draft budget without knowing which tax credits deserve to be continued, scaled back or eliminated. Another possible source of delay is the State Government Reorganization Commission made up of Iowa House and Senate members, which voted on a list of cost-saving measures last month. Those measures would affect assumptions on state spending in the coming fiscal year.

Republican former governor Terry Branstad bragged to Obradovich that he always submitted his budgets early, adding that state legislators now face a shorter session without having the budget in hand.

However, Senate Majority Leader Mike Gronstal told Radio Iowa this week that lawmakers will move a major bill on reorganizing state government before they start work on next year’s budget. It makes sense, because you can’t make accurate spending projections without knowing how state agencies will be restructured.

I’ll update this post later with more details of Culver’s speech.

UPDATE: The Burlington Hawk Eye posted the transcript. He asked legislators “to pass a supplemental appropriations bill early this session to restore some of the cuts to the Department of Public Defense” (Culver cut the current-year budget across the board in October.) For the fiscal 2011 budget, Culver asked lawmakers “to fully fund community college job training, and to adequately fund the Department of Workforce Development. Year in review: Iowa politics in 2009 (part 2)

Following up on my review of news from the first half of last year, I’ve posted links to Bleeding Heartland’s coverage of Iowa politics from July through December 2009 after the jump.

Year in review: Iowa politics in 2009 (part 1)

I expected 2009 to be a relatively quiet year in Iowa politics, but was I ever wrong.

The governor’s race heated up, state revenues melted down, key bills lived and died during the legislative session, and the Iowa Supreme Court’s unanimous ruling in Varnum v Brien became one of this state’s major events of the decade.

After the jump I’ve posted links to Bleeding Heartland’s coverage of Iowa politics from January through June 2009. Any comments about the year that passed are welcome in this thread.

Although I wrote a lot of posts last year, there were many important stories I didn’t manage to cover. I recommend reading Iowa Independent’s compilation of “Iowa’s most overlooked and under reported stories of 2009,” as well as that blog’s review of “stories that will continue to impact Iowa in 2010.”

Terry Branstad's accountability problem

For a guy who claims to be proud of his record, former governor Terry Branstad sure has a funny way of showing it.

On one issue after another, Branstad takes credit for things he didn’t do and evades responsibility for things he did. So, the governor who kept two sets of books boasts about enacting budget reforms that that other people pushed in response to his fiscal mismanagement.

The governor who used state bonding more than once says that politicians who create debt should be voted out of office.

Pressed on his record of expanding gambling in Iowa, Branstad has suggested he had little choice in the matter: “What was I supposed to do? Over 70% of the people wanted it even though I was personally opposed to it.”

Now Branstad is playing the same game on the Road Use Tax Fund and the idea of eliminating federal deductibility from Iowa’s tax system.
