Read highlights from Art Cullen's Pulitzer Prize-winning editorials

The best news out of Iowa last week was Storm Lake Times editor Art Cullen winning the 2017 Pulitzer Prize for “editorials fueled by tenacious reporting, impressive expertise and engaging writing that successfully challenged powerful corporate agricultural interests in Iowa.” Our state’s journalism community has long recognized the quality of Cullen’s work. The same series of columns earned him one of the Iowa Freedom of Information Council’s Skip Weber Friend of the First Amendment awards last year.

Cullen will donate most of his prize money to non-profits, including charities assisting refugees and the Iowa Freedom of Information Council, whose executive director Randy Evans helped Cullen press his case with Buena Vista County leaders who were withholding public records. Speaking to James Warren of Poynter and Jared Strong of the Carroll Daily Times Herald, Cullen went out of his way to credit his son, Tom Cullen, who “did most of the heavy lifting” while digging into who was paying for the legal defense of three counties sued by the Des Moines Water Works.

Resolution of lawsuit removes political case for Des Moines Water Works bill

Opponents of the legislative effort to disband the Des Moines Water Works got a boost yesterday when the water utility’s Board of Trustees voted not to appeal last month’s federal court ruling dismissing their lawsuit against three northwest Iowa counties. The Iowa Farm Bureau’s wrath over that case inspired a bill that would transfer authority over the Des Moines Water Works to three area city councils.

Agriculture committees in the Iowa House and Senate advanced versions of the Water Works bill, but neither chamber voted on the measure before a “funnel” deadline in late March. Several House and Senate Republicans representing districts with independently-managed water utilities spoke privately about opposing the bill.

Among Iowans who have been fighting this legislative overreach, one big fear has been that powerful Republicans would slip Water Works language into an appropriations bill during the final days of the session. Senate Appropriations Committee Chair Charles Schneider has pledged not to do so, but his House counterpart Pat Grassley has made no such promise. The deadline for appealing the federal court ruling was coming up on April 17, and some Water Works supporters worried that pursuing the case might strengthen the Farm Bureau’s allies at the Capitol, who are still trying to get this language to Governor Terry Branstad.

Instead, the Water Works will waive its right to appeal in exchange for the defendants agreeing not to pursue legal fees. According to Laura Sarcone, communications specialist for the water utility, the next step will be defense counsel getting the boards of supervisors of Sac, Buena Vista, and Calhoun counties to sign off on the agreement. The U.S. Department of Justice would also have to approve the resolution.

I would guess that the county supervisors will happily agree not to pursue legal fees in exchange for finalizing an end to the lawsuit. After all, the cost of defending the case didn’t come out of their budgets. As Art Cullen discussed in a Pulitzer Prize-winning series of editorials for the Storm Lake Times, secret donors, supposedly unknown even to the county supervisors themselves, paid for the first $1 million or so of the defendants’ legal expenses. The Iowa Farm Bureau and Iowa Corn Growers Association stepped in to cover the rest.

I enclose below a Water Works news release and the ruling from U.S. District Court Chief Judge Leonard Strand. In dismissing the case, he found that the Water Works “may well have suffered an injury” from pollutants entering waterways in the named counties, but the northwest Iowa drainage districts “lack the ability to redress that injury.” Almost certainly, the Water Works would not have prevailed on appeal to the Eighth Circuit. The lawsuit accomplished only one thing: making Iowa’s dirty water a more salient political issue. Even so, bills that would address the major source of the problem–agricultural runoff–have no more traction now than they ever did.

Republicans seeking to eliminate Leopold Center for Sustainable Agriculture

Republican lawmakers are seeking to eliminate the two main sources of funding for the Leopold Center for Sustainable Agriculture at Iowa State University. The Iowa legislature created the center 30 years ago as part of the Groundwater Protection Act, one of the landmark environmental laws in this state’s history. Its threefold mission:

(1) identify the negative environmental and socioeconomic impacts of existing agricultural practices, (2) research and assist the development of alternative, more sustainable agricultural practices, and (3) inform the agricultural community and general public of the Center’s findings.

The center’s director, Dr. Mark Rasmussen, told Bleeding Heartland today that roughly $1.5 million of the Leopold Center’s approximately $2 million annual budget comes from receiving 35 percent of revenues from a fee on nitrogen fertilizer sales and pesticide registrations. The modest fee of 75 cents per ton of anhydrous ammonia (now selling for approximately $550 per ton) hasn’t changed since the Groundwater Protection Act set up this funding stream in 1987. Citing legislative sources, Rasmussen said Republicans are apparently planning to redirect nitrogen tax revenues. To my knowledge, no bill spelling out the new recipients has been published yet. UPDATE: I have seen the draft appropriations bill for agriculture and natural resources and can confirm it redirects these revenues to a new “Iowa Nutrient Research Fund.” (The Leopold Center’s research addresses a broader range of farming practices.) That appropriations bill calls for the ISU College of Agriculture and Life Sciences to take over any incomplete work by the Leopold Center after July 1, 2017.

The second-largest source of funding for the center is a line item in the Iowa Board of Regents budget, which used to be about $425,000 per year. Actual state funding during the current fiscal year totaled $397,417, and Governor Terry Branstad proposed keeping the center’s funding at that level for fiscal year 2018. But the Republican plan negotiated behind closed doors and revealed this afternoon at an Education Appropriations Subcommittee hearing zeroes out the Leopold Center line item.

The center also receives a “small amount of foundation earnings” from donations to an endowment managed by the ISU Foundation, Rasmussen said, but those funds are “wholly inadequate to keep the center functioning at any level of reasonableness.”

I enclose below an e-mail Rasmussen sent to Leopold Center Advisory Board members today. He noted that the center has been involved with than 600 projects “on topics spanning water quality, manure management, livestock grazing, cover crops, alternative conservation practices, biomass production, soil health and local food systems development in Iowa.” The center’s grants have facilitated “thriving local foods networks,” and research supported by the center informed practices that are now part of Iowa’s Nutrient Reduction Strategy for addressing the state’s major water pollution problems.

It’s not hard to guess why statehouse Republicans want to ax one of the country’s leading institutions in the sustainable agriculture field. Corporate interests associated with conventional farming practices have long been hostile to research supported by the center, such as efforts to reduce nitrogen and phosphorus runoff that causes the Gulf of Mexico “Dead Zone.” Pressure from Big Ag was believed to have influenced Wendy Wintersteen, endowed dean of the ISU College of Agriculture and Life Sciences, when she chose not to offer the job of Leopold Center director to the search committee’s top choice in 2009. (Rasmussen was hired in 2012.)

The GOP education budget would also eliminate state funding for the Iowa Flood Center at the University of Iowa. Advocates for solid research on sustainable agriculture and flood patterns need to contact Republican members of the Education Appropriations Subcommittee: State Senators Tim Kraayenbrink (chair), Craig Johnson (vice chair), and Jason Schultz, and State Representatives Cecil Dolecheck (chair), Tom Moore (vice chair), Dean Fisher, Gary Mohr, and Walt Rogers.

UPDATE: Dolecheck told reporters on April 11 that there was no need for further work by the Leopold Center: ““Most people would tell you that farmers have been educated to that point, the research has been put in place whether it’s cover crops, waterways, those type of things.”

Although time constraints won’t allow everyone to speak, it’s worth making your voice heard. In addition to eliminating the Leopold Center’s main funding sources, the Republican education and natural resources budgets repeal language establishing the center from the Iowa Code.

Top Iowa Senate appropriator: No Water Works language in my spending bills

Iowa Senate Appropriations Committee Chair Charles Schneider has pledged not to include language dismantling the Des Moines Water Works in any spending bill this year.

Legislative action to transfer authority over the Des Moines Water Works from an independent board of trustees to area city councils was once seen as nearly a sure thing, thanks to strong support from the Iowa Farm Bureau. But Republican leaders never brought House File 484 up for debate before a legislative deadline in late March. The bill now sits on the “unfinished business” calendar, fueling speculation that it may rise from near-death before lawmakers adjourn for the year.

Governor Terry Branstad has been an outspoken critic of Des Moines Water Works leaders since the utility sued three northwest Iowa counties in 2015, demanding better enforcement of the Clean Water Act to reduce agricultural runoff. At the Waukee legislative forum on April 8, I asked Schneider about a rumor that Branstad has told House and Senate leaders to get the Water Works bill on his desk, and that such language may be attached to the “standings” bill in order to accomplish that end. The standings bill is typically among the last pieces of legislation considered each year and can become a grab bag of provisions power-brokers demand. Would Schneider commit not to add Water Works language to the standings bill or any other appropriations bill coming out of his committee?

Schneider: That’s the first I’ve heard of the standings rumor. It’s not going to go in my standings bill, and I’m not going to support a Water Works bill unless the Des Moines Water Works, West Des Moines Water Works, and Urbandale Water Works themselves–the utilities, not the cities, the utilities–tell me they would like to see some language in there to give them the ability to regionalize on their own.

Bleeding Heartland: So, you won’t put that in any appropriations bill.

Schneider: I’m not putting it in my standings bill.

Republican State Representative Rob Taylor responded to my question as well:

And I also sit on Appropriations on the House side now. I’m not the chair, but I wouldn’t support putting it in that standings bill either. I think that a bill with that kind of substance–although I will say, that the original bill, and the House version with the amendments from Representative [Jarad] Klein have changed substantially from the original bill–I think that’s a, that’s a critical enough bill for or against that it needs to stand on its own. And putting it on an appropriation is not appropriate, and I would fight tooth and nail to prevent it.

Here’s hoping Schneider has the clout to keep Water Works language out of any final spending bills. He also serves as majority whip, the third-ranking Senate GOP leadership position. The three independent utilities Schneider mentioned oppose the Water Works bill. The city of Des Moines is still registered in favor of House File 484, but the city of West Des Moines changed its stance last month from “for” to “undecided.”

To my knowledge, most of the Republicans on the House Appropriations Committee have taken no public position on this legislation. I’m wary because Appropriations Chair Pat Grassley formerly chaired the Agriculture Committee, where the Water Works bill originated. Assisting the Farm Bureau’s revenge mission could bring political benefits to Grassley, who is widely expected to run for Iowa secretary of agriculture if Bill Northey does not seek re-election in 2018. A front group for the Farm Bureau called the Iowa Partnership for Clean Water ran radio ads supporting the Water Works legislation.

UPDATE: On Iowa Public Television’s “Iowa Press” program this weekend, O.Kay Henderson asked Senate President Jack Whitver, “Will the Iowa legislature dismantle the Des Moines Water Works?” After hesitating for a moment, Whitver answered simply, “No.”

Iowa water quality and confirmation bias

Progressives, farmers and environmentalists heard there is movement in the Iowa legislature to fund water quality and ears perked up — a natural impulse to interpret new events as supporting something we already believe or are working on, also known as confirmation bias.

56 percent of Iowans support increasing the state sales tax three-eighths of a cent to pay for water quality projects and outdoor recreation, according to a Selzer and Company poll reported by the Des Moines Register on Feb 12.

On March 14, State Representative Bobby Kaufmann (R-Wilton) introduced such a bill: the WISE (Water, Infrastructure and Soil for our Economy) bill, House File 597.

After a three year implementation the tax would generate $180 million to fund Iowa’s Natural Resources and Outdoor Recreation Trust Fund, which was created by a 2010 amendment to Iowa’s constitution. It sounds pretty good. However, we shouldn’t let our confirmation bias help Republican efforts to tax the poor, cut the general fund, and support the failed Nutrient Reduction Strategy.

Representative Chip Baltimore (R-Boone) and House Agriculture Committee Chair Lee Hein (R-Monticello) had previously introduced a water quality bill (House Study bill 135) addressing structural issues related to the use of water quality funds. Baltimore favored spending funds on watershed programs such as the governor’s Nutrient Reduction Strategy. Kaufmann’s bill mandates 60 percent of funding be directed to “a research-based water quality initiative (that) includes but not limited to a practice described in the Iowa nutrient reduction strategy.”

When Governor Terry Branstad created the Nutrient Reduction Strategy, in response to a federal requirement to address water quality, it was the least he could do. It was a way of tinkering around the edges of a water quality program, leveraging wide-spread concern about the need to act without changing the underlying structure of the system that creates excessive nitrate and phosphate loads in our water.

Branstad’s approach sucked up media attention and political will while doing little to address the root cause of the water quality problem.

“I welcome any legislative effort regardless of party that looks to protect the environment,” a progressive voter posted on Facebook. “While I agree that it is not fair that we have to take on the burden of trying to clean up after the farmers, I also know that they are a stubborn lot that hold great political power in Iowa. Therefore we need to be pragmatic and take whatever we can get while the Republicans are in charge.”

A lot of people would agree with this sentiment.

It’s clear solutions proposed in the Nutrient Reduction Strategy could work. They won’t work until either the strategy is compulsory, or there is funding to support broad participation.

“Republicans sometimes get accused of not being pro-environment, of not being pro-water quality,” Kaufmann said. “Well, this is our way of taking that bull by the horns and putting forth a good, tax-neutral water quality bill that puts guarantees in it that we can make sure dollars go to water quality.”

Despite Kaufmann’s work on the bill there are issues with the WISE approach to water quality.

Sales tax is regressive, which means it would be applied uniformly to all situations, regardless of the payer. Some might argue that everyone uses water so why shouldn’t everyone pay through sales tax? It is a straw man argument. A sales tax takes a larger percentage of income from low-income earners than from people causing this problem.

What’s worse than the regressive nature of sales tax is the Republican position any new tax must be revenue neutral. That means cutting the state budget. Where will the legislature find an additional $180 million in budget cuts after a year with three successive revenue shortfalls?

“Kaufmann admits there (are) still some questions about how the bill would affect other state programs,” Rob Swoboda reported in Wallaces Farmer. “But, he says, the only way the Republican-led legislature will pass a water-quality funding plan would be if the plan is revenue-neutral.”

Proposed budget cuts should be defined before advocating for the WISE bill.

There is no need to hold the agricultural community harmless in the pursuit of clean water. In 2013, when developing the Iowa Fertilizer Plant (a.k.a. Orascom) in Wever, Governor Branstad said, “the plant would create 2,500 temporary construction jobs and 165 permanent jobs and save farmers $740 million annually by cutting the price of fertilizer.” Whether or not there was a windfall in fertilizer savings farmers can afford to put skin in the water quality game.

“Where public money is needed (to fund water quality initiatives), consider an obvious source: the sale of farm fertilizer,” former state senator David Osterberg wrote in a May 25, 2016 column in the Des Moines Register. “If an urban person buys fertilizer for the lawn, there is a sales tax on the purchase. Farmers are exempt from the normal sales tax on fertilizer and a lot of other things. There is no reason for this exemption. Put the sales tax on fertilizer, earmark it to water-quality strategies and you have, conservatively, about $130 million a year to work with.”

While a majority of voters agree something must be done to improve water quality, political capital shouldn’t be diverted to supporting failed Republican policies just because they sound good or appear to support what we all believe.

Josh Mandelbaum taking on Des Moines City Council member Christine Hensley

Promising to be a “voice for strong neighborhoods and strong schools,” defending local interests and fighting harmful state policies, Josh Mandelbaum confirmed Thursday night that he will run for Des Moines City Council against 24-year incumbent Christine Hensley. I enclose below the audio and full transcript of Mandelbaum’s first campaign speech, along with background on the candidate and a map of Ward 3, which covers west-side neighborhoods south of University Avenue and much of the south side.

I’ve been acquainted with Mandelbaum since before he was a policy advisor for Governor Tom Vilsack and Lieutenant Governor Sally Pederson. More recently, I’ve closely observed his work on renewable energy and clean water issues through our mutual involvement in Iowa environmental circles. I’m an active supporter of the non-profit Environmental Law & Policy Center, where Mandelbaum is a staff attorney. Last year Midwest Energy News named Mandelbaum to its “40 Under 40” list of list of “emerging leaders” working on “America’s transition to a clean energy economy.” He was one of only two Iowans to receive that recognition.

Even if I couldn’t personally vouch for Mandelbaum’s talent and work ethic, I would be excited to see a progressive willing to take on this incumbent. Hensley’s 2015 vote to extend a tax abatement program was indirectly a vote to benefit her employer. Timothy Meinch reported for the Des Moines Register at the time that the city attorney “warned of an ‘appearance of impropriety’ and ‘potential of a conflict of interest’” before Hensley “cast a pivotal vote in favor of developers.” Des Moines Cityview’s Civic Skinny column explained here how Hensley’s deciding vote benefited Midwest Housing Equity Group, “an Omaha-based firm that syndicates and sells tax credits from developers” where she “is a director and paid consultant.”

Hensley has given Des Moines residents plenty of other reasons to look for new representation. Mandelbaum covered several of them in the remarks I transcribed below. Her most egregious act was joining the small board of directors of the Orwellian-named Iowa Partnership for Clean Water. This advocacy organization grew out of the Iowa Farm Bureau’s desire to discredit the Des Moines Water Works, which delivers drinking water to half a million central Iowans, including all of Hensley’s constituents. My theory is that Hensley hitched her wagon to this cause in the hope of becoming Cedar Rapids Mayor Ron Corbett’s running mate in the 2018 race for governor. Whatever her motives, she chose to stand with Big Ag against her own city’s utility, despite evidence connecting farm runoff with high nitrate levels and toxic algae blooms that threaten the local water supply.

This year Hensley urged the city council to support legislation that would disband the Des Moines Water Works. The bill is widely understood to be retribution for the Water Works lawsuit against drainage districts in northwest Iowa (see the first part of this post). Mandelbaum spoke against House File 484 at a public hearing earlier this month; scroll down to view the video.

Taking on an entrenched incumbent is always an uphill battle, especially for a first-time candidate. Hensley will raise a ton of money. Even so, this race is winnable for Mandelbaum. City council elections are low-turnout affairs. Hensley didn’t have a challenger in 2005 or in 2009 and defeated Cal Woods by 3,536 votes to 2,248 four years ago.

Ward 3 “has an overwhelming Democratic registration advantage and has a D+20 performance index,” Pat Rynard noted last month. The Water Works issue alone is highly salient for Des Moines residents. A large number of teachers and public workers live on the west and south sides of Des Moines, as do many progressives interested in economic and social justice. If Mandelbaum can tap into outrage over statehouse Republicans destroying collective bargaining rights and lowering the minimum wage in Polk County, don’t bet against him turning out a few thousand Democrats who have never voted in a local election before. He won’t be able to match Hensley’s fundraising, but with Pederson and former Attorney General Bonnie Campbell co-chairing his campaign, he should raise enough money to get his message out to Ward 3 residents.

This race will be one of the most important local elections in central Iowa this November. Please spread the word.

Expect more downward revisions in Iowa revenue estimates

The Iowa Revenue Estimating Conference (REC) reduced its FY 2017 estimate for General Fund Revenues by $106 million. That’s on top of the $96 million downward revision in December 2016. Since the original estimate used for FY 2017 appropriations (December 2015), cumulative downward revisions total $243 million on a $7.3 billion budget.

This has led to all the gnashing of teeth that comes every time revenues begin to slow. The REC has never been particularly prescient when it comes to predicting the turn in receipts, either on the way down or the way up. I have some insight into this phenomenon because I used to be a revenue estimator for the Iowa General Assembly, and wasn’t any better than they are now. Indeed, economic models in general are not very good at predicting turns in the business cycle until after they happen. They are very good at generating consensus forecasts that tend to magically predict the next year will look a lot like the current year, at least during stable periods.

What’s new this time around is, according to policy makers expressing concern about the downgrade, is the reduction in revenues during what is considered a reasonably healthy economy. In my view, the stress on the General Fund is actually due to two primary factors. The economy is perhaps not quite as robust as consensus opinion suggests. Secondly, it appears the cost of House File 2433 passed during the 2016 legislative session, a bill providing a sales tax exemption for items consumed in manufacturing processes, was dramatically understated.

I suspect those looking to blame the sluggishness on a downturn in the farm sector will be disappointed as farm income growth begins to turn positive. Those who believed hundreds of millions of dollars of tax cuts and credits would spur state revenue growth should be equally disappointed. It’s just not happening.

Three questions about how Iowa got into this budget mess

Iowa’s Revenue Estimating Conference delivered bad news yesterday. Revenues are lagging so far behind projections that even after enacting huge spending cuts in February, the state is on track to have a shortfall of $131 million at the end of the current fiscal year. Next year’s revenues are being revised downward by $191 million as well.

Governor Terry Branstad, Senate Majority Leader Bill Dix, and House Speaker Linda Upmeyer quickly announced plans to use the state’s cash reserves to cover the gap. Dix’s written statement explained, “We must not cripple our schools, public safety and many other essential services with further cuts this year. Our savings account exists for moments such as this.”

Two months ago, many Democratic lawmakers advocated dipping into “rainy day” funds as an alternative to the last round of painful reductions to higher education, human services, and public safety. At that time, Republican leaders portrayed such calls as irresponsible. A spokesperson said Branstad “doesn’t believe in using the one-time money for ongoing expenses.” Now, the governor assures the public, “Iowa is prepared,” thanks to hundreds of millions of dollars in the state’s cash reserves, and Dix boasts about the supposedly strong GOP leadership that filled those reserve funds.

Republican hypocrisy on state budget practices is irritating and all too predictable. But that’s not my focus today.

While transferring funds from cash reserves will solve the immediate problem, it won’t answer some important questions about how we got into this mess.

What you need to know to fight the next four terrible Iowa Republican bills

Republicans have already inflicted immeasurable harm on Iowans during the 2017 legislative session, taking rights away from more than 180,000 workers, slashing funding for higher education and human services, and approving the third-smallest K-12 school funding increase in four decades. The worst part is, they’re nowhere near finished.

Iowa Senate Minority Leader Rob Hogg has flagged twelve of the most destructive bills still alive in the GOP-controlled House and Senate. Any Iowan can attend public hearings scheduled for March 6 or 7 on four of those “dirty dozen” bills. Those who are unable to come to the Capitol in person can submit written comments on the legislation or contact Republican state representatives or senators directly by phone or e-mail.

Weekend open thread: Post-legislative funnel edition

It was a busy week in Iowa politics, as state lawmakers raced the clock before the first “funnel” deadline on Friday. With few exceptions, non-appropriations bills not yet approved by at least one Iowa House or Senate committee are no longer eligible for consideration during the 2017 legislative session. For roundups of which bills are alive and dead, see James Q. Lynch’s story for the Cedar Rapids Gazette and the Des Moines Register article by William Petroski and Brianne Pfannenstiel. Some bills that didn’t clear the funnel may be attached to appropriations bills later. Republican State Senator Brad Zaun hopes to revive a medical cannabis proposal that way, Tony Leys reported for the Des Moines Register.

This is an open thread: all topics welcome. I’d especially appreciate tips on newsworthy comments from today’s legislative forums around the state. A Democrat in Muscatine asked State Representative Gary Carlson this morning whether he had any evidence of election fraud and whether he would acknowledge that the Republican voter ID proposal is a voter suppression bill. Carlson told her, “I just want the right people to vote.” Probably more honest than he meant to be. John Deeth explained the latest disenfranchising provisions House Republicans want to attach to Secretary of State Paul Pate’s bill, now named House File 516.

Final note: although it was sunny and unseasonably warm today in Des Moines, only about 100 people showed up for the “Spirit of America” rally by the Capitol building. A much larger crowd came to the Capitol on a very cold Thursday in February to march against President Donald Trump’s “Muslim ban” and immigration executive orders. An estimated 26,000 turned out for the Iowa Women’s March at the same venue on a Saturday morning in January.

UPDATE: Added after the jump side by side photos of the Women’s March and today’s event. SECOND UPDATE: A reader sent me his photo (taken by a drone) of the crowd at the Capitol for the “Day Without Immigrants” rally on Thursday, February 16. Added below.

Zaun was the first speaker to the pro-Trump audience today, and he noted (accurately) that he was the first Iowa Republican elected official to endorse Trump for president. He didn’t mention that he had previously declared himself “110 percent behind” Wisconsin Governor Scott Walker, whose campaign flamed out months before the Iowa caucuses. On caucus night, Trump finished third in the Senate district Zaun represents, behind Senators Marco Rubio and Ted Cruz.

UPDATE: Past and future presidential candidate Martin O’Malley was back in central Iowa on March 4, attending a fundraiser for State Senator Nate Boulton, among other events. O’Malley’s 2016 presidential campaign had a strong organization on the east side of Des Moines, which is part of Boulton’s district. The former governor of Maryland has visited Iowa regularly since the election, including stops in Davenport to support the special election campaigns of Jim Lykam for the Iowa Senate and Monica Kurth for the Iowa House.

Key Iowa Senate Republican: "Loser pays" bill going nowhere

A Republican bill that would have made Iowa courts far less accessible to ordinary people will die in an Iowa Senate subcommittee, GOP State Senator Charles Schneider told Bleeding Heartland on February 25. Bill Brauch, former director of the Consumer Protection Division in the Iowa Attorney General’s Office, explained here how the so-called “loser pays” bill “would in effect kill Iowa’s private consumer fraud law, and just about eliminate any other type of legal action by an individual against a defendant with money.”

Senate Judiciary Committee Chair Brad Zaun introduced Senate Study Bill 1008 during the first week of the legislative session, then assigned it to a subcommittee chaired by Schneider. Following a February 25 public forum in Clive, I asked Schneider about that bill’s status. He replied, “I don’t think it’s going anywhere. I haven’t held a subcommittee meeting for it, and I’m not planning to.”

I mentioned that Senate Majority Leader Bill Dix had named “loser pays” as one of his top four priorities in an interview with Radio Iowa. Schneider responded, “I’m not planning to hold a subcommittee meeting on it. I don’t think any other tort reform bills include a ‘loser pays’ section in them.”

Under Iowa legislative rules, most non-appropriations bills will be dead for the year if they have not cleared at least one Iowa House or Senate committee by the first “funnel,” coming up on Friday, March 3. The leaders of subcommittees and committees have discretion on what bills to bring up for a vote.

I’m pleasantly surprised to learn Senate Study Bill 1008 will go down without a fight. Only a month and a half ago, Dix cited a “measure that ensures losers in those court cases pay for the cost associated with the case” as one of “four bills that I believe define us and give Iowans a clear indication of where we plan to go with policies for our state.” The Iowa Association of Business and Industry, a lobby group with substantial influence among statehouse Republicans, registered in favor of this bill almost immediately. Perhaps Schneider, who practices law as a day job, was able to convince non-attorneys Dix and Zaun that “loser pays” is unnecessary and unfair. Or perhaps Zaun miscalculated by putting Schneider in charge of this subcommittee.

Whatever caused this bill’s demise, any bit of good news from this dreadful legislative session is worth celebrating.

UPDATE: Reader Marian Kuper noticed that Senate Study Bill 1144 contains a “loser pays” clause for nuisance lawsuits against large livestock farms. Senate Agriculture Committee Chair Dan Zumbach proposed that bill, which contains several provisions designed to shield confined animal feeding operations (CAFOs) from lawsuits. It has passed a subcommittee and appears likely to survive the funnel, with support from several Big Ag lobby groups.

If Todd Prichard runs for governor, his stump speech will sound like this

State Representative Todd Prichard spoke to a packed room at last night’s Northwest Des Moines Democrats meeting. Now in his third term representing Floyd and Chickasaw counties in the Iowa House, Prichard is ranking member on the Agriculture Committee and also serves on Natural Resources, Veterans, and Ways and Means, as well as on an Appropriations subcommittee. Pat Rynard recently profiled the army veteran and former prosecutor who may run for governor in 2018.

I’ve transcribed most of Prichard’s remarks from the Des Moines gathering below and uploaded the audio file, for those who want to listen. He speaks directly and fluidly without coming across as rehearsed or too polished, a common problem for politicians.

At one point, Prichard commented that Republicans didn’t spend a million dollars trying to defeat him last year, as the GOP and conservative groups did against several Iowa Senate Democratic incumbents. Republicans tested some negative messages against him with a telephone poll in August, but apparently didn’t sense fertile ground. Prichard’s opponent Stacie Stokes received little help from her party, compared to some other GOP candidates for Iowa House seats, including a challenger in a nearby district.

Based on the speech I heard on Tuesday, I would guess that if Prichard runs for governor, Republicans may regret not spending a million dollars against him in 2016.

One more point before I get to the transcript: Prichard is living proof that retiring lawmakers should not be allowed to hand-pick their own successors. When State Representative Brian Quirk resigned to take another job soon after winning re-election in 2012, he wanted his former high school football coach Tom Sauser to take his place. As a Bleeding Heartland reader who’s active in Floyd County described here, Prichard decided to run for the House seat shortly before the special nominating convention and barely won the nomination.

Prichard had a chance to start his political career because several days elapsed between his learning about Quirk’s preferred successor and the House district 52 nominating convention. Too often, Iowa Democratic legislators announce plans to retire only a day or two before candidates must submit papers to the Secretary of State’s Office. If Quirk had retired right before the March 2012 filing deadline, as three House Democrats did last year, his friend with the inside track would have been the only Democrat able to replace him. Nothing against retired teachers, but Sauser was not a potential future leader of the party, as Prichard is becoming.

Iowans shut out of Trump's cabinet, and Chuck Grassley's not happy

The less said about President Donald Trump’s divisive, angry, poorly-delivered inaugural address, the better.

Catching up on transition news of particular importance to Iowa, yesterday Trump’s team finally announced that former Georgia Governor Sonny Perdue will lead the U.S. Department of Agriculture. Perdue had long been considered a front-runner for the last cabinet position to be filled, but Trump delayed the selection for weeks in an apparent scramble to find a Latino. (He is the first president since Jimmy Carter not to appoint any Latinos to a cabinet-level position.)

The only Iowans Trump has tapped for important jobs so far are Sam Clovis, who is heading the transition at USDA, future U.S. Ambassador to China Governor Terry Branstad, and Eric Branstad, in line to become White House liaison to the Commerce Department. (By some accounts, U.S. Appeals Court Judge Steven Colloton is on Trump’s short list for the U.S. Supreme Court.)

Senator Chuck Grassley had expressed concern about the delay in choosing a secretary of agriculture and specifically about rumored efforts to find someone other than a white man for the job. He didn’t sound pleased about the Perdue appointment either.

Throwback Thursday: When Terry Branstad first tried to elevate Kim Reynolds, 18 years ago

Terry Branstad passed over some better-known and better-connected Republicans when he picked State Senator Kim Reynolds to be his running mate in 2010. During that campaign, Branstad said he was looking for a lieutenant governor who could take his place. He made clear on many subsequent occasions that he was “grooming” Reynolds. The plan will come to fruition after Branstad is confirmed as U.S. ambassador to China.

Few Iowans outside Clarke County had heard of Reynolds in June 2010, but Branstad had taken an interest in her political career long before then. If his original plan had worked out, Reynolds would have been elected to the Iowa Senate for the first time on this day in 1999.

Branstad's budget puts Kim Reynolds on a collision course with Big Ag

Governor Terry Branstad has rarely found himself at odds with any powerful farm lobby group. In 1995 he signed a law banning agricultural zoning, which fueled explosive growth of confined animal feeding operations across Iowa. Since returning to the governor’s office in 2011, he has named several agribusiness representatives to the the Environmental Protection Commission. He signed the probably unconstitutional “ag gag” bill targeting whistleblowers who might report alleged animal abuse. He moved to protect farmers from state inspections for electrical work. He joined a poorly-conceived and ultimately unsuccessful lawsuit seeking to block a California law on egg production standards. He has consistently rejected calls to regulate farm runoff that contributes to water pollution, instead supporting an all-voluntary nutrient reduction strategy heavily influenced by the Iowa Farm Bureau.

Despite all of the above, the governor’s two-year budget blueprint contains an obscure proposal that will draw intense opposition from Big Ag. By this time next year, the fallout could cause political problems for Branstad’s soon-to-be-successor, Lieutenant Governor Kim Reynolds–especially if Cedar Rapids Mayor Ron Corbett challenges her for the 2018 GOP nomination.

Rich Leopold becomes first Iowa Democratic candidate for governor

Vowing to be an outsider who can bring a “different kind of government” to Iowa, Rich Leopold just announced in a Facebook live appearance that he will run for governor as a Democrat in 2018. I enclose below his news release and a statement of “four cornerstones” that will guide his candidacy, along with a transcript of his comments on video. A first-time candidate for office, Leopold stands apart from the “lobbyists, special interests, and the insider’s club that for far too long has run our government” and “is free from the generations of deal-making and permanent campaigning that has poisoned the capitol,” his “cornerstones” document declares.

Leopold has government experience at the local, state, and federal level. He served as Iowa Department of Natural Resources director during Chet Culver’s administration from 2007 to 2010, when he took a job with the Midwest Region of the U.S. Fish and Wildlife Service. He later worked for the Dickinson County Conservation Board and since 2013 has been with the Polk County Conservation Board, where he is now director. (Disclosure: I joined the board of directors of the Iowa Environmental Council when Leopold was that non-profit’s executive director, shortly before he left to lead the DNR.)

Leopold also chairs the new Grow Iowa PAC, which raised about $10,000 last year and donated to eighteen Democratic candidates or committees.

No other Democrats have confirmed plans to run for governor, but outgoing Iowa Democratic Party chair Andy McGuire is widely expected to announce her candidacy early this year. If either wins the June 2018 primary, Leopold or McGuire would be the first Iowa nominee for governor since Roxanne Conlin in 1982 not to have held elected office.

Many politics-watchers expect at least one member of the Iowa House or Senate to seek the nomination as well, perhaps State Senator Liz Mathis or State Representative Todd Prichard.

UPDATE: State Senator Chaz Allen is also rumored to be considering the gubernatorial race. He or Prichard would have to give up their seats in the legislature in order to run for governor. Mathis was just re-elected to a four-year term, so could run for governor without leaving the Iowa Senate.

As a delegate for Hillary Clinton throughout the caucus season, I became more engaged as the general election approached. I knocked on doors weekly encouraging voters to request an absentee ballot or else convince them to vote for Hillary and down ballot Democrats. I often pestered coworkers and friends about the election and the importance of speaking out against Donald Trump.

I have no regrets and don’t feel my time was wasted in standing for a competent candidate and against an unprepared and unqualified candidate. This post will air some grievances I had during my time as a volunteer this cycle, attempt to explain why Iowans flocked to the GOP, and offer some ideas for next steps for Democrats to take.

How do I explain Adams County to outsiders? It’s a place that is suspended between the past and the future. It’s a place where you are so close to your history that you can literally reach out and touch it, while simultaneously watching that legacy disappear. It’s a place filled with innovation yet steeped in tradition. It’s a place that’s excited about the future while mourning the past.

My experience in Adams County is pretty typical. When I go “home,” it’s to my grandparents’ house in Brooks. My grandparents have lived in the same house for 62 years. The old outhouse is still there. There is a propane tank next to the house for winter heat. As a child, I learned to turn off the water when shampooing and soaping during my shower, only using water to rinse off, in order to keep the well from running dry.

Grassley still determined to hold short, early Sessions confirmation hearings

U.S. Senator Chuck Grassley announced on December 21 that he will continue to chair the Senate Judiciary Committee in the new Congress. In doing that job, his priorities will be “the hearings and confirmation process on executive branch nominations to the Department of Justice, starting with United States Attorney General nominee Jeff Sessions. The committee will also receive and process the nomination of a new Supreme Court justice. Grassley plans to focus on reforming the federal criminal justice system, conducting rigorous oversight of the FBI and Justice Department, ensuring the immigration laws are enforced, working to keep competition in the prescription drug market, reining in excessive government regulations, and protecting whistleblowers and the tools used to root out fraud against the federal government.”

Sessions can expect a less than “rigorous” vetting when Grassley’s committee takes up his nomination next month.

Bruce Rastetter still in the running to be Trump's agriculture secretary

Bruce Rastetter visited Trump Tower in New York today, as seen in this photo Craig Robinson posted on Twitter. Since making a fortune in the agriculture sector (large hog lots and ethanol), Rastetter has been among the largest Iowa donors to Republican candidates. He gave the maximum allowable contribution of $2,700 to Trump’s campaign in August, shortly before joining the GOP nominee’s informal agricultural advisory committee, aptly described by Brian Barth as a “who’s who of industrial agriculture advocates.” Rastetter had supported New Jersey Governor Chris Christie before the Iowa caucuses and maxed out to several Republican U.S. senators as well as to Christie’s presidential campaign.

Trump said little about food or agricultural policy during his campaign and has kept people guessing about his favored candidates to run the U.S. Department of Agriculture. Rastetter’s name didn’t appear on short lists for the job published in the New York Times or Modern Farmer, but he was mentioned in similar stories by Politico and Successful Farming. Such articles aren’t necessarily accurate; Idaho Governor Butch Otter has confirmed that he is being vetted for secretary of agriculture, and his name wasn’t on any short list that I’ve seen.

I assumed Rastetter was no longer a serious contender for Trump’s cabinet in part because of his connection to Christie, who appeared to have fallen out of favor soon after November 8. Vice President-elect Mike Pence took charge of the transition effort and specifically “assumed oversight of the transition at USDA,” according to Daniel Looker’s November 21 report for Successful Farming.

On the other hand, Rastetter is a frequent and influential adviser to Governor Terry Branstad, whom Trump selected to be U.S. ambassador to China this month. He was backstage during Trump’s December 8 “thank you” rally in Des Moines. Though he doesn’t obsessively brag about his wealth like the president-elect does, Rastetter has a large enough bank balance to fit into a cabinet packed with billionaires and multimillionaires.

Picking Rastetter to run the USDA would reassure biofuels supporters who are deeply concerned that Trump chose opponents of the Renewable Fuel Standard to run the U.S. Department of Energy (former Texas Governor Rick Perry) and the Environmental Protection Agency (Oklahoma attorney general Scott Pruitt). For what it’s worth, Branstad has claimed “Trump personally reassured him that Pruitt ‘is going to be for ethanol.’” If Trump keeps his promises on immigration policy, the agriculture sector may be facing a different set of problems. Barth observed in this Modern Farmer story that deporting millions of undocumented immigrants “would undermine the agricultural workforce and ripple out in the food economy in unforeseen, but likely negative, ways.”

Rastetter is currently president of the Iowa Board of Regents, the governing body for Iowa’s state universities. His six-year term on that body expires in April 2017, and Democrats have enough Iowa Senate seats to block his confirmation, should Branstad appoint him to another term.

UPDATE: Ryan Foley of the Associated Press predicted that Rastetter’s attempt to use Iowa State University to promote a major land acquisition in Tanzania “will be thoroughly re-examined” if Trump names Rastetter to his cabinet. Foley reported in 2012 that Rastetter “blurred the line between his role as investor in AgriSol Energy […] and his position on the Board of Regents” when working with ISU on his company’s “plan to develop 800,000 acres of Tanzanian farmland for crop production.” Bleeding Heartland posted many more links here on Rastetter’s attempted “land grab” in Africa.

Tom Philpott reviewed the top prospects for the USDA job in a December 20 piece for Mother Jones. Rastetter’s not on his list. Philpott considers him a “truly heinous” option for various reasons.

SECOND UPDATE: Speaking to the Des Moines Register’s Jason Noble on December 21, Trump spokesperson Jason Miller said, “I do not know if Mr. Rastetter is being considered for a particular post. Obviously he’s someone who comes with a wealth of knowledge and is very well-known in Iowa politics. But [I] don’t have any particular updates on his meeting with transition officials.” (Trump is spending this week at his Florida resort.)

JANUARY UPDATE: After a late push to find a Latino for the USDA position, Trump was supposedly leaning toward former Georgia Governor Sonny Perdue, according to Politico’s morning “Playbook” on January 2. Marvin G. Perez and Jennifer Jacobs reported for Bloomberg later the same day,

Perdue appears to be emerging from a broad pack of candidates. Weekend open thread: Branstad to China?

For years, I’ve predicted Governor Terry Branstad would step down before the end of this term in order to allow his chosen successor Kim Reynolds to run for governor as an incumbent in 2018. My thinking was influenced by political reality: the lieutenant governor has neither a strong ideological or geographical base nor the stature in Iowa Republican circles to win a statewide primary from her current position.

I saw two likely windows for a Branstad resignation: soon after the 2016 general election, or immediately following the 2017 legislative session. Either time frame would give Reynolds a boost on fundraising and other incumbency advantages going into a gubernatorial primary against rivals such as Cedar Rapids Mayor Ron Corbett and Iowa Secretary of Agriculture Bill Northey.

In recent months, I’ve become convinced Branstad would serve out his sixth term after all. At least a dozen sources have independently indicated that the governor sounds open to running for re-election again in 2018. The resounding Republican victories in this year’s Iowa House and Senate races give Branstad another reason to stick around: the chance to work with a GOP-controlled legislature for the first time since 1998.

Yet President-elect Donald Trump has hinted Branstad might be his pick to serve as U.S. ambassador to China. Speaking to reporters before his birthday party/fundraiser last night, Branstad said, “I’m not ruling anything out.”

I don’t see it happening.

Bruce Rastetter not on Trump's short list for agriculture secretary?

Today the New York Times published short lists for every position in Donald Trump’s cabinet, “using information from the Trump transition team, lawmakers, lobbyists and Washington experts.” The leading names for secretary of agriculture are Kansas Governor Sam Brownback, Texas Agricultural Commissioner Sid Miller, former Georgia Governor Sonny Perdue, and Chuck Conner, CEO of the National Council of Farmer Cooperatives.

Six Iowans were among more than 60 people on the “Agricultural Advisory Committee” Trump’s campaign announced in August. Governor Terry Branstad has never expressed interest in a federal government job. Iowa Secretary of Agriculture Bill Northey is widely expected to run for governor in 2018, unless Branstad seeks a seventh term. Sam Clovis is under consideration for deputy chief of staff for policy. Former State Representative Annette Sweeney, who leads a public policy group called Iowa Agri-Women, doesn’t have the stature for a cabinet position. The same goes for Ron Heck, a farmer and past president of the American Soybean Association.

Then there’s Bruce Rastetter, who made a fortune building factory farms and another fortune in the ethanol industry. Often described as a “kingmaker” despite the mixed results for candidates he has favored, Rastetter may soon need a new gig for throwing his weight around politically. His term on the Iowa Board of Regents, where he is nominally president but de facto the decider for the nine-member board, expires at the end of April 2017. Even after last week’s devastation, Democrats have enough votes in the Iowa Senate to block Rastetter’s confirmation, assuming Branstad renominates him to the governing board for the three state universities.

Trump is reportedly considering quite a few corporate executives for cabinet positions, so why isn’t Rastetter on the short list? He may be a casualty of New Jersey Governor Chris Christie’s declining influence in Trump’s inner circle. Rastetter has long been on good terms with Christie, but the governor was replaced as leader of Trump’s transition team soon after the election. (A source told Deadspin that “Trump had just picked Christie as transition chair nominally, as everyone had assumed the New Jersey governor would never actually have to do any work.”)

What will be Rastetter’s next political move if no federal job is forthcoming, and the Iowa Senate declines to confirm him to another term on the Board of Regents? Spin your own scenarios in this thread.

P.S.-Searches on the Iowa Ethics and Campaign Disclosure Board’s website indicate that Rastetter gave less money to Iowa Republican candidates and political committees during the 2016 cycle than he had during the previous several elections. His only five-figure gifts in 2015 or 2016 were $10,000 to Kim Reynolds for Lieutenant Governor, $25,000 to Iowa Senate Minority Leader Bill Dix’s committee, and several gifts totaling $40,000 to House Speaker Linda Upmeyer’s committee. That’s a significant drop from Rastetter’s large contributions to GOP candidates and committees during the 2014 and 2012 election cycles. He hasn’t given any money to Nick Ryan’s Team Iowa PAC since 2012, when his donations to that PAC alone totaled $120,000. The Team Iowa PAC ceased to be a major player in Iowa legislative races after the 2012 election. The American Future Fund 501(c)4 group, for which Rastetter provided “seed money” in 2007, spent less to influence federal elections in 2014 and 2016 than it had in 2012.

UPDATE: Trump’s son-in-law Jared Kushner is reportedly behind the “purge” of Christie loyalists from Trump’s transition team. When Christie was a U.S. attorney, he put Kushner’s father in prison.

Iowa House district 72 preview: Dean Fisher vs. Nathan Wrage

When the dust settled after the 2012 general election, I was frustrated to see how close Iowa Democrats came to winning back the Iowa House majority. Democratic candidates picked up seven GOP-held state House seats that year, but lost half a dozen other races by extremely narrow margins, leaving Republicans with 53 of the 100 seats in the lower chamber.

One of the “seats that got away” was House district 72, where Dean Fisher beat Nathan Wrage by only 216 votes in an open seat due to GOP State Representative Lance Horbach’s retirement. President Barack Obama outpolled Mitt Romney by about 3 percentage points among voters in the district.

IA-Gov: Sales tax hike for conservation may become fault line in 2018

Leaders of a campaign to provide a “permanent and constitutionally protected funding source dedicated to clean water, productive agricultural soils and thriving wildlife habitats” in Iowa touted support in the business and agriculture communities this week. You can watch Iowa’s Water and Land Legacy‘s September 12 press conference here or listen to the audio at Radio Iowa. Under a state constitutional amendment Iowa voters adopted in 2010, revenues generated by the next 3/8th of a cent sales tax increase (estimated at more than $180 million per year) would flow into a Natural Resources and Outdoor Recreation Trust Fund. Scroll to the end of this post for a current list of IWLL coalition members and details on the formula for allocating trust fund money.

Without knowing which parties will control the Iowa House and Senate next year, it’s hard to gauge prospects for passing a sales tax increase. Democratic State Senator Matt McCoy commented on Monday, “The best time to move on a piece of legislation is just following an election. That’s when you get your best bipartisan compromises, and I think ultimately, this is something we can find a bipartisan compromise on.”

Who might lead statehouse Republicans toward such a compromise is unclear. The GOP lawmaker most supportive of IWLL has been State Senator David Johnson. But he left the party this summer to protest presidential nominee Donald Trump and told Bleeding Heartland in a recent interview that he plans to remain an independent during the 2017 legislative session.

At least one Republican running for governor in 2018 will support the sales tax increase: Cedar Rapids Mayor Ron Corbett. That stance will put him in conflict with either Governor Terry Branstad or his chosen successor, Lieutenant Governor Kim Reynolds. In addition, support for funding IWLL among major farm lobby groups could create problems for Iowa Secretary of Agriculture Bill Northey, also a likely gubernatorial candidate in 2018.

Iowa Senate district 32 preview: Brian Schoenjahn vs. Craig Johnson

To win control of the Iowa Senate, where Democrats have held a 26 to 24 majority for the last six years, Republicans will need to beat at least two Democratic incumbents. One of their top targets is Senator Brian Schoenjahn, who is seeking a fourth term in Senate district 32.

Iowa House district 95 preview: Richard Whitehead vs. Louis Zumbach

A wave of Republican retirements created more open seats in potentially competitive state House districts than in any election since Bleeding Heartland started following Iowa politics nearly ten years ago. Most of the battleground races are in the first Congressional district, including House district 95, where state Representative Quentin Stanerson announced last December that he would not seek a third term. The high school teacher was one of only two House Republicans to request a special session last summer to override Governor Terry Branstad’s education funding vetoes.

Stanerson’s seat is probably a must-win for Democrats to have any hope of gaining control of the Iowa House (currently 57 Republicans and 43 Democrats). House district 95 covers a large area in Linn County outside the Cedar Rapids metro area, along with some rural precincts in Buchanan County. I enclose a map below.

The 2012 presidential voting in this district almost perfectly matched the statewide results. President Barack Obama defeated Mitt Romney in Iowa by 822,544 votes (51.99 percent) to 730,617 (46.18 percent). In House district 95, Obama won 52.01 percent of the vote to 46.69 percent for Romney. According to the latest figures from the Iowa Secretary of State’s office, the district contains 6,095 active registered Democrats, 6,224 Republicans, and 7,530 no-party voters.

Neither party had a competitive primary here. Democrat Richard Whitehead and Republican Louis Zumbach have backgrounds shared by many successful candidates for the Iowa legislature. Whitehead spent a career in education, rising from social studies teacher to principal to superintendent. Zumbach is a farmer and small business owner who operates an auctioneering company with his wife. Scroll down to read the official biographies and main talking points for each candidate.

Facebook feeds for Whitehead and Zumbach show that both contenders have shown up for lots of parades and summer festivals around the district. I don’t have access to voter contact data, but Whitehead is rumored to be one of the top Democratic House candidates in terms of number of doors knocked.

Zumbach will likely be able to outspend Whitehead during the final two months of the campaign–not by virtue of raising more money, but because House Republican leaders have accumulated a much larger war chest than their Democratic counterparts. The fundraising totals for the House district 95 candidates were remarkably similar. Whitehead reported $12,480.00 in campaign contributions by early May and another $2,895.00 during the next two months. As of mid-July, he had $14,179.60 cash on hand. Zumbach’s campaign brought in $12,950.00 by early May and another $950.00 by early July. His campaign spent more than Whitehead’s did, largely on signs, merchandise, and advertising, so as of July 14 he had just $5,290.76 cash on hand.

Branstad, Rastetter, Northey join Donald Trump's Agricultural Advisory Committee

So much for an “unofficial” role: Governor Terry Branstad, Iowa Secretary of Agriculture Bill Northey, and Republican power-broker Bruce Rastetter are among more than 60 people named this morning to Donald Trump’s “Agricultural Advisory Committee.” Its “executive board members will convene on a regular basis,” according to a news release I’ve posted after the jump. Note that the campaign statement misspells Northey’s name and describes Rastetter as having hosted the “first Republican Presidential debate.” Actually, Rastetter organized an Iowa Ag Summit at which nine presidential contenders (not including Trump) appeared in March 2015. New Jersey journalist Claude Brodesser-Akner was the first to report Branstad’s and Rastetter’s involvement as Trump advisers last week.

The other Iowans on the list released today are:

• Sam Clovis, who traded in his conservative and religious principles last summer to become Trump’s “national chief policy advisor”;

• former State Representative Annette Sweeney, a friend of Rastetter’s since childhood who chaired the Iowa House Agriculture Committee until redistricting forced her into a losing primary battle against fellow House Republican Pat Grassley. She was a key player in passing Iowa’s unconstitutional “ag gag bill,” the first of its kind in the country. Soon after finishing her legislative service, Sweeney became president of a public policy group called Iowa Agri-Women.

• Ron Heck, identified as an Iowa farmer and past president of the American Soybean Association.

Any comments about the presidential race are welcome in this thread. Northey is widely expected to run for governor in 2018 rather than seek a fourth term as secretary of agriculture. His likely opponents in a GOP gubernatorial primary include Lieutenant Governor Kim Reynolds and Cedar Rapids Mayor Ron Corbett. While the lieutenant governor has repeatedly urged Iowans to vote for Trump at public events, Corbett has wisely kept some distance between himself and the presidential nominee. He steered clear of Trump’s rally in Cedar Rapids on July 28.

Branstad to be "unofficial" Trump adviser; Bruce Rastetter may have same role

New Jersey journalist Claude Brodesser-Akner had the scoop today for NJ.com: Donald Trump’s soon-to-be-announced economic advisers include Iowa Governor Terry Branstad and “Bruce Rastetter, a multimillionaire livestock and bio-fuel tycoon who insiders say is also a leading candidate to be Trump’s agriculture secretary.” They

will advise Trump on agribusiness and energy policy, according to a source within the Trump campaign who was not authorized to speak publicly about the move.

“There’s a clear nexus between [New Jersey Governor Chris] Christie, the Branstads and Rastetter,” explained one Iowa GOP insider familiar with all three men’s dealings with one another but who was fearful of alienating the Iowa governor by speaking out publicly.

Rastetter helped talk Branstad into running for governor again in 2009 and was his campaign’s top donor in 2010. He has exerted substantial influence since Branstad returned to office in 2011, speaking to the governor “at least once a week.” Rastetter tried to recruit Christie to run for president in 2011 and endorsed him in a highly-publicized event last September. Though Branstad did not endorse any presidential candidate before the Iowa caucuses, several people close to him were involved in Christie’s campaign.

Branstad’s spokesperson Ben Hammes confirmed via e-mail that the governor “was asked to advise Mr. Trump in an unofficial role. He will be offering his advice on important issues to Iowa, none more important than renewable fuels.” Iowa Republicans have seized on a recent report by Reuters, suggesting that as president, Hillary Clinton might change federal policy on the Renewable Fuel Standard, a mandate for biofuels blends into gasoline. The governor’s son Eric Branstad is running Trump’s general election campaign in Iowa, having coordinated an ethanol industry group‘s political efforts here before the caucuses.

Hammes declined to comment on Rastetter’s possible role in the Trump campaign or a prospective Trump cabinet. At this writing, Rastetter’s office has not responded to my inquiry. The man often described as an “ethanol baron” sought to enhance his reputation as an authority on agriculture policy last year, when he organized an Iowa Ag Summit, attended by nine presidential hopefuls and a who’s who of Iowa GOP elected officials. Though Rastetter would surely want to have a strong voice in any Republican administration, I have trouble seeing him in a cabinet secretary’s role, with many public events and press availabilities. The way Trump’s poll numbers are looking lately, we will likely never find out whether Rastetter was really the top contender to head the U.S. Department of Agriculture.

UPDATE: According to Cedar Rapids Gazette columnist Todd Dorman, Rastetter met privately with Trump not long before the nominee’s July 28 rally in Cedar Rapids. Excerpts from that story are after the jump, along with comments Hammes provided to Gazette reporter Vanessa Miller.

Calling on RAGBRAI riders to help plant milkweed for monarchs

Monarch butterfly enthusiasts have prepared more than 50,000 balls containing common milkweed seeds for riders participating in next week’s Register’s Annual Great Bike Ride Across Iowa (RAGBRAI). As its name suggests, common milkweed (Asclepias syriaca) is the most prevalent among the 17 types of milkweed found in Iowa. However, the use of genetically-modified Roundup Ready corn and soybeans greatly diminished common milkweed on Iowa cropland. “Kelly Milkweed” Guilbeau and a friend scattered some milkweed seeds while doing RAGBRAI in 2014, then prepared about 2,000 balls of seed to hand out during last summer’s ride across Iowa.

Elizabeth Hill, who manages the Conard Environmental Research Area at Grinnell College, has collaborated with Guilbeau on the Milkweed Matters initiative, greatly expanded this year. I wish them every success; driving around Iowa last week, I saw huge stands of wild parsnip along too many roadsides.

I enclose below two pictures of common milkweed blooming, as well as a press release explaining where riders can pick up seed balls to toss in unmowed ditches along the RAGBRAI route, which runs across southern Iowa from July 24 through 30.

Weekend open thread: ISU cronyism and favoritism edition

Insider dealing at the University of Iowa has drawn intense scrutiny since President Bruce Harreld’s hiring last year. This week, several news reports cast an unflattering light on the culture President Steven Leath is fostering at Iowa State University.

The July 9 Des Moines Register carried a front-page story by Lee Rood on Leath’s recent purchase of land from one of the companies controlled by Iowa Board of Regents President Bruce Rastetter. After trying to weasel out of answering questions regarding what he called his “personal life,” Leath insisted he got no “special deal” on the land. However, the arrangement appears highly irregular, as discussed below following excerpts from Rood’s article.

Two recent stories by Vanessa Miller for the Cedar Rapids Gazette raised further questions about what kind of operation Leath is running. Click through to read about the hiring of former Republican lawmaker Jim Kurtenbach for a high-paying job that was never advertised, as well as Kurtenbach’s restructuring of ISU’s information technology services unit, which involved eliminating 23 positions and paying 19 people not to work since May 25. Excerpts from those stories are below as well.

P.S.- Speaking of cozy Republican networks, Ryan Foley reported for the Associated Press on Friday that the University of Iowa “is retaining a social media startup company with Republican Party ties that benefited from earlier no-bid contracts.” Wholecrowd is run by Jim Anderson, who served as Iowa GOP executive director during part of the time the University of Iowa’s current Vice President for External Relations Peter Matthes was a staffer for the GOP state Senate caucus. Under no-bid contracts Matthes signed with former Iowa GOP state party chair Matt Strawn’s company, Wholecrowd did the same kind of “digital advocacy” work as a subcontractor. The university’s new contract, signed directly with Wholecrowd after a competitive bidding process, seems to have cut Strawn out as the middleman.

Republicans quietly nominated David Kerr in Iowa House district 88

Something strange happened in Iowa House district 88, which unexpectedly became an open seat last month. Less than two hours after State Representative Tom Sands disclosed on June 9 that he would not seek another term, Republicans announced that Jason Delzell would be a candidate in the district. The timing signaled that Delzell was Sands’ preferred successor and the GOP establishment’s choice for the nomination.

However, on June 23, delegates to a special convention nominated Louisa County farmer David Kerr instead. I didn’t hear that news until late last week, because in contrast to past practice when state legislative seats have been open, the Iowa GOP did not announce the special convention date in advance, nor did they send out a statement afterwards on the convention results. Some journalists were informed after the fact that Kerr was nominated, because a press release about him appeared in the Muscatine Journal and Quad-City Times on June 24.

That statement said nothing about a contested race for the GOP nomination, but Delzell confirmed a few days ago via e-mail that he did not withdraw his candidacy and “fought to the end” on June 23. I don’t know how close the vote was. From what I can gather, no journalists attended the special convention, so I assume none were informed about it in advance. For whatever reason, Republicans did not want to draw attention to this event. I have not seen any statement indicating whether Sands endorsed Kerr or lobbied on his behalf.

I enclose below some background on Kerr, along with a map of House district 88. Democrats are poised to nominate Ryan Drew for this House race, though a special convention has not yet been held. Both parties are likely to target House district 88, which contains 5,566 active registered Democrats, 6,397 Republicans, and 6,775 no-party voters, according to the latest figures from the Iowa Secretary of State’s office. President Barack Obama outpolled Mitt Romney here by 50.9 percent to 47.9 percent in 2012.

Big Meat, Small Towns: The Free Market Rationale for Raising Iowa’s Minimum Wage

Austin Frerick, an Iowa native and economist who has worked at the Institute for Research on Poverty and the Congressional Research Service, makes a distinctive case for raising the minimum wage, last increased in Iowa in January 2007. -promoted by desmoinesdem

All of the states that border Iowa, except one, have raised their minimum wage above the federal level. In fact, a majority of states in the union have a higher one. A recent study estimated that 413,000 Iowa workers would benefit from a wage increase to at least $12 and most of the benefits would accrue to full-time adult women. The public also already decidedly supports this action as a recent Des Moines Register poll found that nearly two-thirds of Iowans favored raising it. This debate is especially relevant for Iowans employed in the numerous slaughterhouses that dot the state.

Company towns, once a relic of America’s industrial past, have reemerged in American society, notably in rural Iowa slaughterhouse communities. This occurred because of a market climate that made their monopsony position in these communities attractive to firms. This predicament causes a market failure. Therefore, raising Iowa’s minimum wage will correct this market distortion for these especially vulnerable Iowans.

IA-04: Joni Ernst is all in for Steve King

Today U.S. Senator Joni Ernst became the third Iowa Republican heavyweight to endorse Representative Steve King, who faces a primary challenge from State Senator Rick Bertrand in Iowa’s fourth Congressional district. Ernst didn’t just allow King’s campaign to announce her support in a statement, she also filmed a short video which I’ve enclosed below, along with a transcript.

Birds can be heard singing in the background as Ernst praises King for supporting life, liberty, the military, four-laning U.S. Highway 20, and the fuel blender tax credit. The sound you can’t hear is the door slamming on Bertrand’s already slim chance to win this primary.

Ernst served with Bertrand in the Iowa Senate GOP caucus from 2011 through 2014, so has observed his political work more closely than most Republicans. She could have stayed neutral, though seven-term incumbent King was heavily favored to win the IA-04 primary even before Iowa Secretary of Agriculture Bill Northey and U.S. Senator Chuck Grassley publicly backed him.

As with Grassley’s endorsement, I wonder whether Ernst wanted to dish out some payback to Nick Ryan, the dark money operative who was recruiting a primary challenger in IA-04 and endorsed Bertrand immediately after the state senator made his campaign official.

Ryan worked for Mark Jacobs during his race against Ernst and others in the 2014 GOP primary for U.S. Senate. (Bruce Rastetter, a frequent ally of Ryan and major ethanol industry figure who is also supporting Bertrand against King, backed Ernst early in that race.)

Bertrand has been promoting himself as someone who will deliver for IA-04 in Congress, rather than trying to be a “national figure.” Last week, he asserted in an interview with the Des Moines Register’s William Petroski that there is widespread “discontentment” with King, who “has gone Washington.” Echoing that talking point, Ryan told Petroski, “I believe we can do better. I want a conservative congressman that cares more about getting things done for his district than booking an appearance on Fox or MSNBC.”

Ryan can raise a lot of money to spend on campaigns, but his track record in Iowa GOP contests is mixed. Unsuccessful candidates who benefited from spending controlled by Ryan include: Jim Gibbons in the 2010 primary for Iowa’s third Congressional district, Annette Sweeney in the 2012 primary for Iowa House district 50, Jacobs in the 2014 Senate primary, Matt Schultz in the 2014 primary for IA-03, and Mike Huckabee before the latest Iowa caucuses.

P.S.-Asked this morning whether he wants “to see King defeated” in June, Governor Terry Branstad replied, “It’s up to the voters to decide in each of these instances and I’ve always had confidence in the voters of Iowa to make a good decision and I will obviously support the Republican nominees,” O.Kay Henderson reported for Radio Iowa. Branstad made headlines by calling for Ted Cruz’s defeat less than two weeks before the Iowa caucuses. King was Cruz’s leading surrogate in Iowa after endorsing the Texas senator for president in November.

IA-Sen: Judge playing down, Hogg playing up differences on water quality

By entering the U.S. Senate race, former Lieutenant Governor Patty Judge ensured that environmental issues would become salient for many Iowa Democrats trying to choose among the four candidates running against Senator Chuck Grassley.

During the past two weeks, Judge has sought to minimize the daylight between herself and State Senator Rob Hogg on the need to address water pollution. But Hogg, widely considered Judge’s leading rival for the nomination, has made environmental concerns a big part of his pitch to Democrats.

IA-04, IA-Gov?: Bill Northey endorses Steve King for Congress

The Republican National Convention delegate elections grabbed most of the attention from today’s Iowa GOP district conventions, but Secretary of Agriculture Bill Northey made some news at the fourth district gathering in Fort Dodge. Kathie Obradovich reported for the Des Moines Register,

“When I think of somebody I want in the room talking with conservative congressmen and senators, a potential president, on ethanol issues, I want Steve King,” [Northey] said.

King, in turn, suggested a promotion for Northey — but not to governor, a job for which he is often mentioned as a potential candidate. He noted there will be a new U.S. Agriculture secretary next year. “We’ll no longer have Secretary (Tom) Vilsack. I think maybe Secretary Northey sounds pretty good to me.”

King touted the quadrupling of ag land values during the first 12 years he was in Congress. “We should not forget, those are the best 12 years that agriculture has ever had in the history of this state during that period of time,” he said.

You don’t have to be an economist to know the rise in Iowa farmland values since 2003 has very little connection to who represented our state in Congress. But let’s leave that aside for now. Northey and King have long had a friendly political relationship. The ag secretary cut a radio ad King aired near the end of his toughest re-election campaign, the 2012 race against Christie Vilsack in a substantially redrawn district. Click through to read the transcript of that commercial, in which Northey touted King’s record on agriculture issues and support from farm groups. I would not be surprised to see a similar testimonial hit the airwaves before King’s June 7 primary against State Senator Rick Bertrand. People linked to the ethanol industry are among Bertrand’s heavy-hitter supporters, largely because King endorsed Senator Ted Cruz for president, despite Cruz’s stand on the Renewable Fuel Standard.

Speaking of the presidential race, King discussed possible brokered convention scenarios on this weekend’s edition of Iowa Public Television’s “Iowa Press” program. He predicted that “neither Trump nor Cruz delegates are going to tolerate anyone coming in from the outside that hasn’t been a candidate,” such as U.S. House Speaker Paul Ryan. Northey is widely considered likely to run for governor in 2018 rather than for a fourth term as secretary of agriculture. King’s support could be helpful in a primary that will almost certainly include at least two other candidates: Lieutenant Governor Kim Reynolds and Cedar Rapids Mayor Ron Corbett. Neither has a strong base in rural Iowa, although Corbett has tried to bolster his credentials with the farm community by touting all-voluntary efforts to reduce agricultural runoff and bashing some efforts to regulate farm-based pollution.
