Who's who in the Iowa Senate for 2016

The Iowa legislature’s 2016 session began on Monday. For the sixth year in a row, the 50 state senators include 26 Democrats and 24 Republicans. Just seven senators are women (six Democrats and a Republican), down from a high of ten women serving in the chamber during 2013 and 2014. All current senators are white. To my knowledge, the only African-American ever to serve in the Iowa Senate was Tom Mann, elected to two terms during the 1980s. No Latino has ever served in the Iowa House or Senate; Nathan Blake fell 18 votes short of becoming the first in 2014. No Asian-American has served in the state Senate since Swati Dandekar resigned in 2011.

I enclose below details on the Iowa Senate majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Senate committees. Little has changed since last year, in contrast to the Iowa House, which saw some big changes in the majority Republican caucus since the legislature adjourned in June.

Term limits are a terrible idea generally but would be especially awful if applied to the Iowa Senate, as the longest-serving current senator bizarrely advocated last year. The experience gap between Democrats and Republicans is striking. As detailed below, only four of the 24 Senate Republicans have ten or more years of experience in the Iowa legislature, compared to seventeen of the 26 Democrats. No current Iowa Senate Republican has more than 20 years legislative experience, whereas six Democrats do.

Some non-political trivia: the 50 Iowa Senate members include three Marks, three Bills, three Richards (who go by Rich, Rick, and Dick), two Mikes, two Toms, two Joes, and two men named Charles (one goes by Chaz).

Branstad joins rush to slam door on Syrian refugees

Yesterday Governor Terry Branstad joined the club of 24 governors (23 Republicans and a Democrat) who have said their states will not accept refugees from Syria. They don’t have the power to block resettlement of refugees within their state borders, any more than pandering presidential candidates would be able to adopt unconstitutional religion-based criteria for deciding which people to allow into this country.

Still, Branstad’s knee-jerk reaction to Friday’s terrorist attacks in Paris is a disappointing retreat from the more reasonable stance he took earlier this fall on refugees from Syria coming to Iowa.

District Court lets stand Branstad veto of mental health institute funding

Polk County District Court Judge Douglas Staskal has dismissed a lawsuit challenging Governor Terry Branstad’s authority to veto funding intended to keep two in-patient mental health facilities open. Twenty Democratic state lawmakers and the president of Iowa’s largest public-employee union filed the lawsuit in July, arguing that the governor’s line-item vetoes violated Iowa Code provisions requiring that the state “shall operate” mental health institutes in Mount Pleasant and Clarinda. But Judge Staskal found that “Existing statutes cannot limit the Governor’s item veto authority,” which “is of constitutional magnitude. The only limitations that have been placed on that authority have been derived from the language of the constitution itself. […] And, there is no language in the item veto provision which suggests a statutory limitation on the power it creates. It is elementary that, to the extent there is conflict between a constitutional provision and a statute, the constitution prevails.”

I enclose below longer excerpts from the court ruling, which can be read in full here. Mark Hedberg, the lead attorney representing the plaintiffs, told Bleeding Heartland they “are preparing an appeal” to the Iowa Supreme Court “and will ask that it be expedited.”

Iowa Senate President Pam Jochum endorsing Hillary Clinton is a big deal

Iowa Senate President Pam Jochum endorsed Hillary Clinton for president today in a guest column for the Des Moines Register. This afternoon, she will elaborate on her reasons at a Women for Hillary event in Dubuque.

Jochum joins the list of prominent Iowa supporters of Barack Obama before the 2008 caucuses who are now backing Clinton. An Iowa House Democrat at that time, Jochum headed Obama’s leadership team in Dubuque County. Obama easily won a plurality of delegates in Dubuque and carried all of the neighboring counties too.

More important, Jochum is a hero to many on what you might call “the Democratic wing of the Iowa Democratic Party.” I’m thinking of the 26 percent who voted for Ed Fallon in the 2006 gubernatorial primary, as well as people who have long advocated for campaign finance reform at the state level. Although I think highly of Senate Majority Leader Mike Gronstal, he’s not the progressive champion Jochum is–not by a long shot. She has helped fight some very tough fights, where powerful interest groups were lined up on the other side. I can’t think of an Iowa state legislator in my lifetime who has reached such a senior leadership position while being as consistently progressive as Jochum.

My impression is that many on the “Democratic wing” of the party have already committed to caucus for Bernie Sanders. Others feel conflicted as I do, drawn to Sanders for his passion and his uncompromising policy agenda, while recognizing Clinton’s strengths as a candidate and what it would mean for this country to elect a woman president. That Jochum is on board with Clinton could carry a lot of weight with undecided Democrats like me.

Before today, eight Democratic state senators and nine state representatives had already endorsed Clinton for the 2016 caucuses. I’ve enclosed the full list after the jump, along with excerpts from Jochum’s Des Moines Register op-ed.

Weekend open thread: Brazen acts

What’s on your mind this weekend, Bleeding Heartland readers? This is an open thread: all topics welcome.

After the jump I’ve enclosed clips describing some brazen behavior. Many Iowans think of corruption in public procurement as a problem for other people, like our neighbors in Illinois. But a former Iowa Department of Public Safety employee’s involvement in state contracts awarded to Smith & Wesson raises red flags. I was surprised to learn on Friday that no ethics case will be pursued regarding the possible conflict of interest.

Todd Dorman’s latest column for the Cedar Rapids Gazette highlights comments by “America’s Longest Serving Ironist” (Governor Terry Branstad) about Syrian refugees possibly being resettled in Iowa. Dorman noted that “The master of blindside edicts” now wants “transparency” from the federal government.

His piece reminded me of Branstad’s hypocritical (or non-self-aware, if we’re being charitable) remarks to Clare McCarthy for her feature about refugees for IowaWatch.org. Speaking to McCarthy on July 7, the governor described how refugees from Burma need mentors from within their community to help them adjust to life in Iowa–perhaps forgetting that only days before, he had vetoed funding for a pilot program to train “leaders from the refugee community to help other refugees work through challenges.”

When it comes to political leaders shamelessly doing whatever they want, then failing to take responsibility, Branstad’s got nothing on Russian President Vladimir Putin. Mr. desmoinesdem directed my attention to a classic anecdote about Putin pocketing a Superbowl ring belonging to New England Patriots owner Robert Kraft. Karen Dawisha related the story in her 2014 book Putin’s Kleptocracy: Who Owns Russia? Scroll to the end of this post to read the tale.

UPDATE: A reader commented that former State Representative Renee Schulte also committed a brazen act by shifting gears in a matter of days from being a contractor for the Iowa Department of Human Services to a consultant for a company bidding on contracts to manage Medicaid.

SECOND UPDATE: Not Iowa-specific, but certainly brazen in an “evil genius” way: a “a start-up run by a former hedge fund manager” bought the rights to a life-saving drug last month and “immediately raised the price to $750 a tablet from $13.50, bringing the annual cost of treatment for some patients to hundreds of thousands of dollars,” Andrew Pollack reported for the New York Times.

Judge denies motion to dismiss lawsuit over Branstad closing mental health facilities

Polk County District Court Judge Douglas Staskal ruled yesterday that a lawsuit challenging Governor Terry Branstad’s line-item vetoes of mental health facility funding can move forward.

A group of Democratic state legislators and AFSCME, Iowa’s largest public employee union, filed the lawsuit in July. Last month, attorneys for the state filed a motion to dismiss the lawsuit or force the plaintiffs to “recast” (revise and resubmit) their court filing.

But in a thirteen-page ruling, Judge Staskal rejected the state’s arguments that “the plaintiffs lack standing, have failed to state a claim upon which relief could be granted and that the case presents a nonjusticiable political question.” He found that AFSCME Iowa Council 61 President Danny Homan has standing because he represents the interests of state workers who were laid off when the state government closed in-patient mental health facilities in Clarinda and Mount Pleasant. The judge also noted that state legislators “have standing to challenge the propriety of the Governor’s exercise of his veto authority.” Judge Staskal found plaintiffs had stated a claim: “a challenge to the Governor’s exercise of his line-item veto authority.” As for the political question, the ruling noted, “Whether to close Clarinda and Mount Pleasant is a policy matter for the other branches of government. Whether the Governor’s particular use of his line-item veto power is constitutional is a matter for the courts.”

Judge Staskal did find in favor of one argument advanced by state attorneys, releasing Iowa Department of Human Services Director Chuck Palmer as a co-defendant: “The Director [Palmer] plainly has no authority to veto legislation and there is no allegation that he did veto legislation. Therefore, there is no conceivable set of facts upon which relief could be granted on the claim that the Director exercised an improper veto.”    

The legislators who joined this lawsuit are State Senators Rich Taylor, Tom Courtney, Janet Petersen, Tony Bisignano, Herman Quirmbach, and Dick Dearden, and State Representatives Bruce Hunter, Curt Hanson, Jerry Kearns, Mark Smith, Art Staed, Ako Abdul-Samad, Jo Oldson, Ruth Ann Gaines, Sharon Steckman, Todd Taylor, Mary Gaskill, Kirsten Running-Marquardt, Timi Brown-Powers, and Dave Jacoby.

Iowa's Medicaid privatization raising more red flags

The Branstad administration has justified its “Medicaid Modernization Initiative” with optimistic projections about more “efficient, coordinated and high quality healthcare” and greater “accountability in health care coordination,” delivered at a savings to taxpayers.

Jason Clayworth shared a less encouraging perspective in the August 21 Des Moines Register: all four private insurance companies now negotiating contracts to manage Medicaid in Iowa have “faced serious charges of fraud or mismanagement” related to serving Medicaid recipients in other states. Some of those violations led to “hundreds of millions of dollars in fines” against the insurers.

Some big 2008 Obama supporters on new list of Iowa Women for Hillary

Today Hillary Clinton’s campaign released names of “nearly 200 women from all of Iowa’s 99 counties including nearly two dozen State Legislators, County Chairs and local elected officials” who support Clinton’s presidential bid. I’ve enclosed the full list after the jump. Many of these women also backed Clinton for president before the 2008 Iowa caucuses, such as former Iowa Attorney General Bonnie Campbell, former State Senator Staci Appel, and Ruth Harkin.

Nine women currently serving in the Iowa House are on the Iowa Women for Hillary list: State Representatives Marti Anderson, Timi Brown-Powers, Abby Finkenauer, Ruth Ann Gaines, Vicki Lensing, Mary Mascher, Jo Oldson, Sally Stutsman, and Phyllis Thede. Lensing and Mascher were among 21 state lawmakers who backed Clinton before the 2008 caucuses. Oldson was also in the legislature then; to my knowledge, she did not endorse a candidate before the 2008 caucuses. I am seeking confirmation and will update as needed.

The others were not in the state legislature in 2007, but Anderson and then Johnson County Supervisor Stutsman were high-profile supporters of Clinton’s campaign. Thede and Gaines were county leaders for Obama. I don’t know whether Finkenauer and Brown-Powers were active volunteers for any of the presidential campaigns that year. UPDATE: Brown-Powers told me that she caucused for Obama but was not active in the campaign.

Two current Iowa Senate Democrats are on the new Iowa Women for Hillary list: Janet Petersen backed Obama in 2007, as a member of the Iowa House. Liz Mathis was not a state lawmaker that year, and I am not aware of her publicly endorsing a candidate.

State Representatives Cindy Winckler and Beth Wessel-Kroeschell endorsed Clinton as Iowa House members in 2007 but have not done so this year. I am seeking comment from both on whether they have picked a different candidate, are undecided, or plan not to endorse before the 2016 caucuses.

Like Gaines and Thede, several other women on today’s press release were among the Obama campaign’s county leaders in 2007, such as Peggy Bramman (Delaware County), Clara Oleson (Cedar County), and Debbie Gitchell and Jan Bauer (Story County).

I got a kick out of seeing Bauer’s name, because earlier this year, she told the Washington Post that she was “waiting to see how aggressively pursued I am” before picking a candidate. Bleeding Heartland cited that comment as an unfortunate example of prairie prima donna behavior, which hurts the Iowa caucuses.

The best-known onetime John Edwards supporter on the new Women for Hillary list is Roxanne Conlin, a former U.S. attorney and Democratic nominee for governor and U.S. Senate. She came out for Clinton a few months ago.

Two other prominent Iowa women who weren’t on today’s press release are worth noting as once-dedicated Obama supporters backing Clinton for president in 2016. Jackie Norris was an early Obama campaign staffer in 2007 and ran Obama’s 2008 general election campaign in Iowa. Early last year, she showed up for the “Ready for Hillary” super PAC’s first event in this state. Former Iowa Democratic Party chair Sue Dvorsky announced in June that she will be helping Clinton’s campaign build support for next year’s caucuses.

AFSCME, 20 Democratic legislators sue Branstad over mental health closures (updated)

Iowa’s largest public employee union and 20 Democratic state legislators filed a lawsuit today challenging the closure of mental health institutes in Mount Pleasant and Clarinda. I enclose below a press release from AFSCME Council 61, which lists the six state senators and fourteen state representatives who joined the lawsuit naming Governor Terry Branstad and Department of Human Services Director Chuck Palmer.

The Branstad administration announced plans in January to close two of Iowa’s four in-patient mental health facilities. State legislators were neither consulted nor notified in advance. The Department of Human Services started winding down operations well before the end of the 2015 fiscal year. Democrats fought to include funding for the Clarinda and Mount Pleasant institutes in the budget for the current fiscal year, but Branstad item-vetoed the appropriation. The lawsuit contends that closing the facilities violates Iowa Code, which holds that the state “shall operate” mental health institutes in Mount Pleasant and Clarinda. The governor’s communications director told KCCI that AFSCME’s leader in Iowa “is resistant to change” and that the closed “centers were not suited to offer modern mental health care.”

The Iowa legislature’s decision next year on whether to fund the Clarinda and Mount Pleasant facilities will be critically important. The Iowa Supreme Court recently dismissed the lawsuit challenging the closure of the Iowa Juvenile Home in 2014, without considering the merits of that case, on the grounds that the legislature made the issue “moot” by no longer appropriating state money to operate that facility. By refusing to include funding for the two closed mental health institutes in the budget for fiscal year 2017, Iowa House Republicans could bolster the Branstad administration’s efforts to defeat the lawsuit filed today.

Terry Branstad's weak excuse for axing refugee support funding

The apparent attempt to bury Governor Terry Branstad’s large batch of budget cuts before the July 4 holiday weekend isn’t working. Fallout from the governor’s line-item vetoes continues to make news on a daily basis. Today, Iowa Senate Democratic leaders announced that they have formally asked colleagues to request a special legislative session to override the highest-profile and largest vetoes, which affected education and mental health funding.

Meanwhile, the latest article by the Des Moines Register’s “Reader’s Watchdog” Lee Rood called attention to an item veto that flew below the radar last week: $100,000 from the health and human services budget, intended for a pilot project to serve refugees in Polk County. The amount of money was so small–far less than one-tenth of 1 percent of the $7 billion state budget–that Branstad couldn’t fall back on misleading statements about “fiscal health” to justify this item veto. Instead, he cited an equally weak pretext.

Staci Appel decides against repeat campaign in IA-03

Former State Senator Staci Appel told the Des Moines Register’s Jennifer Jacobs this morning that she has decided not to run for Congress again in Iowa’s third district. Appel was uncontested for the 2014 nomination in IA-03 and raised quite a bit of money but lost to David Young by a disappointing 10-point margin.

No Democrats have announced plans to challenge Young yet, but former State Senator Matt McCoy is widely considered likely to run–even if he’s not the first choice of Democratic insiders in Washington. Former State Senate candidate Desmund Adams has been talking to Democratic activists around the district for the past several months. Former Governor Chet Culver said earlier this year that he would consider running in IA-03. I haven’t heard much chatter about Culver lately, but Pat Rynard sees him “taking a very serious look” at the race and for various reasons put Culver at the top of his “power rankings” on the IA-03 Democratic primary. I would consider McCoy a slight favorite in a primary battle against Culver and Adams.

EMILY’s List leaders were in Des Moines last week, having put David Young on their list of Republicans who should be “on notice.” That PAC endorses and helps to direct like-minded donors toward pro-choice Democratic women candidates. I’m not aware of any women considering the IA-03 race now that Appel has ruled herself off, so I wonder whether EMILY’s List came to town seeking to recruit someone else. After Representative Tom Latham announced his retirement plans, some local Democrats were hoping State Senator Janet Petersen would run in IA-03, but Petersen hasn’t expressed any interest in serving in Congress. She is much more likely to run for governor in 2018.

Any relevant comments are welcome in this thread.

UPDATE: Forgot to mention that Jim Mowrer, who challenged Representative Steve King in IA-04 in 2014, recently moved to Des Moines from Boone. Ha reportedly has not ruled out running against Young.

Iowa Senate confirms all but one Branstad appointee during 2015 session

The Iowa legislature’s 2015 session drags on amid unresolved conflict over various budget issues, especially K-12 school funding. But one aspect of the lawmakers’ work is complete for this year. The Democratic-controlled Iowa Senate has confirmed all but one of Governor Terry Branstad’s more than 200 nominees. The overwhelming majority of those votes were unanimous or nearly so.

In recent years, senators have voted against confirming one or two Branstad nominees. This year no nomination failed on the Iowa Senate floor, and only one department head was ever in real danger of not being confirmed to do his job: Department of Human Services Director Chuck Palmer.

Branstad has occasionally withdrawn nominees who didn’t have support from the necessary two-thirds majority in the Iowa Senate. This year the governor didn’t need to exercise that power, although he sidestepped a near-certain rejection by accepting Teresa Wahlert’s resignation in January, rather than reappointing her to run Iowa Workforce Development. In addition, Iowa Law Enforcement Academy Director Arlen Ciechanowski recently announced plans to retire, tacitly acknowledging the votes weren’t there to confirm him.

Branstad names Geri Huser to Iowa Utilities Board, demotes Libby Jacobs (updated)

I missed this story last week, but Ryan Foley didn’t: Governor Terry Branstad is replacing Sheila Tipton with Geri Huser on the Iowa Utilities Board. Not only that, Branstad appointed Huser to chair that three-member board, demoting current Chair Libby Jacobs for the remainder of her term, which runs through April 2017. A recent board ruling that disappointed MidAmerican Energy, an investor-owned utility serving a large area in Iowa, precipitated the governor’s decision.

Moderatepachy Goes to Des Moines: Vol. I

When I am not a moderatepachy, I am a lawyer.  The majority of my practice is as defense counsel in civil litigation.  Sometimes, the job is rewarding, especially when you win in lawsuits initiated by lawyers who advertise like this (disclosure: I have never opposed them, but I hope to one day, and win).  Other times, the job causes headaches, because my job is to to be a skeptic.

Recently, I went to the Iowa State Senate to talk about this proposed legislation.  SF107 extends the Statute of Limitations for filing civil (and criminal) actions relating to sex abuse of a child.  You can read an 80% accurate depiction of the Senate Subcommitte hearing here.  Believe this moderatepachy, the testimony from the survivors was passionate.  Petrovsky omitted that another survivor of abuse, John, gave compelling testimony.

What Petroski also missed is that the bill would allow suits within 25 years of the “discovery” of abuse by the alleged victim.   In other words, the 60+ year old senior partner at my firm could “discover” tomorrow that he had been abused as a child, and he would have 25 years to file suit… imagine a lawsuit filed in 2039 for something that allegedly occurred during the LBJ administration.   (No doubt Hillary Clinton's granddaughter and Ted Cruz's son will yell at one another about the lawsuit one day on Fox News' “Hannity & Son”).

The sensitive and difficult nature about these types of suits is touched on here by the Iowa Catholic Conference; the Catholic church has a dog in this fight for obvious reasons I need not explain.

Besides those, the reality is that most abusers do not have any money; but insurance policyholders do.   The gimmick, then, is that one sues the abuser… but also wherever the abuser taught, worked, and preached, under a theory that supervisors are liable for whatever their subordinates do.  Imagine the changes that occur in 4 years (the Statute of Limitations right now) in a business, school, or church.  Records, witnesses, memories… gone.  Just like plaintiffs, defendants have a right to a fair trial.  How can one defend against an alleged wrong that occured 30, 50, or 70 years ago?

After the victims testified, it was clear that Senator Petersen (D, SD-18) urgently wanted to move the bill forward.  The defense bar hopes that cooler heads might prevail in the House.  Last year, similar legislation died in a Senate subcommittee.  To oppose this bill is tricky; to be seen as “against” abuse victims is to be seen as tacitly “supporting” abusers.    

What is interesting is that the lobbyist declarations have not been very active; certainly there are other things that keep our legislators busy, and in same cases, motivate our legislative leaders to cave to Farm Bureau pull members of their own caucus off of committees to get things done.

I urge any other Bleeding Heartland readers, if you hear about legislation you might not like, figure out a way to find it, found out who supports it, and share your view with your legislators.    

This moderatepachy may have further updates and hopes to give readers more insights in the legislative sausage being made.  Moderatepachy would also like to salute the work of desmoinesdem, for creating an incredible local resource on Iowa politics.  It smarts that the analysis and writing in this blog and another (D)'s usually has more contextstatewide scope, and humour (say it with a British or French accent to justify my misspelling), than the flagship for my party.   

 

Iowa Senate, House approve gas tax increase

A bill that would raise Iowa’s gasoline tax by 10 cents a gallon is on its way to Governor Terry Branstad’s desk after approval today by both chambers in the Iowa legislature. The Iowa Senate passed Senate File 257 this morning by 28 votes to 21. Sixteen Democrats and twelve Republicans voted for the bill, while ten Democrats and eleven Republicans opposed it. Senate Majority Leader Mike Gronstal had reportedly insisted on at least half the GOP caucus supporting a gas tax increase as a condition for bringing the bill to the floor.

A few hours later, the Iowa House took up the Senate bill (rather than the bill that cleared two House committees last week). Thirty Republicans and 23 Democrats voted yes, while 26 Republicans and 20 Democrats voted no.

Only two state legislators missed today’s votes: Republican State Senator Mark Chelgren and Republican State Representative Chip Baltimore. Baltimore voted against the House version of this bill in committee last week, while Chelgren doesn’t serve on the committees that approved the bill in the Senate. Chelgren appears to have been absent for all of today’s votes, while Baltimore was at the Capitol but left the chamber when the gas tax bill came up. Speaking to reporters later, he tried to make a virtue out of his absence: “I refuse to legitimize either the bill or the process with a vote.” Weak sauce from a guy who is widely expected to seek higher office someday.

Conservative groups are urging Branstad to veto Senate File 257, but that seems unlikely, given the governor’s recent comments on road funding. Branstad’s spokesman said today that the governor will carefully review the final bill before deciding whether to sign it.

Final note: several of the “no” votes came from lawmakers who may face competitive re-election campaigns in 2016. Those include Democrats Chris Brase (Senate district 46), Steve Sodders (Senate district 36), and Mary Jo Wilhelm (Senate district 26), and Republicans Dennis Guth (Senate district 4) and Amy Sinclair (Senate district 14).

The Iowa legislature’s 2015 session begins today. Democrats maintained their 26 to 24 majority in the upper chamber. I’ve also enclosed below details on the tenure of all 50 Iowa senators. The experience gap between the caucuses is striking, even more so since three of the longest-serving GOP state senators retired in 2014. Only seven of the 24 Republicans have served in either the state House or Senate for more than four years, whereas nineteen of the 26 Democrats have more than four years of legislative service. Only four of the 24 Senate Republicans have ten or more years of experience in the Iowa legislature, compared to seventeen of the 26 Democrats. No current Iowa Senate Republican has more than 20 years legislative experience, whereas six Democrats do.

Just seven of the 50 senators are women, down from ten women in the chamber two years ago. The Democratic caucus includes 20 men and six women; the Republican caucus 23 men and one woman.

All current Iowa senators are white. To my knowledge, no African-American has ever served in the Iowa Senate. CORRECTION: Bleeding Heartland reader northwest points out that I forgot Tom Mann, who represented part of Des Moines in the Iowa Senate during the 1980s.

No Latino has ever served in the Iowa House or Senate; Nathan Blake fell 18 votes short of becoming the first in 2014. No Asian-American has served in the state Senate since Swati Dandekar resigned in 2011.

Some non-political trivia: the 50 state senators include three Marks, three Bills, three Richards (who go by Rich, Rick, and Dick), two Mikes, two Toms, two Joes, and two men named Charles (one goes by Chaz).

Five reasons Teresa Wahlert's days are numbered at Iowa Workforce Development

I don’t expect Governor Terry Branstad to replace many state agency leaders going into his sixth term, but before too long he will need to find a new head of Iowa Workforce Development. Although he will probably nominate Teresa Wahlert for that post again, the Iowa Senate will likely reject her confirmation. Here’s why:

1. Wahlert needs at least ten Democrats to join the 24 incoming Iowa Senate Republicans in order to be confirmed. She was confirmed in 2011 with only two votes to spare; two of the twelve Democratic senators who backed her then no longer serve in the Iowa legislature, and several who remain in the Senate have been critical of various Branstad administration policies implemented by Wahlert.

2. Wahlert presided over dismantling staffed Iowa Workforce Development field offices in dozens of communities, following a Branstad line-item veto that was eventually struck down by a unanimous Iowa Supreme Court.

3. Wahlert is a defendant in a lawsuit filed by former Iowa Workers’ Compensation Commissioner Chris Godfrey. Depositions are happening soon in that case, following an Iowa Supreme Court ruling earlier this year.

4. Wahlert is also a defendant in a lawsuit filed by Joseph Walsh, the former Chief Administrative Law Judge for Iowa Workforce Development. Among other things, Walsh alleges that Wahlert “interfere[d] with the administrative judicial process in order to favor employers,” attempted “to illegally strip [Walsh] of his merit protection,” and eventually retaliated by removing him in “a political reorganization disguised as a budget layoff.”

5. Just this week, an arbitrator ruled that Wahlert “overstepped her bounds when she promoted a judge who had been demoted after complaints that she created a hostile work environment.” After the jump I’ve posted excerpts from David Pitt’s report for the Associated Press.

No wonder State Senator Janet Petersen has predicted that Wahlert would face a tough confirmation process if re-appointed by Branstad. He could save everyone a lot of time by choosing new leadership for Iowa Workforce Development.

Mid-week open thread: 2018 IA-Gov scenarios edition

All topics are welcome in this open thread. I’d like to hear from Bleeding Heartland readers about the next race for Iowa governor. Winning that election needs to be a top priority for Iowa Democrats.

I remain 100 percent convinced that Terry Branstad will not serve out his entire sixth term. By the end of 2015, he will have set a record as the longest-serving governor in U.S. history. He is committed to “grooming” Lieutenant Governor Kim Reynolds to be the next governor. But Reynolds was almost unknown when Branstad selected her as his running mate. She had only two years of experience in the state legislature, all of it in the Iowa Senate minority. Before that, she had a long tenure as the Clarke County treasurer, a job that doesn’t allow politicians to build up a profile outside their home county.

Since Reynolds has no constituency in the Republican base, I find it hard to imagine she could win the nomination for governor campaigning from her current job. However, if she has a year or more under her belt as governor by the spring of 2018, she might have a fighting chance in the GOP primary. Even then, I don’t think other Republicans would give her a pass. Plenty of people have ambitions to succeed Branstad. I’ll be surprised if Secretary of Agriculture Bill Northey doesn’t run for governor during the next cycle.

On the Democratic side, several state lawmakers could be credible candidates for governor. Iowa Senate President Pam Jochum considered it this past cycle but opted out for family reasons. I hope Jochum will take the plunge in 2018, as she would be a great candidate and a fantastic governor. State Senators Janet Petersen and Rob Hogg would also be excellent leaders and will probably also give this race a look.

UPDATE: Two-time candidate for secretary of state Jake Porter is considering a gubernatorial bid on the Libertarian ticket and sees both outgoing Secretary of State Matt Schultz and newly-elected Secretary of State Paul Pate as likely Republican candidates. Pate sought the GOP nomination for governor in 1998 after one term in the secretary of state’s office, so he could easily do that again. I find it hard to believe that the Madison County attorney position will give Schultz a good launching pad for a gubernatorial campaign, but anything is possible.

Porter also mentioned State Treasurer Mike Fitzgerald as a possible Democratic candidate. Fitzgerald considered running for governor in 2013.

SECOND UPDATE: Lots of names being floated in the comments: Bob Vander Plaats, Iowa House Speaker Kraig Paulsen, State Representative Peter Cownie, and State Senator Amy Sinclair on the Republican side; newly elected State Senator Chaz Allen or State Representative Nancy Dunkel on the Democratic side.

Erin Murphy, who covers Iowa politics for Lee Enterprises newspapers, has predicted a matchup between Jochum and Reynolds in 2018. I like Jochum’s odds there, a lot.

Associated Press reporter Ryan Foley reports that Republican strategists are “keeping a close eye” on Chaz Allen. I wonder whether that may be wishful thinking on their part, as they appear to have no chance of winning Iowa Senate district 15 as long as Allen is around. I think 2018 would be a little early for him to run for governor.

I should also mention that incoming U.S. Senator Joni Ernst will probably go all-in for Reynolds in the 2018 primary. Reynolds helped to recruit Ernst for the Iowa Senate and later for the U.S. Senate race.

THIRD UPDATE: Some Iowa politics-watchers expect State Senator Liz Mathis to run for governor in 2018. I don’t think she would run against Petersen or Jochum in a primary, though, and I consider either of them more likely to run than Mathis.

IA-03: Who should run against David Young?

The Bleeding Heartland community has been discussing potential Democratic challengers in Iowa’s first Congressional district here, and I expect people will have equally strong views about who should run in IA-03. David Young will be a much tougher opponent in 2016 than Rod Blum, the surprise winner in IA-01. Democrats don’t have a voter registration advantage in the third district like they do in northeast Iowa. Young’s many contacts in Washington will help him raise a ton of money. Furthermore, U.S. Senator Chuck Grassley plans to run for re-election in 2016 and will pull out all the stops to help his former chief of staff Young.

Among the 16 counties in IA-03, Polk County is the only place Democrats have any bench to speak of. Since more than half the registered voters in the Congressional district live in Polk County, it will be critically important for any Democratic challenger to run up the score there. President Barack Obama carried Polk by about 32,000 votes in 2012 but only gained about 51.4 percent of the vote throughout the Congressional district. So, I would guess that any Democratic candidate would need to win Polk County by between 25,000 and 30,000 votes to have a shot against Young.

No doubt many Democrats will be thinking about this race. State Senator Matt McCoy is almost a sure bet, since he was ready to run for Congress way back in 2002 and has said many times he would consider running after outgoing Representative Tom Latham retired. Having just been re-elected to a four-year term, McCoy would not have to give up his Iowa Senate seat to seek higher office in 2016.

State Senator Janet Petersen would be an excellent candidate, but she is up for re-election in 2016, so would have to choose between running against Young and seeking another term in Iowa Senate district 18.

Fewer women will serve in the Iowa Senate, more in Iowa House

For the past two years, ten women have served in the Iowa Senate (20 percent of the chamber’s membership). That number will fall to seven or eight by the time the newly-elected legislature begins its 2015 session.

However, the number of women who will serve in the Iowa House will grow from 25 to 27 for the next two years. Follow me after the jump for details and a full list of Democratic and Republican women who will serve in the newly-elected Iowa legislature.

Following up on prospects for increasing racial and ethnic diversity in the Iowa legislature, all five African-American state representatives were re-elected to the Iowa House this week: Helen Miller (House district 9), Ruth Ann Gaines (House district 32), Ako Abdul-Samad (House district 35), Deborah Berry (House district 62), and Phyllis Thede (House district 93). Neither party nominated any African-American candidates for the Iowa Senate, which remains all-white.  

Iowans have yet to elect a Latino candidate to the state legislature. Democrats nominated Karyn Finn in House district 60 and Maria Bribriesco in Senate district 47, but both lost to Republican incumbents on Tuesday.

As has been the case since Swati Dandekar left the Iowa Senate in 2011, the Iowa legislature includes no Asian-American lawmakers. Neither party nominated any Asian-American candidates in 2014.

Iowa Senate Democrats roll out state government reforms

The Iowa Senate Oversight Committee met yesterday to approve a wide range of recommendations on state government management, contracting, and labor practices. O. Kay Henderson posted audio from the committee meeting at Radio Iowa. On a 3-2 party-line vote, Democrats on the committee approved recommendations in the following nine areas:

• A ban on secret settlements and hush money

• Expanded whistleblower protections

• Anti-cronyism measures

• Reform of the state’s “do-not-hire” database

• A ban on no-bid contracts for state projects

• Increase accountability in state infrastructure projects

• Protect Iowans right to fair hearings by preventing political appointees and at-will employees from supervising or evaluating judges

• Restore integrity to Iowa’s unemployment trust fund by appointing trusted and transparent leadership

• Require that the Legislature be notified when the Governor receives reports of founded workplace violence in state agencies.

One of the Republicans who voted against the recommendations, State Senator Julian Garrett, characterized the Democratic proposals as “political theater” not “borne out by the facts.”

“No laws were broken. No codes of ethics were violated,” Garrett said. “Instead, we have discovered that there is a difference of opinion in management philosophies…and we have learned that sometimes front-line workers don’t care for or particularly agree with their bosses.”

In Garrett’s view, Governor Terry Branstad is running the state “exceptionally well” and should get more credit for ending secret settlements through an executive order. However, witnesses appearing before the Iowa Senate Oversight Committee in recent months testified to many problems in state government beyond settlements that included confidentiality clauses (which were the first scandals to get widespread attention). Committee Chair Janet Petersen mentioned several of them in her opening remarks for yesterday’s meeting. After the jump I’ve posted a more detailed list of recommendations, along with findings that prompted them. Whether these proposals go anywhere during the 2015 legislative session will depend on party control of the Iowa House and Senate after the November election.

Rod Boshart paraphrased Petersen as predicting that if Branstad is re-elected, several of his appointees who were involved in these scandals may have trouble being confirmed by the Iowa Senate, “notably Iowa Workforce Development Director Teresa Wahlert.”

Weekend open thread: Cost of doing nothing edition

What’s on your mind this weekend, Bleeding Heartland readers? This is an open thread.

Sunday’s Des Moines Register includes a good feature by Lauren Mills of IowaWatch.org and the Iowa Center for Public Affairs Journalism. She lays out how payday lenders are “burying Iowans” in debt. Iowa Senate Ways and Means Committee Chair Joe Bolkcom pointed out that the payday lending business model depends on “locking people into this cycle of debt.” Previous research has indicated that payday lenders cost Iowa consumers about $36 million per year. Mills reports that this industry spends heavily on campaign contributions and lobbying the Iowa legislature. Lobbyists talk a good game about jobs and helping people who need cash for emergency expenses. But think how many more jobs could be created if Iowans living paycheck to paycheck had $36 million more to spend on goods and services, rather than on outlandish “loan shark rates.”

Mills reports that legislation to regulate interest rates charged by payday lenders has been stalled. Bolkcom said Senate Majority Leader Mike Gronstal won’t bring up the bill unless it can pass the Republican-controlled Iowa House. House Majority Leader Linda Upmeyer called that a “convenient excuse” for the Senate not to act. I haven’t noticed her or any other House Republicans acknowledging this problem, though.

The best chance for Iowa lawmakers to address payday lending was during the period when Democrats controlled “the trifecta.” In 2007, the Iowa House and Senate approved, and Governor Chet Culver signed, a bill capping interest rates on car title loans. (Such legislation had been stalled for years when Republicans controlled the Iowa House, although it attracted bipartisan support in both chambers in 2007.) Three years later, Bolkcom and then Iowa House Democrat Janet Petersen made a major push to pass a similar interest rate cap on payday lenders. However, industry lobbyists warned that such a law would put payday lenders out of business, as had happened with car title lenders. A wide range of organizations supported the payday lending reform, including the Iowa Attorney General’s office, the Iowa Catholic Conference, the Child and Family Policy Center, and Iowa Citizens for Community Improvement. But ultimately, the House version of that bill died when conservadem State Representative Mike Reasoner sided with two Republicans to kill it in subcommittee.

Some Iowa local governments, most recently in Waterloo, have passed zoning rules to try to prevent payday lenders from targeting low-income neighborhoods. But state regulations are the only realistic way to stop the cycle of debt perpetuated by lenders who keep borrowers coming back for more high-interest loans and cash advances. Iowans on the edge are paying the price for the legislature’s failure to act years ago.

Prospects for increasing diversity in the Iowa legislature

Forty men and ten women currently serve in the Iowa Senate. No senators are African-American, Latino, or Asian-American.

Seventy-five men and 25 women currently serve in the Iowa House. Five state representatives are African-American and none are Latino or Asian-American.

Time for a look at how those numbers might change after the November election, now that primaries have determined the major-party nominees in all state legislative districts. Weekend open thread: Mother's Day edition

What’s on your mind this weekend, Bleeding Heartland readers? This is an open thread: all topics welcome. I’ve enclosed a few links in honor of Mother’s Day.

The Pew Research Center posted “5 questions (and answers) about American moms today.”

Annie Fox, who has a great website for teens, tweens, and their parents, shared her perspective on “What makes a good mom?”

Mother’s Day can be a difficult holiday for many people, especially women who have experienced the death of a child. State Senator Janet Petersen wrote about her stillbirth and her work since then to educate parents on monitoring their babies’ movements during the third trimester. I’ve posted excerpts after the jump.

Mother’s Day can also be challenging for those whose mothers have died. Hope Edelman, the author of the book Motherless Daughters, shared her experiences and advice on how to spend the day when your mother is gone.

Finally, Mother’s Day can stir up painful feelings for those who never received the emotional support they needed from their mothers. Dr. Laura Markham, who runs my all-time favorite parenting website and writes one of the best parenting blogs, recently re-shared her excellent post on “How to Give Unconditional Love When You Didn’t Get It Yourself.”

Speaking of great advice, Froma Harrop’s latest syndicated column urges college students who are the victims of rape or sexual assault to call 911, rather than reporting to campus authorities. “Rape is a violent crime, and when violent crimes occur, the police should be called.” Parents of college students should pass along these wise words. My only quibble with Harrop is that she assumes all such victims are women. Men can also be assaulted sexually, and if that happens to a male college student, he should call 911 as well.

Highlights from this year's Iowa Senate votes on Branstad nominees

During the 2014 legislative session, the Iowa Senate confirmed all but a handful of Governor Terry Branstad’s more than 200 nominees for state boards and commissions. It’s not unusual for senators to vote down one or two appointees, but this year the Senate confirmed everyone who came up for a vote on the floor.

The only close call was former Iowa House Republican Nick Wagner, confirmed to the Iowa Utilities Board last month with just one vote to spare. Branstad originally named Wagner to the three-member utilities board in 2013 but pulled his nomination when it became clear that senators would not confirm him. Branstad named Wagner to that board anyway, right after the Senate adjourned for the year in 2013. By the time his nomination came up for consideration this year, a couple of factors that worked against him were no longer relevant. Former State Senator Swati Dandekar had resigned from the board to run for Congress, so there would no longer be two of three members from Marion (a Cedar Rapids suburb). Furthermore, Branstad named attorney Sheila Tipton to replace Dandekar, so senators could no longer object to the lack of a lawyer on the Iowa Utilities Board.

Still, most of the Democratic caucus opposed Wagner’s nomination. State Senator Rob Hogg cited the nominee’s support for a bad nuclear power bill that the legislature considered a few years back. Meanwhile, State Senator Matt McCoy (who incidentally wanted to pass the nuclear bill) noted that as a key Iowa House Republican on budget matters, Wagner “was not willing to listen” and “took very difficult and very hard-line positions.” After the jump I’ve posted the roll call on the Wagner nomination; 11 Democrats joined all 24 Republicans to confirm him.

As in recent years, the governor withdrew a handful of nominees who were not likely to gain at least 34 votes (a two-thirds majority) in the upper chamber. A few nominees for low-profile boards had to go because of party imbalance issues. Chet Hollingshead, one of seven Branstad appointees to the Mental Health and Disability Services Commission, never came up for a vote, presumably because of a theft incident Bleeding Heartland user Iowa_native described here.

I am not sure why Senate Majority Leader Mike Gronstal informed Branstad that Jason Carlstrom was unlikely to be confirmed as chair of the Iowa Board of Parole. The governor first appointed Carlstrom to that position in the summer of 2012, to fill out the remainder of someone else’s term. The Iowa Senate unanimously confirmed him during the 2013 legislative session. When Branstad reappointed Carlstrom to the parole board this year, I didn’t expect him to run into any trouble. I will update this post if I learn more details.

The highest-profile nominee withdrawn by Branstad was former Iowa House Republican Jamie Van Fossen, whom the governor wanted to chair the Public Employment Relations Board. Cityview’s Civic Skinny described the backstory well; I’ve posted excerpts after the jump. Van Fossen still serves on that board, having been confirmed to a full term in 2012. But the new chair will be Mike Cormack, a Republican who served four terms in the Iowa House and later worked for the State Department of Education. Senators unanimously confirmed Cormack last month. The outgoing Public Employment Relations Board chair, Jim Riordan, has alleged that the board faced political pressure from Branstad staffers to hire an employer-friendly administrative law judge.

Branstad administration scandal news and reaction thread (updated)

While Governor Terry Branstad vacations in Arizona this week, his administration is facing new allegations of misconduct. As first reported in the Sunday Des Moines Register, at least six former state employees were offered secret settlement deals after claiming they were forced out of their jobs for political reasons. Today, Democratic State Senator Bill Dotzler announced that he is seeking a federal investigation into the actions of Iowa Workforce Development Director Teresa Wahlert, whom Dotzler accused of interfering with the work of administrative law judges.

IA-Gov: State Senator Janet Petersen not running

State Senator Janet Petersen has decided against running for governor in 2014, she told Todd Dorman of the Cedar Rapids Gazette yesterday.

Petersen, 43, said family concerns led to her decision. She has children age 6, 9 and 12, and a husband who travels frequently for work. She said trying to balance the demands of a statewide race with her work in the Senate is also a worry. […]

Petersen weighed the prospects of a campaign “struggling with taking on a governor who has been governor forever and doesn’t miss a parade or ribbon cutting,” she said. And, in the end, she decided to stay out of the race.

Last month Petersen ruled out running for Congress in the third district.

An early endorser of Tyler Olson for governor, Petersen had been considered a likely running mate for Olson if he had won the Democratic nomination. Now she’ll go on the list of likely candidates for governor sometime in the future.

State Senator Jack Hatch is now the prohibitive favorite to be Governor Terry Branstad’s Democratic opponent this year. Jonathan Narcisse may enter the Democratic primary, but otherwise Hatch would face only token opposition from Paul Dahl.

IA-Gov: Jonathan Narcisse may run as a Democrat

Radio Iowa’s O.Kay Henderson reports today that Jonathan Narcisse is considering a gubernatorial bid as a Democrat in 2014. Narcisse endorsed Chet Culver during the 2006 IA-Gov primary, then briefly considered running against Culver in the 2010 primary before launching an independent campaign instead. You can find background on Narcisse here and issue positions from his previous campaign on this website. In the 2010 general election, he received more votes than the Libertarian candidate, finishing with 20,747 votes statewide (about 1.9 percent). According to Henderson’s report today, Narcisse has ruled out running as an independent next year and now considers his 2010 choice “naive” and a “mistake.”

Since State Representative Tyler Olson ended his campaign last week, State Senator Jack Hatch is the only declared Democratic candidate for governor. Former State Representative Bob Krause is still in the exploratory phase but sounds likely to make his campaign official early next year. He recently told the Cedar Rapids Gazette’s James Lynch that Olson’s departure will be a “turning point,” adding, “I’ve turned from a dark horse to a horse.” State Senator Janet Petersen, an early Olson endorser, is also thinking about running for governor.

Janet Petersen should run in IA-03, not for governor

Democratic State Senator Janet Petersen told reporters today that she is “thinking about” running for governor next year. Petersen was an early endorser of State Representative Tyler Olson, who just dropped out of the governor’s race.

Who would advise Petersen to take this course? All polls taken this year, including two surveys released this week, indicate that Governor Terry Branstad will be extremely difficult to beat in 2014. Meanwhile, an open Congressional seat in central Iowa is almost a once in a lifetime opportunity. IA-03 is very winnable for a Democrat, and without meaning any disrespect to Staci Appel, Petersen has more legislative experience and accomplishments. She would be a stronger Congressional candidate.

Either way, Petersen doesn’t need to give up her Senate seat to run for higher office. After serving six terms in the Iowa House, she was just elected to represent Iowa Senate district 18 in 2012. She won’t be up for re-election until 2016.

UPDATE: So much for that idea. Senator Petersen responded to my request for comment: “It would be an honor to serve Iowans in Congress, but my family and I don’t want to move to DC.” I understand the decision; she has three young children.

Bombshell in IA-03: Tom Latham not seeking re-election

From the day I first saw Iowa’s new map of political boundaries in 2011, I had a bad feeling that Republican Tom Latham would be representing me in Congress for most of this decade. I did not see today’s news coming: in an e-mail to supporters this afternoon (full text here), the ten-term incumbent announced that he will not seek re-election to the U.S. House in 2014. Latham plans to spend more time with his family.

The Democratic Congressional Campaign Committee was already targeting Iowa’s third Congressional district, and Latham was in the National Republican Congressional Committee’s incumbent protection program. As an open seat, the race will be far more competitive than if longtime incumbent Latham were on the ballot. I am curious to see which Republicans jump in this race. I doubt Des Moines-based teacher and business owner Joe Grandanette, who had already announced a primary challenge to Latham, will be the GOP nominee. I assume several state legislators or former legislators will go for it, but probably not State Senator Brad Zaun, who couldn’t beat Leonard Boswell in the biggest Republican landslide in decades.

Former State Senator Staci Appel has a head start in the race for the Democratic nomination, with nearly $200,000 cash on hand as of September 30 and the support of several Democratic-aligned interest groups, including EMILY’s List. Gabriel De La Cerda is the other declared Democratic candidate in IA-03. With Latham retiring, I wonder if other Democrats will jump in the race. For instance, State Senator Matt McCoy was planning to run for Congress in the third district in 2002 before Representative Boswell decided to move to Des Moines so as not to face Steve King in what was then IA-05.

As of December 1, IA-03 contained 157,456 active registered Democrats, 164,311 Republicans, and 160,205 no-party voters, according to the Iowa Secretary of State’s office.

UPDATE: Shortly after news broke of Latham’s retirement, Appel sent out a fundraising appeal and tweeted that her team was “thrilled to see our work holding Latham accountable has paid off.”

SECOND UPDATE: State Senator Janet Petersen comes to mind as a potential Democratic candidate as well. On the Republican side, I wonder whether some mayors or Waukee City Council Member Isaiah McGee will go for it.

THIRD UPDATE: Lieutenant Governor Kim Reynolds already ruled out running for Congress, but Iowa Secretary of State Matt Schultz is seriously considering it.

Iowa Senate Majority Leader Mike Gronstal lives in IA-03 and could run for Congress without risking his state Senate seat, since he’s not up for re-election until 2016.

Also added statements from Representatives Bruce Braley, Dave Loebsack, and the Iowa Democratic Party below. Iowa Citizens for Community Improvement Action released a statement calling on Latham to help move immigration reform forward, now that he “has nothing to lose.”

IA-Gov: Tyler Olson scaling back campaign temporarily

State Representative Tyler Olson just announced that because he and Sarah Olson are separating after seven years of marriage, he is “scaling back campaign events for the remainder of the year to focus on my family and helping them through this transition.” He said he and his wife took this step “only after significant discussion and professional support to deal with the issues facing our marriage,” and that he is “deeply committed” to continuing the race for governor after the holiday season.

Many prominent Iowa Democrats, including more than two dozen state legislators, have endorsed Olson for governor, as did the state’s largest labor union. I will update this post as needed with political reaction.

UPDATE: Added Olson’s e-mail about the situation after the jump.

Olson has until March 14, 2014 to decide whether to stay in the race. Democrat Liz Bennett is already running in Iowa House district 65, which Olson is vacating.

State Senator Jack Hatch, another Democratic candidate for governor, said in a statement, “This is a private matter and we should all respect the family’s privacy. These matters are always very hard and unpleasant for everyone involved. I wish Rep. Olson, Sarah, and their family the best as they work through this difficult time. I will not have any further comment.”

State Senators Janet Petersen and Jeff Danielson, who both endorsed Olson earlier this year, told the Des Moines Register that they still support his gubernatorial campaign.

SECOND UPDATE: No surprise, Governor Terry Branstad has no comment about Olson’s family situation.

THIRD UPDATE: In another signal Olson is serious about staying in the governor’s race, on December 4 his campaign urged supporters to help collect signatures for his ballot petitions.

Latest farm bill news and Iowa political reaction (updated)

Today members of the U.S. House and Senate began conference committee negotiations on the farm bill. The last five-year farm bill expired in 2012, and the latest extension of most federal farm programs (except for some related to conservation and sustainable agriculture) lapsed on September 30. Two Iowans are on the 41-member conference committee: Democratic Senator Tom Harkin and Republican Representative Steve King (IA-04).

One issue is likely to dominate the Congressional talks: funding levels for nutrition programs, especially the Supplemental Nutrition Assistance Program, formerly known as food stamps. This summer, both Harkin and Republican Senator Chuck Grassley voted for the Senate farm bill, which cut SNAP by about $4 billion over 10 years. Iowa’s four U.S. House members split along party lines when the House approved a Republican bill with $39 billion in cuts over the same time frame. Keep in mind that regardless of what happens in the farm bill talks, all SNAP recipients–including an estimated 1 million veterans and approximately 421,000 Iowans–will see their food assistance reduced as of November 1. Click here for a detailed report on those cuts, which will occur as extra funding from the 2009 federal stimulus bill runs out.

IA-Gov: Hatch rolls out campaign, Olson rolls out endorsements (updated)

State Senator Jack Hatch made his candidacy for governor official in Des Moines this morning, en route to campaign stops in five other Iowa cities. A few days ago, State Representative Tyler Olson sought to build momentum by revealing a long list of state lawmakers who support his gubernatorial campaign.

IA-Gov: Bob Dvorsky is third senator to endorse Tyler Olson

It’s been a banner week for State Representative Tyler Olson. Not only did the top two Iowa Senate Democrats both rule out running for governor, Olson gained public support from State Senator Bob Dvorsky. He posted on Facebook last night, “I’m not just endorsing Tyler, but the idea of creating a new vision for Iowa that will lead our state into the next 30 years of innovation and prosperity.” Dvorsky’s wife, Sue Dvorsky, preceded Olson as Iowa Democratic Party chair and “enthusiastically” endorsed his candidacy a few weeks ago. Olson also has the backing of State Senator Janet Petersen, with whom he served in the Iowa House, and State Senator Rob Hogg, whom he has known for the last decade, as well as several Iowa House Democrats.

The endorsements for Olson are a bit awkward for State Senator Jack Hatch, who hasn’t secured the public support of any fellow legislators as he explores a gubernatorial campaign.

I understand jumping on board with a candidate you believe in, but at the same time, I feel that a Democratic establishment stampede to any candidate (as happened with Brad Anderson’s secretary of state campaign) is premature when the field isn’t even set. In addition to Olson and Hatch, former State Representative Bob Krause is running for governor, and State Treasurer Mike Fitzgerald hasn’t ruled out the race. The Iowa Democratic Party would benefit from at least one spirited statewide primary contest next spring, especially since the U.S. Senate race is just a coronation on our side.

Last-minute Iowa legislative scramble is nothing to brag about

The Iowa Senate wrapped up its work for the year shortly after midnight on May 23, and Iowa House members adjourned about 11 hours later. Lawmakers in both parties have been congratulating themselves for compromising on some big issues that ended in stalemate the previous two years. Rod Boshart compiled an excellent list of what the legislature did and didn’t approve during 2013.

We all can appreciate the desire to finish a big project before a holiday weekend, and since legislators stopped receiving per diem payments weeks ago, they understandably wanted to get out of town as quickly as possible. However, I found it disturbing that votes were held before most lawmakers, let alone members of the public, had time to digest final conference committee deals on education reform, an alternative to Medicaid expansion, property taxes, and the health and human services budget. Transparency isn’t just a buzzword. Had journalists and advocacy groups been able to look over the last-minute compromises, people might have discovered problematic language or even simple drafting errors, which could produce unintended consequences after Governor Terry Branstad signs these bills into law.

I have a lot of questions about the final education reform bill and the plan to provide health insurance to low-income Iowans, particularly those earning between 101 percent and 138 percent of the poverty level. I also need more time to sort through the budget numbers and final changes to the standings bill. After the holiday weekend Bleeding Heartland will examine the important results of the legislative session in more detail. For now, I’ve posted after the jump details on who voted for and against the major bills approved this week.

UPDATE: In the May 24 edition of the On Iowa Politics podcast, statehouse reporters Mike Wiser and James Lynch discussed how the big issues came together “behind closed doors,” with no public scrutiny or oversight. Lynch commented that to his knowledge, the conference committee named to resolve the impasse over Medicaid expansion never formally met, except perhaps for one organizational meeting. Lynch recounted one occasion when Iowa House Republican Dave Heaton was briefing journalists about the health care talks, and the journalists asked when that happened, since there hadn’t been any public notices of conference committee meetings. According to Lynch, Heaton replied, “We’re not having meetings, but we’re meeting.” Senate President Pam Jochum said that negotiations between Democratic State Senator Amanda Ragan and House Majority Leader Linda Upmeyer produced the “key to Iowa’s health care compromise.” Notably, Upmeyer didn’t have a prominent role in passing the House health insurance plan, nor was she named to the conference committee assigned to merge the House and Senate proposals.

Speaking to journalists on May 22, Senate Majority Leader Mike Gronstal and Jochum weren’t able to answer a specific question about compromise wording reached regarding Medicaid coverage of abortions. That was no minor issue–it was the last sticking point holding up approval of the health and human services budget. In effect, Gronstal told journalists, you can see the wording after the final bill is published.

Another Iowa legislative victory for Big Ag

Factory farm advocates failed in 2009 to circumvent the Iowa DNR’s rulemaking on applying manure over frozen and snow-covered ground. Then they failed in 2010 to win passage of a bill designed to weaken Iowa’s newly-adopted regulations on manure storage and application.

But this year, the Iowa Pork Producers Association succeeded in convincing state lawmakers to relax requirements for CAFO operators to be able to store their own manure properly. All they had to do was dress up their effort as an attempt to help families with aspiring young farmers.

IA-Sen: Most Democratic state legislators endorse Braley

Representative Bruce Braley’s campaign for U.S. Senate rolled out its largest batch of endorsements today: 71 state legislators. All 26 Iowa Senate Democrats plus 45 of the 47 Iowa House Democrats are named in the press release I’ve posted after the jump. For some reason, Iowa House Minority Leader Kevin McCarthy and former Iowa House Speaker Pat Murphy are not in this group. Murphy is running for the first Congressional district seat Braley is vacating.

Earlier this week, Braley’s campaign announced that it raised more than $1 million during the first quarter. That is a solid number, and I’ll be interested to see how the numbers break own (contributions from individuals vs PACs, for instance). Bleeding Heartland will publish a detailed roundup of Iowa Congressional fundraising after all the candidates have filed their reports with the Federal Election Commission. Those reports are due April 15.

Iowa Senate approves Medicaid expansion along party lines

Last night the Iowa Senate approved Senate File 296, a bill to expand Medicaid, on a strictly party-line vote of 26 to 23. You can listen to the entire Senate debate (approximately 90 minutes) at Radio Iowa. I’ve posted highlights from the debate after the jump, along with the full list of 52 organizations that have registered their support for Senate File 296. Some corporations and organizations have have registered their lobbyists as undecided on Senate File 296, but at this writing, not a single organization is registered against the Medicaid expansion.
