NRA's Iowa affiliate targeting four Senate Democrats

The Iowa Firearms Coalition, an affiliate of the National Rifle Association, has formed a political action committee that is targeting four Democratic-held Iowa Senate districts in its effort to strip power from “anti-gun Senate majority leaders.” The strategy is logical, because in recent years several high-profile gun bills died in the upper chamber after clearing the Republican-controlled Iowa House.

However, I was surprised to see a couple of Senate races missing from the Iowa Firearms Coalition PAC’s list.

Since the latest deadline for state legislative candidates to report to the Iowa Ethics and Campaign Disclosure Board passed on May 19, I’ve been going through the forms filed by incumbents or challengers in potentially competitive races.

Some of the contribution totals were much lower than I expected to see.

Heidi Heitkamp will keynote the Iowa Democratic Party's Hall of Fame dinner

Heads up, possible future presidential candidate spotters: U.S. Senator Heidi Heitkamp of North Dakota will speak at a major Democratic gathering in Des Moines on June 17. Alternating each summer between the capital city and Cedar Rapids, the Hall of Fame is typically the Iowa Democratic Party’s second-largest event of the year, after the to-be-renamed Jefferson-Jackson Dinner.

I enclose below today’s announcement from the Iowa Democratic Party and some background on Heitkamp, who was North Dakota’s attorney general before being elected to the U.S. Senate in 2012. Ticket sales (starting at $50) won’t be as brisk as for last summer’s event, which drew all five declared Democratic presidential candidates, but no doubt many activists will be interested to see Heitkamp in person. Her appearance may also draw some protesters, as she has been a “loud and proud” supporter of North Dakota’s oil extraction industry, and the proposed Dakota Access (Bakken) pipeline is a hot topic in this state’s environmental community.

This year’s Hall of Fame honorees include Senate Majority Leader Mike Gronstal in the elected official category, Iowa Federation of Labor President Ken Sagar as “outstanding supporter,” and State Representative Sharon Steckman for “oustanding leadership.” Scroll down to read the full list.

UPDATE: Should have mentioned that Heitkamp has the most conservative voting record in the Senate Democratic caucus, according to the Progressive Punch database. You can view ratings of votes on various types of issues here. Heitkamp has a “perfect” progressive record in only one category: fair taxation. As is common among Democrats representing tough states or districts, Heitkamp’s votes have become more conservative since Republicans gained a Senate majority (and therefore control over what comes to the floor).

Iowa families get promises but no guarantee on autism insurance coverage

Iowa families hoping for guaranteed insurance coverage of autism services will have to wait at least one more year. Despite Democratic efforts to add an autism coverage mandate to the health and human services budget for fiscal year 2017, the compromise approved on the final day of this year’s legislative session excluded such language. Instead, lawmakers increased state funding for various autism-related grants and programs.

According to the lead Republican negotiator on the human services budget, families affected by autism will have insurance coverage by January 2017 without a mandate, thanks to Wellmark Blue Cross/Blue Shield’s decision to sell policies through Iowa’s public insurance exchange. But those policies will not be available to Iowans living in dozens of counties, nor will they cover applied behavior analysis (ABA) interventions, which are effective but prohibitively expensive for many people with spectrum disorders.

Never let it be said that the 2016 Iowa legislature accomplished nothing

In four months of work this year, Iowa lawmakers made no progress on improving water quality or expanding conservation programs, funded K-12 schools and higher education below levels needed to keep up with inflation, failed to increase the minimum wage or address wage theft, let most criminal justice reform proposals die in committee, didn’t approve adequate oversight for the newly-privatized Medicaid program, opted against making medical cannabis more available to sick and suffering Iowans, and left unaddressed several other issues that affect thousands of constituents.

But let the record reflect that bipartisan majorities in the Iowa House and Senate acted decisively to solve a non-existent problem. At a bill-signing ceremony yesterday, Governor Terry Branstad and supporters celebrated preventing something that probably never would have happened.

Five red flags about the Iowa Democratic Party's Caucus Review Committee

The Iowa Democratic Party’s Caucus Review Committee will hold its first meeting “for purposes of organization” on Saturday, May 7. Members of the public may attend the event, which begins at 10 am at the Airport Holiday Inn (Iowa Conference Rooms B & C) at 6111 Fleur Drive in Des Moines. The meeting will likely run well into the afternoon as the 26 committee members hear from speakers including Republican Party of Iowa officials, who will share what they learned from their review of the 2012 caucuses.

Whether Iowa will ever be able to hold meaningful caucuses again is an open question. Democratic National Committee Chair Debbie Wasserman-Schultz has allies in national circles who share her belief that the party should require “simpler” and “more democratic” primaries for the purposes of presidential selection. If forced to abandon caucuses, Iowa would probably be relegated to the end of the nominating process in June, unless our state’s leaders manage to lobby for an earlier primary date.

Assuming the caucuses continue as an important event in presidential campaigns, the Iowa Democratic Party should address some of the current system’s major shortcomings. Based on what I’ve heard (and not heard) from various Caucus Review Committee members, the exercise seems destined to produce minor improvements in how the caucuses are managed, as opposed to big changes to address the caucuses’ disenfranchising and unrepresentative features.

Medicaid oversight bill passes Iowa Senate with bipartisan support

Since Terry Branstad returned to the governor’s office, the overwhelming majority of Iowa Senate votes on contentious political issues have fallen along strict party lines: 26 Democrats one way and 24 Republicans the opposite. However, the Branstad administration’s rush to privatize Medicaid has created space for bipartisanship, as a growing number of Republicans acknowledge the dangers of shifting to managed care for a program through which one in six Iowans access health services.

Last month, three GOP senators joined their Democratic colleagues to vote for a bill that would have halted Iowa’s Medicaid privatization. That legislation is going nowhere in the Republican-controlled state House, and federal officials recently approved waivers to allow the Iowa Department of Human Services to implement the managed care policy as of April 1.

Yesterday a quarter of the GOP state senators voted with all 26 Democrats for a Medicaid oversight bill that had cleared the Senate Human Resources Committee unanimously. In her remarks to open floor debate on Senate File 2213, Human Resources Committee Chair Amanda Ragan said the bill was designed “to safeguard the interests of Medicaid members, encourage the participation of Medicaid providers, and protect Iowa taxpayers.” She told colleagues, “we must require DHS and the managed care companies to protect consumers, preserve provider networks, address the unique needs of children and assure accountability.”

IA-Sen: Patty Judge thinking about challenging Chuck Grassley

The Des Moines Register’s Jason Noble snagged a surprising scoop yesterday: former Lieutenant Governor and Iowa Secretary of Agriculture Patty Judge is considering running for the U.S. Senate this year. Referring to Grassley’s approach to the U.S. Supreme Court vacancy, Judge told Noble,

“Iowans have always been straight shooters, and up until the recent time I would have said the same thing about Chuck,” Judge said. […]

“I don’t like this double-speak,” Judge said. “I don’t like this deliberate obstruction of the process. I think Chuck Grassley owes us better. He’s been with us a long time. Maybe he’s been with us too long.”

To qualify for the Democratic primary ballot, Judge would need to submit nominating papers with the Secretary of State’s Office by March 18, three weeks from today. That doesn’t leave much time to collect at least 2,104 signatures, including minimum amounts in at least ten Iowa counties. But Judge could pull together a campaign quickly, having won three statewide elections–for secretary of agriculture in 1998 and 2002 and on the ticket with Chet Culver in 2006.

Three other Democrats are seeking the nomination to run against Grassley: State Senator Rob Hogg, former State Senator Tom Fiegen, and former State Representative Bob Krause. Former State Representative Ray Zirkelbach launched a U.S. Senate campaign in November but ended his campaign last month, Zirkelbach confirmed by phone this morning.

Dozens of Democratic state lawmakers endorsed Hogg in January. I enclose the full list below. Any comments about the Senate race are welcome in this thread.

Iowa Democratic Party to consider caucus improvements, but not real change

In an e-mail newsletter to supporters on February 12, Iowa Democratic Party Chair Andy McGuire hailed the “awe-inspiring,” “historic,” and “extraordinary” happenings at nearly 1,700 precinct caucuses on February 1, adding,

For all the positives that came from caucus night, we are also aware of the concerns that came from some of our precincts. We are listening. We are always looking for ways to make the caucus process better and this year will be no different. That’s why we will be forming a committee to start the process of innovating and improving, while keeping in place what makes the caucus process so special.

As a Democrat with a longstanding interest in making the caucuses more inclusive and a better reflection of Iowa voters’ preferences, I immediately sought further details about the committee, in particular whether its members will consider major reforms such as absentee ballots, proxy voting, or a GOP-style straw poll caucus.

McGuire has not responded to my questions, but Iowa Democratic Party communications director Samuel Lau answered by e-mail, “This committee is still in the very beginning phases of planning, but it will be developed in partnership with our State Central Committee, our partners and our allies. The party has always made it a priority to listen to the concerns of Iowans in order to improve our caucus process, and no discussion topics will be ‘off the table.’”

Comments by various party insiders to the Des Moines Register’s Jason Noble tell a different story. Party leaders are open to ideas for running the precinct caucuses more smoothly but not to broader changes in how the Iowa caucuses work.

Who are Iowa's superdelegates in 2016?

The Democratic Party’s “superdelegates” have been in the news lately as a potential base of support for Hillary Clinton in what may be a long battle with Bernie Sanders for the presidential nomination. I agree entirely with Pat Rynard that talking about superdelegates as Clinton’s “firewall” plays perfectly into the Sanders campaign narrative of anti-establishment warrior. Furthermore, I support eliminating superdelegates, which came into being before the 1984 presidential campaign as a way to give party insiders more leverage over the nominating process.

Since we’re stuck with superdelegates for this cycle, I’ve named Iowa’s likely representatives below. The Democratic National Committee has yet to confirm the list but is expected to do so next month.

Iowa Senate district 16: Nate Boulton raised more money in four months than Dick Dearden did in seven years

When Nate Boulton announced his Iowa Senate campaign in September, he subtly indicated he would be a different kind of legislator than State Senator Dick Dearden, the longtime Democratic incumbent who is retiring this year. Boulton promised to “be an active and engaged representative of district interests” and to “bring bold progressive ideas and a fresh, energetic style of leadership to the Iowa Senate.”

Just a few months into his primary race against Pam Dearden Conner, the retiring senator’s daughter, Boulton sent a strong signal that he will be a more “active and engaged” candidate as well. Campaign finance disclosure forms show that Boulton raised $75,383 during the last four months of the year, a phenomenal total for a non-incumbent, first-time state legislative candidate in Iowa. Not only did Boulton out-raise his primary rival, he raised more than Dearden (a 22-year incumbent) has brought in cumulatively since 2008.

Budget looms large, social issues largely absent on the Iowa legislature's opening day in 2016

Governor Terry Branstad wore a pink tie and many colleagues remarked on history made yesterday at the Capitol, as Linda Upmeyer became the first woman to preside over the Iowa House as speaker, as well as the first child of an Iowa legislative leader to rise to the same position. Erin Murphy’s take on the milestone is worth a read.

As in recent years, social issues were almost entirely absent from the leaders’ opening remarks to their Iowa House and Senate colleagues. State budget priorities dominated the comments relating to public policy, with Republicans emphasizing the importance of not spending too much and Democrats emphasizing the need to spend enough on education and other vital services. No one mentioned Branstad’s call to extend the penny sales tax for school infrastructure and divert part of the revenue stream to water programs.

Who's who in the Iowa Senate for 2016

The Iowa legislature’s 2016 session began on Monday. For the sixth year in a row, the 50 state senators include 26 Democrats and 24 Republicans. Just seven senators are women (six Democrats and a Republican), down from a high of ten women serving in the chamber during 2013 and 2014. All current senators are white. To my knowledge, the only African-American ever to serve in the Iowa Senate was Tom Mann, elected to two terms during the 1980s. No Latino has ever served in the Iowa House or Senate; Nathan Blake fell 18 votes short of becoming the first in 2014. No Asian-American has served in the state Senate since Swati Dandekar resigned in 2011.

I enclose below details on the Iowa Senate majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Senate committees. Little has changed since last year, in contrast to the Iowa House, which saw some big changes in the majority Republican caucus since the legislature adjourned in June.

Term limits are a terrible idea generally but would be especially awful if applied to the Iowa Senate, as the longest-serving current senator bizarrely advocated last year. The experience gap between Democrats and Republicans is striking. As detailed below, only four of the 24 Senate Republicans have ten or more years of experience in the Iowa legislature, compared to seventeen of the 26 Democrats. No current Iowa Senate Republican has more than 20 years legislative experience, whereas six Democrats do.

Some non-political trivia: the 50 Iowa Senate members include three Marks, three Bills, three Richards (who go by Rich, Rick, and Dick), two Mikes, two Toms, two Joes, and two men named Charles (one goes by Chaz).

Des Moines Water Works ran nitrate removal system for nearly half of 2015

The Des Moines Water Works announced yesterday that it spent some $1.5 million during 2015 to operate its nitrate removal system “for a record 177 days, eclipsing the previous record of 106 days set in 1999.” The utility provides drinking water to about 500,000 residents of central Iowa, roughly one-sixth of the state’s population. The U.S. Environmental Protection Agency considers 10 mg/l the maximum safe level for nitrates in drinking water. The Des Moines Water Works switches the nitrate removal system on when nitrates exceed 9 mg/l in both of its sources, the Raccoon River and the Des Moines River. I enclose below the full press release from the Water Works, as well as charts from the U.S. Geological Survey’s website showing recent nitrate levels in the Raccoon and Des Moines rivers.

Runoff from agricultural land is the primary source of nitrates in Iowa waterways. As David Osterberg wrote yesterday, “so little land in Iowa is devoted to urban uses (lawns or golf courses) that even if urban application rates of Nitrogen and Phosphorous fertilizer were much higher than that on farms, only 2 percent of the pollution from land application of fertilizer comes from lawns and golf courses.” This “nutrient pollution” not only incurs extra costs for providing safe drinking water but also creates toxic algae blooms, which caused a record number of beach advisory warnings during the summer of 2015.

Last January, the Des Moines Water Works filed a lawsuit against drainage districts in northwest Iowa’s Sac, Calhoun and Buena Vista Counties. Drake University Law Professor Neil Hamilton wrote an excellent backgrounder on this unprecedented litigation: Sixteen Things to Know About the Des Moines Water Works Proposed Lawsuit. In a guest column for the Des Moines Register last May, Hamilton debunked the “strenuous effort” to convince Iowans that “the lawsuit is unfair and unhelpful.”

Governor Terry Branstad has depicted the lawsuit as a sign that “Des Moines has declared war on rural Iowa” and repeatedly criticized the Water Works last year. Iowa Secretary of Agriculture Bill Northey claims the water utility “has attempted to stand in the way of these collaborative efforts” to reduce nutrient pollution. A front group funded by the Iowa Farm Bureau and other agribusiness interests and led by Cedar Rapids Mayor Ron Corbett, among others, has also tried to turn public opinion against the lawsuit. In recent weeks, that group with the Orwellian name of Iowa Partnership for Clean Water has been running television commercials seeking to demonize Water Works CEO Bill Stowe.

Northey, Corbett, and Lieutenant Governor Kim Reynolds may soon become bitter rivals for the 2018 GOP nomination for governor. But those three will stand together opposing any mandatory regulations to reduce agricultural runoff. All support Iowa’s voluntary nutrient reduction strategy, shaped substantially by Big Ag and lacking numeric criteria strongly recommended by the U.S. EPA.

William Petroski and Brianne Pfannenstiel report in today’s Des Moines Register that Branstad “is exploring a legislative proposal that would provide money for water quality projects by using projected revenue growth from an existing statewide sales tax for schools.” Apparently “superintendents have been getting called to the state Capitol to discuss the proposal” with Branstad and Reynolds. Fortunately, that cynical attempt to pit clean water against school funding appears to have zero chance of becoming law. Of the ten state lawmakers or representatives of education or environmental advocacy groups quoted by Petroski and Pfannenstiel, none endorsed the half-baked idea. Their reactions ranged from noncommittal to negative. Speaking to Rod Boshart of the Cedar Rapids Gazette, Iowa Senate Majority Leader Mike Gronstal said of a possible Branstad proposal on water quality funding, “We certainly would be willing to look at that but we’re not going to cannibalize education or the basic social safety net so that he can put a fig leaf on his record on the environment.”

UPDATE: Erin Murphy reported more details about Branstad’s proposal: extend the 1 percent sales tax for school infrastructure, dedicate the first $10 million in annual growth to schools and allocate the rest to water programs.

SECOND UPDATE: Added below excerpts from Murphy’s report for the Cedar Rapids Gazette on Branstad’s plan. I’m disappointed to see U.S. Secretary of Agriculture Tom Vilsack endorse this ill-conceived proposal. Of course we “need to work on [water quality] now,” but why does the money have to come out of school funds? Remember, the Branstad administration is already pushing a corporate tax break that will cost public school districts millions of dollars a year for infrastructure on top of tens of millions of dollars in lost state revenue.

THIRD UPDATE: Branstad told reporters today he does not believe there is support in the legislature to raise the sales tax. Under a constitutional amendment adopted in 2010, 3/8 of a cent of the next Iowa sales tax increase would flow into the natural resources trust fund. He also indicated that he would not support extending the penny sales tax for school infrastructure beyond 2029, when it is scheduled to expire, without lawmakers agreeing to divert some of the funding to water programs. According to incoming Iowa House Speaker Linda Upmeyer, “House Republicans have been divided on whether to extend the school infrastructure sales tax beyond 2029.”

The 15 Bleeding Heartland posts I worked hardest on in 2015

As I mentioned on Tuesday, writing is a labor of love for me. Some posts are much more labor-intensive than others.

All of the pieces linked below took at least a couple of days to put together. Some were in progress for weeks before I was ready to hit the publish button. (No editor, deadlines, or word limits can be a dangerous combination.) A few of the particularly time-consuming posts required additional research or interviews. More often, the challenge was figuring out the best way to present the material.

Several pieces that would have qualified for this list are not included, because they are still unfinished. Assuming I can get those posts where they need to be, I plan to publish them during the first quarter of 2016.

Iowa Senate President Pam Jochum endorsing Hillary Clinton is a big deal

Iowa Senate President Pam Jochum endorsed Hillary Clinton for president today in a guest column for the Des Moines Register. This afternoon, she will elaborate on her reasons at a Women for Hillary event in Dubuque.

Jochum joins the list of prominent Iowa supporters of Barack Obama before the 2008 caucuses who are now backing Clinton. An Iowa House Democrat at that time, Jochum headed Obama’s leadership team in Dubuque County. Obama easily won a plurality of delegates in Dubuque and carried all of the neighboring counties too.

More important, Jochum is a hero to many on what you might call “the Democratic wing of the Iowa Democratic Party.” I’m thinking of the 26 percent who voted for Ed Fallon in the 2006 gubernatorial primary, as well as people who have long advocated for campaign finance reform at the state level. Although I think highly of Senate Majority Leader Mike Gronstal, he’s not the progressive champion Jochum is–not by a long shot. She has helped fight some very tough fights, where powerful interest groups were lined up on the other side. I can’t think of an Iowa state legislator in my lifetime who has reached such a senior leadership position while being as consistently progressive as Jochum.

My impression is that many on the “Democratic wing” of the party have already committed to caucus for Bernie Sanders. Others feel conflicted as I do, drawn to Sanders for his passion and his uncompromising policy agenda, while recognizing Clinton’s strengths as a candidate and what it would mean for this country to elect a woman president. That Jochum is on board with Clinton could carry a lot of weight with undecided Democrats like me.

Before today, eight Democratic state senators and nine state representatives had already endorsed Clinton for the 2016 caucuses. I’ve enclosed the full list after the jump, along with excerpts from Jochum’s Des Moines Register op-ed.

Dear U of I, backroom dealings are nothing new.

BACKGROUND FOR THE BLEEDING HEARTLAND READER

Malcolm Price Laboratory School was a small K-12 school attached to and operated by the University of Northern Iowa.  MPLS was primarily used by the teacher education program to train teachers.  It was a critical part of UNI, “the teacher’s college”.  Year after year, however, with mounting budget pressures at UNI, talk would take place about closing MPLS.  Tired of this annual worry, supporters of MPLS through the help of their local legislatures, pushed for and obtained legislation creating the Iowa Research & Development School at MPLS.  This group thought the days of threats of closure were over since their existence was now statutory.  In 2012 they found out they were wrong.

In light of the recent events at the University of Iowa regarding the president selection process, I think it appropriate to share a narrative I drafted back in 2012 when UNI closed MPLS and other programs.  It was the fruit of an open records request for email.  The intended audience was the parents and supporters of MPLS.

Insurance company insiders knew about Iowa's Medicaid privatization plans long before public

Governor Terry Branstad didn’t run for re-election last year on a plan to let private insurance companies manage health care for some 560,000 Iowans on Medicaid. He didn’t work with key state legislators to draw up his administration’s “Medicaid Modernization” plans. The governor’s draft budget, submitted in January, projected some $51 million in savings on Medicaid for the 2016 fiscal year. But key lawmakers like the chair of the Iowa Senate Health and Human Resources Appropriations subcommittee didn’t learn that four private companies would be selected to handle almost all Medicaid services until the Iowa Department of Human Services made its request for proposals public in February.

Recent accusations of bias and conflicts of interest, as well as allegedly inaccurate scoring of insurers’ proposals, have raised many questions about how the Iowa DHS selected the four companies now negotiating contracts to manage Medicaid for one-sixth of Iowans. Reports of campaign contributions by lobbyists and political action committees representing firms that sought Iowa’s Medicaid business prompted one watchdog to decry “pay to play” politics.

Those news stories point to a conclusion that isn’t getting enough attention: various insurance companies and their paid representatives knew what was coming down the pike long before the Branstad administration disclosed its plans to privatize Medicaid.

Throwback Thursday: Curt Hanson's crucial Iowa House special election victory

Today is State Representative Curt Hanson’s birthday. Six years ago at this time, he was in the thick of the first state legislative campaign following the Iowa Supreme Court’s Varnum v Brien ruling on marriage equality. Hanson’s win in a highly competitive House district was probably the second most important special election in recent Iowa history (after Liz Mathis’s victory in November 2011, which protected the Democratic Iowa Senate majority).

Preview of the coming Iowa House Republican leadership battle

Iowa House Speaker Kraig Paulsen announced yesterday that he will not seek re-election in 2016 and will step down from leadership before next year’s legislative session. His surprise move kicks off what will be the most competitive leadership election within the House Republican caucus since colleagues elected Paulsen minority leader shortly after the 2008 general election.

Linda Upmeyer, a seven-term incumbent who has served as majority leader since 2011, immediately confirmed that she will run for speaker. She would be the first woman to lead the Iowa House, and to my knowledge, the first child of an Iowa legislative leader to follow a parent in that role. Upmeyer’s father Del Stromer was House speaker for part of the 1980s.

She won’t get Paulsen’s job without a fight, though.

Branstad vetoes will stand: not enough support for Iowa legislative special session

Governor Terry Branstad’s vetoes of education and mental health funding will stand, as the two-thirds majority needed to call a special legislative session has failed to materialize in either the Iowa House or Senate.

A special session always looked like a long-shot, given that Iowa House Republican leaders didn’t want to spend extra money on education and only reluctantly agreed to extend funding for mental health institutions. In addition, 23 of the 24 Iowa Senate Republicans voted against the supplemental spending bill. They had no stake in the compromise the governor blew apart.

Still, the outcry over school funding (including dozens of normally non-political superintendents speaking out) created an opening for Republican lawmakers. Even if they didn’t believe in the substantive value of additional education or mental health funding, they could have taken a big issue off the table for next year’s statehouse elections. So far, very few Republicans seem worried about the political fallout from not overriding Branstad’s vetoes. Democrats appear ready to remind voters at every opportunity who created the holes local education leaders are scrambling to fill.

Four takeaways from Branstad destroying the Iowa legislature's budget compromise

Late in the afternoon on the last day state offices were open before the long holiday weekend, Governor Terry Branstad used his veto pen to strike “all the big deals” Iowa House Republicans and Senate Democrats negotiated to end this year’s legislative session.

The budget compromise was already a much better deal for statehouse Republicans than for Democrats. House GOP leaders got the global budget targets they had demanded, which were lower than what the governor requested and Democrats proposed. Most of the concessions to Democrats came in House File 666, a $125 million collection of one-time appropriations.

While Branstad didn’t veto the entire supplemental spending bill like he did in 2014, he cut out House File 666’s largest and highest-priority items for statehouse Democrats: $55.7 million for K-12 school districts, $2.5 million for community colleges, nearly $2.9 million for the University of Iowa, $2.25 million for Iowa State University, and $1.1 million for the University of Northern Iowa.

In other words, after standing on the sidelines during most of the battle over the 2016 budget, Branstad handed House Republicans near-total victory. The fallout will be substantial.

Anatomy of a rare and costly strategic error by Mike Gronstal

The Iowa legislature is wrapping up its work for this year with the usual frenzy of appropriations bills. Months of stalemate over K-12 education funding and social safety net programs ended late last week with a deal that gave Iowa House Republican leaders what they wanted on overall state spending ($7.168 billion) and “allowable growth” for local school district budgets (up by only 1.25 percent). A $125 million supplemental spending bill will allocate one-time money for K-12 schools and some other Democratic priorities.

It will take a while to sort through the wreckage and identify the good, bad, and ugly line items hiding in the appropriations bills for fiscal year 2016. Democrats can only pray that Governor Terry Branstad won’t veto the supplemental spending bill like he did last year.

What’s already clear: Republicans have many more reasons to celebrate. House Speaker Kraig Paulsen was all smiles about the budget deal, while Senate Majority Leader Mike Gronstal admitted candidly, “I think there’s plenty of disappointment to go around, but we fought long and hard for what we thought was important and I think we, in the end, had some success.” Speaking to reporters earlier this week, Gronstal noted, “If left to our own devices, we would pass a very different budget. But it is our duty to work together to come to common ground between the two sides.”

Why did this “common ground between the two sides” end up so much closer to the Republican negotiating position? Because months ago, Gronstal gave House leaders what they wanted on tax bills, without securing any concessions on spending. Even a brilliant politician can make a mistake.

Weekend open thread: Iowa marriage equality anniversary edition

Happy Passover or Happy Easter to all who are celebrating this weekend. In past years Bleeding Heartland has posted links about those religious holidays. For today’s open thread, I’m reflecting on the Iowa Supreme Court’s Varnum v Brien ruling, announced on April 3, 2009.

Lambda Legal, which represented the Varnum plaintiffs, published a timeline of the case. The LGBT advocacy group filed the lawsuit in December 2005, banking on the Iowa Supreme Court’s “extraordinary history” of independence and “civil rights leadership.”

If Iowa lawmakers had approved a state constitutional amendment on marriage, the Varnum case might never have been filed (in anticipation of Iowans approving a ban on same-sex marriage, as voters had done in many other states). But during the 2004 legislative session, the marriage amendment failed by one vote in the upper chamber, thanks to the united Senate Democratic caucus, joined by GOP senators Maggie Tinsman, Don Redfern, Mary Lundby, and Doug Shull. All four Republican moderates had left the legislature by the time the Iowa Supreme Court ruled on Varnum. Redfern retired in 2004. Tinsman lost her 2006 primary to a social conservative challenger. Shull retired from the Senate in 2006 and unsuccessfully sought a seat in the state House that year. Lundby retired from the legislature in 2008 and passed away the following year.  

Reading through the early Democratic and Republican reaction to the Varnum decision should make all Iowa Democrats proud. Senate Majority Leader Mike Gronstal and former House Speaker Pat Murphy deserve credit for their leadership at a time when some Democrats would have run for cover on an issue perceived to be unpopular. Minority civil rights should never be conditional on majority approval.

As for the Republicans in the Bleeding Heartland community, you can be proud that your party’s state legislators seem less and less interested in fighting the losing battle to restrict marriage to heterosexual couples.

Three of the seven justices who concurred in Varnum v Brien (Chief Justice Marsha Ternus, Justice David Baker, and Justice Michael Streit) lost their jobs in Iowa’s 2010 retention elections. Justice David Wiggins survived a campaign against his retention in 2012. The remaining three justices who concurred in the decision are up for retention in 2016: Chief Justice Mark Cady (author of the ruling), Justice Daryl Hecht, and Justice Brent Appel. It’s not yet clear whether Bob Vander Plaats and his fellow-travellers will make a serious effort to remove them, or whether they will give up in the face of Iowans’ growing acceptance of marriage equality.

The LGBT advocacy group One Iowa holds an annual gala around the anniversary of the Varnum ruling. Last night the group honored Iowa Senate President Pam Jochum and Des Moines Register columnist Rekha Basu, among others. Iowa Senate, House approve gas tax increase

A bill that would raise Iowa’s gasoline tax by 10 cents a gallon is on its way to Governor Terry Branstad’s desk after approval today by both chambers in the Iowa legislature. The Iowa Senate passed Senate File 257 this morning by 28 votes to 21. Sixteen Democrats and twelve Republicans voted for the bill, while ten Democrats and eleven Republicans opposed it. Senate Majority Leader Mike Gronstal had reportedly insisted on at least half the GOP caucus supporting a gas tax increase as a condition for bringing the bill to the floor.

A few hours later, the Iowa House took up the Senate bill (rather than the bill that cleared two House committees last week). Thirty Republicans and 23 Democrats voted yes, while 26 Republicans and 20 Democrats voted no.

Only two state legislators missed today’s votes: Republican State Senator Mark Chelgren and Republican State Representative Chip Baltimore. Baltimore voted against the House version of this bill in committee last week, while Chelgren doesn’t serve on the committees that approved the bill in the Senate. Chelgren appears to have been absent for all of today’s votes, while Baltimore was at the Capitol but left the chamber when the gas tax bill came up. Speaking to reporters later, he tried to make a virtue out of his absence: “I refuse to legitimize either the bill or the process with a vote.” Weak sauce from a guy who is widely expected to seek higher office someday.

Conservative groups are urging Branstad to veto Senate File 257, but that seems unlikely, given the governor’s recent comments on road funding. Branstad’s spokesman said today that the governor will carefully review the final bill before deciding whether to sign it.

Final note: several of the “no” votes came from lawmakers who may face competitive re-election campaigns in 2016. Those include Democrats Chris Brase (Senate district 46), Steve Sodders (Senate district 36), and Mary Jo Wilhelm (Senate district 26), and Republicans Dennis Guth (Senate district 4) and Amy Sinclair (Senate district 14).

Top staffers leaving Iowa Democratic Party (updated)

Only a few weeks after becoming the state chair of the Iowa Democratic Party, Dr. Andy McGuire is overseeing big staff changes. As first reported by Iowa Starting Line yesterday, Troy Price is leaving after a little more than two years as executive director. Excerpt from an e-mail McGuire sent to State Central Committee members after a conference call on the evening of February 17:

I want to let you all know that our executive director Troy Price and our deputy executive director Kevin Geiken will be transitioning out of the party over the next couple of weeks. Troy will continue at the party until March 3, and Kevin is planning to remain to help with the SCC retreat March 7-8. I want to thank both of them for their outstanding service to the party and wish them all the best in their next endeavors.

I would also like to announce that Ben Foecke will be coming on as our new Executive Director starting February 23. Ben came to work at the Iowa Democratic Party out of college, canvassing door-to-door for the Harkin/Vilsack coordinated campaign in 2001. He became Caucus Director in 2004, overseeing the (then) largest Precinct Caucus in Iowa history. Since 2009, Ben has worked for the Iowa Senate Majority Fund.

I will update this post as needed with further details. UPDATE: Added below the official statement from the Iowa Democratic Party.

SECOND UPDATE: O.Kay Henderson noted that Foecke worked for Mike Blouin’s gubernatorial campaign during the 2006 Democratic primary. McGuire was Blouin’s running mate during that race. Pat Rynard pointed out,

[Iowa Senate Majority Leader Mike] Gronstal endorsed and lobbied hard behind the scenes for McGuire’s candidacy, getting involved in internal party politics in a way he hasn’t before. Now one of his long-time staffers may lead the party’s day-to-day operations. As one of the only remaining elected Democratic leaders left in the state, it appears that Gronstal is taking a much more active control over the direction of the state party.

Iowa legislative state of play on school funding

A standoff over state funding for K-12 education appears unlikely to be resolved anytime soon. The Republican-controlled Iowa House has approved legislation setting “allowable growth” in state funding to school districts at 1.25 percent for fiscal year 2016; the House Journal for January 27 includes details on the debate, during which members rejected on a party-line vote a Democratic amendment to increase school spending, and later approved House File 80, also along party lines. House Republicans reportedly support a 2.45 percent increase in school funding for fiscal year 2017 but have not brought legislation before the full chamber yet.

Meanwhile, Democrats who control the Iowa Senate are committed to setting allowable growth at 4 percent for each of the next two fiscal years. Many education groups have lobbied lawmakers for at least 4 percent allowable growth, and in a Senate Democratic survey of Iowa superintendents, 96 percent of respondents said the appropriate level of supplemental state aid for the coming fiscal year should be 4 percent or higher.

Yesterday four education funding bills passed the upper chamber; a statement enclosed after the jump covers the key points in each bill. The legislation setting allowable growth at 4 percent for fiscal year 2016 and 2017 passed on party-line votes (roll calls are in the Senate Journal). Republicans joined their colleagues to unanimously approve the other two bills, which would “have the state pick up the 12.5 percent property tax share under the state’s foundation aid formula for both fiscal years.” Rod Boshart summed up the bottom line:

Under the GOP approach, current state per-pupil funding of $6,366 would grow by $80 in fiscal 2016 and another $158 in fiscal 2017. By contrast, the Senate’s 4 percent position would boost per-pupil funding to $6,621 for the 2015-16 academic year and $6,886 the following school year.

Or to view it another way, the House approach would include nearly $100 million in additional K-12 school funding for fiscal year 2016, while the Senate approach would provide an additional $212 million this coming year and $217 million the following year.

The obvious compromise would be to increase school aid by somewhere between 2-3 percent for each of the next two years, but Republican lawmakers and Governor Terry Branstad insist there’s no room in the state budget for that much additional spending. Note that no one questioned whether Iowans could afford an extra $100 million in tax cuts, mostly for business, which just passed the Iowa House unanimously.

During yesterday’s debate, Democratic State Senator Tony Bisignano argued that the big commercial property tax cut approved in 2013 will shortchange Iowa students. (Indeed, when that commercial property tax bill passed, many people warned that it would lead to cuts in public services.) State Senator Joe Bolkcom also criticized “messed up” priorities that favor “special interests” in the state tax code. As long as I’ve been paying attention to the Iowa legislature, tax expenditures have always been an easier sell than more money for schools or other public services. That dynamic won’t change this year.

Four reasons Mike Gronstal will win another term in Iowa Senate district 8

Iowa Senate Majority Leader Mike Gronstal celebrated his 65th birthday on January 29. The Des Moines Register’s William Petroski caught up with Gronstal after fellow senators sang “Happy Birthday” and confirmed that the longtime Democratic leader has no plans to retire. He’s up for re-election next year in Senate district 8, covering the Council Bluffs area and Carter Lake (scroll to the end of this post to view a detailed map).

Now that Tom Harkin has retired, Gronstal may be the Iowa Democrat whom Republicans most love to hate. But I have news for them: he’s going to win another term in 2016, and here’s why.

Three pros and three cons of Andy McGuire as Iowa Democratic Party chair (updated)

Earlier today the Iowa Democratic Party’s State Central Committee selected Dr. Andy McGuire to lead the party for the next two years. McGuire was the favorite going into the election and won on the third ballot against Kurt Meyer. Another candidate for state chair, former Congressional candidate Jim Mowrer, then ran for first vice chair and was elected on the first ballot.

Dr. McGuire has been active in Iowa Democratic politics for more than 20 years, since working on her sister-in-law Sheila McGuire’s 1994 Congressional campaign in Iowa’s fifth district. (Sheila McGuire later served as state party chair for a term.) In the political world, Andy McGuire is best-known for being Mike Blouin’s running mate during the 2006 Democratic primary for governor. The pro-choice mother of seven helped balance the ticket, as many Democratic activists were concerned about Blouin’s stance on abortion rights.

In recent years, McGuire has often been mentioned as a possible Congressional candidate, but she ruled out running in Iowa’s third district in 2016 if elected to lead the party. Many central Iowa Democrats expect her to run for governor in 2018.

Although I favored one of the other candidates, McGuire brings a lot to the table as a state party leader. My first thoughts on the pros and cons of her election are after the jump.

The case for each candidate for Iowa Democratic Party chair

State Central Committee members of the Iowa Democratic Party meet tomorrow to choose a new state chair for the next election cycle. Four candidates are seeking the job: Dr. Andy McGuire, Kurt Meyer, Jim Mowrer, and Tim Tracy. The competition itself is a welcome change from the Iowa Democratic Party’s standard operating procedure. For as long as I can remember, the State Central Committee has never considered multiple candidates for state chair. Members have merely rubber-stamped the choice of Senator Tom Harkin or the Democratic governor at the time.

Bleeding Heartland asked each of the candidates to make their best case for becoming the next Iowa Democratic leader. Some party insiders have also shared e-mail correspondence sent to State Central Committee members on behalf of one or the other candidates. Iowa Senate Majority Leader Mike Gronstal, Attorney General Tom Miller, Representative Dave Loebsack (IA-02) and former Representative Leonard Boswell (IA-03) are among those who endorsed McGuire. Former Iowa Democratic Party Executive Director Norm Sterzenbach has urged party leaders to pick Mowrer.

After the jump I’ve enclosed the arguments for choosing McGuire, Meyer, Mowrer, or Tracy (listed in alphabetical order). I don’t know any of them well, but I’ve met each of them and think highly of all. If I were on the State Central Committee, I would lean toward Meyer. The party needs a full-time chair, rather than a leader who would have to juggle those duties with another job. Moreover, I think choosing another Des Moines insider with the strongest connections to VIPs and major donors sends a “business as usual” message. Bleeding Heartland 2laneIA raised another concern about McGuire: she is a vocal supporter of Hillary Clinton for president. It would be healthier for the Iowa caucuses if party leaders remained neutral before a nominee is determined. Although I don’t expect any strong competition for Clinton here, I wouldn’t want other potential candidates to fear the state party will stack the deck against them.

We need the state Democratic leader to focus on building the party up at the county level. All of the candidates talked about that in their presentations to the State Central Committee. But Meyer has done the most work in the trenches, organizing and motivating activists in several northern Iowa counties. That work contributed to Mitchell County being the whitest county in the U.S. to vote for Barack Obama (and Howard County the fifth-whitest to favor Obama over Mitt Romney), as well as to State Senator Mary Jo Wilhelm’s narrow victory over Republican Senator Merlin Bartz in 2012. Without Wilhelm, there’s no Iowa Senate majority. Mowrer and McGuire have strong records on fundraising too, but I don’t see fundraising as the most urgent task for the Iowa Democratic Party right now.

Themes from the opening day of the Iowa legislature's 2015 session

Exciting times for Iowa politics watchers: the state legislature’s 2015 session began in Des Moines today. A tentative schedule for this year’s work is available here (pdf). The last day lawmakers will receive per diem expenses is on May 1, but for the past four years of divided control between a Republican House and a Democratic Senate, the session has always gone into overtime–sometimes by a little and sometimes by a lot. Bleeding Heartland previously posted details on the each chamber’s majority and minority leadership teams, along with all chairs, vice chairs, and members of standing committees. Today legislative leaders from both parties pledged to work together. After the jump I’ve enclosed the full texts of opening day remarks. Iowa Senate Majority Leader Mike Gronstal called for making Iowa’s middle class the “focus of the 2015 session” by ensuring adequate education spending, fighting wage theft, and expanding worker training while keeping a balanced budget. He praised Governor Terry Branstad for agreeing to go back to setting K-12 school funding a year in advance, as is required by state law, but warned the governor not to make a partisan statement by proposing too little funding for education when he addresses the legislature tomorrow.

Echoing some of the priorities she named last year, Senate President Pam Jochum said building an economy that “works for everyone” means supporting families and especially children: “For too long, the well-being of children has been considered a woman’s issue.’ It is not just a ‘woman’s issue’. It is an American issue. It is an Iowan issue.” Jochum urged lawmakers to expand access to education from pre-K through college, make “quality, affordable childcare” more available across the state, and boost an initiative to “detect and help prevent mental health and developmental problems among young children.”

Iowa House Minority Leader Mark Smith said the top priorities for House Democrats are strengthening the middle class and re-vitalizing rural Iowa. In addition to expanding early childhood education and providing adequate funds for K-12 schools, Smith called for raising the minimum wage, though GOP leaders have shown no willingness to negotiate on that issue.

As has been true in recent years, top Iowa House and Senate Republicans focused on fiscal issues and mostly avoided social issues. Iowa House Speaker Kraig Paulsen challenged his colleagues “to ensure that government do less and do it better” when “others bring forward their laundry list of funding opportunities, spending priorities, or flashy government programs.” He called for more tax cuts along the lines of a 2006 bipartisan agreement to eliminate the state tax on Social Security benefits. (Mike Owen of the Iowa Policy Project explained in a guest column for the Quad-City Times why that tax cut was passed “under false pretenses” and skewed Iowa’s tax code “further to the benefit of the wealthy.”) House Majority Leader Linda Upmeyer emphasized the need to “craft a responsible budget.” She singled out the Medicaid program for criticism, claiming growth in Medicaid spending is “not sustainable” and will threaten lawmakers’ ability to invest in education, job training, infrastructure, and renewable energy. Iowa Senate Minority Leader Bill Dix called on senators to “work together to rein in spending, make cuts and reduce the size of government and lift up all Iowans in the process by reducing their tax burdens.”

None of the Republicans set a goal of undoing marriage equality, and only House Speaker Pro Tem Matt Windschitl made passing reference to other top priorities for social conservatives when he said, “Let us work together to make Iowa the best place to live, where taxes are low, jobs are abundant, education is top of the line, innocent life is protected and Second Amendment rights are fully embraced.”

Who's who in the Iowa Senate for 2015

The Iowa legislature’s 2015 session begins today. Democrats maintained their 26 to 24 majority in the upper chamber. After the jump I’ve posted details on the Iowa Senate majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Senate committees. Where relevant, I’ve noted changes from the previous committee assignments. Click here for a similar post on the new Iowa House.

I’ve also enclosed below details on the tenure of all 50 Iowa senators. The experience gap between the caucuses is striking, even more so since three of the longest-serving GOP state senators retired in 2014. Only seven of the 24 Republicans have served in either the state House or Senate for more than four years, whereas nineteen of the 26 Democrats have more than four years of legislative service. Only four of the 24 Senate Republicans have ten or more years of experience in the Iowa legislature, compared to seventeen of the 26 Democrats. No current Iowa Senate Republican has more than 20 years legislative experience, whereas six Democrats do.

Just seven of the 50 senators are women, down from ten women in the chamber two years ago. The Democratic caucus includes 20 men and six women; the Republican caucus 23 men and one woman.

All current Iowa senators are white. To my knowledge, no African-American has ever served in the Iowa Senate. CORRECTION: Bleeding Heartland reader northwest points out that I forgot Tom Mann, who represented part of Des Moines in the Iowa Senate during the 1980s.

No Latino has ever served in the Iowa House or Senate; Nathan Blake fell 18 votes short of becoming the first in 2014. No Asian-American has served in the state Senate since Swati Dandekar resigned in 2011.

Some non-political trivia: the 50 state senators include three Marks, three Bills, three Richards (who go by Rich, Rick, and Dick), two Mikes, two Toms, two Joes, and two men named Charles (one goes by Chaz).

Weekend open thread: 50 "most wanted" Iowa Democrats edition

What’s on your mind this weekend, Bleeding Heartland readers? This is an open thread: all topics welcome.

Iowa Democrats are chattering away on social media about the “50 Most Wanted” list Jennifer Jacobs wrote for today’s Sunday Des Moines Register.

The Iowans who made the “50 most wanted” list are influencers who can slap together a house party and get more than 40 people to show up to meet their candidate. A dozen are paid political operatives – the ones who not only know the Iowa terrain best, but also know how to organize a 99-county campaign, build buzz and a perception of momentum, and win over caucusgoers. Dozens more influencers not mentioned here will be highly sought after for their guidance.

Jacobs’ list includes many household names but also donors and activists who rarely attract public notice, even though they are influential in their communities (such as Kim Weaver in northwest Iowa and Kurt Meyer in northeast Iowa). State Senate Majority Leader Mike Gronstal is number one on the list, and while he is certainly the most powerful Iowa Democrat overall, he’s probably not the most important “get” for a presidential campaign. The rest of the top ten: U.S. Representative Dave Loebsack, Attorney General Tom Miller, retiring Senator Tom Harkin and his wife Ruth Harkin, U.S. Secretary of Agriculture and former Governor Tom Vilsack and his wife Christie Vilsack, Iowa secretary of state candidate Brad Anderson, major donor Jerry Crawford, and Dr. Andy McGuire, a possible future Congressional candidate or perhaps chair of the Iowa Democratic Party.

Incidentally, Jacobs put Bruce Braley’s Senate campaign manager Sarah Benzing in the number 50 slot, but I believe she will be more sought after by future Democratic candidates than many others who are higher up on this “most wanted” list. The Braley campaign’s biggest problems can’t be pinned on Benzing. Moreover, she has run three successful U.S. Senate races, including Sherrod Brown’s 2012 campaign in Ohio–a state with a notoriously weak and dysfunctional Democratic Party.

The huge bill to keep the federal government funded through next September has drawn most of the political news coverage this weekend. Retiring Representative Tom Latham was the only Iowan to support this bad bill in the U.S. House. Both of Iowa’s U.S. senators voted against it last night.

Mike Gronstal staying on as head of DLCC

Iowa Senate Majority Leader Mike Gronstal is staying on as board chairman of the Democratic Legislative Campaign Committee, the group announced today. I’ve enclosed the full statement after the jump.

The DLCC focuses on state legislative elections around the country. The group has its work cut out, because Republicans made huge gains in state legislatures in November. In fact, “The GOP now controls 68 out of 98 partisan state legislative chambers — the highest number in the history of the party.” Holding the 26-24 Iowa Senate majority was one of the few bright spots for Democrats, along with maintaining a majority in the Kentucky House of Representatives (which complicates life for potential presidential candidate Rand Paul).

The Iowa GOP will have more state Senate pickup opportunities in 2016 than they did this year. Twelve Iowa Senate races saw significant spending by one or both parties in 2012, whereas only a half-dozen or so Senate seats looked competitive going into 2014. By October of this year, most of the spending by Iowa Democrats and Republicans was concentrated in four state Senate races. Depending on retirements and candidate recruitment, at least ten Iowa Senate districts will be potentially competitive during the 2016 cycle.

Incidentally, the only other Iowan on the DLCC’s board of directors is Senator Wally Horn of Cedar Rapids. Just re-elected to another four-year term in Senate district 35, Horn has served in the Iowa legislature for 42 years (10 in the state House and 32 in the Senate), longer than any other sitting lawmaker.

U.S. Supreme Court rejects appeal of defamation case based on Iowa political ad

Hot off the press: the U.S. Supreme Court has declined to hear Republican State Senator Rick Bertrand’s appeal of a Iowa Supreme Court ruling rejecting his defamation case. Bertrand’s lawsuit stemmed from a negative ad the Iowa Democratic Party ran against him during his 2010 campaign against Rick Mullin. To my surprise, Bertrand won significant damages in a jury trial, and a partial victory at the Iowa District Court level. The district court judge reduced the damages awarded to Bertrand but determined that the controversial television spot constituted “implied libel.”

Both Bertrand and the defendants in the defamation case (Mullin and the Iowa Democratic Party) appealed to the Iowa Supreme Court, which heard the case in January. Bertrand’s only option left was a U.S. Supreme Court appeal. I never thought he would get far with this lawsuit, because of extensive case law supporting strong protections for political campaign speech, as well as a high bar for any public figure claiming defamation (libel or slander).

Today, Bertrand v. Mullin et al appeared on a long list of cases in which the U.S. Supreme Court denied certiorari.

Weekend open thread: Cost of doing nothing edition

What’s on your mind this weekend, Bleeding Heartland readers? This is an open thread.

Sunday’s Des Moines Register includes a good feature by Lauren Mills of IowaWatch.org and the Iowa Center for Public Affairs Journalism. She lays out how payday lenders are “burying Iowans” in debt. Iowa Senate Ways and Means Committee Chair Joe Bolkcom pointed out that the payday lending business model depends on “locking people into this cycle of debt.” Previous research has indicated that payday lenders cost Iowa consumers about $36 million per year. Mills reports that this industry spends heavily on campaign contributions and lobbying the Iowa legislature. Lobbyists talk a good game about jobs and helping people who need cash for emergency expenses. But think how many more jobs could be created if Iowans living paycheck to paycheck had $36 million more to spend on goods and services, rather than on outlandish “loan shark rates.”

Mills reports that legislation to regulate interest rates charged by payday lenders has been stalled. Bolkcom said Senate Majority Leader Mike Gronstal won’t bring up the bill unless it can pass the Republican-controlled Iowa House. House Majority Leader Linda Upmeyer called that a “convenient excuse” for the Senate not to act. I haven’t noticed her or any other House Republicans acknowledging this problem, though.

The best chance for Iowa lawmakers to address payday lending was during the period when Democrats controlled “the trifecta.” In 2007, the Iowa House and Senate approved, and Governor Chet Culver signed, a bill capping interest rates on car title loans. (Such legislation had been stalled for years when Republicans controlled the Iowa House, although it attracted bipartisan support in both chambers in 2007.) Three years later, Bolkcom and then Iowa House Democrat Janet Petersen made a major push to pass a similar interest rate cap on payday lenders. However, industry lobbyists warned that such a law would put payday lenders out of business, as had happened with car title lenders. A wide range of organizations supported the payday lending reform, including the Iowa Attorney General’s office, the Iowa Catholic Conference, the Child and Family Policy Center, and Iowa Citizens for Community Improvement. But ultimately, the House version of that bill died when conservadem State Representative Mike Reasoner sided with two Republicans to kill it in subcommittee.

Some Iowa local governments, most recently in Waterloo, have passed zoning rules to try to prevent payday lenders from targeting low-income neighborhoods. But state regulations are the only realistic way to stop the cycle of debt perpetuated by lenders who keep borrowers coming back for more high-interest loans and cash advances. Iowans on the edge are paying the price for the legislature’s failure to act years ago.
