Bill Brauch is a retired Iowa lawyer. He served as an Assistant Iowa Attorney General from 1987 to 2015, and was Director of the Consumer Protection Division of the Attorney General’s office from 1995 until 2015. He is a 1987 graduate, with distinction, of the University of Iowa College of Law. He is presently chair of the Polk County Democrats. 

An Iowa constitutional amendment on the November ballot would insert in the state constitution a process for filling a vacancy in the office of lieutenant governor. Under the amendment, if the governor dies, resigns, or is removed from office, the lieutenant governor would assume the office of governor for the remainder of the term, thereby creating a vacancy in the office of lieutenant governor, which the new governor could fill by appointment.

While Iowa currently has a vacancy in that office following the resignation of Lieutenant Governor Adam Gregg, the governor already has the power to appoint Gregg’s successor. This proposed amendment was driven by what happened in 2017 when Governor Terry Branstad was confirmed as U.S. Ambassador to China, and the powers of the governor devolved onto Kim Reynolds.

Election week 2020 felt like an anti-gravity bungee jump for Iowa Democrats. We went from the depths of despair on election night, suffering losses we never expected, to huge relief — euphoria even — on Saturday when it was clear Joe Biden had won the presidency. That our next vice president will be a woman of African and Indian descent added to the joy of knowing that Donald Trump’s occupation of the White House will soon come to an end.

But there is no question Iowa Democrats are hurting. We lost statehouse seats we should have won. We did poorly in the U.S. Senate and presidential races. We lost one — maybe two — U.S. House seats. (We were not alone in this. Democrats even lost seats in states Biden won!)

Iowa Senate Republicans have hit the ground running this session, and their agenda is replete with extreme proposals. One of them hasn’t gotten much notice yet but, if enacted, would represent the most radical change to Iowa’s judicial system since its inception.

Senate Study Bill 1008 would impose the “loser pays” standard in all civil actions in Iowa courts. This means that if you lose a civil lawsuit you not only have to pay your own attorney fees, you have to pay the other side’s attorney fees as well. Another term for this would be “instant bankruptcy!”

Imagine you are injured in a car accident and sue the other driver to seek recovery for your injuries. If the case is hard-fought both sides might run up tens of thousands of dollars in attorney fees. Say the case is a close one and you lose by a whisker – the jury thought you had a good case but your proof fell just short. Under SSB 1008, you’ll not only have to pay your own attorney fees, you’ll have to pay the other side’s as well!
