Iowa Republicans may be able to enact a near-total abortion ban soon, depending on how the U.S. Supreme Court and Iowa Supreme Court resolve pending abortion cases.

But the three Democrats hoping to succeed retiring Polk County Attorney John Sarcone have all ruled out charging people for potential crimes related to having or performing an abortion.

It’s conventional wisdom that Roe v Wade was a poorly written judicial decision. Not the first, nor the last.

I’m not a constitutional law scholar and I can’t say whether the weight of precedent should counteract the weakness of a poorly reasoned opinion. But each and every one of the conservative justices who can be expected to concur with the draft opinion overturning Roe assured senators during their confirmation hearing that the 1973 precedent was settled law, and that the principle of stare decisis carries such grave weight that the prospect of overturning “settled law” was unlikely.

But then, for anyone who believed what those potential justices said, I have the proverbial bridge in Brooklyn to sell you. It just isn’t relevant to ask whether future justices lied under oath, because everyone knew they were lying. It’s a game we play.

It’s been a rough week for abortion rights advocates. Many of my own friends, relatives, and acquaintances feel helpless and hopeless in the face of Roe v Wade‘s likely demise. These people don’t need to be reminded to vote. But voting for Democrats hasn’t stopped the rollback of reproductive rights. Anyway, the next opportunity to vote for pro-choice candidates is six months away.

If you believe no one should be forced to continue an unwanted pregnancy, here are some concrete ways to help keep abortion available for those who need the procedure.

U.S. Senator Joni Ernst has said little publicly about abortion since Politico published a draft opinion indicating that the U.S. Supreme Court is poised to overturn the Roe v Wade and Casey precedents. The topic wasn’t mentioned in any of the seven press releases her office has published since the news broke on May 2.

Speaking to the conservative network Newsmax the morning after Politico published the draft opinion, Ernst and her interviewer focused on the leak (which the senator described as “absolutely abhorrent”). They did not discuss how Republicans in Congress would respond to a decision sweeping away rights women have enjoyed for nearly five decades.

But according to an article by a well-sourced reporter, Ernst has been part of closed-door talks on the best way to ban abortion nationwide.

The Planned Parenthood affiliate that includes Iowa is preparing for an influx of patients seeking abortions from states where the procedure may soon be banned.

Since 2018, Iowa has been part of Planned Parenthood North Central States, which also provides reproductive health care services in Minnesota, Nebraska, North Dakota, and South Dakota. Both of the Dakotas have enacted “trigger” laws, which would immediately ban abortion as soon as the U.S. Supreme Court overturns the Roe v. Wade precedent. An effort to pass a similar law in Nebraska failed last month, but proponents have vowed to try again later this year.

Dr. Sarah Traxler, chief medical officer for Planned Parenthood North Central States, told reporters during a May 3 news conference that the organization’s regional and national leaders have long “been planning for this worst-case scenario.”

She promised, “We’re going to be here for the long haul, and we’re going to fight to make sure that this is accessible to everybody.”

Five U.S. Supreme Court justices will soon overturn the Roe v Wade and Casey decisions, according to a draft majority opinion obtained by Politico. Josh Gerstein and Alexander Ward published excerpts from the draft, which author Justice Samuel Alito circulated in February.

Assuming the court overrules Roe sometime in the next two months, abortion will become illegal immediately in more than a dozen states. Other Republican-controlled states, including Iowa, will likely pass total or near-total abortion bans soon after.

But any such law could not take effect here as long as a 2018 Iowa Supreme Court precedent stands. In that case, the majority held that the Iowa Constitution protects a fundamental right “to decide whether to continue or terminate a pregnancy,” and any limits on that right are subject to strict scrutiny.

That ruling could be overturned in two ways.

News flash: the so-called pornography is an excuse. The content of some books does bother them. But even that is a distraction from what’s really at stake: the very existence of a public school system. 

Americans for Prosperity — Iowa announced its first two endorsements for Republican legislative primaries on January 13. In both Iowa House districts, the candidates backed by the influential conservative lobby group will face more experienced GOP lawmakers in the June 7 primary.

Drew Klein, state director of the Koch-funded network‘s Iowa chapter, declined to comment for the record about the reasons underlying AFP — Iowa’s 2022 primary endorsements. AFP lobbies for or against dozens of bills Iowa lawmakers consider every year. The group’s priorities include tax cuts, undermining public sector unions, reducing occupational licensing requirements, and various measures to redirect public funds away from public schools.

AFP is backing Zach Dieken in the new House district 5, where State Representative Dennis Bush is seeking re-election, and first-term State Representative Steven Bradley in the new House district 66, where six-term State Representative Lee Hein is also running. The group is already publicizing its endorsements in Facebook ads.

In my very first days of private practice, I met a patient with an aggressive form of breast cancer. She was young, in her 30s. She and her husband had two children under the age of 5 and were doing the same struggling most young middle-class Americans do at that point in life. They worried about bills, insurance, saving for big purchases. They were not likely thinking about retirement, and they had no plans for a medical emergency. Now their family was faced with a medical crisis that no one could have predicted.

I could tell her hands were full as her husband tried to wrangle the kids who were up and down the walls of the exam room as she explained her situation to me.

When my wife and I consider a major home project, such as a kitchen or bathroom remodel, we apply the principle I call “pawn takes queen.” As in chess, the idea is to consider several moves ahead so as to anticipate the ramifications. It’s time to codify Roe v. Wade.

We all understand that the 1973 U.S. Supreme Court decision was a seminal victory for women across the country. Roe allowed American women to be treated a little more equally in our country’s social, political, and economic life.

As a doctor, I understand that the decision to have an abortion is not an easy one. I have never had a woman in my clinic decide to terminate a pregnancy lightly. Like all medical procedures, it is between a woman and her doctor.

As it stands, the GOP’s top priority is creating an anti-abortion mob of vigilantes to patrol the streets, looking for women to turn in for a reward. Make no mistake – this will result in a cottage industry of professionalized bounty hunters looking for vulnerable women to prey on.

About 14 percent more abortions were performed in Iowa during calendar year 2020 compared to the previous year, indicating that a sharp increase recorded in 2019 was not a one-off.

Iowa Department of Public Health data shows 4,058 pregnancy terminations occurred during 2020, up from 3,566 abortions performed in 2019. That number represented a 25 percent increase from the 2,849 abortions recorded in 2018.

Prior to 2019, abortions were on a steady downward trend in Iowa and nationally for at least a decade. The figure recorded for 2020 was the highest since 2013.

The Iowa Supreme Court will soon revisit one of the most politically charged questions of our time.

Last week a Johnson County District Court permanently blocked the state from “implementing, effectuating or enforcing” a law requiring a 24-hour waiting period before all abortions. Judge Mitchell Turner ruled the law unconstitutional on two grounds. The state is appealing the ruling and argues that a 2018 Iowa Supreme Court precedent, which established a fundamental right to an abortion under the Iowa Constitution, was “wrongly decided.”

Republican lawmakers planned for this scenario when they approved the waiting period during the waning hours of the 2020 legislative session. They may get their wish, but a reversal of the 2018 decision is not guaranteed.

During the closing days of the Iowa legislature’s 2021 session, Republicans accomplished one task that eluded them in 2020: getting a constitutional amendment on abortion halfway toward appearing on a statewide ballot. I expected the House and Senate to approve the measure quickly, emboldened by a larger majority in the lower chamber, where the proposal stalled last year.

Instead, Republicans spent months haggling over how the amendment would be phrased, hoping to make this effort more palatable to Iowans who currently oppose it.

I’ve been lucky to travel all over the U.S. and around the globe during my professional career. Every time I tell a stranger I’m from Iowa, I’m confronted with the same question: “Why would anyone want to live in Iowa?”

I often asked my parents the same question when I was growing up, but over time I grew to appreciate being an Iowan and love to brag about our state. Telling people about what it means to be “Iowa nice” and showing off pictures of a beautiful sunset over a cornfield makes it easy to show why Iowa can be great place to live. But convincing someone to move here? That’s another story.

In the hopes of attracting people to move here, I wanted to examine all the compelling reasons why Iowa is a great place to live.

Several initiatives Republican legislators have promoted this year lack popular support, according to the latest Iowa Poll by Selzer & Co for the Des Moines Register and Mediacom. One of the most unpopular proposals tested was a state constitutional amendment that would clear a path for future abortion bans.

The U.S. House voted 244 to 172 on March 17 to reauthorize the Violence Against Women Act (VAWA) with some new provisions. All Democrats present, including Representative Cindy Axne (IA-03), were joined by 29 Republicans, including Representative Mariannette Miller-Meeks (IA-02), to send the bill to the U.S. Senate. Republican Representatives Ashley Hinson (IA-01) and Randy Feenstra (IA-04) opposed the legislation.

A national review of state policies on reproductive health and rights gave Iowa a mixed grade for policies on sex education and access to abortion and family planning.

The nonprofit Population Institute‘s 50-state “report card” gave Iowa a C based on thirteen metrics related to “effectiveness, prevention, affordability, and access” to sex education and reproductive health care. The “minus” was added because of a 2019 law that made Planned Parenthood ineligible for certain sex education grants. That law is on hold pending the Iowa Supreme Court’s review of a lower court ruling, which found the statute unconstitutionally targeted Planned Parenthood while allowing another abortion provider to continue to receive the sex education funding.

Iowa Republicans have enacted most of their legislative agenda with little trouble during the past four years of full control of state government. But a few priorities eluded them, including a constitutional amendment that would pave the way for future abortion bans. Unable to find 51 votes in the state House for that measure last year, the GOP settled for mandating a 24-hour waiting period before all abortions.

The 2020 elections increased the GOP’s majority in the lower chamber from 53-47 to 59-41. Republicans didn’t waste time returning to unfinished business: a new version of the attack on reproductive rights cleared an Iowa House Judiciary subcommittee on January 19.

The Iowa legislature’s 2021 session began on January 11 with the usual appeals to work together for the good of Iowans. But potential for bipartisan work on high-profile issues appears limited, as the Republicans who enjoy large majorities in the state House and Senate have quite different priorities from their Democratic counterparts.

In doing so, Trump has disregarded every imperative set forth in the Preamble to the Constitution. His latest impeachable offense is one of many throughout his term. But what did Congressional Democrats impeach him for? A quid pro quo with Ukraine that no one understood.

It’s just one example of how the Dumpstercratic Party has lumbered from one blunder to another: from failing to take advantage of its majority status in the Senate under President Barack Obama (“Maa … Mitch McConnell hit me!”), to spending a two-year primary season quibbling over what it stands for, to feebly sponsoring weak candidates in the general election. The party needs a massive reboot. But not the one you’re thinking of.

Iowa — and the country — is suffering from a leadership deficit.

In this election, we can send a clear message.

In Iowa House district 39, first-term State Representative Karin Derry has shown integrity in leadership where others have not.

Brad Zaun’s fifth campaign for the state legislature will be his toughest yet.

Like affluent suburban areas around the country, Iowa Senate district 20 has been trending away from Republicans. Democrats in the northwest suburbs of Des Moines did well in the 2019 local elections and more recently surpassed the GOP in voter registrations.

Zaun has adapted to the new environment with messaging that doesn’t mention his party affiliation, his votes for many controversial laws, his numerous attempts to ban abortion, or his early support for Donald Trump’s candidacy.

On the contrary, he is campaigning as an “independent voice” and leader on improving education and mental health services.

Who could have predicted it, other than anyone familiar with reproductive health care?

Republican lawmakers and Governor Terry Branstad eliminated Iowa’s successful Medicaid Family Planning Waiver in 2017 and created a new state program that excluded abortion providers. The move forced Planned Parenthood to close four of its Iowa clinics around the state and dramatically decreased the number of Iowans receiving birth control and other reproductive services.

Preliminary data from the Iowa Department of Public Health indicate that Iowans had 25 percent more abortions in 2019 than in the previous year.

State Representative Ashley Hinson didn’t miss a roll call vote as the Iowa House wrapped up its work in June, legislative records show. But the two-term Republican mostly stayed out of the House chamber while colleagues debated controversial bills.

The tactic allowed Hinson, who is also the GOP challenger in Iowa’s first Congressional district, to avoid public questioning about policies she supported. Notably, she was absent during most of the House deliberations on imposing a 24-hour waiting period for abortions, establishing a barrier to voting by mail, and giving businesses near-total immunity from lawsuits related to COVID-19.

Neither Hinson nor her Congressional campaign responded to Bleeding Heartland’s repeated inquiries about those absences.

Spirits lifted in the pro-choice community when Iowa House Majority Leader Matt Windschitl did not call up a constitutional amendment on abortion shortly after the legislature reconvened this month.

Republican leaders wanted to pass the amendment, which had advanced from committee months earlier. When a high-profile bill doesn’t come to the floor, it often means the majority party doesn’t have the votes for final passage.

Indeed, at least three of the 53 House Republicans resisted immense pressure to vote for legislation designed to overturn an Iowa Supreme Court ruling protecting “the constitutional right of women to terminate a pregnancy.”

Unfortunately, the holdouts agreed to a last-minute abortion restriction that may provide a faster way to undo the high court’s work.

At the end of my first full session as state senator representing Cedar Falls, Hudson, and southwest Waterloo, here’s my report on selected highlights of this year’s session: three good decisions, three bad decisions, and three decisions put off until next year.

Governor Kim Reynolds denied 35 requests to sign Iowa on to multi-state legal actions during the first year of an unusual arrangement in which Attorney General Tom Miller ceded some of his authority.

Reynolds refused to allow the state to weigh in on lawsuits related to federal or state policies on immigration, reproductive rights, environmental regulation, consumer protection, gun safety, LGBTQ rights, and access to President Donald Trump’s personal records.

During the same time frame, the governor approved eighteen requests from Miller to join cases involving a wide range of legal matters.

Iowa Republicans were too clever by half when they slipped language targeting Planned Parenthood into a budget bill last year. Instead of prohibiting state agencies from awarding sex education grants to all entities that provide abortions, GOP lawmakers wrote an exception into the law so that UnityPoint facilities could remain eligible for the funding.

For that reason, a Polk County District Court determined this week that the prohibition violated the Iowa Constitution’s equal protection guarantee.

Iowa Republican lawmakers and Governor Kim Reynolds have long sought to eliminate a woman’s right to choose, and several new attempts were introduced during the 2020 legislative session.

In plain language, this is about increasing unwanted pregnancies and trapping women in cycles of menstruation and reproduction that, once again, deny them control of their fertility and the autonomy to be free and creative agents of their own future. Anti-abortion extremist rhetoric professes protection for women and future “unborn” (an emotionally loaded euphemism for the medical term, fetus).

In reality, it means anyone who styles themselves as a fetus protector will be in a position to control women’s lives. Their stance is two dimensional:

Iowa physicians will be able to determine on a case-by-case basis whether abortion is essential health care for their patients, under an agreement the state reached today with plaintiffs who challenged Governor Kim Reynolds’ attempt to halt surgical abortions.

Only three days after staff for Governor Kim Reynolds confirmed surgical abortions are among the “nonessential or elective surgeries” now prohibited in Iowa under a public health emergency proclamation, several groups went to court to block the governor’s action.

UPDATE: The ACLU of Iowa, Planned Parenthood, and the Emma Goldman Clinic filed suit to block this policy on March 30.

Governor Kim Reynolds temporarily banned surgical abortions in Iowa through her latest action on the state of public health disaster emergency caused by novel coronavirus (COVID-19), the governor’s office said on March 27.

Republican State Senator Brad Zaun has declined to clarify whether his proposed 72-hour waiting period for all abortions would also apply to people needing a common medical procedure after a miscarriage.

At a political forum in Grimes on February 21, Zaun told a constituent who asked about miscarriages that his bill calls for a “72-hour ultrasound before any abortion is performed.”

March 3 was Planned Parenthood Day on the Hill, and I am sure many of you have been inundated with the genuine and sincere entreaties of friends and fellow members of Planned Parenthood and NARAL to reject the ill-conceived, ill-advised, unrepresentative bills you are herding toward passage regarding restrictions on procedures to terminate pregnancy.

I agree with all of them, and I know that you know these are real constituents with real concerns about private matters that most of you have never experienced, nor will ever experience.
