Iowa Supreme Court dismisses defamation case based on 2010 political ad

Today the Iowa Supreme Court unanimously dismissed a defamation case filed by Republican State Senator Rick Bertrand over a 2010 negative television ad. You can read the full ruling here (pdf). I’ve posted a few excerpts below.

The Iowa Democratic Party ran the ad on behalf of Democratic candidate Rick Mullin shortly before the 2010 general election. Bertrand immediately filed a defamation lawsuit, in what I assumed was a stunt to change the media narrative. However, he pursued the case after winning the Iowa Senate race. In 2012, a jury decided in favor of Bertrand and awarded him $231,000 in damages. Later, a district court judge reduced the damages to $50,000 but determined that the tv ad constituted “implied libel.” The judge concluded that several statements in the commercial, though technically accurate, created a misleading impression about Bertrand. Both sides appealed to the Iowa Supreme Court. Mullin and the Iowa Democratic Party asked the justices to overturn the original verdict, while Bertrand defended his libel claim and objected to the damages being reduced.

I always expected the verdict to be overturned on appeal, because of extensive case law supporting strong protections for political campaign speech, as well as a high bar for any public figure claiming defamation (libel or slander).

Chief Justice Mark Cady cited many judicial opinions in his ruling, joined by Justices Thomas Waterman, Daryl Hecht, Bruce Zager, and David Wiggins. Justices Edward Mansfield and Brent Appel recused themselves from this case for reasons Bleeding Heartland discussed here. During the oral arguments in January, some observers thought Waterman sounded sympathetic to Bertrand’s attorney–which goes to show comments made during oral arguments don’t necessarily reflect the way a judge will decide a case.

This morning, Bertrand told the Des Moines Register, “The Iowa Supreme Court failed the people of Iowa and they failed the nation today. They did not show the courage to really say no to lies and corruption in politics.” Iowa Senate Majority Leader Mike Gronstal released the following statement: “We are pleased with the decision by the Iowa Supreme Court. The decision affirms our original position: the communication in question was factually accurate and protected free speech.”

Highlights from this year's Iowa Senate votes on Branstad nominees

During the 2014 legislative session, the Iowa Senate confirmed all but a handful of Governor Terry Branstad’s more than 200 nominees for state boards and commissions. It’s not unusual for senators to vote down one or two appointees, but this year the Senate confirmed everyone who came up for a vote on the floor.

The only close call was former Iowa House Republican Nick Wagner, confirmed to the Iowa Utilities Board last month with just one vote to spare. Branstad originally named Wagner to the three-member utilities board in 2013 but pulled his nomination when it became clear that senators would not confirm him. Branstad named Wagner to that board anyway, right after the Senate adjourned for the year in 2013. By the time his nomination came up for consideration this year, a couple of factors that worked against him were no longer relevant. Former State Senator Swati Dandekar had resigned from the board to run for Congress, so there would no longer be two of three members from Marion (a Cedar Rapids suburb). Furthermore, Branstad named attorney Sheila Tipton to replace Dandekar, so senators could no longer object to the lack of a lawyer on the Iowa Utilities Board.

Still, most of the Democratic caucus opposed Wagner’s nomination. State Senator Rob Hogg cited the nominee’s support for a bad nuclear power bill that the legislature considered a few years back. Meanwhile, State Senator Matt McCoy (who incidentally wanted to pass the nuclear bill) noted that as a key Iowa House Republican on budget matters, Wagner “was not willing to listen” and “took very difficult and very hard-line positions.” After the jump I’ve posted the roll call on the Wagner nomination; 11 Democrats joined all 24 Republicans to confirm him.

As in recent years, the governor withdrew a handful of nominees who were not likely to gain at least 34 votes (a two-thirds majority) in the upper chamber. A few nominees for low-profile boards had to go because of party imbalance issues. Chet Hollingshead, one of seven Branstad appointees to the Mental Health and Disability Services Commission, never came up for a vote, presumably because of a theft incident Bleeding Heartland user Iowa_native described here.

I am not sure why Senate Majority Leader Mike Gronstal informed Branstad that Jason Carlstrom was unlikely to be confirmed as chair of the Iowa Board of Parole. The governor first appointed Carlstrom to that position in the summer of 2012, to fill out the remainder of someone else’s term. The Iowa Senate unanimously confirmed him during the 2013 legislative session. When Branstad reappointed Carlstrom to the parole board this year, I didn’t expect him to run into any trouble. I will update this post if I learn more details.

The highest-profile nominee withdrawn by Branstad was former Iowa House Republican Jamie Van Fossen, whom the governor wanted to chair the Public Employment Relations Board. Cityview’s Civic Skinny described the backstory well; I’ve posted excerpts after the jump. Van Fossen still serves on that board, having been confirmed to a full term in 2012. But the new chair will be Mike Cormack, a Republican who served four terms in the Iowa House and later worked for the State Department of Education. Senators unanimously confirmed Cormack last month. The outgoing Public Employment Relations Board chair, Jim Riordan, has alleged that the board faced political pressure from Branstad staffers to hire an employer-friendly administrative law judge.

Weekend open thread: End of 2014 legislative session edition

What’s on your mind this weekend, Bleeding Heartland readers? This is an open thread: all topics welcome.

The Iowa legislature got out of town on May 2, 110 calendar days after the 2014 session began. That’s ten days after lawmakers’ per diem payments ran out but earlier than in any year since 2010, when Democrats held majorities in both chambers. After the jump I’ve posted closing remarks delivered by the top Iowa Senate Democrats (Majority Leader Mike Gronstal and President Pam Jochum) and the top Iowa House Republicans (Speaker Kraig Paulsen and Majority Leader Linda Upmeyer). A series of posts next week will focus on some of the more significant legislative results from the session, as well as important bills that never did pass.

I’ve also enclosed Gronstal’s prepared remarks on the final Iowa Senate vote of the session: granting subpeona power to the Government Oversight Committee to continue investigating various scandals in Governor Terry Branstad’s administration. Gronstal emphasized that the resolution is “narrowly drafted” and “not a criminal investigation. The goal is not to convict people. The only goal is to find out what went wrong [in state government] and how to fix it.” The resolution passed by voice vote just before the Senate adjourned on Friday morning. Iowa Senate Minority Leader Bill Dix blasted what he called a “dangerous” and “underhanded partisan move.” He claimed the “disruption of separation of powers” will invite “a state constitutional crisis,” and that the Oversight Committee’s investigation is politically motivated.

Finally, in non-legislative news, Patrick Caldwell reported for Mother Jones this week on a remarkably shady deal involving Danny Carroll in 1996. At the time, Carroll was a real estate agent in the Grinnell area and an Iowa House Republican. He currently chairs the Republican Party of Iowa–though probably not for much longer. After reading Caldwell’s piece, I want to know why anyone supposedly committed to Christian values would participate in a scheme to take advantage of an elderly widow with debts.

Branstad, key Iowa House Republicans more open to medical cannabis

Governor Terry Branstad has opposed efforts to legalize marijuana for medical use in Iowa, but on Monday he he signaled that he is open to taking a small step forward this year.

[I]t looks like we could end up with something that’s very limited in focus, like as passed recently in Utah and Alabama,” Branstad said. “I’m certainly working with legislators to see if there’s a possibility to work something out on that before the legislature adjourns.”

The new Utah law allows extract in oil form, but not smoking marijuana to treat a medical condition. Along the same lines, James Q. Lynch reported stunning news: Iowa House Public Safety Committee Chair Clel Baudler is open to legalizing the use of medical cannabis, in oil form. After meeting with parents whose children suffer from seizure disorders, Baudler said, “These little kids are taking some drugs that are really hot […] So if we educate ourselves and possibly we can give them some relief, that’s a good thing.”

Last summer, Baudler bragged that he would wear as a “badge of honor” his designation as one of the country’s ten worst state legislators, according to the Marijuana Policy Project.

He and Iowa House Speaker Kraig Paulsen indicated that to have any chance of passing the Republican-controlled House, a bill to legalize the use of cannabis would have to exclude marijuana that can be smoked. That will disappoint Iowans suffering from cancer, severe pain, or debilitating chronic diseases like multiple sclerosis. Smoking marijuana can ease nausea and other symptoms in such patients. Speaking to Lynch, Baudler said people who want to use cannabis to treat conditions other than seizure disorders should “Move to Colorado.”

Even limited progress on this issue is welcome, but I hope Iowa lawmakers will move forward with a broader study of medical cannabis programs.

UPDATE: Iowa Senate Majority Leader Mike Gronstal is willing to help “move a limited bill on medical cannabis oil forward.” Senate Minority Leader Bill Dix is non-committal for now.

Iowa legislative news roundup: dead and alive after the second funnel

The Iowa legislature’s second “funnel” deadline passed late last week. To remain eligible for debate during the remainder of this year’s session, most legislation needed to have passed one chamber as well as a committee in the other chamber. There are a few exceptions to the rule, namely appropriations bills and some tax measures. Rod Boshart listed the most significant “dead” and “alive” bills for the Cedar Rapids Gazette. The Iowa House Republican staff compiled a more comprehensive list of “second funnel survivors,” including bill summaries. The Iowa Senate Democratic staff highlighted the most important bills passed by the Senate that died in the House.

After the jump I’ve enclosed more links and some analysis on bills that died as well as those still under consideration. From my perspective, the most surprising casualty of the funnel was a bill to extend the statute of limitations for sex crimes against children (see the “safety and crime” section below).

Highlights from Branstad's 2014 Condition of the State address

Governor Terry Branstad delivered his annual “Condition of the State” address to Iowa lawmakers this morning. By Branstad’s standards, it was not a partisan speech. He drew several standing ovations from legislators in both parties, and it’s easy to imagine the Democratic-controlled Iowa Senate embracing most of the policies he advocated. In fact, immediately after the speech, Senate Majority Leader Mike Gronstal told Iowa Public Television’s Dean Borg that he “didn’t hear anything” he disagreed with. Gronstal did get in a quick jab at the governor, though, pointing out that Branstad hailed “predictability” for the state budget, which is what statehouse Democrats are seeking for school districts. During the last two years, House Republicans and Branstad have refused to comply with Iowa law requiring the legislature to set allowable growth levels for K-12 school districts a year in advance.

Stylistic note: for a guy who’s been in politics as long as Branstad has, he keeps his eyes glued to his script a lot. Experienced public speakers typically make more eye contact with the audience.

Iowa Republican lawmakers who voted for the last minimum wage increase

Iowa Senate President Pam Jochum and House Minority Leader Mark Smith both called for raising Iowa’s minimum wage in their opening remarks to fellow legislators yesterday. Increasing the minimum wage from the current level of $7.25 would raise earnings for roughly 332,000 Iowa workers, according to a 2012 estimate. It would acknowledge the reality that “the minimum wage does not keep a full-time worker out of poverty.”  

Governor Terry Branstad said last week that a minimum wage hike is “not part of my agenda,” suggesting that job training and efforts to attract high-skilled jobs would be sufficient. Iowa House Speaker Kraig Paulsen indicated that he sees a minimum wage increase as “[m]aking it harder to be an employer in the state of Iowa.”

However, appearing on Iowa Public Radio’s “River to River” program yesterday, Senate Majority Leader Mike Gronstal pointed out that Branstad signed a minimum wage increase during the 1980s and that Paulsen had voted for the January 2007 bill that raised the wage. On the same program, Iowa House Majority Leader Linda Upmeyer acknowledged that there may be support for a minimum wage increase in her caucus, since at least half of current House Republicans who were in the legislature in 2007 had voted for that minimum wage hike. Like Paulsen, Upmeyer was a yes vote. At the time, he was House minority whip and she was one of four assistant minority leaders.

Iowa’s last minimum wage hike was the first bill Governor Chet Culver signed into law. House File 1 sailed through, passing by 79 votes to 19 in the Iowa House and 40 votes to 8 in the Iowa Senate. All of the Democrats supported the bill. After the jump I’ve listed how all of the current Republican lawmakers voted on the minimum wage increase. Twelve supported the bill, thirteen opposed it, and one was absent for the 2007 vote.

Highlights from the first day of the Iowa legislature's 2014 session

The Iowa House and Senate convened today to begin the 2014 legislative session. All of the opening remarks reflected on key achievements of the 2013 session, such as compromise bills on commercial property tax cuts, education reform, and providing health care to low-income Iowans. All of the speeches called for more bipartisan work this year, and all stressed “pocketbook” issues such as improving education and building the middle class rather than social issues. But Republican and Democratic leaders take different priorities into the 2014 session.

I’ve summarized below the key points Iowa House and Senate majority and minority leaders raised today. I also enclosed lengthy excerpts and in some cases the full texts of their opening day speeches.

Click here for a tentative schedule of key dates during the 2014 legislative session. Lawmakers tend to finish their work earlier in election years than in odd-numbered years, but I highly doubt they will be ready to adjourn by March 30, as House Speaker Paulsen hopes. They will be lucky to finish work on the state budget by April 22, when lawmakers stop receiving per diem payments.

Mike Gronstal sees eight competitive Iowa Senate races

Iowa Senate Majority Leader Mike Gronstal is “fairly confident” going into this year’s state legislative elections, he told Mike Glover in a recent interview. He cited a “pretty good message” to take to voters as well as a “a slight advantage on the map” that will allow Democrats to play “a little less defense and a little more offense,” compared to 2012.

I agree with Gronstal that Democrats are better positioned now to hold their 26 to 24 majority in the upper chamber than they were at the same point two years ago. Follow me after the jump for a quick look at the eight districts the Senate majority leader expects to be targeted this fall.

Iowa Democratic leaders challenge ALEC membership claims

Iowa House Minority Leader Mark Smith and Iowa Senate Majority Leader Mike Gronstal both issued statements yesterday challenging a document that listed all 150 members of the Iowa legislature as members of the American Legislative Exchange Council (ALEC). The group lobbies for conservative and pro-corporate policies in state legislatures around the country, often submitting model legislation that lawmakers propose on their behalf.

In an open letter to ALEC’s executive director, Smith said none of the 47 Iowa House Democrats have applied to ALEC for membership or paid dues. He questioned “why ALEC would accept payment of dues on behalf of legislators who clearly want no part of your organization,” adding that it “likely” violates Iowa ethics law for “a corporation or other entity” to pay dues to ALEC on behalf of lawmakers. Gronstal’s statement, which is at the bottom of this post, describes ALEC’s claims as “deceptive and deceitful,” since none of the 26 Iowa Senate Democrats is a member of the organization.

New IA-03 Democratic candidate speculation thread

Time for a new thread on other Democrats who may join former State Senator Staci Appel and Gabriel De La Cerda as candidates for Congress in Iowa’s third district. Right now my best guess is that State Senator Matt McCoy will throw his hat in. He was planning to run for Congress in IA-03 way back in 2001, but he stood aside when Representative Leonard Boswell decided to move to Des Moines. McCoy has said previously (and confirmed again this week) that he would consider running for an open Congressional seat. He could raise substantial money as the chair of the Iowa Senate Commerce Committee and is well-known in the LGBT community as our state’s first out gay legislator. One complicating factor for McCoy: he is up for re-election next year in Iowa Senate district 21, covering parts of Des Moines and West Des Moines. He would have to give up his Senate seat in order to take a chance on IA-03.

Several other prominent Democrats contacted by the Des Moines Register indicated directly or through associates that they are thinking about this race, but I just don’t see former Governor Chet Culver, Polk County Democratic Party Chair Tom Henderson, former Des Moines City Council member Michael Kiernan or Dr. Andy McGuire following through.  

Any new Democrat who enters this primary will be playing catch-up. As of September 30, Appel’s campaign had nearly $200,000 cash on hand. Perhaps more important, her campaign sent out a press release on December 18 highlighting more than a dozen groups that are standing by their endorsements of her candidacy. I’ve posted that release after the jump. The loyal Appel endorsers include several labor unions, Planned Parenthood Voters of Iowa, EMILY’s List, and the LGBT advocacy group Human Rights Campaign.

Democrats who have ruled out a candidacy in IA-03 include Iowa Senate Majority Leader Mike Gronstal, State Senator Janet Petersen, and Boswell’s 2008 Democratic primary challenger Ed Fallon. The Des Moines Register’s Jennifer Jacobs mentioned Des Moines Mayor Frank Cownie and both Tom and Christie Vilsack as possible candidates, but I would be shocked if any of them ran for Congress next year.

Branstad, federal officials reach agreement on Medicaid expansion alternative

Governor Terry Branstad announced today that his administration and officials in the U.S. Department of Health and Human Services have struck a deal over the Iowa Health and Wellness Plan, our state’s alternative to a straightforward Medicaid expansion. Earlier this week, federal officials approved most of the proposal but rejected a provision that would have kicked some low-income Iowans off the plan if they failed to pay monthly premiums. Under the tentative agreement, Iowa would still be able to charge premiums to some people who did not meet wellness criteria, but those people would not lose coverage for not paying the premiums. A statement released by the governor’s office is after the jump.

Branstad had the option of appealing the HHS decision, and Iowa House Speaker Kraig Paulsen suggested yesterday that Iowa officials should fight for the whole plan state legislators approved in May. Iowa Senate Majority Leader Mike Gronstal argued that the governor should “take the deal” federal officials approved: “It wasn’t the whole nine yards, but it was about 8.9 yards. It was most of what we asked for.” Commenting on this evening’s news, Senate President Pam Jochum said, “Hallelujah. Amen. […] I can’t imagine the governor would have wanted to be held responsible for 55,000-plus people losing coverage come Jan. 1.”

Any relevant comments are welcome in this thread. Charging even small health insurance premiums to people making less than $11,000 a year is stupid in my opinion, but this compromise is better than no coverage for tens of thousands of Iowans.

P.S.- Can’t help noticing how just like the messaging from his re-election campaign, the governor’s press releases invariably mention Lieutenant Governor Kim Reynolds whenever possible. I doubt she played any role in these negotiations or the governor’s decision not to appeal the HHS decision on the Iowa Health and Wellness Plan.

IA-Gov: Mike Gronstal not running (updated)

Senate Majority Leader Mike Gronstal announced tonight that he will not run for governor in 2014. Gubernatorial candidate Bob Krause tweeted that Gronstal told the audience at the Pottawattamie County annual Democratic fundraiser that his Senate seat is needed to maintain the Democrats’ 26-24 Senate majority. IA-03 Congressional candidate Gabriel De La Cerda also reported Gronstal’s announcement. Gronstal has represented the Council Bluffs area in the Iowa Senate for many years and was just re-elected to another four-year term in 2012. Since he’s not up for re-election in 2014, he could have run for governor without giving up his seat. However, if he became governor a special election would be called in Senate district 8. Republicans hold both of the Iowa House seats in that district.

I am not surprised by Gronstal’s decision. I was more surprised when he said he was seriously considering the race. While I agree he could be a good governor, and other Democrats could be excellent Senate majority leaders, I would be concerned about finding another Democrat who could hol

UPDATE: Gronstal told Radio Iowa’s O.Kay Henderson that he made the decision in the last ten days, adding, “I think Terry Branstad is imminently [eminently] beatable. This is not the same Terry Branstad that was governor back in the ’80s who understood the spirit of compromise, so I think we have a much more ideological governor. I am confident we (Democrats) can find a candidate who will be able to beat him.”

Q-poll: Iowans approve of Branstad but feel he's been governor "long enough"

Governor Terry Branstad got good news and bad news from the latest Quinnipiac statewide poll, released today. The survey of 1,256 registered Iowa voters between July 15 and 17 found that Branstad is in positive territory with Iowans: 51 percent approve of his work as governor, while just 33 percent disapprove. Moreover, 50 percent of respondents have a favorable opinion of Branstad, while 37 percent view him unfavorably. Another good sign for the incumbent: 67 percent were either very or somewhat satisfied with “the way things are going in Iowa today”; just 31 percent said they were very or somewhat dissatisfied.

On the downside, just 43 percent of respondents said Branstad deserves to be re-elected; 46 percent said he does not. About 54 percent said the governor “has been in office long enough,” while 37 percent said he should seek another term.

No one’s going to panic at Terrace Hill over this poll. Thinking abstractly that Branstad should retire is different from choosing to vote for someone else. Clearly many people in that “long enough” group like Branstad and think he’s doing a decent job. I doubt those people would vote for a challenger unless they felt that Branstad was physically unable to serve for another four years.

The potential Democratic candidates for governor are mostly unknown to Iowa voters. About 77 percent of Quinnipiac’s respondents haven’t heard enough about Senate Majority Leader Mike Gronstal to form an opinion, 85 percent said the same about State Senator Jack Hatch, and 92 percent said the same about State Representative Tyler Olson.

Olson’s campaign was quick to send out an e-mail blast touting the poll as proof that Iowans agree it’s “time for a new start in the Governor’s office.” I posted that message after the jump. I haven’t seen any comment from the Branstad campaign about the new poll, but I also enclosed below a statement released today touting the governor’s job creation efforts.

IA-Sen, IA-Gov: Highlights from the latest Public Policy Polling survey

Public Policy Polling has a new poll out on the Iowa governor and U.S. Senate races. Click here for Tom Jensen’s summary and here (pdf) for full results with questionnaire and cross-tabs. PPP surveyed 668 registered Iowa voters between July 5 and 7, producing a statistical margin of error of plus or minus 3.8 percent.

Highlights: both President Barack Obama (46/50) and Governor Terry Branstad (45/46) are slightly underwater on approval ratings. However, Branstad has double-digit leads over Senate Majority Leader Mike Gronstal, State Senator Jack Hatch, and State Representative Tyler Olson. Lieutenant Governor Kim Reynolds is much less known than Branstad and is tied with or barely ahead of the Democratic candidates in hypothetical gubernatorial match-ups.

In the Senate race, Democratic Representative Bruce Braley has higher name recognition than any of the Republicans and is more liked than disliked by Iowans who have an opinion about him (34 favorable/24 unfavorable). In head to head match-ups, he leads Matt Whitaker by 9 points, Sam Clovis, Joni Ernst and Mark Jacobs by 12 points, and David Young by 13 points.

Any relevant comments are welcome in this thread. I wouldn’t read too much into horse race polling 16 months before the election, especially since none of the Senate candidates are particularly well-known, nor are the Democrats running for governor. Braley polls about the same against any of the Republicans now, but as the campaign progresses I believe it will become apparent that certain GOP candidates have more upside than Clovis, for example.  

New IA-Gov speculation thread

Time for a new thread to discuss possible candidates for governor next year. I think we can all agree that Governor Terry Branstad will seek a sixth term, barring some unforeseen health problem.

Many Democrats expect State Representative Tyler Olson to announce his gubernatorial campaign soon now that he has stepped down as Iowa Democratic Party state chair. His resignation letter previewed the obvious case for his candidacy: time for a new generation to step up and lead. Olson is roughly the same age Branstad was when he ran for governor the first time in 1982.

Other Democrats who are either formally exploring or considering the governor’s race are closer to Branstad’s current age: former State Representative Bob Krause, State Senator Jack Hatch, Senate Majority Leader Mike Gronstal, and State Treasurer Mike Fitzgerald. After the jump I’ve posted Fitzgerald’s recent comments about a possible run for governor and a letter to the editor from Krause, who objects to being ignored by the Des Moines Register.  

State Senator Rob Hogg confirmed via e-mail this week that he will not run for governor in 2014 (or for Congress, U.S. Senate, or Iowa Secretary of State, he added). Hogg is up for re-election next year in Iowa Senate district 33, covering part of Cedar Rapids. He has been touring Iowa over the past month to promote his new book, America’s Climate Century: What Climate Change Means for America in the 21st Century and What Americans Can Do about It. I haven’t finished my copy yet, but it is readable and surprisingly optimistic in its call to action.

Five perspectives on Iowa's new property tax law

Yesterday Governor Terry Branstad traveled to Hiawatha, the home base of Iowa House Speaker Kraig Paulsen, to sign a wide-ranging bill on property taxes, income taxes, and the earned income tax credit. Senate File 295 passed both chambers of the Iowa legislature with bipartisan support. Tom Vilsack rules out IA-Gov candidacy

Radio Iowa’s O.Kay Henderson just tweeted a few minutes ago that according to U.S. Secretary of Agriculture Tom Vilsack’s spokesman Matt Paul, Vilsack “considered it” but won’t run for governor of Iowa next year. No one will be surprised by this news. It’s good for Vilsack to make it official as other Democrats consider challenging Governor Terry Branstad: Iowa Senate Majority Leader Mike Gronstal, State Senator Jack Hatch, Senate President Pam Jochum, State Treasurer Mike Fitzgerald, State Representative Tyler Olson, and former State Representative Bob Krause.

Any comments about the governor’s race are welcome in this thread.

IA-Gov: Des Moines Mayor Frank Cownie thinking about it (updated)

Des Moines Mayor Frank Cownie may seek the Democratic nomination for governor, Graham Gillette reported at Iowa Watchdog today.

Cownie has courted both Republicans and Democrats in recent weeks and appears ready to jump into the fray. Cownie has called [Governor Terry] Branstad vulnerable and [State Senator Jack] Hatch unelectable, giving him a shot at taking over Terrace Hill.

Cownie said he believes his record will attract Iowa voters. Hatch and Branstad are seen as state political insiders. Cownie sees himself as the person with executive experience capable of bringing something new to the governor’s office, he said.

Cownie and Hatch could easily split the Polk County Democratic vote, leaving the door open for a candidate from another part of the state. Des Moines is Iowa’s most populous city, but it’s not nearly large enough to dominate a statewide primary. Both Hatch and Cownie are strong on many progressive issues. Cownie was first elected mayor in 2004 after serving two years on the Des Moines City Council.

Any comments about the governor’s race are welcome in this thread.

UPDATE: Then again, maybe he won’t. Cownie told the Des Moines Register’s Jennifer Jacobs Friday afternoon, “the rumors of my running for governor at this moment are greatly exaggerated.”

Meanwhile, Senate Majority Leader Mike Gronstal will “make a decision before the end of the summer” about running for governor.

Last-minute Iowa legislative scramble is nothing to brag about

The Iowa Senate wrapped up its work for the year shortly after midnight on May 23, and Iowa House members adjourned about 11 hours later. Lawmakers in both parties have been congratulating themselves for compromising on some big issues that ended in stalemate the previous two years. Rod Boshart compiled an excellent list of what the legislature did and didn’t approve during 2013.

We all can appreciate the desire to finish a big project before a holiday weekend, and since legislators stopped receiving per diem payments weeks ago, they understandably wanted to get out of town as quickly as possible. However, I found it disturbing that votes were held before most lawmakers, let alone members of the public, had time to digest final conference committee deals on education reform, an alternative to Medicaid expansion, property taxes, and the health and human services budget. Transparency isn’t just a buzzword. Had journalists and advocacy groups been able to look over the last-minute compromises, people might have discovered problematic language or even simple drafting errors, which could produce unintended consequences after Governor Terry Branstad signs these bills into law.

I have a lot of questions about the final education reform bill and the plan to provide health insurance to low-income Iowans, particularly those earning between 101 percent and 138 percent of the poverty level. I also need more time to sort through the budget numbers and final changes to the standings bill. After the holiday weekend Bleeding Heartland will examine the important results of the legislative session in more detail. For now, I’ve posted after the jump details on who voted for and against the major bills approved this week.

UPDATE: In the May 24 edition of the On Iowa Politics podcast, statehouse reporters Mike Wiser and James Lynch discussed how the big issues came together “behind closed doors,” with no public scrutiny or oversight. Lynch commented that to his knowledge, the conference committee named to resolve the impasse over Medicaid expansion never formally met, except perhaps for one organizational meeting. Lynch recounted one occasion when Iowa House Republican Dave Heaton was briefing journalists about the health care talks, and the journalists asked when that happened, since there hadn’t been any public notices of conference committee meetings. According to Lynch, Heaton replied, “We’re not having meetings, but we’re meeting.” Senate President Pam Jochum said that negotiations between Democratic State Senator Amanda Ragan and House Majority Leader Linda Upmeyer produced the “key to Iowa’s health care compromise.” Notably, Upmeyer didn’t have a prominent role in passing the House health insurance plan, nor was she named to the conference committee assigned to merge the House and Senate proposals.

Speaking to journalists on May 22, Senate Majority Leader Mike Gronstal and Jochum weren’t able to answer a specific question about compromise wording reached regarding Medicaid coverage of abortions. That was no minor issue–it was the last sticking point holding up approval of the health and human services budget. In effect, Gronstal told journalists, you can see the wording after the final bill is published.

U.S. Appeals Court strikes down Arizona's 20-week abortion ban

During the 2011 legislative session, Iowa House Republicans approved a ban on most abortions after the 20th week of pregnancy. Several attempts by Republicans to bring that bill to the floor in the Iowa Senate failed. At the time, Senate Majority Leader Mike Gronstal warned that the House legislation “invites a very serious court challenge” and violates a woman’s “right to make her own personal, private decision about abortion without the interference of politicians.” After the original bill died in the upper chamber, the Iowa House passed an even more restrictive ban on abortions after 20 weeks gestation (which is equivalent to about 18 weeks post-fertilization). Governor Terry Branstad supports efforts to ban abortion after 20 weeks in Iowa, but as long as the Iowa Senate remains under Democratic control, such legislation will not advance here.

Many other states have passed versions of a ban on late-term abortions. Yesterday a Ninth Circuit U.S. Appeals Court panel struck down the law Arizona adopted in 2012. The three judges (including one conservative appointed by a Republican president) agreed that the law violates a woman’s constitutional rights.

Tax bargain is "Christmas for Walmart," raw deal for most Iowans (updated)

Iowa House and Senate conference committee negotiators appear to have struck a grand bargain on taxes. I haven’t seen any press release on the agreement yet from Senate Democrats, so I don’t know whether there is consensus in the caucus for the deal. But both Senate Majority Leader Mike Gronstal and Minority Leader Bill Dix are backing the compromise, as is House Speaker Kraig Paulsen.

After the jump I’ve posted commentary on the deal and a memo outlining the details. The bulk of the tax cuts will go to commercial property owners, but I see no evidence that the majority of small business operators (who rent rather than own property) will benefit at all. Democrats are getting the earned income tax credit increase they’ve been trying to pass for years, and that’s an important issue. However, the same vulnerable populations that benefit from the earned income tax credit will bear the brunt of the state and county service cuts that will likely happen as the commercial property tax reductions are phased in.  

I haven’t had my eye on property taxes during this year’s legislative session, because I assumed no compromise would be found between the very different bills favored by Iowa House Republicans and Iowa Senate Democrats. A recent analysis by the Iowa Fiscal Partnership showed that the Democratic approach was better for commercial property owners “with less than $622,500 valuation in property,” while larger businesses (such as national retailers or real estate trusts) would do better under the GOP plan. That must-read study also undercut the case for any urgency to reduce property taxes in Iowa.

Any relevant thoughts are welcome in this thread. UPDATE: Added some comments from Iowa legislators and information about a loophole that could disqualify a lot of commercial property from the tax reduction.

Another Iowa legislative victory for Big Ag

Factory farm advocates failed in 2009 to circumvent the Iowa DNR’s rulemaking on applying manure over frozen and snow-covered ground. Then they failed in 2010 to win passage of a bill designed to weaken Iowa’s newly-adopted regulations on manure storage and application.

But this year, the Iowa Pork Producers Association succeeded in convincing state lawmakers to relax requirements for CAFO operators to be able to store their own manure properly. All they had to do was dress up their effort as an attempt to help families with aspiring young farmers.

Iowa Medicaid expansion news roundup (updated)

Last week Governor Terry Branstad finally introduced legislation to enact his Healthy Iowa Plan instead of the Medicaid expansion foreseen under the 2010 federal health insurance reform law. Strangely, neither the governor’s office nor the Iowa House Republican caucus held a news conference or even posted a press release about House Study Bill 232. The bill arrived at the statehouse on Thursday, April 4, after many legislators had left for the weekend.

So far House and Senate Republicans appear united behind Branstad’s approach, while the governor’s office strives to counter the obvious case against his plan (costs more, covers less). I’ve posted arguments for both sides and other news links after the jump.

IA-Sen: Most Democratic state legislators endorse Braley

Representative Bruce Braley’s campaign for U.S. Senate rolled out its largest batch of endorsements today: 71 state legislators. All 26 Iowa Senate Democrats plus 45 of the 47 Iowa House Democrats are named in the press release I’ve posted after the jump. For some reason, Iowa House Minority Leader Kevin McCarthy and former Iowa House Speaker Pat Murphy are not in this group. Murphy is running for the first Congressional district seat Braley is vacating.

Earlier this week, Braley’s campaign announced that it raised more than $1 million during the first quarter. That is a solid number, and I’ll be interested to see how the numbers break own (contributions from individuals vs PACs, for instance). Bleeding Heartland will publish a detailed roundup of Iowa Congressional fundraising after all the candidates have filed their reports with the Federal Election Commission. Those reports are due April 15.

Iowa House votes to relax manure storage rules for CAFOs (updated)

In an ideal world, evidence that more than half of Midwest rivers and streams can’t support aquatic life would inspire policy-makers to clean up our waterways. Rivers that are suitable for swimming, fishing, and other recreation can be a huge economic engine for Iowa communities.

We live in Iowa, where most of our lawmakers take the Patty Judge view: “Iowa is an agricultural state and anyone who doesn’t like it can leave in any of four directions.”

Yesterday the Iowa House approved a bill to relax manure storage regulations for large confined animal feeding operations (CAFOs). All of the House Republicans and two-thirds of the Democrats supported this bad legislation. Details on the bill and the House vote are below.

Iowa Senate approves Medicaid expansion along party lines

Last night the Iowa Senate approved Senate File 296, a bill to expand Medicaid, on a strictly party-line vote of 26 to 23. You can listen to the entire Senate debate (approximately 90 minutes) at Radio Iowa. I’ve posted highlights from the debate after the jump, along with the full list of 52 organizations that have registered their support for Senate File 296. Some corporations and organizations have have registered their lobbyists as undecided on Senate File 296, but at this writing, not a single organization is registered against the Medicaid expansion.

IA-Gov: Tom Vilsack thinking about a comeback?

U.S. Secretary of Agriculture Tom Vilsack may be thinking about running for Iowa governor again in 2014, according to one of his longtime friends.

UPDATE: Vilsack stopped by the Iowa capitol on February 19 to meet with statehouse Democrats. According to State Representative Marti Anderson, he came to “talk about the looming sequester in DC. and other Food, Farm, and Jobs issues from USDA.”

Branstad's new property tax plan and other Condition of the State news (updated)

Governor Terry Branstad just finished delivering his annual Condition of the State speech to Iowa House and Senate members. He unveiled a new property tax reform plan, which would cut commercial property taxes by 20 percent over four years. Previously the governor had called for cutting commercial property taxes by 40 percent. Branstad also urged legislators to approve the key points of education reform proposals he released yesterday. Finally, he outlined three policies that, in his view, would help Iowa become the healthiest state in the country.

Themes from the Iowa legislature's opening day in 2013

The Iowa House and Senate began their 2013 session yesterday with the usual welcoming speeches from legislative leaders and the ritual of choosing desks for each lawmaker in the chambers. Judging from this photo, returning legislators get first dibs.

As was the case in 2012, social issues like abortion and same-sex marriage were absent from the opening-day speeches. Republican leaders emphasized the need to cut both property and income taxes. Iowa House Speaker Kraig Paulsen also claimed credit on behalf of Republicans for Iowa’s improving fiscal condition. House Majority Leader Linda Upmeyer spent a fair amount of time criticizing Congress before calling for state action to improve education and cut taxes. House Speaker Pro Tem Steve Olson repeated some themes of last year’s election campaign and quoted U.S. Senator Marco Rubio of Florida. Similarly, Senate Minority Leader Bill Dix concentrated on tax reforms.

Senate Majority Leader Mike Gronstal focused on education and workforce training programs to address “Iowa’s skill shortage.” Senate President Pam Jochum focused on health-related issues: improve mental health services, helping elderly people stay in their own homes, and expanding Medicaid, which she described as “the biggest opportunity for this session to make a positive difference for Iowans.” Iowa House Minority Leader Kevin McCarthy emphasized the need for bipartisan work on a range of issues: education, mental health care delivery, the transition to a new maximum security prison, and protecting natural resources.

Who's who in the Iowa Senate for 2013

The Iowa legislature’s 2013 session opened today. After the jump I’ve posted details on the Iowa Senate majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Senate committees. Democrats hold a 26 to 24 majority in the upper chamber. The huge experience gap between the Iowa Senate caucuses is striking. Only seven of the 24 Republicans have served as lawmakers in either the House or Senate for more than four years, whereas 19 of the 26 Democrats have more than four years of legislative service. More proof smoking bans save lives

How about a little good news on a lousy day? A new study confirms previous research, which showed public smoking bans reduce hospitalizations for heart attacks and other life-threatening problems. The Iowa Smokefree Air Act, which went into effect in July 2008, has likely prevented many premature deaths.

UPDATE: The smoking ban was controversial while it was debated in 2008. Below I’ve listed all of the state legislators who had the courage to send that bill to Governor Chet Culver’s desk.

Iowa DNR director: Please help us stave off the EPA (updated)

Iowa Department of Natural Resources Director Chuck Gipp is asking for $1.3 million in additional state funding to help his agency hire eleven new livestock facility inspectors for next year. Gipp has been affiliated with agricultural interest groups throughout his career. He just endorsed a strategy on keeping nutrients of out waterways that was “fiercely criticized” by Iowa DNR staffers with the most expertise on farm runoff.

Why would Gipp suddenly ask for more DNR inspectors? According to his own testimony, he’s trying to keep the U.S. Environmental Protection Agency from enforcing Clean Water Act provisions against Iowa livestock farms.
