Iowa attorney general: Kim Reynolds can't appoint new lieutenant governor

Iowa Attorney General Tom Miller announced today that he believes Lieutenant Governor Kim Reynolds will become the governor, and not merely “acting governor,” once Governor Terry Branstad resigns to become U.S. ambassador to China. However, in the same 23-page opinion (enclosed in full below), Miller determined that under Iowa’s constitution, Reynolds will not have the authority to appoint a new lieutenant governor once she is sworn in.

Reynolds has been vetting candidates to take her place for months, as staff in the governor’s office insisted she will have the right to appoint a new lieutenant governor. Miller’s office had indicated in December that the attorney general agreed with the Branstad administration’s view on the coming transfer of power, despite language in the Iowa Constitution stating that the governor’s powers “shall devolve upon the Lieutenant Governor” in the event of a vacancy, and calling for the Iowa Senate president to be next in line if the lieutenant governor proves incapable of “performing the duties pertaining to the office of governor.” At the time, Miller provided no legal analysis, but his office released a 1923 Iowa attorney general’s opinion, which you can read here.

Three months ago, independent State Senator David Johnson exercised his right to request a formal opinion from Miller on nine questions about the succession. He asked Miller to produce the opinion “on an expedited basis” and specifically asked him not to “simply rely on the precedent of a predecessor’s 1923 opinion.”

Staff in the Attorney General’s office, led by Solicitor General Jeffrey Thompson, conducted “extensive legal and historical research” before reaching the conclusions Miller characterized as a “split decision” during today’s press conference.

Miller noted the precedent for using the title of “governor” when previous Iowa lieutenant governors exercised the governor’s powers following a vacancy. He also noted that when vice presidents have assumed the presidency, we have called those men “president” rather than “acting president.”

Miller said five factors pointed toward the conclusion that Reynolds does not have the authority to appoint a new lieutenant governor. An important one for him was language in Article IV, Section 19 of the Iowa Constitution, which spells out the succession of power from the governor to the lieutenant governor to the president of the Senate. (I’ve enclosed that passage below.) A state constitutional amendment in 1988, which provided for the lieutenant governor to be elected on a ticket with the governor, did not change the wording about the line of succession. Furthermore, Miller found, the historical record shows “The framers [of Iowa’s constitution] intended that those in the gubernatorial line of succession be elected.”

Miller also pointed to historical practice when the U.S. Constitution’s succession language mirrored the current wording of Iowa’s constitution (saying the president’s powers “shall devolve on the Vice President”). Before the 25th Amendment to the U.S. Constitution was adopted in 1967, none of the eight vice presidents who became the head of state following the death of a sitting president attempted to appoint a new vice president for the remainder of the term.

Speaking to reporters today, Miller said that as a matter of policy, he supports the idea of the new governor having the power to appoint a new lieutenant governor. But he maintained the Iowa Constitution would have to be amended to provide for that process.

Asked what would happen if the governor’s office disagrees with his legal analysis, Miller said he expects them to follow his opinion and repeatedly expressed hope that they will do so. If Reynolds proceeds with appointing a new lieutenant governor, her action “may or may not be challenged” in court. Responding to a follow-up question, Miller clarified that the Attorney General’s Office would not file that lawsuit, repeating that he hopes Reynolds will not take that course.

I am seeking feedback from attorneys on whether an ordinary Iowa voter would have standing to go to court if Reynolds disregards Miller’s conclusions about what the constitution allows. Iowa Senate President Jack Whitver would clearly have standing, since a new lieutenant governor would take his place in the line of succession. But the loyal Republican Whitver certainly would not object.

Front-runners for the lieutenant governor spot in the Reynolds administration are rumored to include State Representative Zach Nunn and State Public Defender Adam Gregg.

A shameful end to the most destructive Iowa legislative session of my lifetime

The Iowa House and Senate adjourned for the year around 7:15 am on Saturday, after staying up all night while Republican leaders tried to hammer out last-minute deals on medical cannabis and water quality funding.

The medical cannabis compromise passed with bipartisan majorities in both chambers, but I’m not convinced the revised House File 524 will be an improvement on letting the current extremely limited law expire on July 1. The bill senators approved last Monday by 45 votes to five would have provided some relief to thousands of Iowans suffering from nearly 20 medical conditions. House Republican leaders refused to take it up for reasons Speaker Linda Upmeyer and House Majority Leader Chris Hagenow never articulated.

The new bill thrown together during the all-nighter theoretically covers nine conditions, but as Senator Joe Bolkcom explained in a video I’ve enclosed below, the only form of cannabis allowed (cannabidiol) will not be effective to treat eight of those. Although few if any Iowans will be helped, Republicans can now claim to have done something on the issue and will consequently face less pressure to pass a meaningful medical cannabis bill during the 2018 legislative session.

Republicans shut down the 30-year-old Leopold Center for Sustainable Agriculture, which supported research on farming practices that could preserve our soil and water resources. But on Friday night, they gave up on doing anything serious to clean up our waterways, 750 of which are impaired, according to the latest data released by the Department of Natural Resources. CORRECTION: More recent DNR data indicate Iowa “contains 608 waterbodies with a total of 818 impairments.” (Some waterways have more than one impaired segment.) On the opening day of this year’s session, Hagenow promised “significant new resources to water quality efforts.” Why not come back next week and keep working until they find some way forward?

I’ll tell you why: lawmakers’ per diems ran out on April 18. Heaven forbid Republicans should work a few more days with no pay to address our state’s most serious pollution problem. Incidentally, this crowd just passed an education budget that will force thousands of students to go deeper in debt. They voted earlier this year to cut wages for tens of thousands of Iowans living paycheck to paycheck in counties that had raised the minimum wage. These “public servants” also handed more than 150,000 public workers an effective pay cut by taking away their ability to collectively bargain over benefits packages. As if that weren’t enough, they made sure many Iowans who get hurt on the job will be denied access to the workers’ compensation system or will get a small fraction of the benefits they would previously have received for debilitating shoulder injuries.

Lives will be ruined by some of the laws Republicans are touting as historic accomplishments.

Even worse, lives will likely end prematurely because of cuts in the health and human services budget to a wide range of programs, from elder abuse to chronic conditions to smoking cessation to Department of Human Services field operations. I enclose below a Democratic staff analysis of its provisions. During House and Senate floor debates, Republican floor managers offered lame excuses about the tight budget, which doesn’t allow us to allocate as much money as we’d like to this or that line item. Naturally, they found an extra $3 million for a new family planning program that will exclude Planned Parenthood as a provider.

Different Republican lawmakers used the same excuses to justify big cuts to victims assistance grants in the justice systems budget. That choice will leave thousands of Iowans–mostly women–without support next year after going through horrific assaults or ongoing abuse.

Despite some big talk from House Appropriations Committee Chair Pat Grassley, Republicans didn’t even try to rein in business tax credits, which have been the state’s fastest-growing expenses in recent years. The budget crunch is real and may get worse. But no one forced Republicans to inflict 100 percent of the belt-tightening on those who rely on public services.

Weekend open thread: Iowa legislative news roundup

The Iowa legislature’s second “funnel” deadline passed on March 31. In theory, aside from appropriations bills, any legislation that hasn’t yet cleared one chamber and at least one committee in the other chamber is no longer eligible for consideration for this year. However, leaders can resurrect “dead” bills late in the session or include their provisions in appropriations bills. The Des Moines Register’s William Petroski and Brianne Pfannenstiel reviewed important bills that did or did not make it through the funnel. James Q. Lynch and Rod Boshart published a longer list in the Cedar Rapids Gazette.

This paragraph caught my eye from the Register’s story.

Senate Majority Leader Bill Dix, R-Shell Rock, said everything that lawmakers are doing is a reflection of learning from states where prosperity is occurring as a result of business-friendly policies. That formula includes low-cost government, innovative public services, and easing regulatory burdens on businesses to spur job creation and to allow Iowa companies to compete in a global marketplace, he added.

Not so much: Republicans following a similar playbook drove Kansas and Louisiana into the ground. Wisconsin has performed poorly in employment growth, poverty reduction, household income, and wages compared to neighboring Minnesota, where corporate interests didn’t capture state government.

This is an open thread: all topics welcome. I enclose below links and clips about bills I haven’t had time to write about yet. Two are “business-friendly” policies that will hurt Iowans suffering because of exposure to asbestos or medical malpractice. One would make local governments and first responders less accountable by excluding all “audio, video and transcripts of 911 calls involving injured victims of crimes or accidents” from Iowa’s open records law.

Quick update on House File 484, the bill to dismantle the Des Moines Water Works: once seen as almost a sure thing due to covert support from the Iowa Farm Bureau, the bill was on the House debate calendar for many days in March but never brought to the floor. Majority Leader Chris Hagenow put House File 484 on the “unfinished business” calendar on March 30, after House Republicans voted down a Democratic motion to exclude it from that list.

Opponents of the Water Works bill have become more confident lately, as several GOP representatives and senators have said privately they oppose the legislation. In addition, a Harper Polling survey commissioned by the Water Works showed that 68 percent of respondents oppose disbanding independent water works boards in Des Moines, West Des Moines, and Urbandale in order to give city councils control over the water utility. The same poll indicated that by a 55 percent to 23 percent margin, respondents said an independent board of trustees rather than the city council is “best qualified to manage your local water utility.” By an 88 percent to 5 percent margin, respondents said “people who live in the community” and not the state legislature should have “the final say” on municipal utilities. No one should be complacent, because powerful forces are behind this legislation. Republican leaders could attach Water Works language to must-pass budget bills.

P.S.- The legislature is supposed to wrap up its business this month and adjourn for the year before the end of April. I suspect that even with unified Republican control, the session will go into overtime. Lawmakers haven’t finalized budget targets for the 2018 fiscal year yet. With less money to go around following the recent downgrade in revenue forecasts, and legislators of both parties calling for a review of increasingly expensive tax credits and exemptions, I expect several more weeks of behind the scenes negotiations before the House and Senate are ready to approve appropriations bills.

Iowa Democrats, talk less about ALEC and more about people's lives

Thousands of Iowans will suffer brutal consequences from the two major bills Republican senators approved Monday. House File 295 blocks local governments from raising the minimum wage. Once Governor Terry Branstad signs the bill, thousands of people working in Linn, Johnson, and Wapello counties will get an immediate pay cut. Some 25,000 people in Polk County will be stuck earning $7.25 an hour, instead of getting a raise to $8.75, beginning next week. House File 518 will make it harder for employees to file workers’ compensation claims and will vastly reduce benefits for those who do qualify, especially anyone with a shoulder injury.

Both bills passed on party-line 29-21 votes after Republicans had rejected every effort to mitigate the harm done to working people.

As each Democratic amendment went down during hours of debate on the Senate floor, feelings of sadness, disgust and anger came through in the speeches of some Democrats and independent State Senator David Johnson. Why are you doing this, several asked their GOP colleagues. You don’t have to follow your floor manager, some pleaded. You can reject the “shameful” attempt to target poor people or those affected by life-altering workplace accidents.

Another dismal day in the Iowa legislature provoked an outpouring on social media, where progressive activists have mobilized this year in response to the Republican agenda. A measurable wave of “greater grassroots activism on the political left” is one of the few bright spots in the national landscape. In Iowa too, ordinary people are contacting their state lawmakers in record numbers and showing up to challenge them at district forums.

Watching these discussions unfold, I’ve noticed a reflexive tendency to blame one destructive Iowa GOP bill after another on the Koch brothers or the American Legislative Exchange Council. The more Democrats make the conversation about Koch money or ALEC, the easier it is for Republicans to avoid talking about the real-world consequences of their actions.

Peter Cownie won't say who suggested worst workers' comp proposals

The Iowa House has already approved and the Senate will consider today the most sweeping changes to our workers’ compensation system in decades. The legislation would disadvantage injured workers in many ways. Three points in the initial Republican proposal have drawn the most intense criticism from employee advocates who spoke to journalists, published commentaries, testified at a public hearing, or reached out directly to state lawmakers:

• Shifting the burden of proof by forcing employees filing a claim to show workplace activity was the “predominant” factor in an injury;

• Cutting off benefits for most injuries at age 67, which would discriminate against older workers; and

• Classifying shoulder injuries as “scheduled member” rather than “body as a whole” injuries, language seen as a gift to meatpacking companies because it would “drastically” reduce benefits.

Those provisions were so widely acknowledged to be unjust that Republicans amended them before passing House File 518. GOP State Senator Charles Schneider has said he and other colleagues favor changing the same three sections of the Senate version.

How did such cruel ideas come before the legislature to begin with? Hoping to find out, I turned to State Representative Peter Cownie, who introduced the workers’ compensation bill in his capacity as House Commerce Committee chair.

Iowa Republicans on voter ID: La la la, we can't hear you

Bare-knuckles partisanship is a running theme of the 2017 Iowa legislative session, so Thursday’s party-line House vote to approve new voting restrictions was unremarkable. Nor was it surprising that Republicans cut off floor debate before members discussed most of the Democratic amendments to House File 516. Before last month, House leaders hadn’t invoked the “time certain” procedural maneuver since March 2011. They’ve used it twice this year already: to destroy collective bargaining rights and now for the bill containing voter ID, signature verification, and other ways to make voting more difficult.

After listening to the March 6 public hearing and about half of the twelve hours House members debated the bill, I was struck by how Republicans stayed on the message we’ve heard from Secretary of State Paul Pate. No one will be unable to vote because of this bill, and everyone who needs a new voter ID card will get one for free.

At the hearing and on the Iowa House floor, numerous speakers offered specific examples of how the GOP proposal could prevent eligible voters from casting a ballot.

They might as well have been talking to a wall.

Iowa House Majority leader commits to preserving non-partisan redistricting

Iowa House Majority Leader Chris Hagenow is committed to preserving Iowa’s “great system” of having a non-partisan commission draw new political maps following each ten-year census, he told Bleeding Heartland on February 25. Iowa’s redistricting process has been a model for the country since the 1970s. I’ve been concerned that during the next few years, Republicans might use their political power to enact a new redistricting law. Following the 2010 census, gerrymandering gave the GOP airtight state legislative majorities in Pennsylvania, Michigan, and Wisconsin, and several other states.

Since the majority leader controls which legislation reaches the Iowa House floor, I asked Hagenow after a February 25 public forum in Clive whether he would ever consider supporting a bill to change Iowa’s redistricting process. “No, we’re not doing that,” he said emphatically. Would he consider such legislation in 2019 and 2020, if Republicans still control both chambers? “No, I don’t want that. We have a great system.”

I noted that everywhere Republicans have had the trifecta during the last decade, they have gerrymandered. Hagenow responded, “We have not had that conversation. I think we’ve got a great system. I think that we should continue with that system.”

Even if Republicans retain the governorship and Iowa House and Senate majorities in 2018? “Yes. We’ve got a great system.”

A few minutes later, I put the same question to Republican Senator Charles Schneider, who serves as Iowa Senate majority whip. “I will never support that,” he said without hesitation. You will never support gerrymandering? “Nope, never.” Even if Republicans control the legislative and executive branches after 2018? “Never. What we have right now is fair.”

I will follow up with House Speaker Linda Upmeyer, Senate Majority Leader Bill Dix, and Lieutenant Governor Kim Reynolds, to see if they also will unequivocally promise to protect non-partisan redistricting in Iowa. The more Republican elected officials we can get on the record now, the better. In November, staff for Governor Terry Branstad did not respond to my e-mails seeking comment on whether the governor would rule out signing a bill that replaced the current system with rules allowing the political party in control of the legislature to draw new legislative and Congressional districts.

Branstad bill would reduce insurance coverage for mental health care

Governor Terry Branstad has introduced a bill that would make Iowa the only state not to license mental health counselors. House Study Bill 138 would remove licensing requirements for a number of professions and eliminate some state boards, including the Board of Behavioral Sciences and the Board of Social Work. Mental health counselors are expressing alarm about language that would make social workers, marriage or family counselors, and mental health counselors “registered” rather than “licensed.”

The likely consequence would be insurance companies refusing to cover services by unlicensed providers, depriving Iowans of access to therapy unless they are able to pay the full cost of mental health counseling out of pocket.

I enclose below an action alert the Iowa Mental Health Counselors Association posted yesterday, which contains talking points to use when communicating with state lawmakers about House Study Bill 138. The bill has been assigned to a subcommittee of Republican State Representatives Bobby Kaufmann and Dawn Pettengill and Democratic State Representative Mary Mascher.

The lobbyist for the association representing mental health counselors said yesterday, “The bill as drafted will not be having a subcommittee next week and is taking on serious water. The speaker’s office said that [House Speaker Linda Upmeyer’s] members are getting more emails on the licensure provisions of that bill than they did on collective bargaining.” According to one rumor, the bill may be revised and reintroduced next week, so concerned citizens should call the governor’s office (515-281-5211) to share their views with Branstad’s staff.

UPDATE: A Facebook commenter reached Kaufmann, chair of the subcommittee, by phone on February 24: “He said this bill was assigned to him, he thinks it’s a bad bill and he’s going to kill it.”

SECOND UPDATE: On a different Facebook thread, someone reported speaking to House Majority Leader Chris Hagenow about this bill, having run into him while shopping. Hagenow indicated House Study Bill 138 would not advance in its current form.

Multiple sources confirmed on Friday that lawmakers have been bombarded with constituent contacts about this legislation. When the governor’s staff introduce a new and improved version of this proposal, I would guess they will leave licensing of mental health care professionals alone.

According to Claire Celsi, Hagenow announced at a February 25 legislative forum in Clive that the governor is wrong on this bill and that lawmakers do not support it.

Everything you want to know about Iowa's horrible new collective bargaining law

Republicans in the Iowa House and Senate voted today to dramatically reduce collective bargaining rights for some 180,000 public employees, following approximately 27 hours of debate in the Iowa Senate and fourteen and a half hours of debate in the Iowa House. GOP leaders moved House File 291 and Senate File 213 simultaneously through both chambers in order to speed up the process.

Democrats had offered dozens of amendments to the bills, which were published for the first time on February 7. Instead of allowing full discussion of every amendment, GOP leaders moved to cut off debate at a “time certain” today. That maneuver had never been used in the Iowa Senate and has been invoked only rarely in the Iowa House–including to end debate on the collective bargaining bill Republicans passed in March 2011. Debate ended in the Iowa House at noon, after which the majority quickly voted down all the remaining amendments with no discussion. Six Republicans joined all 41 Democrats to vote against the bill on final passage. Two of them, Tom Moore and Dave Heaton, are former teachers. Clel Baudler is a retired state trooper. Andy McKean and Shannon Lundgren were just elected from eastern Iowa swing districts, where registered Democrats outnumber Republicans. McKean is also very familiar with Chapter 20 as a former county supervisor and longtime state lawmaker. I don’t know why Mary Ann Hanusa opposed the bill. UPDATE: Hanusa did not respond to my request for comment, but I learned from another source that she is also a former teacher who works in education administration.

Senators debated all night long Wednesday into Thursday morning, with Republicans voting down every Democratic amendment. Independent State Senator David Johnson voted with Democrats on all the amendments and joined them in giving several passionate speeches. Few Republicans in either chamber chose to speak in favor of the bills, aside from Senate Labor Committee Chair Jason Schultz, House Labor Committee Chair Dave Deyoe, and State Representative Steven Holt, who floor-managed the bill and distinguished himself as the legislature’s least convincing liar. The Des Moines Register’s William Petroski summarized some of the important Democratic amendments. I didn’t stay up to watch the whole debate, so would welcome examples of some of the most absurd Republican comments, like State Senator Mark Chelgren accusing Democrats of “stalling” while his party had shown an “incredible amount of patience.” Nothing says “patient” like making sweeping changes to a 43-year-old law, affecting 180,000 Iowans, after only nine days in the legislature.

Senate leaders ended debate at 2 pm Thursday, after which Republicans voted down the remaining Democratic amendments, then substituted the text of the House bill for the Senate bill, to get the legislation to Governor Terry Branstad more quickly. Branstad’s chief of staff, Michael Bousselot, spent the final hours of debate in the Senate chamber. House File 291 eventually passed on a 29-21 Senate vote.

Iowa’s largest public-sector union, AFSCME Iowa Council 61, plans to file a lawsuit claiming the new law is unconstitutional, presumably because of the way it grants more bargaining rights to “public safety” workers than to others, many of whom do dangerous jobs. I enclose below statements about the bill by legislative leaders from both parties, as well as documents prepared by Iowa House Democratic and Republican staff, which discuss in more detail how House File 291 will affect collective bargaining rights for different types of public employees. Regarding substantive impacts, I also recommend the recent guest posts here by state employee Ruth Thompson, University of Northern Iowa Professor Chris Martin, and attorney James Larew, who predicted that today’s action “will be remembered as the most destructive blow to our ability to govern ourselves fairly and efficiently in nearly half a century.”

GOP spin notwithstanding, collective bargaining “reform” in Iowa was designed primarily with political goals in mind, like similar measures in other states. Republicans know that crippling public sector unions will make it harder for Democrats to win elections.

Although Republicans repeatedly claimed during the House and Senate debates that their bill would help local governments, Chapter 20 has worked so well that more than 140 school districts rushed to sign new contracts with the teachers union before the legislature acted. Boards of supervisors in several large counties passed resolutions condemning the proposal. Linn County Supervisor Brent Oleson’s case against the bill is convincing.

Iowa House, Senate GOP leaders not co-sponsoring "personhood" bills

While most Iowa politics junkies were absorbed by lengthy collective bargaining debates in the state House and Senate, Republican lawmakers introduced identical “personhood” bills in both chambers on February 14.

Notably, leaders of the House and Senate are not among the co-sponsors of the bills declaring “that life is valued and protected from the moment of conception, and each life, from that moment, is accorded the same rights and protections guaranteed to all persons by the Constitution of the United States, the Constitution of the State of Iowa, and the laws of this state.”

Iowa House leaders Upmeyer, Hagenow have held no public forums this year

Four weekends in a row, Iowans have turned out in large numbers to challenge Republican lawmakers about cuts to higher education and other state services, a historically small funding increase for K-12 schools, a bill to discontinue funding for Planned Parenthood’s non-abortion services, and most recently, plans to sweep away every meaningful aspect of public employees’ collective bargaining rights.

The two people with the most influence over events in the Iowa House won’t be found in any images of packed legislative forums carried by local news outlets or shared on hundreds of social media feeds.

That’s because House Speaker Linda Upmeyer and House Majority Leader Chris Hagenow haven’t scheduled any meetings open to the public since the 2017 session began.

Who's who in the Iowa House for 2017

The Iowa House opens its 2017 session today with 59 Republicans, 40 Democrats, and one vacancy, since Jim Lykam resigned after winning the recent special election in Iowa Senate district 45. The 99 state representatives include 27 women (18 Democrats and nine Republicans) and 72 men. Five African-Americans (all Democrats) serve in the legislature’s lower chamber; the other 95 lawmakers are white. No Latino has ever been elected to the Iowa House, and there has not been an Asian-American member since Swati Dandekar moved up to the Iowa Senate following the 2008 election.

After the jump I’ve posted details on the Iowa House majority and minority leadership teams, along with all chairs, vice chairs, and members of standing House committees. Where relevant, I’ve noted changes since last year.

Under the Ethics Committee subheading, you’ll see a remarkable example of Republican hypocrisy.

Some non-political trivia: the Iowa House includes two Taylors (one from each party) and two Smiths (both Democrats). As for first names, there are six Davids (four go by Dave), four Roberts (two Robs, one Bob, and a Bobby), four Marys (one goes by Mary Ann), and three men each named Gary, John, and Charles (two Chucks and a Charlie). The 16 highest-traffic Bleeding Heartland posts in 2016

Traffic can be a touchy subject for bloggers. Most writers know the pain of pouring a lot of effort into a project that gets little traction. On the flip side, although clicks are always welcome, seeing a post take off is not as satisfying when you are less invested in the piece. The most-viewed post in nearly 10 years of Bleeding Heartland’s existence was nothing special, just another opinion poll write-up. FYI: A good way to get the Drudge Report to link to your site is to type up a long list of negative statements about Hillary Clinton.

I’ve never compiled a year-end list like this before, but since people occasionally ask what material is most popular at the blog, I figured, why not start a new tradition? Ulterior motive: I hope more readers will be inspired to write for Bleeding Heartland in 2017 after learning that guest authors wrote some of this year’s most-viewed posts, including the one at the very top.

Few changes in Iowa House Republican leadership team

Iowa House Republicans came out of this campaign in better shape than they could have hoped six months ago. The party successfully defended every incumbent and every GOP-held open seat, including one with a significant Democratic registration advantage. Even better, Republicans defeated State Representative Patti Ruff and picked off one of the four Democratic-held open seats, despite a big tax problem for the GOP candidate there. During the last presidential election year, Republicans suffered a net loss of seven Iowa House seats and were lucky to avoid losing more. In contrast, the caucus came out of last Tuesday with a two-seat gain and a 59-41 majority, just one seat shy of their advantage in the chamber after the 2010 landslide.

Happy endings provide little incentive to shake things up. To no one’s surprise, House Republicans re-elected most of their leadership team during yesterday’s caucus meeting in Des Moines. Linda Upmeyer will continue as speaker, her position stronger now than last year, since several representatives who were rumored to be at odds with her have now retired. Chris Hagenow stays on as majority leader and Matt Windschitl as House speaker pro-tem.

The biggest change is Zach Nunn moving up from one of the assistant majority leader positions to majority whip. Media reports don’t indicate whether last year’s majority whip Joel Fry sought the position again or stepped down from the leadership team voluntarily.

Similarly, Walt Rogers is no longer an assistant majority leader, having held one of those positions from early 2013 through last year’s legislative session.

UPDATE: Two sources indicate that Fry is likely to lead the Human Resources Committee, since its previous chair Linda Miller retired this year. Under House rules, assistant leaders don’t chair committees. Still seeking insight on the next move for Rogers.

Two of the just-selected assistant majority leaders played the same role last year: Jarad Klein and John Wills. The other two, Mike Sexton and Megan Jones, join House leadership for the first time. UPDATE: According to one source, Jones and Klein ran against Nunn for majority whip.

Like her counterpart in the upper chamber, incoming Iowa Senate Majority Leader Bill Dix, Upmeyer didn’t lay out specific policy plans when speaking to reporters yesterday. We’ll find out later which taxes Republicans plan to cut, how badly they will decimate collective bargaining rights for public employees, and whether they will do anything to make medical cannabis more widely available to Iowans suffering from severe health conditions.

Upmeyer seemed to rule out raising the sales tax by 3/8 of a cent to fill the the Natural Resources and Outdoor Recreation Trust Fund. That fund has been empty since 63 percent of Iowans approved a constitutional amendment to create it in 2010. Cedar Rapids Mayor Ron Corbett is one of very few elected Republican officials to be on record backing a sales tax hike to fund conservation efforts.

Election results thread: Dark days ahead

Polls just closed in Iowa. Considered a heavy favorite to win the electoral college, Hillary Clinton is in serious danger of losing the presidency. Results from swing states to the east suggest that Donald Trump is outperforming Mitt Romney in heavily white working-class and rural areas. That doesn’t bode well for our state, even if early vote numbers suggested Clinton might have a chance.

Most of the battleground state House and Senate districts are overwhelmingly white. Republicans have been able to outspend Democrats in almost all of the targeted races. We could be looking at a GOP trifecta in Iowa for the first time since 1998.

No surprise: the U.S. Senate race was called for Chuck Grassley immediately. He led all the late opinion polls by comfortable double-digit margins.

Five reasons Chris Hagenow is worried about winning Iowa House district 43

The Republican Party has spent more than $400,000 defending Iowa House Majority Leader Chris Hagenow’s seat in the Des Moines suburbs, which he held by only 23 votes in the last presidential election cycle. Most of the money has bought television commercials, beginning six weeks ago and continuing in heavy rotation to the end.

Hagenow led with a ludicrous spot portraying himself as some kind of champion for education funding and the preschool program he voted to eliminate. He moved to a deceptive hit piece against Democratic challenger Jennifer Konfrst, followed by an ad touting his role in making EpiPens more widely available for kids. A second negative spot was a narrowly-focused attack on a tax lien Konfrst resolved many years ago–the height of hypocrisy, since Republican leaders were simultaneously funding the campaign of a House candidate with a much larger, still unpaid federal tax liability. In the last few days, local television stations have been running Hagenow’s initial positive ad, which misrepresents his record on education funding.

Hagenow is running scared, for good reason.

Iowa GOP spends big money promoting House candidate with unpaid federal taxes

Fighting for his political life in a district that’s trending away from him, Iowa House Majority Leader Chris Hagenow has approved hundreds of thousands of dollars in campaign spending on television commercials. Two spots have trashed his Democratic challenger Jennifer Konfrst over accounting errors that led to some overdue taxes. The first Hagenow hit piece was blatantly false. The second ad, now in heavy rotation on Des Moines stations, is more narrowly focused on a tax lien put on Konfrst’s home more than a decade ago.

Republican Party of Iowa Chair Jeff Kaufmann portrayed Konfrst as unfit to serve because she made a mistake calculating child care expenses. After hiding from early media inquiries about his commercial, Hagenow defended the ad last week, telling the Des Moines Register, “One of the biggest jobs we deal with (in the Legislature) is spending taxpayers’ dollars […] And our focus has always been to handle that as responsibly as possible.”

So why did House Republican leaders give their blessing for the Iowa GOP to spend more than $93,000 promoting Shannon Lundgren, a House candidate with a much larger federal tax liability that “remains unpaid”?

Coward Chris Hagenow running false personal attack against Jennifer Konfrst

Iowa House Majority Leader Chris Hagenow has plenty of reasons to worry about being re-elected in House district 43. During the last presidential election year, he won his race by fewer than two dozen votes, and the district has fewer registered Republicans now than it did in November 2012. His well-qualified challenger Jennifer Konfrst has been working hard, and Democrats in the district have submitted nearly 1,000 more absentee ballot requests than have Republicans.

Hagenow didn’t run any positive television commercials during the 2012 election cycle and only started airing a misleading ad against his opponent in late October.

In contrast, a few weeks ago the majority leader went up with a bizarro world tv ad portraying himself as an advocate for education. That spot was ludicrous on several levels, as Bleeding Heartland discussed here and Iowa Starting Line chronicled here. Hagenow has been part of a leadership team that for several years in a row ignored Iowa law on setting K-12 education funding. He and his fellow House Republicans have repeatedly refused to appropriate enough money to help school districts keep up with rising costs. Although Hagenow postures as a supporter of preschool in his tv ad, he voted to eliminate the state preschool program in early 2011. Furthermore, because House Republicans insisted on only a small increase in K-12 school funding this year, the West Des Moines school district (where most of Hagenow’s constituents live) cut its 3-year-old preschool program.

But as deceptive as Hagenow’s positive ad is, the hit piece he started running against Konfrst on October 5 is even more mendacious.

Weekend open thread: Revisionist history

What’s on your mind this weekend, Bleeding Heartland readers? This is an open thread: all topics welcome.

Many cities and towns in northeast Iowa have been flooded over the last few days, and Cedar Rapids is bracing for the city’s second-worst flood in history. The latest forecast indicates the Cedar River will crest Tuesday morning around 23 feet, about two feet below the projected crest from a couple of days ago but still seven feet above “major flood” level. Many downtown streets are closed, National Guard members will assist local law enforcement, and a small army of volunteers have been sandbagging and trying to protect local landmarks. The Cedar Rapids Gazette is regularly updating this page with more 2016 flood coverage.

Several Iowa House Republican candidates began running television commercials this past week. Some GOP candidates for the Iowa Senate have been on the air for a couple of weeks now, and campaigns on both sides have begun to send out direct mail. Usually, those communications are not available online, so I appreciate reports on any direct mail pieces or state legislative campaign commercials you’ve seen or heard on radio and tv stations in your area. Whatever details you can remember are helpful, as are screen shots or pdf files showing images. My e-mail address is near the lower right-hand corner of this page.

In Iowa House district 43, one of the top targets for Democrats, House Majority Leader Chris Hagenow is running a tv ad whitewashing his record on education. Several other Republicans are trying out similar talking points, which presumably tested well in polls that were in the field a few weeks ago. I’ll have more to say about Hagenow’s ad in a future post. A few key points for now:

• Five legislative sessions in a row, House Republicans have refused to pass bills setting state support for K-12 education (“allowable growth”) on the timeline required by state law. Their delays left school district leaders unable to plan their budgets on time.
• Six legislative sessions in a row, Iowa House and Senate Democrats have fought House Republicans over education funding. Every year, House GOP leaders insisted on a final budget below what school districts, community colleges, and state universities would need to keep up with rising costs.
• Hagenow absurdly postures as a supporter of more funding for preschool. In reality, within weeks after Republicans took over the Iowa House in 2011, Hagenow and everyone else in his caucus voted to eliminate state preschool funding. If Hagenow had gotten his way, Iowa would not even have a state-supported preschool program for 4-year-olds.

Speaking of revisionist history, Donald Trump’s campaign is now claiming that Carter Page was never a foreign policy adviser to the presidential candidate. Both Trump and Page talked to journalists in March about his adviser role. Why the change? Probably because according to Michael Isikoff’s September 23 story for Yahoo News, “U.S. intelligence officials are seeking to determine” whether Page “has opened up private communications with senior Russian officials.” Questions center on Page’s activities during a July visit to Moscow.

But how well-connected is Page in Russia anyway? Julia Ioffe talked to specialists in the U.S. and Moscow and reported in her must-read piece for Politico, “despite the tightly knit nature of the expat business community in Russia, no one I spoke to had ever heard of Carter Page.” Several people who have worked in the Russian energy sector discounted Page’s self-described role with the gas monopoly Gazprom. People who knew Page from Merrill Lynch’s Moscow office or his work with Russia’s electricity monopoly were unimpressed. Talk about irony: the ultimate con man Trump, who lies about matters large and small, may have been tricked into elevating Page’s stature.

Ioffe’s reporting suggests that Iowa’s own Sam Clovis recruited Page on behalf of the Trump campaign. Clovis refused to answer the journalist’s questions.

A close look at Republican message-testing in key Iowa House races

Republicans are testing potentially damaging messages about Iowa House Democratic candidates, along with statements that might increase support for GOP candidates in battleground legislative districts. After listening to several recordings of these telephone polls and hearing accounts from other respondents, I have three big takeaways:

• Republicans are seeking ways to insulate themselves from voter anger over inadequate education funding and the Branstad administration’s botched Medicaid privatization;
• The time-honored GOP strategy of distorting obscure legislative votes is alive and well;
• The Iowa Democratic Party’s platform plank on legalizing all drugs may be used against candidates across the state.

Weekend open thread: Trump at the Ernst "Roast and Ride" edition

Republican presidential nominee Donald Trump was back in Des Moines yesterday as the headliner for Senator Joni Ernst’s second annual “Roast and Ride” fundraiser. Approximately 400 people rode their motorcycles to the state fairgrounds, where politicians addressed a crowd of about 1,800. Radio Iowa posted the full audio of Trump’s remarks and highlights here. Shane Vander Hart live-blogged the event for Caffeinated Thoughts.

I got a kick out of the Ernst Twitter feed, featuring photos of the rock band The Nadas, various other special guests and crowd shots, but not a single picture of headliner Trump.

Why so shy, Senator?

Not to worry, lots of other people got pictures of Ernst standing next to Trump and recorded her urging Iowans to get out the vote for the whole GOP ticket.

Representative Steve King (IA-04) was up there with Trump and Ernst, despite telling Radio Iowa on Friday he was “uneasy” about the presidential nominee seeming to backpedal lately on his promise to deport undocumented immigrants. ABC’s Meghan Keneally recapped Trump’s mixed messages about immigration policy this past week. For more, see Nick Corasaniti’s latest report for the New York Times and this piece by Peter Beinart for The Atlantic. Trump attempted to clean up the mess in an interview with CNN’s Anderson Cooper on Friday. His campaign manager Kellyanne Conway tried but failed to articulate a coherent position on CBS this morning.

At the Roast and Ride, Trump promised, “We’re gonna get rid of these people, day 1, before the wall [is built on the Mexican border], before anything.” The family of Sarah Root, the inspiration for Steve King’s “Sarah’s law,” joined Trump on stage. My heart goes out to them. Losing a loved one to a drunk driver would be devastating.

Senator Chuck Grassley and Representatives Rod Blum (IA-01) and David Young (IA-03) all spoke to the Roast and Ride crowd but declined to stand on stage for the group photo with Trump. Who can blame them?

Speaking of Trump’s toxicity, Hillary Clinton delivered an excellent speech this week to connect the dots on how Trump has promoted racist and race-baiting ideas, giving hope and cover to white supremacists. The full transcript is here. Watching the white nationalist movement become emboldened by Trump’s campaign has been one of the most disturbing political developments of the last year.

This is an open thread: all topics welcome. I skipped the Roast and Ride to go knock some doors on behalf of Jennifer Konfrst, the Democratic candidate in Iowa House district 43. Incumbents have a lot of advantages when running for re-election, especially a powerful legislator like Konfrst’s opponent, House Majority Leader Chris Hagenow. But a leadership role has drawbacks in a campaign too. For instance, when a no-party voter in this district tells me at the door she’s upset the legislature hasn’t done anything on bike safety, it’s nice to be able to mention that as majority leader, Hagenow has a huge say in what bills come out of committee and up for votes on the House floor. So if you want the House to act on bills that have already passed the state Senate (like the safe passing law that’s a high priority for the Iowa Bicycle Coalition, or real medical cannabis reform, or insurance coverage for autism services, or better oversight of privatized Medicaid), you need to change the House leadership.

July 4 open thread

Happy Independence Day to the Bleeding Heartland community! Enjoy the day safely, and please remember that amateur fireworks can not only hurt people, but also cause distress for war veterans suffering from PTSD.

It’s less hot today than usual on July 4, which will make walking with Jennifer Konfrst and other Democrats in this afternoon’s Windsor Heights parade much more pleasant. If you went to any parades this weekend, please share your anecdotes. I urge Democrats to wear sunscreen, comfortable shoes, and a t-shirt with a positive message. Don’t be rude to any political adversaries, and don’t respond in kind if heckled by Republicans. My go-to answers to parade watchers insulting me or candidates I support include, “My dad was a Republican” or “It’s a free country” or “Happy Fourth of July!”

This is an open thread: all topics welcome. Thanks to media coverage picking up on the Iowa DNR’s recent warning about wild parsnip, last year’s post about that hazardous plant and poison hemlock has become the most-viewed edition of Iowa wildflower Wednesday. This weekend’s follow-up with more pictures of wild parsnip has become the most-shared Bleeding Heartland piece about wildflowers, which is ironic, since very few of more than 125 posts in this series have featured European invaders.

Some people confuse wild parsnip with golden Alexanders, a North American native with small yellow flowers. But the plants look quite different, and golden Alexanders tend to boom earlier in the year than wild parsnip.

Ten Iowa legislative incumbents who raised surprisingly little for their re-election campaigns

Since the latest deadline for state legislative candidates to report to the Iowa Ethics and Campaign Disclosure Board passed on May 19, I’ve been going through the forms filed by incumbents or challengers in potentially competitive races.

Never let it be said that the 2016 Iowa legislature accomplished nothing

In four months of work this year, Iowa lawmakers made no progress on improving water quality or expanding conservation programs, funded K-12 schools and higher education below levels needed to keep up with inflation, failed to increase the minimum wage or address wage theft, let most criminal justice reform proposals die in committee, didn’t approve adequate oversight for the newly-privatized Medicaid program, opted against making medical cannabis more available to sick and suffering Iowans, and left unaddressed several other issues that affect thousands of constituents.

But let the record reflect that bipartisan majorities in the Iowa House and Senate acted decisively to solve a non-existent problem. At a bill-signing ceremony yesterday, Governor Terry Branstad and supporters celebrated preventing something that probably never would have happened.

Six reasons Newt Gingrich would be a perfect running mate for Donald Trump

Former U.S. Representative Greg Ganske has a guest column in today’s Des Moines Register making the case for former House Speaker Newt Gingrich as Donald Trump’s running mate. Gingrich has been unofficially auditioning for the job lately. Ganske argues that Newt has the qualities that Trump has said he’s looking for: someone with “a strong political background, who was well respected on the Hill, who can help me with legislation, and who could be a great president.”

Although Governor Terry Branstad is pushing Senator Joni Ernst to be Trump’s running mate, several well-known Iowa Republicans would probably be as thrilled with a Trump-Gingrich ticket as Ganske. Iowa House Speaker Linda Upmeyer was Gingrich’s first high-profile endorser here in 2011, when she was Iowa House majority leader. State party chair Jeff Kaufmann also supported Gingrich before the 2012 caucuses, when Kaufmann served as Iowa House speaker pro-tem. In December 2011, Gingrich picked up support from several more GOP state lawmakers, including then Speaker Kraig Paulsen and rising star Chris Hagenow, who is now House majority leader.

While Gingrich has never struck a chord with me, he seems like a perfect match for Trump, and not only because he has the policy knowledge the presumptive Republican nominee lacks.

Iowa Democrats trying to add autism insurance coverage to budget bill

Earlier this month, Claire Celsi informed Bleeding Heartland readers about the demise of an autism insurance bill after State Representative Peter Cownie refused to bring the measure up for a vote in the Iowa House Commerce Committee, which he chairs.

Budget looms large, social issues largely absent on the Iowa legislature's opening day in 2016

Governor Terry Branstad wore a pink tie and many colleagues remarked on history made yesterday at the Capitol, as Linda Upmeyer became the first woman to preside over the Iowa House as speaker, as well as the first child of an Iowa legislative leader to rise to the same position. Erin Murphy’s take on the milestone is worth a read.

As in recent years, social issues were almost entirely absent from the leaders’ opening remarks to their Iowa House and Senate colleagues. State budget priorities dominated the comments relating to public policy, with Republicans emphasizing the importance of not spending too much and Democrats emphasizing the need to spend enough on education and other vital services. No one mentioned Branstad’s call to extend the penny sales tax for school infrastructure and divert part of the revenue stream to water programs.

Who's who in the Iowa House for 2016

The Iowa House opened its 2016 session today with 57 Republicans and 43 Democrats. The 100 state representatives include 27 women (21 Democrats and six Republicans) and 73 men. Five African-Americans (all Democrats) serve in the legislature’s lower chamber; the other 95 state representatives are white. No Latino has ever been elected to the Iowa House, and there has not been an Asian member since Swati Dandekar moved up to the Iowa Senate following the 2008 election.

After the jump I’ve posted details on the Iowa House majority and minority leadership teams, along with all chairs, vice chairs, and members of standing House committees. Where relevant, I’ve noted changes since last year. All are on the Republican side, mostly following from Kraig Paulsen’s decision to step down as speaker, Chuck Soderberg’s retirement, and the passing of Jack Drake.

Some non-political trivia: the Iowa House includes two Millers (one from each party), two Taylors (one from each party), and two Moores (both Republicans). As for first names, there are six Davids (four go by Dave), four Roberts (two Robs, one Bob, and a Bobby), four Marys (one goes by Mary Ann), four Johns, and three Brians. There are two Lindas, two Elizabeths (a Beth and a Liz), and two men each named Dan, Mark, Greg, Tom, Bruce, Todd, Chris, and Charles (one goes by Chuck).

"The View from Nowhere" in Iowa legislative news coverage

When politicians lie, opponents often echo longtime Senator Daniel Patrick Moynihan’s famous words: You’re entitled to your opinion, but you’re not entitled to your own facts.

Politicians can get away with deception, however, when journalists present conflicting facts as opposing viewpoints in a “he said/she said” frame. So it was when Governor Terry Branstad recently touted phony job creation numbers, and reputable Iowa journalists hid behind “critics say” rather than acknowledging reality: no serious economist would recognize those statistics.

And so it was when the Des Moines Register again covered the Iowa Department of Revenue’s unprecedented attempt to rewrite tax code through the rule-making process. Statehouse reporter Brianne Pfannenstiel’s attention to the topic is welcome. The rule change has been an under-reported Iowa politics story this fall, even though it could have a huge impact on the state budget in coming years. Unfortunately, as was the case in earlier articles for the Register on the same controversy, Pfannenstiel avoided stating some important truths about the Branstad administration’s efforts, attributing such observations to “others” including “Democratic lawmakers.”

The journalist’s reflex to appear impartial by presenting factual statements as partisan opinions is part of what media critic Jay Rosen has called the View from Nowhere.

Jon Neiderbach ends campaign in Iowa House district 43

Jon Neiderbach announced on Facebook today that he has decided not to run in Iowa House district 43: “We desperately need to fight hard to fix Iowa government, but I came to the conclusion that this wasn’t the best way for me to help make that happen.” He added that he “strongly” endorses fellow Democrat Jennifer Konfrst, “a wonderful candidate with strong connections to HD 43,” and will volunteer for her campaign. Neiderbach was the Democratic candidate for state auditor in 2014 and launched his bid for the Iowa House this September.

Incoming Iowa House Majority Leader Hagenow will be favored to win a fifth term here. His campaign will have virtually unlimited financial resources, and for decades, voters in this part of the Des Moines suburbs have elected Republicans to the state legislature. However, Hagenow is far more conservative than most of those predecessors. In addition, as Bleeding Heartland has noted before, Hagenow won re-election by fewer than two dozen votes in the last presidential election cycle, after Republicans spent heavily on negative tv ads that Democrats left unanswered. He won by fewer than 100 votes in 2008.

House district 43 leans slightly to the GOP on paper, with 6,673 active registered Democrats, 7,416 Republicans, and 5,981 no-party voters, according to the latest figures from the Iowa Secretary of State’s office. President Barack Obama outpolled Mitt Romney in these precincts by 50.6 percent to 48.3 percent, smaller than his statewide winning margin. Then again, Joni Ernst beat Bruce Braley by only 2 percent in HD-43, a lot less than her 8-point victory in the 2014 U.S. Senate race.

Final note: few Iowans in either party know more about the inner workings of state government than Neiderbach, who worked in the non-partisan Legislative Fiscal Bureau for fourteen years and as a management analyst for the Iowa Department of Human Services for fifteen years after that. He would be a valuable asset to any Democrat’s efforts to improve state budgeting and operations.

Jon Neiderbach is second Democrat to challenge Chris Hagenow in Iowa House district 43

This morning Jon Neiderbach officially launched his candidacy in Iowa House district 43. The former Iowa legislative fiscal analyst, Des Moines School Board president, and Democratic nominee for state auditor in 2014 said he is running

because the current Representative from District 43 is financed by special interests and is more interested in advancing his political career than fighting inefficient and ineffective government. Residential property taxes have soared since he has been in office, and education funding has been inadequate.

My experience with the Iowa Legislature and in state and local government allow me to understand how bureaucracy and special interests resist change. I am a fiscal conservative committed to open and transparent government, and I will not be sidetracked by campaign money, other politicians, or building a political career.

Neiderbach’s key issues will be limits on campaign contributions, “accountable government” with no more tax increases or “corporate welfare,” investing more in K-12 education, and reducing student debt. His campaign is on the web here as well as on Facebook and on Twitter @neiderbach2016.

According to the latest figures from the Iowa Secretary of State’s Office, House district 43 contains 6,678 active registered Democrats, 7,454 Republicans, and 5,954 no-party voters.

Four-term Republican incumbent Chris Hagenow was recently chosen to be the new Iowa House majority leader. Challenging him will be an uphill battle, as Republicans will spare no expense to hold this seat. On the other hand, as Bleeding Heartland discussed here, this once-heavily Republican suburban district has been trending toward swing status. President Barack Obama won 50.6 percent of the vote in 2012 in the HD-43 precincts, while Mitt Romney won 48.3 percent. Joni Ernst beat Bruce Braley by only 2 percent in HD-43–a lot less than her statewide winning margin in the 2014 U.S. Senate race.

Hagenow narrowly won this House seat in 2008, by 93 votes. He had an easy re-election in 2010 but had to spend money on push-polls and negative tv ads to eke out a 23-vote margin over Susan Judkins in the last presidential election cycle.

Last month, Jennifer Konfrst became the first Democrat to launch a campaign in House district 43. The party establishment seems to favor Konfrst, who already has the official support of State Senator Janet Petersen and State Representative Jo Oldson. I’m happy to see two qualified, dedicated people ready to take on Hagenow. May Konfrst and Neiderbach work hard and fight fair as they seek Democratic votes across the district. Bleeding Heartland is unlikely to endorse in this primary.

Iowa AG Miller to GOP lawmakers: No authority to investigate fetal tissue transfers

Iowa Attorney General Tom Miller has informed 56 Republican state legislators that his office has neither “jurisdiction over transfers of fetal tissue” nor the “authority to investigate or demand information about the transfer of fetal tissue.” In a letter dated today, Miller noted that “Iowa does not have any state laws governing the transfer of fetal tissue,” which means that only offices of U.S. Attorneys are able to enforce federal laws in this area.

Last month, the GOP lawmakers asked Miller’s office “to investigate current and planned abortion operations within Iowa to ensure compliance with the law.” Their letter set out ten detailed questions regarding the disposal, donation, or possible sale of body parts following abortions. Miller directed the legislators to contact U.S. attorneys’ offices in Iowa if they “have reliable information that federal laws relating to fetal tissue are being violated.”

I enclose below the August 24 letter from Iowa House and Senate Republicans, today’s written response from Miller, and a two-page letter Planned Parenthood of the Heartland provided to the Attorney General’s Office regarding the lawmakers’ query. Planned Parenthood’s response noted that the organization “does not now, and has not in the past, participated in” any fetal tissue donation programs but adheres to “rigorous standards of care” and “compliance with all applicable laws and regulations” in every area of its work, including abortion services.

Many Iowa Republicans will be furious, not only because Miller will not act on their unfounded suspicions, but also because the Attorney General’s Office responded to their query in what appears to be a textbook late-afternoon, pre-holiday-weekend news dump.

Also worth noting: Iowa House Speaker-select Linda Upmeyer and incoming House Majority Leader Chris Hagenow did not sign the August 24 letter to Miller, but House Speaker Pro-Tem Matt Windschitl, incoming Majority Whip Joel Fry, and Assistant Majority Leaders Zach Nunn, Jarad Klein, and Walt Rogers did. Iowa Senate Minority Leader Bill Dix did not sign the letter, but Minority Whip Jack Whitver and Assistant Minority Leaders Rick Bertrand, Randy Fenestra, Charles Schneider, and David Johnson did.

Jennifer Konfrst running against Chris Hagenow in Iowa House district 43

Jennifer Konfrst announced this morning that she will challenge four-term GOP incumbent Chris Hagenow in Iowa House district 43. The swing district covers Windsor Heights, Clive, and part of West Des Moines. A detailed map is after the jump, along with Konfrst’s press release and official bio. On the other hand, this part of the Des Moines suburbs, solidly Republican for decades, has been trending toward Democrats for some time. President Barack Obama won 50.6 percent of the vote in 2012 in the HD-43 precincts, while Mitt Romney won 48.3 percent. Although Joni Ernst carried the district in the 2014 U.S. Senate race, she beat Bruce Braley by only 2 percent in HD-43–a lot less than her winning margin statewide. The latest figures from the Iowa Secretary of State’s office indicate that 6,682 active registered Democrats, 7,493 Republicans, and 5,897 no-party voters live in the district.

Hagenow won his first election to the House in 2008 by 93 votes against then Windsor Heights Mayor Jerry Sullivan. After being re-elected comfortably in the 2010 midterm, Hagenow got a scare in the last presidential year. Despite paying for push-polls and negative tv ads against a challenger who was massively outspent, the incumbent defeated Susan Judkins by only 23 votes in 2012.

Judkins now serves on the Clive City Council. Last week she confirmed to Bleeding Heartland that she will not run for the Iowa House in 2016.

Konfrst may face a competitive primary anyway, because Jon Neiderbach is seriously considering a campaign against Hagenow. He was the Democratic nominee for state auditor in 2014. I think highly of both Konfrst and Neiderbach. The Iowa Democratic establishment sometimes hyperventilates about contested primaries, but assuming the candidates fight fair, I see little downside to two people pounding the pavement to get out the vote in my home district before next June’s primary.

Bonus political trivia: To my knowledge, HD-43 is one of just two Iowa House seats where voters registered with each major party currently outnumber independents. The other is Democratic State Representative John Forbes’ territory in House district 40 (part of Urbandale).

Key Iowa Republican budget negotiators eager to leave Capitol

In the span of a few weeks, four Republicans who were heavily involved in shaping this year’s state budget have made sure they won’t be at the negotiating table during the Iowa legislature’s 2016 session. First, Matt Hinch quit as Governor Terry Branstad’s chief of staff. The weekly Business Record reported yesterday that Hinch “joined the Des Moines office of government affairs and lobbying group Cornerstone Government Affairs as a vice president.”

Days after the Branstad administration announced Hinch’s departure, Kraig Paulsen resigned as Iowa House speaker. He plans to be a back-bencher next year and will not seek re-election to the Iowa House in 2016. It’s not yet clear whether he will remain an attorney for the Cedar Rapids-based trucking firm CRST International, or whether he will seek a different private-sector job.

Last Friday, Branstad’s office announced that Jake Ketzner was leaving as the governor’s legislative liaison. I’ve enclosed the full statement on the staff changes after the jump. Yesterday, the marketing and lobbying firm LS2group revealed that Ketzner will be their newest vice president, specializing in “campaign management, government affairs, and public affairs.”

Finally, House Appropriations Committee Chair Chuck Soderberg told journalists yesterday that he will resign to take a leadership role in the Iowa Association of Electric Cooperatives, a powerful interest group.

I can’t blame these Republicans for not wanting to spin their wheels at the Capitol during next year’s legislative session. Election years are not conducive to bipartisan deal-making in the best of times. Last month, possibly influenced by Hinch and Ketzner, Branstad poisoned the well with vetoes that erased most of the House GOP’s budget concessions to Senate Democrats. Although Paulsen insisted he had negotiated in good faith, he and his top lieutenant Linda Upmeyer (the incoming House speaker) didn’t lift a finger to override the governor’s vetoes.

Newly-elected House Majority Leader Chris Hagenow told a conservative audience in Urbandale today, “I’m not as skeptical about next year as maybe some are. I think there’s a lot of good things that we can get done [in the legislature],” Rod Boshart reported.

That makes one of us. Seeing Hinch, Paulsen, Ketzner, and Soderberg vote with their feet reinforces my belief that next year’s legislative session will mostly be a waste of many people’s time and energy.

P.S.- Some grade A political framing was on display in the governor’s press release enclosed below: “During the 2015 session, Ketzner worked across party lines to secure bipartisan support for historic infrastructure investment that an economic development study called a prerequisite for economic development in Iowa.” In other words, he helped persuade lawmakers to increase the gasoline tax. Ketzner’s official bio at LS2goup likewise speaks of his work “across party lines to secure bipartisan support for significant transportation and broadband infrastructure investments.”

Linda Upmeyer will be first woman Iowa House speaker; Chris Hagenow to be majority leader

Iowa House Republicans chose Linda Upmeyer to replace Kraig Paulsen as House speaker today. First elected to the legislature in 2002, Upmeyer has served as majority leader since 2011. House leaders did not release details on today’s vote. State Representative Josh Byrnes was the only other candidate to seek the speaker’s post, despite rumors that one or more other Republicans were sounding out colleagues about the race. All credit to Byrnes for putting himself out there against the party establishment favorite. That takes guts.

O.Kay Henderson posted highlights from Upmeyer’s remarks to reporters today, as well as the audio clip. Not known for showing a lot of emotions in public, Upmeyer’s voice broke as she talked about her late father, Del Stromer, who served as House speaker during the 1980s. She doesn’t sound inclined to change much about how Paulsen was running the lower chamber, but joked, “I use more words than Speaker Paulsen, and I will try to curb that temptation going forward.”

Chris Hagenow will move up from majority whip to replace Upmeyer as majority leader, and Joel Fry will move from an assistant majority leader position to majority whip. Matt Windschitl will continue to serve as House speaker pro-tem. Hagenow told reporters that no one else sought the majority leader post. Bobby Kaufmann ran for majority whip.

Henderson quoted Byrnes as saying,

“I feel like I’m in that movie, Groundhog Day….It’s the same leadership in the House, the same leadership in the Senate. It’s the same governor and the parameters just feel like they’re just set and we can’t move from them. We need new ideas. We need new energy, we need to be able to accept other people’s concepts and infuse those in and I hope that, you know, she can do that.”

According to Byrnes, rank-and-file legislators are upset with missed deadlines, as the legislature has failed to set state school aid levels on time and met for weeks past its scheduled adjournment date. Byrnes also said Iowans are soured by the hyper-partisanship they see from statehouse politicians. […]

Upmeyer told reporters she’ll address the concerns Brynes raised.

“We never should be comfortable with where we’re at,” Upmeyer said. “We always should be striving for innovation and to do things smarter and better and so I absolutely applaud that.”

No need for a lot of innovation here, Madam Speaker: just accept reasonable compromises instead of refusing to budge from your initial negotiating position, and approve school funding bills on time, as happened for a decade and a half before Iowa House Republicans decided to stop following state law a few years back.

Update on the race to replace Kraig Paulsen as Iowa House speaker

Iowa House Republicans will meet in Des Moines on August 20 to choose a new speaker, Erin Murphy reported earlier this week. Outgoing Speaker Kraig Paulsen surprised mtost Iowa politics watchers when he announced last week that he will step down from leadership before next year’s legislative session and will not seek re-election to the Iowa House in 2016.

House Majority Leader Linda Upmeyer and State Representative Josh Byrnes quickly let it be known that they will run for speaker. The rumor mill expects another House Republican to seek the position, but to my knowledge, no one has gone public with that ambition. Several House members have not responded to my request for comment, including Representative Peter Cownie, who was rumored to be interested in the speaker’s post two years ago. I’ve heard rumblings about Representative Guy Vander Linden, but speaking by phone on August 10, he told me, “I don’t intend to run for speaker. I don’t feel prepared to run for speaker.” He said he undecided on whom he will support to replace Paulsen but inclined to back Upmeyer, because “continuity is important.”

House Majority Whip Chris Hagenow is supporting Upmeyer for speaker and formally announced on Monday that he will seek the post of majority leader. Current House Speaker Pro-Tem Matt Windschitl is also backing Upmeyer and does not appear interested in moving up to majority leader.

According to the Des Moines Register’s Kathie Obradovich, over the weekend WHO talk radio host Simon Conway referred to State Representative Walt Rogers (currently one of four assistant majority leaders) as “quite probably the next majority leader” of the Iowa House. However, Rogers told me he will not run for majority leader, because he’s “having fun and working hard” with Rick Santorum’s presidential campaign. Rogers was an early Santorum endorser during the last election cycle, and Santorum in turn supported Rogers’ short-lived Congressional campaign.

Rogers declined to comment when I asked whether he will support Upmeyer for speaker.

As for whether Vander Linden might run for majority leader, he told me, “I haven’t given it any serious consideration,” adding, “I would give a politician’s ‘Never say never.’”

Governor Terry Branstad is wisely staying out of the speaker’s race.

Preview of the coming Iowa House Republican leadership battle

Iowa House Speaker Kraig Paulsen announced yesterday that he will not seek re-election in 2016 and will step down from leadership before next year’s legislative session. His surprise move kicks off what will be the most competitive leadership election within the House Republican caucus since colleagues elected Paulsen minority leader shortly after the 2008 general election.

Linda Upmeyer, a seven-term incumbent who has served as majority leader since 2011, immediately confirmed that she will run for speaker. She would be the first woman to lead the Iowa House, and to my knowledge, the first child of an Iowa legislative leader to follow a parent in that role. Upmeyer’s father Del Stromer was House speaker for part of the 1980s.

She won’t get Paulsen’s job without a fight, though.
