Social conservative Ginny Caligiuri launches IA-02 bid

Describing herself as a “pro-life, pro-2nd Amendment, pro-Israel, and pro-Constitution conservative,” Ginny Caligiuri made her quest for the Republican nomination in Iowa’s second Congressional district official today. Her candidacy was no secret; the former state director for the Congressional Prayer Caucus, National Governor’s Prayer Team, and US National Prayer Council had nominating papers out to be signed at the February 5 precinct caucuses and has been making the rounds at GOP county central committee meetings.

The announcement for Caligiuri’s kickoff event in Osceola on March 8 noted, “The 2nd District elected Donald Trump, and Ginny plans to help him accomplish what he was elected to do.” That line struck me as a subtle dig at Caligiuri’s competition in the GOP primary. Dr. Christopher Peters is a libertarian-minded Republican; as the IA-02 nominee, he announced in October 2016 that he would not vote for Trump.

I enclose below Caligiuri’s official bio and a map of Iowa’s Congressional districts. According to the latest figures from the Secretary of State’s office, the 24 counties contain 160,891 active registered Democrats, 141,798 Republicans, an 181,740 no-party voters.

The Cook Political Report and Larry Sabato’s Crystal Ball both rate this race as a likely Democratic hold for six-term Representative Dave Loebsack. For reasons discussed here, I think Republicans missed their best chance to defeat Loebsack by not targeting his district during the 2016 cycle. Trump carried the 24 counties in IA-02 by 49.1 percent to 45.0 percent, a huge swing from Barack Obama’s 55.8 percent to 42.7 percent margin over Mitt Romney in 2012.

Heartbeat bill advances where personhood failed

The Iowa Senate Judiciary Committee has advanced a bill that would ban nearly all abortions after a fetal heartbeat can be detected. Senate Study Bill 3143 is the most extreme anti-abortion bill to clear an Iowa legislative committee in decades. Any physician terminating a pregnancy in the absence of a “medical emergency”–narrowly defined to include only life-threatening conditions–could be charged with a class D felony. All eight Republicans on the panel voted for the legislation, while all five Democrats opposed it. Committee approval on February 12 keeps the bill alive for at least another month, until the second “funnel” deadline on March 16.

Less than a year ago, Senate Judiciary Chair Brad Zaun was disappointed not to have the votes on his committee to advance a “personhood” bill, which declared that life would be protected from the moment of conception. The same eight Republicans who supported the heartbeat bill this week served on Judiciary during the 2017 session.

Which minds changed is not clear, nor is it apparent whether the bill will gain final approval in either chamber. Not every bill that comes out of committee receives a vote in the full Senate. Republican leaders blocked an effort to force a floor vote on personhood last year.

However, the shift among at least two Republicans on Judiciary suggests that GOP leaders may feel pressure to fire up the social conservative base.

GOP lawmakers approve third-smallest K-12 funding increase in four decades

Iowa House and Senate Republicans approved about $32 million in additional spending for public K-12 school districts today, which works out to $67 per pupil, according to the non-partisan Legislative Services Agency. The 1 percent increase in allowable growth, sometimes called supplemental state aid, is the third-smallest by percentage since Iowa adopted the current school funding system in the early 1970s.

The Iowa Senate begins work today with 29 Republicans, 20 Democrats, and one independent, former Republican David Johnson.

I enclose below details on the majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Iowa Senate committees. Where relevant, I’ve noted changes since last year’s legislative session.

Just six senators are women (five Democrats and a Republican), down from ten women serving in the chamber in 2013 and 2014 and seven during 2015 and 2016. All current senators are white. To my knowledge, the only African-American ever to serve in the Iowa Senate was Tom Mann, elected to two terms during the 1980s. If all Iowa candidates had to win under rules Republicans forced on unions

“There’s not one Republican in this state that could win an election under the rules they gave us,” asserted AFSCME Council 61 President Danny Homan after the first round of public union recertification elections ended this week.

He was only slightly exaggerating.

A review of the last two general election results shows that Iowa’s capitol would be mostly devoid of office-holders if candidates for statewide and legislative races needed a majority vote among all their constituents–rather than a plurality among those who cast ballots–to be declared winners.

Senate education omnibus bill awaits House vote

It’s a jab, a right cross, a left hook followed by a right uppercut. That’s how it seems for educators in Iowa since the General Assembly convened in January. The most recent blow came almost one month ago when Senator Amy Sinclair introduced Senate Study Bill 1137 in an education subcommittee meeting. That bill eventually became Senate File 475, the Education Omnibus Bill. The bill has passed the Senate with limited support from Democrats and now sits in the House awaiting debate and a vote.

The thirteen page bill, carefully divided into seven divisions, contains a lot of items that educators hate and very little that would be considered redeeming.

"Personhood" in trouble as Iowa legislative deadline approaches

One of the anti-abortion community’s top legislative priorities, a bill declaring that life begins at conception, appears likely to perish in this week’s “funnel.” Social conservatives introduced companion “personhood” bills in the Iowa House and Senate two weeks ago. Under legislative rules, all non-appropriations bills must pass at least one committee in one chamber by March 3 in order to remain eligible for consideration this year.

However, House File 297 has not even been assigned to a House Human Resources subcommittee, and Senate File 253 appears not to have the votes to get out of the Senate Judiciary Committee.

Iowa House, Senate GOP leaders not co-sponsoring "personhood" bills

While most Iowa politics junkies were absorbed by lengthy collective bargaining debates in the state House and Senate, Republican lawmakers introduced identical “personhood” bills in both chambers on February 14.

Notably, leaders of the House and Senate are not among the co-sponsors of the bills declaring “that life is valued and protected from the moment of conception, and each life, from that moment, is accorded the same rights and protections guaranteed to all persons by the Constitution of the United States, the Constitution of the State of Iowa, and the laws of this state.”

Four things I learned about the Iowa Republicans who just voted to defund Planned Parenthood

On Thursday Iowa Senate Republicans approved a bill that would end most state and federal funding for Planned Parenthood’s family planning services. All 29 Republicans and independent Senator David Johnson voted for Senate File 2, while all 20 Democrats voted against the measure. The Senate Judiciary Committee had approved the bill on a party-line vote the previous day.

Passage was a foregone conclusion, since the entire GOP caucus co-sponsored the bill, and statehouse Republicans have been trying to defund Planned Parenthood for years.

Although I already knew Republican lawmakers were willing to force the state to spend ten times more for family planning services, with no reliable funding stream, I still learned some new things watching Senate File 2 move through the upper chamber.

Iowa Republicans unprepared for backlash on Planned Parenthood funding

GOP lawmakers have been trying to defund Iowa’s leading provider of reproductive health care for years. Their previous efforts attracted relatively little public attention, since the Democrats in control of the state Senate would not go along.

Democrats no longer hold enough seats in the legislature to stop Republicans from enacting a plan that will require Iowa to spend ten times more, even as family planning services become less accessible.

As expected, an Iowa Senate Judiciary subcommittee advanced Senate File 2 during a January 24 meeting. The outcome was a foregone conclusion, since all 29 Senate Republicans are co-sponsoring the bill that would create a state-run family planning program, excluding Planned Parenthood as a qualified provider.

But the vast majority of Iowans support continued state funding for Planned Parenthood’s non-abortion services. Republicans weren’t prepared for hundreds of them to show up at the Capitol yesterday.

Don't panic: Iowa House Education chair doesn't want to abolish tenure

State Senator Brad Zaun’s bill to prohibit “the establishment or continuation of a tenure system” has worried many people who understand how badly that policy would harm Iowa’s state universities. Wisconsin Republican lawmakers spurred an exodus of highly-regarded faculty from that state’s top university, and the Wisconsin law to weaken tenure didn’t go nearly as far as Zaun’s bill would.

Fortunately, the bill seems unlikely to clear the Iowa House Education Committee–if it even gets that far.

After ten years of Democratic control, the last six with a one-seat majority, the upper chamber now contains 29 Republicans, 20 Democrats, and one independent (former Republican David Johnson).

I enclose below details on the Iowa Senate majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Senate committees. Click here to find the same information from the 2016 legislative session.

Just six senators are women (five Democrats and a Republican), down from ten women serving in the chamber in 2013 and 2014 and seven during the past two years. All current senators are white. To my knowledge, the only African-American ever to serve in the Iowa Senate was Tom Mann, elected to two terms during the 1980s. No Latino has ever served in the Iowa legislature; in 2014, Nathan Blake fell 18 votes short of becoming the first to join the Senate. No Asian-American has served in the state Senate since Swati Dandekar resigned in 2011.

Twelve holes in the internal ISU Flight Service audit

The Iowa Board of Regents gave Iowa State University President Steven Leath a well-choreographed vote of confidence on Monday. First, Chief Audit Executive Todd Stewart took the board through highlights from his team’s review of ISU’s Flight Service, noting the “full cooperation” provided by ISU staff. Then a contrite yet defensive Leath took the floor. Still insisting he did not violate any policies or laws, the president admitted he could have shown “better judgment” and said he is “very sorry” about “things I should have done differently.” In particular, he “used the university planes more frequently than was absolutely necessary, and should have been more transparent about some of the use.” He promised to be “more thoughtful” and learn from this experience. The 12-page auditor’s report and full statement from Leath are enclosed at the end of this post.

Regent Larry McKibben was up next to thank Leath for his leadership and contribution to positive trends at ISU, adding that he hopes for more “great things” during the next five years. The chair of the Regents’ audit committee has never viewed what he called a “ding on an airplane wing” as grounds to change his opinion of Leath. His remarks before the regents went into closed session signaled that the overseers would neither fire nor severely sanction the ISU president.

After board members evaluated Leath’s performance, Board President Bruce Rastetter asserted that Leath had “eliminate[d] any questions about the personal benefit that he may have received by using the university aircraft,” having reimbursed the ISU Foundation for costs associated with some flights. He went on to say,

“Clearly, President Leath’s acknowledgment that he takes full responsibility for the issues identified in the audit and that he should have been more transparent about the use of the planes reassures this board, and I hope all Iowans, that the president deserves our continued trust and support,” Rastetter said. “Furthermore, the board believes the audit has put to rest any concerns about President Leath’s use of the aircraft.”

This Iowan is not reassured. The audit has big holes and failed to fully account for costs of Leath’s airplane habit.

After campaigning on lies, Iowa Senate Republicans still won't lay out agenda

All but one of the 29 Republicans who will serve in the Iowa Senate for the next two years elected their leaders on Friday, changing little from the group that led the minority caucus during the last legislative session.

Bill Dix moves from Senate minority leader to majority leader.

Jack Whitver moves from minority whip to Senate president.

Jerry Behn, who preceded Dix as minority leader but hasn’t been in leadership since 2012, will become Senate president pro tem. He’s the longest-serving current Republican senator.

My own state senator, Charles Schneider, moves from an assistant minority leader position to majority whip.

Dan Zumbach and Randy Feenstra will be assistant majority leaders, having been assistant minority leaders during the last legislative session. The other two assistant majority leaders are new to leadership: Michael Breitbach and Amy Sinclair, the only woman in the 29-member incoming GOP caucus.

After the caucus meeting, Dix spoke only in general terms about the new majority’s plans.

Fewer women will serve in the new Iowa Senate and House (updated)

The non-partisan organization 50/50 in 2020 has set a goal of electing 25 women to the Iowa Senate and 50 women to the Iowa House by 2020. Yesterday’s elections will bring a lot of new voices to the state capital. However, chambers that were already less diverse than most other state legislatures will become even less representative of the state’s population.

LATE UPDATE: The new Iowa House will in fact have one more female member than the chamber did in 2015 and 2016, following Monica Kurth’s victory in the special election to represent House district 89.

How many more Iowa GOP women will find their voice on Donald Trump?

Melissa Gesing reached her limit this week. Four days after a 2005 video showed Donald Trump telling a reporter he could “do anything” to women, two days after Trump insisted in the second presidential debate that those comments were merely “locker room talk,” Gesing stepped down as president of the Iowa Federation of Republican Women. In her October 11 resignation letter, she described her move as a “last resort,” saying she can’t “look at myself in the mirror each morning if I do not take a stand against the racism, sexism, and hate that Donald J. Trump continues to promote.” She explained her decision at greater length in a blog post called “Ending this bad and unhealthy relationship.”

So far, no other woman in the top echelon of Iowa Republican politics has jumped ship. The Iowa Federation of Republican Women named a new president today and restated its support for the Trump-Pence ticket.

But how long can that last, with more women coming forward every day to say Trump kissed or groped them without consent, and used his position of power to walk in on women or underage girls undressed?

Never let it be said that the 2016 Iowa legislature accomplished nothing

In four months of work this year, Iowa lawmakers made no progress on improving water quality or expanding conservation programs, funded K-12 schools and higher education below levels needed to keep up with inflation, failed to increase the minimum wage or address wage theft, let most criminal justice reform proposals die in committee, didn’t approve adequate oversight for the newly-privatized Medicaid program, opted against making medical cannabis more available to sick and suffering Iowans, and left unaddressed several other issues that affect thousands of constituents.

But let the record reflect that bipartisan majorities in the Iowa House and Senate acted decisively to solve a non-existent problem. At a bill-signing ceremony yesterday, Governor Terry Branstad and supporters celebrated preventing something that probably never would have happened.

Iowa Democrats trying to add autism insurance coverage to budget bill

Earlier this month, Claire Celsi informed Bleeding Heartland readers about the demise of an autism insurance bill after State Representative Peter Cownie refused to bring the measure up for a vote in the Iowa House Commerce Committee, which he chairs.

As both Autism Awareness Month and the 2016 legislative session wind down, Democrats in the Iowa House and Senate have been working to add the same requirements to a must-pass budget bill. Follow me after the jump for background and where things stand in this fight.

Medicaid oversight bill passes Iowa Senate with bipartisan support

Since Terry Branstad returned to the governor’s office, the overwhelming majority of Iowa Senate votes on contentious political issues have fallen along strict party lines: 26 Democrats one way and 24 Republicans the opposite. However, the Branstad administration’s rush to privatize Medicaid has created space for bipartisanship, as a growing number of Republicans acknowledge the dangers of shifting to managed care for a program through which one in six Iowans access health services.

Last month, three GOP senators joined their Democratic colleagues to vote for a bill that would have halted Iowa’s Medicaid privatization. That legislation is going nowhere in the Republican-controlled state House, and federal officials recently approved waivers to allow the Iowa Department of Human Services to implement the managed care policy as of April 1.

Yesterday a quarter of the GOP state senators voted with all 26 Democrats for a Medicaid oversight bill that had cleared the Senate Human Resources Committee unanimously. In her remarks to open floor debate on Senate File 2213, Human Resources Committee Chair Amanda Ragan said the bill was designed “to safeguard the interests of Medicaid members, encourage the participation of Medicaid providers, and protect Iowa taxpayers.” She told colleagues, “we must require DHS and the managed care companies to protect consumers, preserve provider networks, address the unique needs of children and assure accountability.”

Little has changed since last year, in contrast to the Iowa House, which saw some big changes in the majority Republican caucus since the legislature adjourned in June.

Term limits are a terrible idea generally but would be especially awful if applied to the Iowa Senate, as the longest-serving current senator bizarrely advocated last year. The experience gap between Democrats and Republicans is striking. As detailed below, only four of the 24 Senate Republicans have ten or more years of experience in the Iowa legislature, compared to seventeen of the 26 Democrats. No current Iowa Senate Republican has more than 20 years legislative experience, whereas six Democrats do.

Scott Walker becomes this year's Tim Pawlenty, with debates playing Straw Poll's role

Wisconsin Governor Scott Walker will end his presidential campaign today, the New York Times reported. The onetime leader in Iowa and national polling has been sinking for months and dropped to low single digits in national surveys following the first two Republican debates. Although Walker racked up a bunch of early Iowa endorsements in the winter and spring, I always felt he might retrace the path of Minnesota Governor Tim Pawlenty, who quit the race four years ago after a disappointing Ames Straw Poll showing.

Part of me feels this humiliating end to a once-promising campaign couldn’t have happened to a nicer guy. But the other part of me is worried, because Walker was running an incompetent campaign, and his exit means some more competent candidate may end up becoming the consensus establishment choice: perhaps Carly Fiorina, Senator Marco Rubio, or my worst fear for the general election, Ohio Governor John Kasich.

Any comments about the Republican presidential race are welcome in this thread. I will update this post later with reaction to Walker’s decision.

UPDATE: Ryan Foley points out that Walker quit the GOP primary race for Wisconsin governor early before the 2006 campaign, “a move that endeared him to the faithful and helped pave [the] way for [his] later rise.” The GOP has nominated failed candidates before (Bob Dole, John McCain, Mitt Romney), though Rick Perry’s experience shows second chances aren’t a given for one-touted candidates who under-performed.

Iowa AG Miller to GOP lawmakers: No authority to investigate fetal tissue transfers

Iowa Attorney General Tom Miller has informed 56 Republican state legislators that his office has neither “jurisdiction over transfers of fetal tissue” nor the “authority to investigate or demand information about the transfer of fetal tissue.” In a letter dated today, Miller noted that “Iowa does not have any state laws governing the transfer of fetal tissue,” which means that only offices of U.S. Attorneys are able to enforce federal laws in this area.

Last month, the GOP lawmakers asked Miller’s office “to investigate current and planned abortion operations within Iowa to ensure compliance with the law.” Their letter set out ten detailed questions regarding the disposal, donation, or possible sale of body parts following abortions. Miller directed the legislators to contact U.S. attorneys’ offices in Iowa if they “have reliable information that federal laws relating to fetal tissue are being violated.”

I enclose below the August 24 letter from Iowa House and Senate Republicans, today’s written response from Miller, and a two-page letter Planned Parenthood of the Heartland provided to the Attorney General’s Office regarding the lawmakers’ query. Planned Parenthood’s response noted that the organization “does not now, and has not in the past, participated in” any fetal tissue donation programs but adheres to “rigorous standards of care” and “compliance with all applicable laws and regulations” in every area of its work, including abortion services.

Many Iowa Republicans will be furious, not only because Miller will not act on their unfounded suspicions, but also because the Attorney General’s Office responded to their query in what appears to be a textbook late-afternoon, pre-holiday-weekend news dump.

Also worth noting: Iowa House Speaker-select Linda Upmeyer and incoming House Majority Leader Chris Hagenow did not sign the August 24 letter to Miller, but House Speaker Pro-Tem Matt Windschitl, incoming Majority Whip Joel Fry, and Assistant Majority Leaders Zach Nunn, Jarad Klein, and Walt Rogers did. Iowa Senate Minority Leader Bill Dix did not sign the letter, but Minority Whip Jack Whitver and Assistant Minority Leaders Rick Bertrand, Randy Fenestra, Charles Schneider, and David Johnson did.

Governor Terry Branstad’s vetoes of education and mental health funding will stand, as the two-thirds majority needed to call a special legislative session has failed to materialize in either the Iowa House or Senate.

A special session always looked like a long-shot, given that Iowa House Republican leaders didn’t want to spend extra money on education and only reluctantly agreed to extend funding for mental health institutions. In addition, 23 of the 24 Iowa Senate Republicans voted against the supplemental spending bill. They had no stake in the compromise the governor blew apart.

Still, the outcry over school funding (including dozens of normally non-political superintendents speaking out) created an opening for Republican lawmakers. Even if they didn’t believe in the substantive value of additional education or mental health funding, they could have taken a big issue off the table for next year’s statehouse elections. So far, very few Republicans seem worried about the political fallout from not overriding Branstad’s vetoes. Democrats appear ready to remind voters at every opportunity who created the holes local education leaders are scrambling to fill.

A close look at the status of abortion regulations in Iowa

Anti-abortion activists suffered a setback last month when the Iowa Supreme Court unanimously ruled unconstitutional the state ban on using telemedicine for medical abortions. But the health and human services budget for the fiscal year that began on July 1 contained two provisions sought by those who want to reduce the number of abortions performed in Iowa.

The first part of this post examines new language in the Iowa Code related to ultrasounds for women seeking abortions. Who was closer to the mark: Iowa Right to Life, which hailed the “HUGE life-saving victory” as the anti-choice movement’s biggest legislative success in two decades? Or Planned Parenthood of the Heartland, which countered that the ultrasound language would neither change the standard of care at their clinics nor “directly impact a woman’s access to abortion”?

Next, the post addresses language lawmakers first adopted in 2013 and renewed in the just-passed human services budget, which allows the Iowa governor to determine whether Medicaid should reimburse for abortion services. No other state has a similar provision.

Finally, I offer some thoughts on an odd feature of anti-abortion activism in the Iowa legislature. State Senate Republicans advocate more for restrictions on abortion rights and access than do GOP representatives in the House, even though “pro-choice” Democrats control the upper chamber, while all 57 members of the House majority caucus are nominally “pro-life.” Iowa House leaders have not been eager to put abortion bills on the agenda. This year, rank-and-file House Republicans didn’t even introduce, let alone make a serious attempt to pass, companion bills to most of the abortion-related legislation their counterparts filed in the state Senate.

Iowa Senate, House approve gas tax increase

A bill that would raise Iowa’s gasoline tax by 10 cents a gallon is on its way to Governor Terry Branstad’s desk after approval today by both chambers in the Iowa legislature. The Iowa Senate passed Senate File 257 this morning by 28 votes to 21. Sixteen Democrats and twelve Republicans voted for the bill, while ten Democrats and eleven Republicans opposed it. Senate Majority Leader Mike Gronstal had reportedly insisted on at least half the GOP caucus supporting a gas tax increase as a condition for bringing the bill to the floor.

A few hours later, the Iowa House took up the Senate bill (rather than the bill that cleared two House committees last week). Thirty Republicans and 23 Democrats voted yes, while 26 Republicans and 20 Democrats voted no.

Only two state legislators missed today’s votes: Republican State Senator Mark Chelgren and Republican State Representative Chip Baltimore. Baltimore voted against the House version of this bill in committee last week, while Chelgren doesn’t serve on the committees that approved the bill in the Senate. Chelgren appears to have been absent for all of today’s votes, while Baltimore was at the Capitol but left the chamber when the gas tax bill came up. Speaking to reporters later, he tried to make a virtue out of his absence: “I refuse to legitimize either the bill or the process with a vote.” Weak sauce from a guy who is widely expected to seek higher office someday.

Conservative groups are urging Branstad to veto Senate File 257, but that seems unlikely, given the governor’s recent comments on road funding. Branstad’s spokesman said today that the governor will carefully review the final bill before deciding whether to sign it.

Final note: several of the “no” votes came from lawmakers who may face competitive re-election campaigns in 2016. Those include Democrats Chris Brase (Senate district 46), Steve Sodders (Senate district 36), and Mary Jo Wilhelm (Senate district 26), and Republicans Dennis Guth (Senate district 4) and Amy Sinclair (Senate district 14).

Fewer Iowa Senate Republicans eager to ban same-sex marriage

Ever since I saw how few Iowa House Republicans are still co-sponsoring a state constitutional amendment on marriage, I’ve been watching and waiting for Republicans in the state Senate to introduce their version of the same legislation. Any effort to overturn marriage equality will be a dead letter in the Iowa Senate as long as Democrats maintain their majority. Nevertheless, I was curious to see how many (or few) Republican senators are still willing to stand up and be counted on this issue.

Late last week, State Senator Dennis Guth, one of the leading social conservatives in the chamber, finally introduced Senate Joint Resolution 6, “specifying marriage between one man and one woman as the only legal union that is valid or recognized in the state.” Just eleven of the 24 Republicans are co-sponsoring this amendment. That’s a significant drop from two years ago, when three-quarters of the Iowa Senate GOP caucus co-sponsored the marriage amendment.

Looking more closely at who is and is not “loud and proud” about taking rights away from LGBT couples, some patterns emerge.

Who's who in the Iowa Senate for 2015

The Iowa legislature’s 2015 session begins today. Democrats maintained their 26 to 24 majority in the upper chamber. After the jump I’ve posted details on the Iowa Senate majority and minority leadership teams, along with all chairs, vice chairs, and members of standing Senate committees. Where relevant, I’ve noted changes from the previous committee assignments. Click here for a similar post on the new Iowa House.

I’ve also enclosed below details on the tenure of all 50 Iowa senators. The experience gap between the caucuses is striking, even more so since three of the longest-serving GOP state senators retired in 2014. Only seven of the 24 Republicans have served in either the state House or Senate for more than four years, whereas nineteen of the 26 Democrats have more than four years of legislative service. Only four of the 24 Senate Republicans have ten or more years of experience in the Iowa legislature, compared to seventeen of the 26 Democrats. No current Iowa Senate Republican has more than 20 years legislative experience, whereas six Democrats do.

Just seven of the 50 senators are women, down from ten women in the chamber two years ago. The Democratic caucus includes 20 men and six women; the Republican caucus 23 men and one woman.

All current Iowa senators are white. To my knowledge, no African-American has ever served in the Iowa Senate. CORRECTION: Bleeding Heartland reader northwest points out that I forgot Tom Mann, who represented part of Des Moines in the Iowa Senate during the 1980s.

No Latino has ever served in the Iowa House or Senate; Nathan Blake fell 18 votes short of becoming the first in 2014. No Asian-American has served in the state Senate since Swati Dandekar resigned in 2011.

Some non-political trivia: the 50 state senators include three Marks, three Bills, three Richards (who go by Rich, Rick, and Dick), two Mikes, two Toms, two Joes, and two men named Charles (one goes by Chaz).

Iowa Senate district 12 special: Mark Costello vs. Steve Adams and Don Brantz

Republicans nominated State Representative Mark Costello for the December 30 special election to replace Joni Ernst in Iowa Senate district 12. The district covers Mills, Fremont, Montgomery, Page, Taylor, and Ringgold counties in southwest Iowa. This post includes a map.

Seven candidates sought the GOP nomination in this strongly Republican district, containing more than twice as many registered Republicans as Democrats. Besides the five candidates Bleeding Heartland discussed here, David Sieck and Charla Schmid joined the GOP race. Sieck is a Mills County farmer who has been active on Missouri River management issues. Schmid has served several terms on the Montgomery County School Board and is active in Business and Professional Women/Iowa. She also serves on the board of directors of 50/50 in 2020, a bipartisan group encouraging more Iowa women to run for office.

The Iowa Republican’s Craig Robinson wrote up last night’s nominating convention, where Costello led from the beginning and secured the nomination on the fourth ballot.

A Democratic district convention will meet this weekend to nominate Steve Adams of Red Oak. He is a community development specialist with Iowa State University Extension.

Earlier this week, Libertarians nominated Don Brantz for the Senate district 12 special. He is “a longtime Mills County supervisor and southwest Iowa social worker” who is running on a platform of increasing funding for rural schools and abolishing the state Department of Education. It’s smart for Libertarians to compete here. Odds are long, but anything can happen in a low-turnout environment, and how many people will show up to vote on December 30?

Costello is the heavy favorite. If he wins, a special election will be needed in Iowa House district 23, covering Mills and Fremont counties, plus most of Montgomery County. House Republican leaders did not assign any committee chairmanship to Costello, perhaps expecting that he would soon leave for the Iowa Senate.

Regardless of who wins the Senate district 12 special, the number of women in the Iowa Senate will drop from ten the past two years to seven for the next two years. First-termer Amy Sinclair will be the only woman in the Iowa Senate GOP caucus.  

Mid-week open thread: 2018 IA-Gov scenarios edition

All topics are welcome in this open thread. I’d like to hear from Bleeding Heartland readers about the next race for Iowa governor. Winning that election needs to be a top priority for Iowa Democrats.

I remain 100 percent convinced that Terry Branstad will not serve out his entire sixth term. By the end of 2015, he will have set a record as the longest-serving governor in U.S. history. He is committed to “grooming” Lieutenant Governor Kim Reynolds to be the next governor. But Reynolds was almost unknown when Branstad selected her as his running mate. She had only two years of experience in the state legislature, all of it in the Iowa Senate minority. Before that, she had a long tenure as the Clarke County treasurer, a job that doesn’t allow politicians to build up a profile outside their home county.

Since Reynolds has no constituency in the Republican base, I find it hard to imagine she could win the nomination for governor campaigning from her current job. However, if she has a year or more under her belt as governor by the spring of 2018, she might have a fighting chance in the GOP primary. Even then, I don’t think other Republicans would give her a pass. Plenty of people have ambitions to succeed Branstad. I’ll be surprised if Secretary of Agriculture Bill Northey doesn’t run for governor during the next cycle.

On the Democratic side, several state lawmakers could be credible candidates for governor. Iowa Senate President Pam Jochum considered it this past cycle but opted out for family reasons. I hope Jochum will take the plunge in 2018, as she would be a great candidate and a fantastic governor. State Senators Janet Petersen and Rob Hogg would also be excellent leaders and will probably also give this race a look.

UPDATE: Two-time candidate for secretary of state Jake Porter is considering a gubernatorial bid on the Libertarian ticket and sees both outgoing Secretary of State Matt Schultz and newly-elected Secretary of State Paul Pate as likely Republican candidates. Pate sought the GOP nomination for governor in 1998 after one term in the secretary of state’s office, so he could easily do that again. I find it hard to believe that the Madison County attorney position will give Schultz a good launching pad for a gubernatorial campaign, but anything is possible.

Porter also mentioned State Treasurer Mike Fitzgerald as a possible Democratic candidate. Fitzgerald considered running for governor in 2013.

SECOND UPDATE: Lots of names being floated in the comments: Bob Vander Plaats, Iowa House Speaker Kraig Paulsen, State Representative Peter Cownie, and State Senator Amy Sinclair on the Republican side; newly elected State Senator Chaz Allen or State Representative Nancy Dunkel on the Democratic side.

Erin Murphy, who covers Iowa politics for Lee Enterprises newspapers, has predicted a matchup between Jochum and Reynolds in 2018. I like Jochum’s odds there, a lot.

Associated Press reporter Ryan Foley reports that Republican strategists are “keeping a close eye” on Chaz Allen. I wonder whether that may be wishful thinking on their part, as they appear to have no chance of winning Iowa Senate district 15 as long as Allen is around. I think 2018 would be a little early for him to run for governor.

I should also mention that incoming U.S. Senator Joni Ernst will probably go all-in for Reynolds in the 2018 primary. Reynolds helped to recruit Ernst for the Iowa Senate and later for the U.S. Senate race.

THIRD UPDATE: Some Iowa politics-watchers expect State Senator Liz Mathis to run for governor in 2018. I don’t think she would run against Petersen or Jochum in a primary, though, and I consider either of them more likely to run than Mathis.

Prospects for increasing diversity in the Iowa legislature

Forty men and ten women currently serve in the Iowa Senate. No senators are African-American, Latino, or Asian-American.

Seventy-five men and 25 women currently serve in the Iowa House. Five state representatives are African-American and none are Latino or Asian-American.

Lazy Beltway journalism: Pat Grassley, Matt Schultz among "40 under 40"

I wouldn’t pretend to know who the rising political stars are in all 50 states, but the Washington Post’s Aaron Blake published a 40 Under 40 feature this week, purporting to identify “people who have made names for themselves in politics outside of Washington, D.C. – state-level politicians, mayors, local officials and operatives – but could soon be known to all of us.”

I strongly disagree with whoever influenced Blake’s Iowa selections (State Representative Pat Grassley and Secretary of State Matt Schultz). After the jump I explain why, as well as which Iowans would make the cut for a more accurate “40 Under 40” list.

Highlights from this year's Iowa Senate votes on Branstad nominees

During the 2014 legislative session, the Iowa Senate confirmed all but a handful of Governor Terry Branstad’s more than 200 nominees for state boards and commissions. It’s not unusual for senators to vote down one or two appointees, but this year the Senate confirmed everyone who came up for a vote on the floor.

The only close call was former Iowa House Republican Nick Wagner, confirmed to the Iowa Utilities Board last month with just one vote to spare. Branstad originally named Wagner to the three-member utilities board in 2013 but pulled his nomination when it became clear that senators would not confirm him. Branstad named Wagner to that board anyway, right after the Senate adjourned for the year in 2013. By the time his nomination came up for consideration this year, a couple of factors that worked against him were no longer relevant. Former State Senator Swati Dandekar had resigned from the board to run for Congress, so there would no longer be two of three members from Marion (a Cedar Rapids suburb). Furthermore, Branstad named attorney Sheila Tipton to replace Dandekar, so senators could no longer object to the lack of a lawyer on the Iowa Utilities Board.

Still, most of the Democratic caucus opposed Wagner’s nomination. State Senator Rob Hogg cited the nominee’s support for a bad nuclear power bill that the legislature considered a few years back. Meanwhile, State Senator Matt McCoy (who incidentally wanted to pass the nuclear bill) noted that as a key Iowa House Republican on budget matters, Wagner “was not willing to listen” and “took very difficult and very hard-line positions.” After the jump I’ve posted the roll call on the Wagner nomination; 11 Democrats joined all 24 Republicans to confirm him.

As in recent years, the governor withdrew a handful of nominees who were not likely to gain at least 34 votes (a two-thirds majority) in the upper chamber. A few nominees for low-profile boards had to go because of party imbalance issues. Chet Hollingshead, one of seven Branstad appointees to the Mental Health and Disability Services Commission, never came up for a vote, presumably because of a theft incident Bleeding Heartland user Iowa_native described here.

I am not sure why Senate Majority Leader Mike Gronstal informed Branstad that Jason Carlstrom was unlikely to be confirmed as chair of the Iowa Board of Parole. The governor first appointed Carlstrom to that position in the summer of 2012, to fill out the remainder of someone else’s term. The Iowa Senate unanimously confirmed him during the 2013 legislative session. When Branstad reappointed Carlstrom to the parole board this year, I didn’t expect him to run into any trouble. I will update this post if I learn more details.

The highest-profile nominee withdrawn by Branstad was former Iowa House Republican Jamie Van Fossen, whom the governor wanted to chair the Public Employment Relations Board. Cityview’s Civic Skinny described the backstory well; I’ve posted excerpts after the jump. Van Fossen still serves on that board, having been confirmed to a full term in 2012. But the new chair will be Mike Cormack, a Republican who served four terms in the Iowa House and later worked for the State Department of Education. Senators unanimously confirmed Cormack last month. The outgoing Public Employment Relations Board chair, Jim Riordan, has alleged that the board faced political pressure from Branstad staffers to hire an employer-friendly administrative law judge.

Iowa Senate approves cannabis oil bill

Yesterday the Iowa Senate approved by 36 votes to 12 a bill to legalize the use of medical cannabis oil for treating certain seizure conditions. You can read the full text of Senate File 2360 here. After the jump I’ve posted State Senator Joe Bolkcom’s floor statements in support of the bill, which summarize its key points and limited scope. An Iowa Senate Democratic research staffer provided a more detailed analysis of the bill here (pdf).

The roll call in the Senate Journal shows that all 26 Iowa Senate Democrats voted for the cannabis oil bill, joined by the following ten Republicans: Mike Breitbach, Mark Chelgren, Minority Leader Bill Dix, Joni Ernst, Hubert Houser, David Johnson, Tim Kapucian, Charles Schneider, Amy Sinclair, and Brad Zaun. The twelve Republicans who voted no were Bill Anderson, Jerry Behn, Rick Bertrand, Nancy Boettger, Jake Chapman, Randy Feenstra, Julian Garrett, Sandy Greiner, Dennis Guth, Ken Rozenboom, Roby Smith, and Jack Whitver. Republicans Mark Segebart and Dan Zumbach were absent.

During the floor debate, several Republicans warned that passing the bill would send the wrong message to teenagers, leading to more recreational use of marijuana. That’s hard to fathom, since the bill does not legalize smoking marijuana, even for terminally or chronically ill Iowans who could benefit from medical cannabis in that form.

Key Iowa House Republicans and Governor Terry Branstad have made clear that for now, they would consider only a bill to allow access to medical cannabis oil. I hope a study committee on broader use of medical marijuana will go forward. Senate File 2360 is a step in the right direction and will give families like this one options other than moving to Colorado. However, the bill leaves out too many suffering people.

P.S.- A sign of how far the political ground has shifted in the medical marijuana debate: Joni Ernst and Brad Zaun are in fiercely competitive GOP primaries (for U.S. Senate and IA-03, respectively). Both of them voted for this bill.

Bipartisan group pushing Iowa legislative study of medical marijuana

What a difference a month makes. Four weeks ago, State Senator Joe Bolkcom declared his bill to legalize the medical use of cannabis dead on the same day he introduced it. Now five Republican senators have joined Bolkcom and four other Iowa Senate Democrats seeking to advance the conversation about medical marijuana before next year’s legislative session.

Click here to read the full text of Senate Resolution 112, which requests the creation of an interim study committee “to make recommendations on the feasibility of establishing a medical cannabis program in this state allowing qualifying resident patients to purchase and possess cannabis for medical purposes, and to file a final report including recommendations with the general assembly by December 30, 2014.” If the Senate approves the resolution, the Iowa Legislative Council led by House Speaker Kraig Paulsen and Senate Majority Leader Mike Gronstal will likely approve a study committee to evaluate medical marijuana later this year.

Depending on the study committee’s conclusions, a medical marijuana bill might garner more bipartisan support during the 2015 legislative session. Kudos to Democrats Bolkcom, Matt McCoy, Bill Dotzler, Jack Hatch, and Tom Courtney, and Republicans Ken Rozenboom, Mike Breitbach, Brad Zaun, Amy Sinclair, and Charles Schneider for supporting this resolution. It’s worth noting that all five Republican co-sponsors were elected to the Iowa Senate in 2012 and therefore will not face re-election again until 2016. Consequently, all five will be serving in the Iowa Senate next year, regardless of which party controls the chamber after the 2014 elections.

Democratic gubernatorial candidate Hatch has long been on record supporting medical marijuana in Iowa. Earlier this month, Governor Terry Branstad warned of “unintended consequences” and said much more study of the issue is needed.

UPDATE: I should have mentioned that while Zaun isn’t up for re-election to the state Senate this year, he is one of six GOP candidates running in Iowa’s third Congressional district. I wonder whether any of his rivals in IA-03 will criticize this stance.

Last-minute Iowa legislative scramble is nothing to brag about

The Iowa Senate wrapped up its work for the year shortly after midnight on May 23, and Iowa House members adjourned about 11 hours later. Lawmakers in both parties have been congratulating themselves for compromising on some big issues that ended in stalemate the previous two years. Rod Boshart compiled an excellent list of what the legislature did and didn’t approve during 2013.

We all can appreciate the desire to finish a big project before a holiday weekend, and since legislators stopped receiving per diem payments weeks ago, they understandably wanted to get out of town as quickly as possible. However, I found it disturbing that votes were held before most lawmakers, let alone members of the public, had time to digest final conference committee deals on education reform, an alternative to Medicaid expansion, property taxes, and the health and human services budget. Transparency isn’t just a buzzword. Had journalists and advocacy groups been able to look over the last-minute compromises, people might have discovered problematic language or even simple drafting errors, which could produce unintended consequences after Governor Terry Branstad signs these bills into law.

I have a lot of questions about the final education reform bill and the plan to provide health insurance to low-income Iowans, particularly those earning between 101 percent and 138 percent of the poverty level. I also need more time to sort through the budget numbers and final changes to the standings bill. After the holiday weekend Bleeding Heartland will examine the important results of the legislative session in more detail. For now, I’ve posted after the jump details on who voted for and against the major bills approved this week.

UPDATE: In the May 24 edition of the On Iowa Politics podcast, statehouse reporters Mike Wiser and James Lynch discussed how the big issues came together “behind closed doors,” with no public scrutiny or oversight. Lynch commented that to his knowledge, the conference committee named to resolve the impasse over Medicaid expansion never formally met, except perhaps for one organizational meeting. Lynch recounted one occasion when Iowa House Republican Dave Heaton was briefing journalists about the health care talks, and the journalists asked when that happened, since there hadn’t been any public notices of conference committee meetings. According to Lynch, Heaton replied, “We’re not having meetings, but we’re meeting.” Senate President Pam Jochum said that negotiations between Democratic State Senator Amanda Ragan and House Majority Leader Linda Upmeyer produced the “key to Iowa’s health care compromise.” Notably, Upmeyer didn’t have a prominent role in passing the House health insurance plan, nor was she named to the conference committee assigned to merge the House and Senate proposals.

Speaking to journalists on May 22, Senate Majority Leader Mike Gronstal and Jochum weren’t able to answer a specific question about compromise wording reached regarding Medicaid coverage of abortions. That was no minor issue–it was the last sticking point holding up approval of the health and human services budget. In effect, Gronstal told journalists, you can see the wording after the final bill is published.

Another Iowa legislative victory for Big Ag

Factory farm advocates failed in 2009 to circumvent the Iowa DNR’s rulemaking on applying manure over frozen and snow-covered ground. Then they failed in 2010 to win passage of a bill designed to weaken Iowa’s newly-adopted regulations on manure storage and application.

But this year, the Iowa Pork Producers Association succeeded in convincing state lawmakers to relax requirements for CAFO operators to be able to store their own manure properly. All they had to do was dress up their effort as an attempt to help families with aspiring young farmers.

Ghost of past vetoes haunts Iowa education reform negotiations

Governor Terry Branstad has invested a lot of political capital in education reform. His staff organized a large conference on the topic in 2011, featuring U.S. Secretary of Education Arne Duncan and other nationally-recognized speakers. Later that year, the governor rolled out an ambitious blueprint for education reform, which was a focus of his “Condition of the State” speeches to state lawmakers in 2012 and 2013. Branstad wants something bigger and better than the narrowly-focused education reform deal approved last spring. To encourage legislators to work harder on this issue, the governor has even held up K-12 school funding decisions that should have been made a year ago under Iowa law.

Iowa House and Senate members are now negotiating over education reform bills approved in each chamber on party lines. But Branstad’s past use of his line-item power is standing in the way of broad legislation.

Iowa Senate approves Medicaid expansion along party lines

Last night the Iowa Senate approved Senate File 296, a bill to expand Medicaid, on a strictly party-line vote of 26 to 23. You can listen to the entire Senate debate (approximately 90 minutes) at Radio Iowa. I’ve posted highlights from the debate after the jump, along with the full list of 52 organizations that have registered their support for Senate File 296. Some corporations and organizations have have registered their lobbyists as undecided on Senate File 296, but at this writing, not a single organization is registered against the Medicaid expansion.
